HomeMy WebLinkAbout1989_11_15 Town Board Regular Minutes 147 MINUTES OF THE REGULAR MEETING OF THE TOWN BOARD AND BOARD OF FIRE COMMIISSIONERS OF THE TOWN OF MAMARONECK, HELD ON THE 15TH DAY OF NOVEMBER 1989 IN THE COURT ROOM OF THE TOWN CENTER, 740 WEST BOSTON POST ROAD, MAMARONECK, NEW YORK CONVENE REGULAR MEETING The Regular Meeting of the Town Board was called to order by Supervisor Battalia at 7:00 p.m., at which time the Board recessed into a Budget Work Session. The Budget Work Session was held in Conference Roan A, after which time, on motion duly made and seconded, it was unanimously declared adjourned at 8:20 p.m. RECONVENE REGULAR =PING The Regular Meeting of the Town Board was called to order at 8:30 p.m. in the Court Roan Present were the following members of the Board: Supervisor Dolores A. Battalia Councilwoman Caroline Silverstone Councilwoman Elaine Price Councilman John McGarr Councilman Stephen Chapin was unable to be present at the meeting. Also present were: Patricia A. DiCioccio, Town Clerk Stephen V. Altieri, Town Administrator Paulette Gabbriellini, Assistant to the Administrator Eric S. Zaidins, Counsel to the Town Carmine DeLuca, Comptroller Richard Tortorella, Fire Chief William McDermott, 1st Deputy Fire Chief CALL TO ANON Supervisor Battalia pointed out to those assembled the locations of exits as required by law for public gatherings. Supervisor Battalia explained that the Public Hearing on the Alternative Veterans Tax Exemption would not be held tonight due to a clerical error which failed to have the Notice published on time. 148 November 15, 1989 PRESENTATION - Burton Meighan Town Historian g The Supervisor called on Burton Meighan, who presented his final report as Historian of the Town of Mamaroneck, noting that he has held this post since 1979 when he was 79 years of age, but does not now possess the feisty vigor of his eighties and, therefore, with a tinge of reluctance, makes way for a younger and more active successor. Battalia, supervisor .� < town of Mamaroneck 149 1 November 15, 1989 At this time the order of the agenda was changed and item No. 1 under AFFAIRS OF THE TOWN was taken up. II 1. Appointment - Town Historian Supervisor Battalia called on Gloria Pritts, who briefly addressed the Board and commented on how honored she was to become Historian of the Town and the Village of Mamaroneck as well. She added that she would like to see the Historians of the past honored by the Town, since records go back to the 1690/s. She mentioned also that the Mamaroneck Village Historical Society on Wednesday, November 29th, is having an historical program on 100 years of the this building which was the high school, that everyone is invited, and that it will be taped for cable. The Supervisor then, upon recommendation of Burton Meighan, requested a motion to appoint Gloria Poccia Pritts as new Town Historian. On motion by Councilman McGarr, seconded by Councilwoman Silverstone, it was unanimously RESOLVED, that this Board hereby appoints Gloria Poccia Pritts of the Village of Mamaroneck as Town Historian, to fulfill the vacancy created by the resignation of Burton C. Meighan. At this time the regular order of the agenda was resumed. PUBLIC BEARINGS - Amendment to Chapter 51 - Noise Regulation - Installation of Stop Signs-Falls Road and Lakeside Drive Supervisor Battalia asked that the Public Hearing on the installation of STOP signs be taken up first and, on motion by Councilwoman Price, seconded by Councilman John McGarr, it was unanimously RESOLVED, that the Public Hearing be, and hereby is declared open. The Town Clerk presented for the record the Affidavits of Publication and Posting of the Notice of Hearing. The Town Administrator explained and, afterward, Supervisor II Battalia asked if anyone wished to speak on behalf of the proposed STOP sign installation or in opposition. There being no response, she requested a motion to close the hearing and, on motion by Councilwoman Silverstone, seconded by Councilman McGarr, the Public Hearing was unanimously declared closed. Thereafter, on motion by Councilwoman Price, seconded by Councilwoman Silverstone, the following resolution was unanimously adopted: 3 150 November 15, 1989 � l WHEREAS, the Town Board of the Town of Mamaroneck has held a Public Hearing on Wednesday, November 15, 1989 to consider an amendment to Chapter 81 (Vehicle and Traffic) of the Code of the Town of Mamaroneck with respect to erecting STOP signs at the intersections of Falls Road and Lakeside Drive; NOW, THEREFORE BE IT RESOLVED, that the following intersections are hereby designated pursuant to Section 1660(a) of the Vehicle and Traffic Law as a "STOP intersection," and STOP signs shall conform in all respects with the provision of Section 1682 and 1683 of the Vehicle and Traffic Law and hereby ordered posted. Add Section 81-6(73) on the