Present were the following members of the Board: Supervisor Dolores A. Battalia Councilwoman Caroline Silverstone Councilman Stephen Chapin Councilwoman Elaine Price CouncilmanJohn McGarr Also present were: Patricia A. DiCioccio, Town Clerk Stephen V. Altieri, Town Administrator Eric S. Zaidins, Counsel to the Town Stephen Silverberg, Counsel to the Town Richard Tortorella, Fire Chief William McDermott, 1st Deputy Fire Chief CALL TO ATTENTION Supervisor Battalia pointed out to those assembled the locations of exits as required by law for public gatherings. PROCLAMATION Supervisor Battalia read and presented to David Schwarz, the proclamation found on the following page (page 2) . PRESENENTION: Dr. Alan Mason Dr. Mason commented that Supervisor Dolores Battalia has been in office for six years and that this Town has had, at least for the past twenty years of his involvement, many chronic problems which went unaddressed or were addressed only in part. He told her that she had made the difference, that running was just the first step, she took on the challenges and tackled these problems, accomplishing a job well done right up to her very last day in office. He remarked that he was very impressed, delighted to have worked with her and glad to have the opportunity tonight to thank her for her spectacular efforts. 171. III Presentwere the following members of the Commission: Commissioner Dolores A. Commissioner Silverstone presented fire claims for authorization of payment and on her motion, seconded by Commissioner Chapin, it was unanimously RESOLVED, that this Commission hereby authorizes payment of the following Fire Department claims as approved by the Fire Chief and audited by the Comptroller's Office: Acocella, Michael J. $ 100.00 Baron, Raymond A. 32.29 Consolidated Uniform Service 36.60 ESCO 25.00 Excelsior Garage & Machine Works, Inc. 356.57 III III Excelsior Garage & Machine Works, Inc. 57.54 Garfield-Wolar Electric Corp. 124.47 Henry, John E. 67.00 Imperial Bag & Paper Co., Inc. 154.75 McBrayer, Diane B. 10.00 NYNEX 9.00 Portronix 247.90 $1,221.03 There being no further business to come before this Commission, on motion by Commissioner Price, seconded by Commissioner McGarr, the meeting was unanimously declared adjourned at 8:50 p.m. AFFAIRS OF THE TOWN 1. Appointment - Traffic Committee Following Councilwoman Silverstone's explanation that Kathy O'Flinn has had to resign from the Traffic Committee since she will take office as a Town Council member on January 1st, on her motion, seconded by Councilwoman Price, it was unanimously RESOLVED, that this Board hereby appoints Rosemary Magazino of Murray Avenue, Town, to serve on the Town of Mamaroneck Traffic Committee at the pleasure of the Town Board. 3 1 [. . December 20, 1989 2. Adoption of 1990 Budget The Administrator noted that there was just one minor change, which was really an appropriation of $1,000 by the Board to the Town Clerk's office for services of the records management officer. Thereafter, on motion by Councilwoman Silverstone, seconded by Councilwoman Elaine Price, the following resolution was adopted on a roll-call vote of the Board: WHEREAS, this Town Board had met on December 6, 1989 at the time and place specified in the Notice of Public Hearing on the adoption of a Preliminary Budget for 1990 and has heard all persons desiring to be heard thereon; NOW, THEREFORE BE IT RESOLVED, that this Board does hereby adopt such Preliminary Budget as the Annual Budget of this Town for the fiscal year beginning on the first day of January 1990, and that such budget as so adopted be entered in detail in the minutes of the proceedings of this Town Board; (Budget herewith inserted) and it is further RESOLVED, that the Town Clerk of this Town shall prepare and certify in duplicate, copies of said Annual Budget as adopted by this Town Board, together with the estimates, if any, adopted pursuant to Section 202-a, subdivision 2 of the Town Law, and deliver one (1) copy thereof to the Clerk of the County Board of Legislators of this County; and it is further RESOLVED, that for the fiscal year 1990, the sum hereinafter set forth in the attached Budget be levied, assessed, and collected upon the taxable properties in the Town of Mamaroneck outside of the Villages of Larchmont and Mamaroneck (part Town), the properties of the several districts and the several parcels of taxable property, franchise and assessments, and persons within the Town and within such special districts, be extended on the tax roll of the Town of Mamaroneck against each of the several parcvels affected by such assessments, or parts thereof; 4 