HomeMy WebLinkAbout1991_06_26 Town Board Regular Minutes M3 NUTES OF THE REGULAR M!MVING OF THE TOWN BOARD AMID BOARD OF FIRE COWUSSIOBWS OF THE TOWN OF MAM?kRONECK, HELD ON THE 26TH OF JUNE 1991 IN THE COURT ROOM OF THE TOWN CENTER, 740 WEST BOSTON POST ROAD, NNECK, NEW YORK CONVENE REGULAR HEWING The Regular Meeting of the Town Board was called to order by Supervisor Silverstone at 7:00 p.m., at which time the Board recessed into Executive Session. The Executive Session held in Conference Rain A to discuss personnel and real estate was, on motion duly made and seconded, unanimously declared adjourned at 8:12 p.m. RECONVENE REGULAR HEETIN= The Regular Meeting of the Town Board was called to order by Supervisor Silverstone at 8:29 p.m. Present were the following members of the Board: Supervisor Caroline Silverstone Councilwoman Elaine Price Councilman John McGarr Councilwoman Kathleen Tracy O'Flinn Councilman Paul Ryan Also present were: Patricia A. Dicioccio, Town clerk Stephen A. Altieri, Town Administrator Steven M. Silverberg, Town Counsel Michael A. Acocella, Jr., Fire Chief Paul A. Munch, Police Chief CALL TO ANON Supervisor Silverstone pointed out to those assembled the locations of exits as required by law for public gatherings. At this time the regular order of the agenda was changed and the following item relating to a Police Department promotion was taken up: June 26, 1991 4. Salary Authorizations - Police Department Police Chief Paul Munch introduced Police Officer Frank G. Pennachio and requested salary authorization promoting him to rank of Police Sergeant, stating that he was appointed to the Department in July of 1986, having served four years in the - Larchmont Police Department where he received three merit awards. He noted that Officer Pennachio is an Emergency Medical Technician certified by the American Red Cross and a basic life-support instructor. He mentioned that the Officers wife, Carol, and two daughters were in the audience. Chief Munch reported that Officer Pennachio was selected from among the top three candidates on Eligibility List #79-898D established by the Westchester County Personnel Office, and selected based on a thorough evaluation of candidates and input fran the Department's middle management on his outstanding work record. He then requested salary authorization prompting him to the rank of Police Sergeant. Officer Pennachio was then sworn in by Supervisor Silverstone and received congratulations. The regular order of the agenda remained changed and the Board recessed into the meeting of the Board of Fire Commissioners. BOARD OF FIRE COMMISSIONM The meeting was called to order by Commissioner Silverstone at 8:27 p.m. in the Court Roan. Present were the following members of the Commission: Commissioner Caroline Silverstone Commissioner Elaine Price Commissioner John McGarr Commissioner Kathleen Tracy O,Flinn Commissioner Paul Ryan The agenda of this meeting was changed and the following item relating to a Fire Department promotion was taken up. Chief Acocella recommended that Jay Reynolds, a Fire Fighter for thirteen years and prior to that a volunteer Fire Fighter and an Explorer, be promoted, per Eligibility List 75-123D, to the position of Fire Lieutenant. Jay Reynolds was then sworn in by Commissioner Silverstone, received congratulations, and introduced his family. 1. Salary Authorization On motion by Commissioner Ryan, seconded by Commissioner -Price, it was unanimously RESOLVED, that this Board hereby authorizes salary for the rank of Fire Lieutenant to Jay Reynolds, at an annual rate of $46,510.00 effective July 1, 1991. 3. Fire Report - May 1991 Supervisor Silverstone read the fire report outlining the number of calls, number of men responding and amount of time entailed. A brief discussion ensued among the Board and the Fire Chief with regard to the proposed Fire Lane Law and the particular situation at Larchmont Acres. There being no further business to come before this Commission, on motion by Ca maissioner Price, seconded by Cc missioner Ryan, the meeting was unanimously declared adjourned at 8:35 p.m. At this time the regular order of the Agenda was resumed. ADJOURNED PUBLIC HEARINGS - Amend Limited Moratorium Law - Amend Zoning Ordinance The Supervisor briefly explained that these Hearings were adjourned because they were originally announced for June 20th and it was determined that there would be two Board members absent that evening. She stated that the Board feels for public hearings at least four Board members should be present and since the meeting of the 20th was posted, the three Board members opened the meeting and then abruptly adjourned it to tonight. 