Southeast and Northwest corners of Lakeside Drive at the intersection of Falls Road. This Local Law shall take effect immediately upon compliance with 11 Section 1682 and 1683 of the Vehicle and Traffic Law. Supervisor Battalia asked for a motion to open the public hearing on a proposed amendment to Chapter 51 with regard to noise regulation, and on motion by Councilwoman Price, seconded by Councilman McGarr, it was unanimously RESOLVED, that the Public Hearing be, and hereby is declared open. � I The Town Clerk presented for the record the Affidavits of Publication and Posting of the Notice of Hearing. Town Counsel, Eric Zaidins, explained the nature of the proposed amendment, noting specifically that this amendment is to change permitted hours of operation of domestic power tools and equipment to the hours of 9:00 a.m. to 6:00 p.m. on Saturdays and 9:00 a.m. to 5:00 p.m. on Sundays; to limit the number of certain types of domestic power tools and equipment that may be used at any one site at one time; and to amend the penalties for offenses. III The Supervisor asked if anyone wished to address the Board in favor or in opposition. Andrew Watson of Oakdale Road questioned how the particular hours were arrived at, noting that in sane instances it could incur added expense for people who hire workers. A great I deal of discussion ensued among the Board and some of the residents. Councilwoman Price stated that she had received a call from a resident, Frank Claps, who could not be here tonight and had wished to address the Board on this subject and asked if the passage of this ordinance could be delayed until he could comment. Following further discussion, the final consensus among the Board was to adjourn this hearing until the Scarsdale ordinance could be studied in order to clear up same very significant points. 4 151 November 15, 1989 Thereafter, on motion by Councilwoman Silverstone, seconded by Councilwoman Price, it was unanimously resolved that this Public Hearing be adjourned to the Town Board Meeting of December 6th. 011 i BOARD OF FIRE COMMISSIONERS The Meeting was called to order by Cciiiissioner Battalia at 9:10 p.m in the Court Room. Item 1 Appointment - Town Historian was taken up earlier in the meeting. 2. Re-Notice Public Hearing - Alternative Veterans Tax Exemption On motion by Councilwoman Price, seconded by Councilwomman Silverstone, it was unanimously 5 is? November 15, 1989 RESOLVED, that this Board hereby sets December 6, 1989 at 8:15 p.m. as the date for a Public Hearing on the proposed Alternative III Veterans Tax Exemption; and be it further RESOLVED, that the Town Clerk be, and she hereby is authorized to publish in an official newspaper of the Town of Mamaroneck, the Notice of said Hearing as required by law. 3. Authorization - Financial Management/Personnel Administration Computer System Councilman McGarr stated that because he is employed by IBM, he would have to abstain frcmm any vote on this item. The Town Administrator briefly summarized the operations of the Town that have been computerized within the past three years and noted that the 1990 budget proposes to complete the computerization of all departments with the exception of the Highway and Public Works Department. He went on to state that for 1990 the greatest level of computerization being proposed is that of financial management and personnel administration. He introduced the proposal of the IBM Appication System/400, noting that IBM is the hardware primarily available through a New York State purchasing contract allowing a 35-40% discount, making other computer hardware non-competitive. The Administrator further explained that this proposal would computerize the general ledger accounting, the purchasing system, budget preparation and budget processing and just about all activities of the Comptrollers office, as well as same aspects of personnel administration. He stated that the total expenditure for this proposal is $146,842.00, which would cover hardware, software, a five-year maintenance program and training of the Tawn staff on the use of the system. Mr. Altieri added that purchase of this system would be done through the use of a statutory note, which is a ten-year debt instrument portioned for each year. The Administrator mentioned that the representative frown IBM, Lee Dayton and Ed Brown from DB Systems, who acts as our consultant and was involved in determining the software package best suited for the Town, are both present to answer any questions. He concluded that the financial management package offered meets the requirements of the New York State Division of Audit and Control, with whom the Town must file a variety of reports. Following a brief question/answer period, On motion by Councilwoman Silverstone, seconded by Councilwanan Price, it was unanimously RESOLVED, that this Board hereby authorizes the Town Administrator to execute agreements with IBM for New World Systems Financial Management System IBM Application System/400. 