HomeMy WebLinkAbout1991_09_11 Town Board Regular Minutes MINUTES OF THE REGULAR MEETING OF THE TOWN BOARD AMID BOARD OF FIRE CONMISSIONERS OF THE TOWN OF MAM�RONECK, FIELD ON THE 11TH DAY OF SEPTEMBER 1991 IN THE COURT ROOM OF THE TOWN CEN M, 740 WEST BOSTON POST ROAD, MAMARONECK, NEW YORK CONVENE REGULAR MEETING The Regular Meeting of the Town Board was called to order by Supervisor Silverstone at 7:00 p m., at which time the Board recessed into a Executive Session. I The Executive Session was held in Conference Room A to discuss personnel, litigation and certiorari. On motion duly made and seconded, the meeting was adjourned at 8:20 p M. RECONVENE REGULAR MMMIWG The Regular Meeting of the Town Board was called to order by Supervisor Silverstone at 8:25 p m. in the Court Roan. Present were the following members of the Board: Supervisor Caroline Silverstone Councilwoman Elaine Price Councilman John McGarr Councilwoman Kathleen Tracy O'Flinn Councilman Paul A. Ryan Also present were: Stephen V. Altieri, Town Administrator Carol A. Acocella, Deputy Town Clerk Steven M. Silverberg, Counsel to the Town Paul Munch, Chief of Police CALL TO ANON Supervisor Caroline Silverstone pointed out to those assembled the locations of exits as required by law for public gatherings. POLICE AWARDS PROGRAM Supervisor Silverstone turned the meeting over to Paul Munch, Chief of Police, who welcomed a new member of the Town of Mamaroneck Police Department, Cedric Winn who was joining the Police Department after serving two and one half years with the City of Mount Vernon. Chief Munch pointed out that Mr. Winn had outstanding credentials and that he resides with his wife Julia in New Rochelle. Chief Munch introduced him and asked Supervisor Silverstone if she would please swear him in. Supervisor Silverstone, after administering the oath, asked if everyone would join in welcoming and congratulating Mr. Winn on his appointment. 1 September 11, 1991 iChief Munch then P lained that he wanted to recognize thirteen � officers who were to receive awards in eight caries for their j outstandin g accomplishments. He explained the different categories and then introduced Lt. John Anderson who had chaired the Award Committee. Lt. Anderson then listed the officers and explained their outstanding accomplishments. He explained that they will be j recognized in the form of a Police Award Linder the newly !' established "Police Awards Program!'. I Lt. Anderson noted that the "Police Awards Programll has received the enthusiastic endorsement from the Town of Mamaroneck Police Department as well as the P.B.A. The Awards are conferred upon officers after a comprehensive evaluation of department activities. During the six month period from January, 1991, fifteen officers received departmental commendations involving ! nine incidents. They are: Off. Anthony Saline - Excellent Police Duty Off. Martin Pfeiffer - Excellent Police Duty Sgt. Michael Nardelli - Excellent Police Duty Off. Alfred Vize - Excellent Police Duty Off. George Valentzas - Excellent Police Duty Off. Thomas Gisin - Excellent Police Duty Off. Frank Dellacamera - Excellent Police Duty Sgt. Frank Occhiogrosso - Distinguished Police Off. Off. Anthony Saline - Distinguished Police Duty Lt. Anderson explained that these Officers had been presented certificates at the annual Police Benevolent Association picnic on July 28th. Supervisor Silverstone noted that this Award Program is a positive step in recognizing the members of the Department and the Award Committee will review events dating back to 1986 so that appropriate recognition can be bestowed Leon those responsible for meritorious actions. Resolution - Repair of Ladder 19 The Administrator stated that this is the only ladder truck owned by the Fire Dept. and the authorization for repairs is considered to be an emergency and for that reason it was not possible to seek competitive bids for this repair, therefore, on motion by Commissioner McGarr, seconded by Commissioner Ryan, it was unanimously RESOLVED, that this Board hereby authorize payment for repair of the ladder truck #19, presently out of order, in the amount of $7565.01. There being no further business to come before this Commission, on motion by Commissioner Price, seconded by Councilman McGarr, the meeting was unanimously declared adjourned at 8:45 p.m. 3 I September 11, 1991 I li AFFAIRS