HomeMy WebLinkAbout1989_10_04 Town Board Regular Minutes 114 I , MINUTES OF THE REGULAR MEETING OF THE TOWN BOARD AND BOARD OF FIRE COMbIISSIONERS OF THE TOWN OF I MAMATh HECK, HELD ON THE 4TH DAY OF OCTOBER 1989 IN THE COURT ROOM III OF THE TOWN CENTER, 740 WEST BOSTON POST ROAD, MAMARONECK, NEW YORK 1 I CONVENE REGULAR MEETING The Regular Meeting of the Town Board was called to order by Supervisor Battalia at 7:30 p.m., at which time the Board recessed into Executive Session. The Executive Session was held in Conference Room A to discuss matters of personnel, after which time, on motion duly made and seconded, it was unanimously declared adjourned at 8:15 p.m. RECONVENE REGULAR MEETING The Regular Meeting of the Town Board was called to order by Supervisor Battalia at 8:20 p.m. in the Court Room I Present were the following members of the Board: Supervisor Dolores A. Battalia Councilwoman Caroline Silverstone Councilman Stephen C. Chapin Councilman John McGarr 1 j Councilwoanan Elaine Price was unable to be present due to her required attendance at a Back-To-School night for her daughter. Also present were: Patricia A. Zaidins, •Counsel to the Town Arthur Dallas, Police Commissioner William McDermott, 1st Deputy Fire Chief III CALL TO AlurENTION 1 Supervisor Battalia pointed out to those assembled the locations of exits as required by law for public gatherings. 115 October 4, 1989 BOARD OF FIRE COMMISSIONERS III The Meeting was called to order by Commissioner Battalia at 8:25 p.m. in the Court Roan. Present were the following members of the Commission: Commissioner Dolores A. Battalia Commissioner Caroline Silverstone Commissioner Stephen C. Chapin Commissioner John McGarr 1. Commissioner McGarr presented fire claims for authorization of payment and on his motion, seconded by Councilwoman Silverstone, it was unanimously RESOLVED, that this Commission hereby authorizes payment of the following Fire Department claims as approved by the Fire Chief and audited by the Comptrollers Office: AAA Emergency Supply Co., Inc. $ 246.66 Larchmont Auto Parts Dist., Inc. 43.24 Lawrence Heat & Power Corp. 303.21 William McDermott 18.69 Mamaroneck Glass Company 55.00 New England Uniform 1,492.70 Portronix 247.90 Rickert Lock & Safe Company 1.32 $2,408.72 There being no further business to cone before this Commission, on motion by Commissioner McGarr, seconded by Commissioner Chapin, the meeting was unanimously declared adjourned at 8:30 p.m. APPROVAL OF MINUTES The Minutes of the Regular Meeting of September 6, 1989 were presented and on motion by Councilwoman Silverstone, seconded by Councilman McGarr, were unanimously approved with one change. III AFFAIRS OF THE TOWN 1. Set Public Hearing - Amendment Flood Damage Prevention Law On motion by Councilwoman Silverstone, seconded by Councilman McGarr, it was unanimously RESOLVED, that this Board hereby sets October 25, 1989 as the date for a Public Hearing on a proposed amendment to the Flood Damage Prevention Law; 2 114 October 4, 1989 and be it further RESOLVED, that the Town Clerk be and she hereby is authorized to publish in an official newspaper, of the Town of Mamaroneck, the Notice of said Hearing as required by law. 2. Set Public Hearing - Installation of Stop Signs at Doris Road and Doris Lane at the Intersection of Prince Willow Lane On motion by Councilwoman Silverstone, seconded by Councilman Chapin, it was unanimously RESOLVED, that this Board hereby sets October 25, 1989 as the date for a Public Hearing on a proposed installation of Stop Signs at Doris Road and Doris Lane at the Intersection of Prince Willow Lane; and be it furthter RESOLVED, that he Town Clerk be and she hereby is authorized to publish in an official newspaper of the Town of Mamaroneck, the Notice of said Hearing as required by law. 1 3. Authorization - Ice Rink/Pool Concession Agreement Following explanation by the Administrator and some discussion by the Board, on motion by Councilwoman Silverstone, seconded by Councilman McGarr, it was unanimously RESOLVED, that this Board hereby authorizes the Town Administrator to enter into agreement, subject to certain amendments, with John Chevalier of Rock Ridge Road, Town, for the purpose of operating a concession stand located at the Hb muocks Ice Rink. 4. Authorization - License Agreement-Monroe Nursery School The Administrator reported on the agreement and fielded some questions from the Board. Councilwoman Silverstone then 3 117 October 4, 1989 congratulated the selection committee and Paulette Gabbriellini in particular for the tremendous job of choosing an employee and working out this agreement. The Supervisor also expressed thanks after which time, on motion by Councilwoman Silverstone, seconded by Councilman McGarr, it was unanimously RESOLVED, that this Board hereby authorizes the Administrator to enter into agreement with Jason Lassiter of Peekskill, New York to inhabit living quarters on the second floor of the premises known as 685 Weaver Street in consideration for maintenance services rendered. 