6 15 November 15, 1989 4. Resolution - Establish Service Charge (Returned Checks) The Administrator explained that the Comptroller had identified that the New York State Legislature, under Chapter 203 of the 1989 Laws has authorized local governments to impose, by resolution, a service charge for those checks returned by depository banks due to insufficient funds. The Town Comptroller, Carmine DeLuca, responded to questions frcan the Board and, following same discussion, on motion by Councilwoman Silverstone, seconded by Councilman McGarr, it was unanimously RESOLVED, that the Town Board of the Town of Mamaroneck, by virtue of its power does hereby institute a charge of $15.00 for any check received by the Town and returned by depository banks due to insufficient funds. 5. Report of Bids - a) Night Vision Scope b) Leaf Disposal Following explanation by the Administrator, on motion by Councilman McGarr, seconded by Councilwoman Silverstone, it was unanimously RESOLVED, that this Board hereby awards Contract TA-89-8 to Professional Security Systems, Inc. of Larchmont, New York as the lowest responsible bidder to furnish a Night Vision Scope in the amount of $5,595.00 to the Town of Mamaroneck. The Administrator reviewed and updated the situation on leaf disposal and explained the options. On motion by Councilwoman Silverstone, seconded by Councilwoman Price, it was unanimously RESOLVED, that this Board hereby awards Contract TA-89-9 to Earthgro Compost Service of Lebanon, Connecticut as the lowest responsible bidder to furnish transportation and disposal of leaves at the rate of $7.06/yard loose and $8.43/yard compacted. 6. Salary Authorization - Highway Department Recreation On motion by Councilwoman Silverstone, seconded by Councilman McGarr, it was unanimously RESOLVED, that this Board hereby appoints David Paterno of Mamaroneck, seasonal Laborer at $7.00 per hour, retroactive to November 7, 1989. 7 1544 November 15, 1989 On motion by Councilwoman Silverstone, seconded by Councilman . Bond Resolution - Larchmont Motel The Administrator commented that pursuant to Local Finance III Law, whenever a municipality draws funds, it must adopt a resolution, and though the final purchase price of the Larchmont Motel has not yet been agreed upon, the resolution merely authorizes issuance not to exceed the amount indicated in the resolution, and it requires affirmative vote of at least four members of the Council to be considered valid. He noted that the Town Clerk is then required to print the resolution and purchase an appropriate notice within ten days of its adoption. Thereafter, on motion by Councilman McGarr, seconded by Councilwoman Silverstone, the following resolution was unanimously adopted: BOND RESOLUTION DATED NOVEMBER 15, 1989. A RESOLUTION AUTHORIZING THE ISSUANCE OF $2,740,000 SERIAL BONDS OF THE TOWN OF NANARONIDCK, WESTCHESTER COUNTY, NEW YORK, TO PAY PART OF THE COST OF THE PURCHASE OF A PARCEL OF APPROXIMATELY 1.78 ACRES OF LAND, LOCATED ON THE CORNER OF BOSTON POST ROAD AND IKOMMOCKS ROAD, AND THE BUILDING LOCATED THEREON. WHEREAS, by Stipulation of Settlement dated July 24, 1989, the Town of Mamaroneck, C. Mayone Corp., doing business as the Larchmont Motel, and the County of Westchester, agreed that the Town of Mamaroneck would acquire a parcel of approximately 1.79 acres of land located on the corner of Boston Post Road and Hammocks Road, including the building located thereon currently being used as a 53 unit motel and owned by C. Mayon Corp. and being commonly known as the Larchmont Motel; and WHEREAS, said Town has agreed to acquire said property, including the so-called Larchmont Motel, after having received numerous complaints regarding said property, having recognized a significant and disproportionate amount of crime at said property, including significant documented drug traffic, after having recognized the close proximity of said Larchmont Motel to an elementar school and that the activities at said Larchmont Motel constitute a potential danger to the health and safety of the young children attending said elementary school, and after having found that said Larchmont Motel is a substantial drain upon police and other municipal services; and . WHEREAS, all conditions precedent to the acquisition of said parcel, including the building located thereon, including compliance with the provisions of the State Environmental Quality Review Act, have been performed; and WHEREAS, it is now desired to authorize funding for that acquisition; NOW, THEREFORE BE IT RESOLVED, by the Town Board of the Town of Mamaroneck, Westchester County, New York as follows: 10 157 November 15, 1989 Section 1. For the specific object of purpose of paying part of the cost