174 December 20, 1989 and it is further RESOLVED, that pursuant to the provisions of Chapter 654 of the Laws of 1927 as amended, and the provisions of Article 12 of Chapter 61 of the Consolidated Laws, known as the Town Law, as amended, there be levied against the several lots and parcels of land contained upon the Statement hereto annexed and marked " hibit A," the several suns set forth opposite each such parcel or lot of land on such statement as and for unpaid water charges due upon said lots or parcels, which said sums shall be placed in a separate column of the tax roll of the Town of Mamaroneck under the name "Water Rents." Authorization - Amendment to Purchase Contract-Larchmont Motel On motion by Councilwoman Silverstone, seconded by Councilwoman Price, it was unanimously RESOLVED, that this Board hereby amends the final purchase price of the Larchmont Motel property to the amount of $2,350,000, within the anticipated amounts stated on the Bond Resolution dated November 15, 1989. 4. Report of Bids - a) Street Painting b) Heating Oil c) Police Uniforms Following explanation by the Administrator, on motion by Councilwoman Silverstone, seconded by Councilman McGarr, it was unanimously RESOLVED, that this Board hereby authorizes the Town Administrator to enter into contract with the following lowest responsible bidders meeting specifications: 5 175 December 20, 1989 M & S Striping for reflectored street painting at .060 per lineal foot and non-reflectored street painting at .045 per lineal foot; Lawrence Heat & Power for fuel oil #2 at .7190 per gallon; Valhar Chemicals for winter and summer police uniforms at $363.50 per complete uniform. 5. Authorization - Temporary Easement Agreement-Army Corps of Engineers Following the Administrator's report, on motion by Councilwoman Silverstone, seconded by Councilman Chapin, it was unanimously RESOLVED, that the Town Board of the Town of Mamaroneck does hereby authorize the Town Supervisor to execute the easement agreement between the Town of Mamaroneck oneck and The Army Corps of Engineers, which enables the Antsy Corps to perform soil borings along the Sheldrake River. 6. Authorization - Transfer of Funds On motion by Councilman Chapin, seconded by Councilman McGarr, it was unanimously RESOLVED, that this Town Board hereby authorizes the transfer of monies into the following Capital Project funds to ensure their availability in 1990: 1. Capital Project 89-9 - Restoration of Parking Lot #1 in the amount of $25,000; 2. Capital Project 86-5 - Computer Equipment, an additional amount of $4,400; t 3. Capital Project 89-1 - Police Cars and Other Automobiles, an additional amount of $1,500; 4. Capital Project 89-7 - Traffic Lights in the amount of $20,000; 5. Capital Project 89-8 - Sidewalk Repair/ Replacement in the amount of $45,000; 6. Capital Project 89-10 - Architectural Fees/ Fire District in the amount of $30,000. 6 f '7q December 20, 1989 7. Salary Authorization - Recreation - Community Services (part time) On motion by Councilwoman Price, seconded by Councilman Chapin, it was unanimously RESOLVED, that as provided for in the 1989 Town Budget, authorization is hereby granted for payment of salary to the following: Jennifer Walsh, Alternate Rey Attendant, Hammocks Pool, $4/hour, effective 12/20/89; Dorothy Crowley, Figure Skating Instructor, Hammocks Ice Rink, $30/hour, effective retroactive 12/1/89; Richard Myers, Skate Guards (weekends) Hammocks Ice Rink, $7/hour, effective retroactive 12/10/89, replacing Ruth Ortiz; Al Guima es, Alternate Manager, Hammocks Park Ice Rink, $9/hour, effective 12/16/89. The Administrator explained that last week an employee resigned in Community Services, and while conducting a recruital for a part-timer, Janet Beal, who was incumbent with the position, agreed to work part time. On motion by Councilman Chapin, seconded by Councilman McGarr, it was unanimously RESOLVED, that this Board hereby appoints Janet Beal to a part-time position in the office of Community services at the rate of $10,00 per hour, effective January 2, 1990. 8. Authorization - Town Cc*nptroller to Close Financial Records - 1989 On motion by Councilman Chapin, seconded by Councilwoman Price, it was unanimously RESOLVED, that this Board hereby authorizes the Town Comptroller to make appropriate journal entries and budget transfers for the purpose of closing the Towns financial records for the fiscal year 1989. 