5. Adoption of Operating Protocol for Larchmont Reservoir Valve Following explanation by the Administrator, on motion by Councilwoman Silverstone, seconded by Councilman McGarr, it was unanimously RESOLVED, that this Board hereby adopts the following operating protocol for the Larchmont Reservoir Valve: 1. Normal Automatic Target is Freeboard 042 inches. 2. An extended period of unsettled weather such a northeasterly flow or an occluded front which cause the normal west to east flow to became east to west should be responded to by changing Automatic Target to 050 inches. 3. A report of Heavy and Widespread Thunderstorms in the area of a forecast of possible urban and small stream flooding (a FIAOD WATCH as used by NOAA) in the New York Metropolitan Area should be responded to by setting the Automatic Target to 060 inches. 4. A FLOOD WARNING as used by NOAA which indicates that urban and small stream flooding is probable or reports of extreme rainfall such as more than an inch per hour in the Metropolitan Area should be responded to with an automatic target setting of 070 inches. 5. A TROPICAL STORM WARNING for the New York Metropolitan Area should be responded to with an Automatic Target setting of 100 inches. 6. A HURRICANE WARNING (as used by NOAA) for the New York Metropolitan Area should be responded to with an Automatic Target setting of 150 inches. 4 118'. October 4, 1989 This is a scheme of graduated responses which should preclude the need to go from 042 inches to 070 inches in one step. Normal (042) inches should be reset when the storm has passed and a westerly wind flow has been established. j REQUIRED NOTIFICATION VALVE PROTOCOL Stage 2. -- No notification required-lowering at discretion of operating staff. Stage 3. -- Notification to Town Administrator by operating staff. Notification to Highway Superintendent by operating staff. Notification to Mayor, Village of Larchmont and Supervisor, Town of Mamaroneck by Town Administrator. Stage 6. -- Notification to Mayor, Village of Larchmont and Supervisor, Town of Mamaroneck by Town Administrator. 6. Update - Hommocks Ice Rink The Administrator informed the Board that since the update of September 20th the building side panels have been received and are being installed, the utilities will be completed on Columbus Day and electrical wiring has been completed in the 1 Ice Rink service building. He went on to say that the partition in the new service building is substantially complete with windows installed in a portion of it, and that new lighting for the ice rink building has been installed. He added further that piping in the ice rink is now being installed and will be tested in approximately three weeks, the final course of paving has been installed in the portion of the building surrounding the ice rink area, and construction has begun on partitions in the old service building. He concluded that the HVAC duct work is complete in the new service building, with delivery of mechanical equipment due, and that the cost to date is $1,436,522.50. 7. Salary Authorizations - Police - Recreation - Community Services Commissioner Dallas introduced George Valentzas as the new candidate for the Police Department and gave a brief update on his background and experience, and noting that he will fill the vacancy created by the recent retirement of Police Officer Carmine Catapano. Thereafter, on motion by Councilman Chapin, seconded by Councilman McGarr, it was unanimously 5 119 October 4, 1989 RESOLVED, that this Board hereby appoints George Valentzas of Harrison, New York to the position of Probationary Police Officer at an annual rate of $23,000 on a transfer basis from his current civil service status as Police j Officer in the City of New Rochelle, New York, effective October 9, 1989. At this time Supervisor Battalia swore in George Valentzas and congratulated him. At this time, on motion by Councilwoman Silverstone, seconded by Councilman McGarr, it was unanimously RESOLVED, that as provided for in the 1989 Town Budget, authorization is hereby granted for the payment of salary to the following: Richard Rella, Senior Recreation Leader., Open House, $45/session, effective 10/13/89. Dean 'Reben, Senior Recreation Leader, Open House, $45/session, effective 10/13/89. James Grieco, Recreation'-Leader, Open House, $35/session, effective 10/13/89. • Nancy Russo, Recreation Assistant, Open House, $15/session, effective 10/13/89. Cathy Cilento, Senior Recreation Leader, Women's Fitness, $55/session, effective 10/5/89. Cindy Owen, Recreation Leader, Women' Fitness, $45/session, effective 10/5/89. Suzanne Elson, Senior Recreation Leader, Teen Center Volleyball Progr°am, '$45/session, effective 11/29/89. Following explanation by the Administrator, on motion by Councilwoman Silverstone, seconded by Councilman McGarr, it was unanimously RESOLVED, that Board hereby appoints Irene Cassaro/Casino of Barry Avenue, Village of Mamaroneck as a provisional Office Assistant in the Community Services Department, at an annual salary of $19,770, effective October 10th in accordance with Section 65 of Civil Service Law. 6 . 