3 June 26, 1991 ADJOURNED PUBLIC HEARING Amend Limited Moratorium Law Supervisor Silverstone requested a motion to open the Public Hearing to amend the Limited Moratorium Law and on motion by Councilwoman O'Flinn, seconded by Councilman McGarr, it was unanimously RESOLVED, that the Public Hearing be, and hereby is declared open. The Town Clerk presented for the record the Affidavits of Publication and Posting of the Notice of Hearing. Town Counsel gave a brief summary of the Limited Moratorium Law adopted by the Town Board last May restricting development of the country club properties in the town while it completes its study of the zoning of these properties. He stated that since the one-year moratorium will be ending, the purpose of this amendment is to continue the moratorium on development for an additional period of six months. The Supervisor then asked if anyone wished to speak in favor and a resident, Sandra Tashoff spoke in favor of this extension. She then asked if anyone wished to speak in opposition. There being no further comments from the audience or the Board, she asked for a motion to close the Hearing, and on motion by Councilwoman Price, seconded by Councilman Ryan, the Public Hearing was unanimously declared closed. Thereafter, on motion by Councilwoman Price, seconded by Councilman McGarr, it was unanimously RESOLVED, that the Town of Mamaroneck hereby declares itself as lead agency; and further moves that it has determined that the proposed action will not have a significant impact on the environment and, consequently, a draft environmental impact statement will not be prepared for the purposes of amending the existing Limited Development Moratorium law enacted on May 16, 1990 for an additional period of six months, said moratorium to end November 25, 1991. At this time, on motion by Councilman McGarr, seconded by Councilman Ryan, it was unanimously RESOLVED, that this Board hereby amends Local Law 3-1990 LIMITED DEVELOPMEW MORATORIUM to continue the moratorium on development of certain parcels for an additional period of six months while the Town completes its study of the zoning of the following parcels designated on the Town tax map as follows: Section 2 Block 201 Lot 19, Block 224 Lot 1000, Block 225 Lot 1; Section 3 Block 344 Lot 99, Block 347 Lot 1; and Section 4 Block 414 Lot 20. 4 June 26, 1991 ADJOURNED PUBLIC HORING - Amend Zoning Ordinance The Supervisor asked for a motion to open the Public Hearing to amend the Zoning Ordinance and on motion by Councilwoman O1Flinn, seconded by Councilwoman Price, it was unanimously RESOLVED, that the Public Hearing be, and it hereby is declared open. The Town Clerk presented for the record the Affidavits of Publication and Posting of the Notice of Hearing. The Town Administrator briefly explained that the purpose of the proposed amendment is to reduce the size of parking spaces for multi-family uses as a way to increase the number of spaces in apartment complexes since car sizes have been reduced substantially. He noted that the Traffic Committee felt this would be of benefit to the community although some residents owning older model cars may be invonvenienced, and they recommended that there be a provision requiring multi-family properties to maintain 10% of parking spaces in the lot at the larger dimensions. The Board discussed the issue. The Supervisor asked if anyone wished to comment in favor of or in opposition to the proposed amendment. There were no comments from the audience, and further discussion ensued among the Board, after which time general consensus was to hold this over to the September meeting awaiting further comment from the Traffic Committee. AFFAIRS OF THE TOWN 1. Appointment - Chairman, Conservation Advisory Commission Councilwoman O-*Flinn gave a brief background and upon her recommendation and motion, seconded by Councilwoman Price, it was unanimously RESOLVED, that this Board hereby appoints Louise Perez of Cherry Avenue, Larchmont Village, as the Chairperson of the Conservation Advisory Commission to fill the vacancy of Kevin Ryan, for a tern of office expiring on December 1991. 2. Consideration of Water Rate Increase The Supervisor introduced John Hock, Manager of the Westchester Joint Water Works, explaining that the Water Works serves the Town and Village of Harrison, Village of Mamaroneck and Town of Mamaroneck. Mr. Hock noted that the Water Works can only recommend but has no power to establish water rates which have not increased since 1986. He explained how looking at the trend of decrease of net revenues, which is normal after a period of time has elapsed since the last rate increase, expenses of operating the Water Works increase and allocated expense to the Town increase correspondingly. He further explained that, on the other hand, revenues are fairly stable and since there is no 5 June 26, 1991 tremendous growth within the Town, established rates remain constant, with the exception of seasonal effects. For instance, he went on to say, in wet years not much water is sold and there have been two wet years in a row 1989 and 1990, but 1988 was a dry, hot summer and a lot of water was sold. He added that in the first year after a rate increase, there is a noticed increase in net income, which in time will drop, and that projecting what will occur over the caning years, it will drop to a point where there will be concern that the Town can meet its obligations for indebtedness and reimbursement to the Water Works for capital improvements made on behalf of the Town. He concluded that the