9. Authorization - Borrowing of Funds-Computer Equipment On motion by Councilman McGarr, seconded by Councilman Chapin, it was unanimously RESOLVED, that this Board hereby authorizes the Comptroller tQ bar $160,000 for computer equipment on a 5-year anticipation note. 7 11 77 December 20, 1989 10. Update - County Budget Councilwoman Silverstone gave a brief update on the status of the 1990 County budget, noting that they are now talking about a $30,000,000 cut, which is still an insufficient amount since the increase should amount to no more than 5 to 7%. Councilwoman Price also spoke briefly about the problems with the present budget. It was the general consensus that another letter be sent to the County by the Town Supervisor. 11. Authorization - Rejection of Bids-Night Vision Scope Following some discussion, on motion by Councilwoman Price, seconded by Councilman McGarr, it was unanimously RESOLVED, that the Town Board of the Town of Mamaroneck hereby rejects all bids on Bid Contract #TA-89-8, for the furnishing and delivery of one Night Vision Scope, on the grounds that incorrect bid specifications were noticed for a model of Night Vision Scope not manufactured. 12. Resolution- Change Date of January 17, 1990 Town Board Meeting On motion by Councilwoman Silverstone, seconded by Councilwoman Price, it was unanimously RESOLVED, that the Town Board of the Town of Mamaroneck does hereby change its regularly scheduled Town Board Meeting of January 17, 1990 to January 24, 1990. WRITTEN COMMUNICATIONS ORAL COMMUNICATIONS , Representatives of Mamaroneck High School presented a petition with 345 signatures urging the Town Board to do everything possible to insure that at least 6 families without homes are considered in the new plans of the Larchmont Motel Site. APPROVAL OF MINUTES The minutes of a Special Meeting of November 7, 1989 were presented and approved. The minutes of the Regular. Meeting of November 15, 1989 were presented and approved with changes. 8 178 December 20, 1989 TOWN CLERK REPORTS The Town Clerk presented the Statement of Canvass to be filed for the record. The Town Clerk also presented the Monthly Report of the Town Clerk's Office for the month of November 1989, as well as the Building and Plumbing Report for the Months of October and November 1989. THE SUPERVISOR Supervisor Battalia noted that being of sound mind (of which she is certain in view of the fact that she has not sought another term as Supervisor) she wishes to leave for the record the following: To Helen Mohan, a hundred new Section-8 apartments; To Ross Valenza, the quick and speedy demise of the State Board of Equalization; To Tom Leddy, no snow and a magic wand to fix street lights; To Chief Tortorella and the Fire Council, a new Fire House; To Arthur Dallas, a New Years Eve reservation for a suite at the Larchmont Motel; To Carmine DeLuca, it was very exciting to have a dozen roses from another man and having your husband keep saying "who sent the roses," to Carmine, a scholarship to sleep-a-way computer camp and a also a copy of The Feminine Mystique; To Bill Zimmerman, I leave the deed for the Hammocks Pool, and a contract for Ticketron to handle credit card reservations for summer day camp; To Paulette Gabbriellini, I leave a dozen paper diapers and a franchise in Kinder Rare; To Clara, I leave an amendment to her recent Blue Knight Award which shall now read "the youngest rider of the year," and also some new leases for the tenants this year; To Lillian, from now on the confidential secretary to the Supervisor will be known as fairy godmother, and I leave the secret code to my filing system; To Pat, all my used meeting folders, and a new volunteer assistant to the Town Board; To Eric, a double paternity leave; To Steve Silverberg and Lee Hoffman, a word of advice, the next time two middle-aged women take you out to lunch and tell you they have troubles, believe them; To Steve Altieri, six more hands, four more feet, two clones and my smile; 9 179 December 20, 1989 To John McGarr, a reservation for pre-school summer day camp; To Steve Chapin, a litter law; To Cathy O'Flinn, membership in the Bonnie Briar Country Club; To Elaine, a slingshot to deal with Gordon Marshall; To Caroline, my Excedrin, my Mylanta, my Geritol, my Pepto Bismol, my gavel and the title "Town Mother;" To the people of the Town of Mamaroneck, my thanks, my appreciation for allowing me to serve, and I do_believe that I leave you in the finest hands of one of the best and brightest Boards that has ever served this Town. Supervisor Battalia next stated: HI want to thank a few people before I go, which is a very dangerous thing to do, but I will try to do it. The first people I would like to thank are the the Town Staff. I never realized before I ran for office just how resilient Town employees have to be, every few years