120 October 4, 1989 8. Authorization - Consolidating Registration Following a brief explanation by the Town Clerk, on motion by Councilwoman Silverstone, seconded by Councilman McGarr, it was unanimously RESOLVED, that the Town Board of the Town of Mamaroneck hereby approves and authorizes the Town Clerk to consolidate voter registration into three districts: Village of Mamaroneck, Village of Larchmont and Town of Mamaroneck; and be it further RESOLVED, that registration days be held on Saturday, October 7, 1989 from 1:00 p.m. to 9:00 p.m.; and on Thursday, October 12, 1989 fran from 4:00 p.m. to 9:00 p.m. at the Town Center, 740 West Boston Post Road, Mamaroneck, New York. 9. Resolution re: Record Disposition Following explanation by the Town Clerk, on motion by Councilman McGarr, seconded by Councilwoman Silverstone, it was unanimously RESOLVED, that the Town Clerk is hereby authorized by the Town Board of the Town of Mamaroneck to dispose of all records that are reviewed and designated to be in that category deemed "Disposable" pursuant to Article 57-A of the Arts and Cultural Affairs Law; and be it further RESOLVED, that the Town Clerk is hereby authorized to send a copy of this resolution to the State of New York Education Department, State Archives and Records Administration, requesting permission to dispose of those records which the Town Clerk has designated "Disposable" as aforestated. 7 121 October 4, 1989 10. Report of Bids - 50f Aerial Tower Truck IIIFollowing a brief explanation by the Administrator, on motion by Councilwoman Silverstone, seconded by Councilman Chapin, it was unanimously RESOLVED, that this Board hereby authorizes the award of contract TA--89-6 to Teco, Inc. of Fort Wayne, Indiana as the lowest, responsible bidder, to furnish and deliver to the Town of Mamaroneck one 50 Foot Aerial Tower Truck in the amount of $61,809; and be it further RESOLVED, that this Board hereby authorizes the Town Administrator to execute an agreement with Teco, Inc. for furnishing the 50 Foot Aerial Tower Truck. IIIPROCITION - United Nations Week-October 22-28, 1989 I Supervisor Battelle announced that the week of October 22nd through 28th will celebrate the 44th birthday of the United Nations and she presented the following proclamation: (see page 9) I WRITTEN COMMUNICATIONS ORAL COMMUNICATIONS There were no written or oral communications to cane before the Board at this time. REPORTS OF THE COUNCIL Councilwoman Silverstone reported that the Recycling Task Force has been meeting almost weekly and is moving along at a rapid pace. III She noted that they will be coming out, within the next few weeks, with a proposed law to make newspaper recycling mandatory. She added that the Town has hired an advertising agency to prepare a booklet for mailing to local residents in the Town and both Villages. She meted that in order to pay for this booklet, as well as post cards, signs, logos and various other types of literature, they will be using the combined grants which the Village of Mamaroneck and the Joint Village of Larchmont/Town of Mamaroneck Sanitation Commission were able to gain from various agencies in the amount of about $40,000. Battalia 44L1r,./Apv Town of Mamaroneck � \ 9 123 October 4, 1989 THE SUPERVISOR I III Supervisor Battalia announced that on October 15th at 2:00 p.m. there will be a ribbon-cutting ceremony at the bridge on the Duck Pond, and that the neighbors are organizing a block party to coincide. The Supervisor stated that if anyone may have read in tonight's newspaper that there will be a hearing on Davids Island, it is not a Coast Guard re-opening of the hearing on Davids Island but a Coast Guard subcommittee of the House of Representatives who were scheduled to hold hearings here on Long Island Sound and have made a decision to hold it specifically on Davids Island. She noted further that the Town and Villages of Larchmont and Pelham formally retained counsel to represent them, and the Regional Minimal decided that because of the really aggressive stance of the three communities, they and representatives of the developer should came to a meeting, argue their points and then a determination can be made as to the re-opening of the hearing. This, she concluded, was the vehicle chosen as a direct result of the endeavors of the three communities through the Sound Shore Coalition. She urged all of the community to attend and make their comments known. She noted that at that time the Coast Guard will detail the nature of the proposal as it stands now. She noted that federal procedure, much different from that of the state, is an almost insurmountable burden and you have to offer expert testimony. Some discussion ensued among the Board and residents. III TOWN CLERK MONTHLY REPORTS The Town Clerk submitted the report of the Building and Plumbing Department for the month of August 1989 and the report of the Town Clerk's Office for the month of September 1989.