of the acquisition of the parcel of land and the building located thereon described in the preambles hereof, in III accordance with the Stipulation of Settlement described in the preambles hereof, said land and building to be used for such purposes as shall be determined by this Town Board in a further resolution or resolutions of the Town Board, there are hereby authorized to be issued $2,740,000 serial bonds of the Town of Mamaroneck, Westchester County, New York, pursuant to the provisions of the Local Finance Law. Section 2. It is hereby determined that the maximum estimated cost of such specific of object or purpose is $2,900,000, and that the plan for the financing thereof is as follows: a) By the issuance of the $2,740,000 serial bonds authorized to be issued pursuant to this bond resolution. Further details concerning said bonds will be prescribed in a further resolution or resolutions of this Town Board; and b) By the expenditure of $160,000 current funds of said Town, previously expended therefor. Pursuant to Section 107.00 of the Local Finance Law, such current funds shall constitute the down payment required by Section 107.00 of the Local Finance Law. Section 3. It is hereby determined that the period of III probable usefulness of the aforesaid class of objects or purposes is thirty years, pursuant to subdivision 21(a) of paragraph a of Section 11.00 of the Local Finance Law. It is hereby further determined that the maximum maturity of the serial bonds herein authorized will exceed five years. Section 4. Subject to the provisions of the Local Finance Law, the power to authorize the issuance of and to sell bond anticipation notes in anticipation of the issuance and sale of the serial bonds herein authorized, including renewals of such notes, is hereby delegated to the Supervisor, the chief fiscal officer. Such notes shall be of such terms, foam and contents, and shall be sold in such manner, as may be prescribed by said Supervisor, consistent with the provisions of the Local Finance Law. Section 5. The faith and credit of said Town of Mamaroneck, Westchester County, New York, are hereby irrevocably pledged to the payment of the principal of and interest on such obligations as the same respectively become due and payable. An annual appropriation shall be made in each year sufficient to pay the principal of and interest on such obligations becoming due and payable in such year. III Section 6. The validity of such bonds and bond anticipation notes may be contested only if: 1) Such obligations are authorized for an object or purpose for which said Town is not authorized to expend money, or 2) The provisions of law which should be complied with at the date of publication of this resolution are not substantially complied with, and an action, suit or proceeding contesting such validity is commenced within twenty days after the date of such publication, or 3) Such obligations are authorized in violation of the provisions of the Constitution. 11 158 November 15, 1989 Section 7. Upon this resolution taking effect, the same shall be published in full in The Daily Times, together with a notice of the Town Clerk in substantially the fonu provided in Ill Section 81.00 of the Local Finance Law. Section 8. This resolution is adopted subject to permissive referendum in accordance with Section 35.00 of the Local Finance Law. Resolution- County Tax Supervisor Battalia stated that she heard the County Executive has submitted his budget and the lowest tax increase would be 18%, the highest at 52% imposed upon the Village of Scarsdale, and the calculated increase for the Town of Mamaroneck is 42%. She requested adoption of a resolution requesting the County Legislator to verify this and, if it is the case, to vote against the budget. She added that she does not think this Comlmuiity can sustain a 42% increase in County Tax, which was raised 13% last year and 15% the year before. She noted that our tax is considerably higher than most communities. Thereafter, on motion by Councilwoman Price, seconded by Councilman McGarr, the following resolution was unanimously adopted: WHEREAS, the County Executive has submitted a Westchester County Budget with a proposed tax increase to the Town of Mamaroneck in the amount of 42%; and WHEREAS, the Town of Mamaroneck has had an increase in Westchester County Taxes of 13% last year and 15% the year before, causing it to be unable to sustain an additional 42% increase this year; N7W, THEREFORE BE IT RESOLVED, that the Town Board of The Town of Mamaroneck hereby requests that its County Legislator for the 7th Legislative District vote against this enormous County Tax increase to the Town of Mamaroneck for the year 1990. 12 159 November 15, 1989 WRITTEN COMMUNICATIONS ORAL COMMUNICATIONS III There were no written or oral communications to come before the Board at this time.