everything is kind of " up for grabs," and they read about themselves in the paper, and hear about themselves in the street, and sometimes they have to adapt and adopt rather swiftly to changing winds and changing new faces. Mine was a big change six years ago, but I have to tell you that the Town Staff has been loyal, dedicated and taken me through scene difficult times. They have been very responsive and Ism not really sure that the Townfolk are aware of the dedication that exists among their employees....in particular, Pat DiCioccio, Jake, Bill Zimmerman, Ellen, Arthur Dallas, and Lillian, who kind of just picked up where sometimes a mess had been left. You were always willing to challenge, to try, and you really turned things around for me, and I thank you for that. To Steve Silverberg, you're a good counselor, and from one lawyer to another, you're the lawyer I'd pick to represent. To all the volunteers and the Boards and Commissions, Alan Mason and David Schwarz....we've had 200 people wane foreward. It's not what I have done....its what I've asked people to do and what they have been willing to do....and in particular to those volunteers in the Fire Department and VAC, who really, really put themselves on the line. To the Town Board past for your cooperation, I want to thenk you Lee, Tam and Larry. They were very loyal and very good opposition. To the present Town Board, I'm sorry for all the hard work and all the meetings, but thank you. To Steve Altieri, again I don't think people know what they have in a Town Administrator, and I have to tell you that Steve and I were not friends when we started. Battalia as Supervisor of the Town of Mamaroneck WHEREAS, Delores Battalia, one of the outstanding citizens of Westchester County, will be honored on December twentieth, nineteen hundred eighty-nine, at the Mamaroneck Town Center for her service as Supervisor of the Town of Mamaroneck; and WHEREAS, Delores has successfully presided over the thirty thousand residents of the Town of Mamaroneck as Supervisor since nineteen hundred eighty-four; and WHEREAS, Her loyal service to The Town of Mamaroneck and The County of Westchester includes: Member of the Westchester County Executives' Town/Village Task Force, Chairman of the County Clerk's Advisory Committee on Weapon Permits, Member of the Mamaroneck Town Traffic Committee, Member of the Human Rights Commission in the Town of Mamaroneck, Member of the Mamaroneck School Board Selection Committee as well as the Larchmont Fair Housing Committee; and WHEREAS, She has been a partner in her own firm, Stein & Battalia since nineteen hundred and seventy-nine providing needed services to many Westchester residents; and WHEREAS, She also serves as Director, Corporate Secretary & General Counsel to Battalia & Associates, Inc. , located in New York City; and WHEREAS, Her distinguished service to Westchester County includes acting as Arbitrator on the Westchester County Panel in the Ninth Judicial District of the State of New York; and WHEREAS, Dolores A. Battalia is the wife of O. William Battalia, and they are in turn parents of six children; Julie, Stephen, Christina, Lisa, Gregory, and Paula, and WHEREAS, She has been a resident of Westchester County since nineteen hundred and sixty-four, the Town of Mamaroneck since nineen hundred and sixty-eight, and presently resides in the Village of Mamaroneck, and WHEREAS, She has respectively served as a member of the Mamaroneck & Larchmont League of Women Voters as well as the Westchester Residential Opportunities; and 16 188 December 20, 1989 WHEREAS, Dolores has been actively involved at the College of New Rochelle, acting as Chairman and Board Member for the Castle Gallery as well as Member of the President's Advisory Council; and WHEREAS, She has been honorably admitted to the Supreme Court, State of New York in nineteen hundred and seventy-nine and into the United States District Courts, Southern and Eastern Districts of New York in nineteen hundred and eighty- one, as well as the United States Supreme Court in nineteen hundred and eighty-two; and WHEREAS, Her associations in professional organizations include the New York State Bar Association (Member of Special Committee of Public Access to Proceedings and Information) , Westchester Association of Town Supervisors, Village Officials Association, New York Women's Bar Association, Mamaroneck-Harrison-Larchmont Bar Association, Westchester County Bar Association, and Columbian Lawyers Association of Westchester; now, therefore, be it RESOLVED, That the New York State Assembly pause to honor, with respect and admiration, Delores A.