recommended 9% increase will enable the Town to continue to operate its water system without imposing a water district tax at this time, and that capital and operating expenses will continue to be met by revenues from the sale of water. He went on to explain some of the future capital improvements to be.met and also how to structure the increase to encourage conservation incentives. Mr. Hock again mentioned his recommendation of a 9% increase and then went on to field questions from the Board and audience as a somewhat lengthy discussion ensued. At this time, on motion by Councilman McGarr, seconded by Councilwoman Price, it was unanimously RESOLVED, that this Board hereby approves a 6.2% average increase in water rates and a modification of the rate structure to provide greater equalization of the rates among users as proposed in the June 4, 1991 document received by the Westchester Joint Water Works. 3. Authorization - Pryer Manor Bridge The Administrator explained that the lowest bid received by the City of New Rochelle to repair Pryer Manor Bridge was $95,000 higher than the original engineering estimates and, therefore, the projected cost will be in the range of $400,000 representing and increase of $75,000 for the Town and for the City of New Rochelle. Following a brief discussion among the Board, on motion by Councilman Ryan, seconded by Councilman McGarr, it was unanimously RESOLVED, that this Board hereby accepts the bid of the McNamee Construction Company as the lowest, responsible bidder of the Pryer Manor Bridge Project #10-690-P3 contingent upon the City of New Rochelle, acceptance and award of this bid; and be it further RESOLVED, that this Board hereby authorizes a maximum amount of $200,000 as its portion of the above cost which will be equally shared by the City of New Rochelle. 6 &hh,- June 26, 1991 4. Salary Authorizations - Police Department - Conservation - Recreation - Town Center Building On motion by Councilwoman Price, seconded by Councilman McGarr, it was unanimously RESOLVED, that this Board hereby authorizes salary for the rank of Police Sergeant to Officer Frank G. Pennachio at an annual rate of $49,350.00 effective June 21, 1991. On motion by Councilman McGarr, seconded by Councilwoman O'Flinn, it was unanimously RESOLVED, that this Board hereby authorizes salary payment to the following simmer employees in the Conservation work program: Samantha Sanders, $5.50/hour effective 6/10/91; Jeffrey Tarantino,$5.25/hour effective 6/24/91; Carolyn Munn, $5.00/hour effective 6/24/91; Devra First $5.00/hour effective 6/24/91; Andrew Shabasson $5.00/hour effective 6/24/91. All staff as Assistant Swim Instructors @ $20.00 per hour. 1 - 10 June 26, 1991 On motion by Councilman McGarr, seconded by Councilman Ryan, it was unanimously RESOLVED, that this Board hereby authorizes salary in the amount of $5.75 per hour for Brian Dillon as a simmer custodian assisting Corky Russell in several projects in the Town Center Building effective 6/24/91. 5. Acceptance of Resignation - Police Commissioner On motion by Councilman McGarr, seconded by Councilman Ryan, it was unanimously RESOLVED, that this Board hereby accepts the resignation of Police Commissioner Arthur Dallas, effective as of August 2, 1991., 6. Traffic Committee Item The Administrator submitted four recommendations by the Traffic Committee requiring public hearings. On motion by Councilwoman Price, seconded by Councilman Ryan, it was unanimously RESOLVED, that this Board hereby sets September 11, 1991 as the date for Public Hearings on the following: 1. Parking - East and West Brookside Drive 2. Stop Sign - Oakdale Road and Stratford Road 3. Stop Sign - Marbourne Drive and Stonewall Lane 4. Blossom Terrace - No Parking Here to Corner and be it further RESOLVED, that the Town Clerk be and she hereby is authorized to publish in an official newspaper of the Town, Notice of said Hearing as required by law. APPROVAL OF MINUTES The Minutes of the Regular Meeting of May 8, 1991 were approved with a change. The Minutes of the Regular Meeting of May 22, 1991 were approved with corrections. 11 June 26, 1991 WP11T= COMMUNICATIONS ORAL COMMUNICATIONS The Supervisor stated that they have received some written communications concerning the country club properties and have added these responses to the record of the Hearings. A discussion was held concerning the date of the Regular Meeting of July and on motion by Councilwoman Price, seconded by Councilwoman O'Flinn, it was unanimously RESOLVED, that this Board hereby sets the date of the Regular Town Board Meeting for July on Wednesday, July 10, 1991. REPORTS OF THE COUNCIL Councilman McGarr reported that at the Recreation Commission meeting at the end of May, he was advised that the Engineers report on the ice rink was scheduled to be complete on July 1st. Some discussion followed. Councilwoman o,Flinn spoke about the fundraising campaign held by the Beautification Committee, which sent letters to 3400 residents and which, to their pleasant surprise, was responded to by a huge number of donations to enhance the Weaver and Murray intersections.