OF THE TOWN I 1. Appointment - Planning Board I on recommendation and motion by Councilwoman Price,. seconded by Councilman Ryan, it was unanimously RESOLVED, that this Board hereby reappoints Sanford Bell of Maple Hill Drive to serve as Chairman of the Planning Board for a tear of seven years, said tern expiring July 1998. I 2. Authorization - Settlement of Certiorari Following explanation by the Town Administrator, on motion by Councilwoman Price, seconded by Councilwoman O'Flinn, it was unanimously RESOLVED, that in accordance with the terms recommended by the Town Assessor, this Board hereby authorizes settlement of certiorari proceeding on the following property: Single-family residence owned by Sarah & Neil Soss located at 3 South Ridge Road, Mamaroneck, Block 206, Lot 510 vs. Town of Mamaroneck for reduction of assessment year 1990 from $35,600 to $31,600 for a reduction of $4,000. On motion by Councilwoman Price, seconded by Councilwoman O'Flinn, it was unanimously RESOLVED, that in accordance with the terms recommended by the Town Assessor, this Board hereby authorizes settlement of certiorari proceeding on the following property: Garden Hanes Management, 151 Fenimore Road & 329 Livingston Avenue, Block 908, Lot 1; 6 & 7 story stucco apartment house containing 86 units & 307 rooms. Set date for Public Hearings - Fire Lane Laws i Following explanation by Town Counsel, it was decided to first change the dates of the Town Board meetings in October and after those dates are set, then the Public Hearing date for the Fire Lane Law could be set. At this time, the order of the Agenda was changed and No. 9 was discussed. 9. Change Date of Town Board Meetings Scheduled for October. Following discussion, on motion by Councilwoman Price, seconded by Councilwoman O'Flinn, it was unanimously RESOLVED, that the Town Board does hereby authorize the Regular Meeting scheduled for October 2, 1991, be changed to October 9, 1991 and that the October 16, 1991 meeting be changed to October 23, 1991. i At this time, the regular order of the Agenda was resumed and Item. No. 3 under AFFAIRS OF THE TOWN was taken up. I 3. Set Date for Public Hearings - Fire Lane Laws - Incinerator Law After discussion, on motion by Councilwoman Price, seconded by Councilwoman, O'Flinn, it was unanimously RESOLVED, that this Board hereby sets October 9, 1991, as the date for a Public Hearing on the proposed Fire Lane Law. and be it further RESOLVED, that the Town Clerk be and she hereby is authorized to publish in an official newspaper of the Town, Notice of said Hearing as required by law. -Incinerator Law After discussion by Town Counsel, on motion by Councilwoman Price, seconded by Councilman McGarr, it was unanimously RESOLVED, that this Board hereby sets October 9, 1991, as the date for a Public Hearing on the proposed Incinerator Iaw. i and be it further RESOLVED, that the Town Clerk be and she hereby is authorized to publish in an official newspaper of the Town, Notice of said Hearing as required by law. 6 i September 11, 1991 At this time the order of the Agenda was changed to discuss setting a date for a third public hearing which was not on the Agenda. Coucilwaman O'Flinn explained that the Traffic Cau nittee had a meeting the night before and had discussed, at the urging of residents in the area of Murray Avenue, reducing the speed limit , in that area. Following further explanation by Councilwoman O'Flinn and Town Counsel, Steven Silverberg, on motion by Councilwoman Price, seconded by Councilman McGarr, it was unanimously RESOLVED, that this Board hereby sets October 9, 1991 as the date for a Public Hearing on the proposed Murray Avenue speed limit. and be it further RESOLVED, that the Town Clerk be and she hereby is authorized to publish in an official newspaper of the Town, Notice of said Hearing as required by law. I Councilman Ryan suggested that we change the date of the Public Hearing on the proposed Fire Incinerator Law to October 23, 1991, in place of October 9, 1991, in order to leave time for the Public Hearing on the proposed Murray Avenue traffic problem scheduled for October 9, 1991. I On motion by Councilman Ryan, seconded by Councilwoman Price, it was unanimously i RESOLVED, that this Board hereby change the previous motion and authorizes October 23, 1991 as the date for the Public Hearing on the proposed Incinerator Law. and