TOWN OF MAMARONECK
held September 5th, 1923.

Justices Boyd, Collins, Dudley

Counsellor Gamble.
Upon motion, duly seconded, it was VOTED that the
minutes of meetings of June 11th, June 13th, and July 18th, 1923
be approved as printed.
A communication was received from Mr. L. Harold Bayly,
who also appeared before the Board, in relation to erroneous ass-
essment made upon his property, said assessment being made before
the property was improved. The communication was ordered, received,
placed on file, and the matter was referred to Counsellor Gamble
for the necessary resolution.
Mr. Henry Harlach of the Building Commission appeared
before the Board in relation to the fining of plans and the action
of the Board of Appeals upon plans awaiting their decision. The
matter was referred to Counsellor Gamble to take up with the
Board of Appeals with the view that thr entire matter be cleared
up and expedited. Mr. Harlach also spoke in relation to the viola-
tion of the Building Code by John McLoughlin on Hillcrest Avenue,
and it was VOTED that the matter be referred to Counsellor Gamble
and the Building Commission for proper action.
The officers of the Weaver Street Fire Company appeared
before the Board requesting an expenditure to take care of the
lighting and draping of the auditorium stage of the Weaver Street
Fire Company's building. Upon motion by Clerk Sherman, seconded by
Justice Boyd, it was
RESOLVED that the request of the officers of
the Weaver Street Fire Company for additional
lighting and draping of the stage in the audi-
torium of the new Weaver Street Fire House be
referred to the Fire House Committee of this
Board for their recommendation and report;
and be it furhter
RESOLVED that Counsellor Gamble be requested
to submit to this Board an opinion as to the
legal expenditure in relation to same.
A communication was received from Charles M. Baxter Jr.
requesting the cancellation of taxes due to an error in the Town
records of March 3rd, 1873, affecting Section 8, Block 87, Lot 13,
which is now owned by Michael Merola, and upon the recommendation
of Counsellor Gamble, the following resolution was, upon ROLL CALL
unanimously adopted:
WHEREAS, Michael Merola, the present owner
of lot 13 in block 87, section 8, on assess-
ment map of the Town of Mamaroneck, and for-
merly known as old lot No. 79 Map of Washing-
tonville, Village of Mamaroneck, has brought
to he attention of this Board that it appears
from the records of the Treasurer of the County
of Westchester that the aforesaid lot was sold
March 3, 1973 for taxes of 1871 to the Town of
Mamaroneck, for a term of 1000 years for the
sum of $13.27; and
WHEREAS, the Receiver of Taxes reports that
the original assessment rolls and the Col-
lector's books of record for said years are
not on file in his office; and that he is
therefore unable for this reason to correct-
ly check and determine the payment of said
tax; and
WHEREAS, from the evidence submitted it would
appear that said tax had been paid and never
so marked, due to an error in the Town records
as of that date; and it seems equitable that
said matter should be adjusted in the inter-
ests of both parties,
THEREFORE, upon the recommendation of the
Receiver of Taxes, be it
RESOLVED that the Receiver of Taxes be and
he hereby is authorized, empowered and di-
rected to accept the flat amount tax due,
to wit. $13.27, as appears from the records
of the Treasurer of the County of Westchester
on the aforesaid lot for said year, plus the
cost of sale, and to waive and cancel penal-
ties and interest thereon; and it is further
RESOLVED that the Receiver of Taxes upon the
receipt of the aforesaid tax of $13.27, plus
the cost of the sale, be and he hereby is
authorized and empowered to mark his records
paid and cancelled and to issue to and file
with the Treasurer of the County of West-
chester the necessary cancellation certifi-
cate in due form of law; and it is further
RESOLVED that the Town Clerk be and he hereby
is authorized and empowered to execute and
deliver certified copies of the aforesaid
resolution.
The Clerk brought to the attention of the Board the
matter of vacancies in Inspectors of Election offices, and upon
motion, duly seconded, it was VOTED that the matter be referred
to the Clerk to take up with the officers of the political parties
with authority to make such appointments as are necessary.
The Clerk also presented the matter of changing polling
places in one or two districts, and the matter was referred to him
with autjority to make such changes as are to the best interests
of the Town.
The Counsel reported that the Board of Sewer Commissioners
Sewer District No. 1, Town of Mamaroneck, ad heretofore purchased
for use in connection with the sewer system in said sewer dis-
trict, from various owners, lots 21, 22, 67 and 68 in block 57
section 1, and lot 3 in block 61, section 1, as shown on the ass-
essment map of the Town of Mamaroneck, and that there were unpaid
against the aforesaid lots, and recommends said taxes on the afore-
said property be marked cancelled. Upon motion duly seconded, it was
RESOLVED that it be and hereby is author-
ized and empowered to cancel the State,
County and Town and School taxes for the
year 1922 and lots 21, 22, 67 and 68 in
block 57 section 1, and lot 3 in block 61
section 1 as shown on the assessment map
of the Town of Mamaroneck; and it was further
RESOLVED that the Supervisor be authorized
and empowered to direct the Receiver of
Taxes to note the aforesaid cancellation
of taxes upon his books of record and to
direct the Board of Assessors to not the
aforesaid change of ownership on their
assessment book.
Counsel reported in connection with the construction of
the new Weaver Street Fire House the Town had acquired by purchase
from various owners for said purpose, the following property, to wit:
Lots 38, 39, 42, 43, 44, 73, 74, 78, 79, 80, 81, 82, 83, 84, and 85
in Block 50, section 1 as shown on the Assessment Map of the Town
of Mamaroneck, and that there were outstanding against said lots
unpaid State, County, and Town taxes and School taxes for the year
1922, which should be cancelled of record and which he recommended
being done. Upon motion, duly seconded, it was
RESOLVED that the Supervisor be and he
hereby is authorized and empowered to
cancel State, County, Town and School taxes
for the year 1922 on the following property
to wit: Lots 38, 39, 42, 43, 44, 73, 74, 80
as shown on the assessment map of the Town
of Mamaroneck, and be it further
RESOLVED, that the Supervisor be and he
hereby is authorized and empowered to
cancel School taxes for the year 1922
on Lots 78 and 79, Block 50, section 1
as shown on the assessment map of the Town
of Mamaroneck: and it was further
RESOLVED that the Supervisor be and he
hereby is authorized and empowered to
direct the Receiver of Taxes to note
the aforesaid cancellation on his Tax
records and to direct the Board of Ass-
essors to note the change of ownership
on their books of record.
The Committee appointed by the Supervisor in connection
with the furnishing of the new Weaver Street Fire House reported
that they had gone into the matter thoroughly and had authorized
the purchase of such furniture and fixtures as in their judgement
was proper, and asked the approval of the Board of the expenditures
so made by them. Upon motion, duly seconded, it was
RESOLVED that the report of the Committee
appointed in connection with the furnishing
of the new Weaver Street Fire House be re-
ceived, and that the action of the Committee
in making the necessary purchases in connect-
ion with the same be and the same hereby is
approved; and it was futher
RESOLVED that the Supervisor be and he hereby
is authorized, empowered and directed to make
payment for the expenditures so made by the
Committee when proper Town vouchers approved
by said Committee are presented; and it was
further
RESOLVED that the amounts so expended by the
Supervisor be refunded by the issuance of a
certificate of indebtedness in said amount
which said certificate of indebtedness shall
be a propert Town charge against Fire, Lighting
and Water Supply District No. 1 of the Town of
Mamaroneck.
Upon motion the meeting adjourned at 11.40 P.M.