be it further RESOLVED, that the Town Clerk be and she hereby is authorized to publish in an official newspaper of the Town, Notice of said Hearing as required by law. 4. Reschedule Public Hearings Following discussion and the fact that the newspapers have already been noticed for September 25, 1991, on motion by Councilwoman Price, seconded by Councilman McGarr, it was unanimously RESOLVED, that the Board reschedule the Public Hearing for proposed Parking - East & West Brookside Drive for September 25, 1991: I' and be it further RESOLVED, that the Town Clerk be and she hereby is authorized to publish in an official newspaper of the Town, Notice of said Hearing as required by law. September 11, 1991 Oakdale & Stratford Roads RESOLVED, that the Board reschedule the Public Hearing on the proposed Stop Sign on Oakdale Road & Stratford Road for September 25, 1991: and be it further RESOLVED, that the Town Clerk be and she hereby is authorized to publish in an official newspaper of the Town, Notice of said Hearing as required by law. Marbourne Drive & Stonewall Lane RESOLVED, that the Board reschedule the Public Hearings for the proposed Stop Sign on Marbourne Drive & Stonewall Lane for September 25, 1991: and be it further I RESOLVED, that the Town Clerk be and she hereby is authorized to publish in an official newspaper of the Town, Notice of said Hearing as required by law. Blossom Terrace RESOLVED, that the Board reschedule the Public Hearing on the proposed No Parking Here to Corner Sign on Blossom Terrace for September 25, 1991: and be it further RESOLVED, that the Town Clerk be and she hereby is authorized to publish in an official newspaper of the Town, Notice of said Hearing as required by law. Tree Preservation Law RESOLVED, that the Board schedule the Public Hearing for the proposed Amendment to the Tree Preservation Law for September 25, 1991: and be it further RESOLVED, that the Town Clerk be and she hereby is authorized to publish in an official newspaper of the Town, Notice of said Hearing as required by law. 5. Authorization - Westchester County Snow Removal Contract Councilman McGarr asked when was payment for this service last increased. s i �I i i I September 11, 1991 Mr. Altieri replied that it has been three years and suggested that we execute the agreement now and then through the Westchester Officials Association work to get a resolution passed to increase the payment schedule for snow removal since the cost to us for delivering same has increased. Following a further explanation by the Town Administrator on the costs, on motion by Councilwoman O,Flinn, seconded by councilwoman Price, it was unanimously RESOLVED, that the Town Board of the Town of Mamaroneck does hereby authorize the Town Administrator to execute the agreement with the County of Westchester for snow and ice control on County roads located within the Town for the year 1991-1992. 6. Adoption of 1992 Budget Calendar Supervisor Silverstone stated that there were conflicting dates on the budget calendar, and made a suggestion that we give the Administrator time to make the necessary changes to the Budget Calendar, but that we accept it now as presented and amend it at a later date, therefore, on motion by Councilwoman Price, seconded by Councilwoman O'Flinn, it was unanimously 9 I i i September 11, 1991 RESOLVED, that this Board hereby accepts the 1992 Budget Calendar as follows: BUDGET CALENDAR - 1992 BUDGET August 15th issue work papers to Department Heads i September 16th Receive back work papers from Department Heads October 23rd Presentation of Tentative Budget to Town Board by Budget officer October 30th Public Work Session - Operating its November 6th Public Work session November 13th Public Work Session - Outside Agencies November 21th Public Work Session - Capital and Operating budget reviews Decor 4th Public Hearing on the Budget December 18th 1992 Budget Adoption III s 8. Salary Authorizations - Highway Department - Police Department - Recreation Department Pursuant to the memo from Town Administrator, on motion by Councilwoman Price, seconded by Councilman McGarr, it was unanimously RESOLVED, that this Board hereby authorizes an annual salary in the amount of $18,500 to Antonio Fiera of Mamaroneck for the position of Laborer in the Highway Department, effective September 3, 1991. and be it further RESOLVED, that this Board hereby authorizes an annual salary in the amount of $29,779 to Cedric T. Winn as a Probationary Police Officer effective Monday, September 3, 1991. PROCLAMATION At this time Supervisor Silverstone proclaimed September 21 through October 14 be observed as Coastweeks: P R O C L A M A T I O N -- i WfBMEAS, the Town of Mamaroneck, including the Villages of Larchmont and Mamaroneck have a varied coastline of rocky i shores, sandy beaches, productive estuaries and salt marshes and wetland areas; and o. Caroline Silverstone, Supervisor, Town of Mamaroneck 12 r i i September 11, 1991 REPORTS OF THE SUPERVISOR The Administrator and Supervisor concurred that everything possible is being carried out by the Town to assist the Village of Larchmont during its Centennial celebration and parade being held on September 28th, including extra parking being made available and shuttle buses being provided for reaching the parade area. REPORTS OF THE COUNCIL Councilwoman Price reported about the problem of getting a crosswalk on Weaver Street adjacent to Maple Hill Drive and Sts. John & Paul School. Discussion followed regarding the installation of blinking lights, and stop signs.. Supervisor Silverstone told Mr. Byrne that she would contact the President of the Parish Council at Sts. John & Paul School and the Principal, to ask them if they would like a crosswalk and if they would attend the next meeting of the Traffic Committee in October, she will make sure that this item gets on the Traffic Committee agenda. Mr. Byrne reminded Supervisor Silverstone that this has been under investigation for four years. WRITFEN COMMUNICATIONS The following written communication was given to the Board by Mr. Byrne of 19 Villa Road, Larchmont who was present at the meeting. Mr. Byrne asked that this letter be placed into the Record. Further discussion ensued. Mr. Byrne asked the Town Council to implement the additional recommendations made by the Traffic Committee and the former Police Commissioner in June of 1990, to enhance safety of school children on Weaver Street at Sts. .John & Paul School to include blinking warning lights on Weaver Street North of the school and No Parking signs on Weaver Street between Maple Hill Drive and Dante Street. He also suggested that a crosswalk across Heather Lane and across Maple Hill Drive be considered to improve safety. Byrne 19 Villa Road Larchmont, New York 10538 14 I September 11, 1991 I REPORTS OF THE COUNCIL Councilwoman O'Flinn advised that during Coastweek, the Life Center is sponsoring a clean-up at Harbor Island and Manor Beach. The clean-up is on Sunday, September 22nd between 1:00 and 4:00 in the afternoon. She said they are looking for volunteers, and that old clothes should be worn. They will be taking an inventory of items found that day. Councilwoman Price stated that work would begin at 12:00 at Mamaroneck Harbor and 1:00 at Manor Beach. Councilwoman O'Flinn also reminded everyone that construction would be beginning at the intersection of Weaver Street and Murray Avenue over the next few weeks. Councilwoman Price complimented the Town Administrator on purchasing sign machines. She also stated that we are working with the Board of Architectural Review on the revitalization of the Post Road. Discussion followed regarding this project. Supervisor Silverstone reported that the Habitat project is officially in effect. The family has been chosen, and volunteers will begin digging the foundation very soon. ORAL OOMMUNICATIONS Valerie O'Keeffe asked Councilwoman Price about the beautification of the Boston Post Road and whether it included Blockbuster Video. Councilwoman Price replied that it would, to which Valerie O,Keeffe expressed interest as to whether or not they are going to redo the driveway around Blockbuster and whether it would include removing the blacktop in the center of the sidewalk between the Post Road and the Blockbuster building. Councilwoman Price explained that the blacktop would remain, and that it is a loading zone designated as such. Valerie O,Keeffe also asked if we, as taxpayers, are paying for the beautification of the Boston Post Road. Councilwoman Price explained that this is all part of the Urban Renewal Plan and that the Town has received grants from Westchester County for our Master Plan along the Boston Post Road and that sidewalks and curbs are included in that Master Plan.
