TOWN OF MAMARONECK
held July 18th, 1923.
The meeting was called to order by Supervisor Burton
at 9 P.M.
Present: Supervisor Burton
Justices, Boyd, Collins, Dudley,
Town Clerk Sherman
Counsellor Gamble.
Upon motion duly seconded, it was VOTED that the minutes
of the meetings of June 4th and June 6th, 1923 be approved as printed.
The Supervisor reported that the old fire house building
is now being vacated by the Weaver Street Fire Company, and that
inasmuch as the Sewer Commissioners have purchased two lots on the
opposite side of Edgewood Road for sewer purposes, that he delieved
it advisable that rather than sell said building, it would be wise
and to the interest of the Town to move said building on the afore-
said lots and alter it for use as offices for the police department.
After discussion, upon motion duly seconded, it was
RESOLVED that the Supervisor be and he hereby
is authorized and empowered to make a contract
with the Sewer Commission for the use of said
lots by the Town, and be it further
RESOLVED that he be authorized and empowered
to take the necessary steps to prepare said
lots to receive said building and to remove
the same thereto; that the cost of same be a
charge upon the unincorporated section of the
Town and that he be authorized to issue Certi-
ficate of Indebtedness to cover the cost in-
curred in carrying this resolution into effect.
The Supervisor also presented estimate from Silleck E.
Coles, for the cost of removing said building across Edgewood Road,
quoting the cost for doing said work at $525. Same was ordered
noted in the minutes and placed on file.
The question of the removal of the firealarm system to
the new fire building was brought up and upon motion, duly seconded,
it was
VOTED that Mr. H. J. Brewer be requested to
take tap the matter of removing the fire alarn
system to the new fire house, and report back
to this Board his recommendation in relation
to same , and it was further
RESOLVED that Mr. R. J. Brewer be authorized
and empowered to go ahead with the details
necessary thereto.
The report of the Receiver of Taxes for the months of
May and June 1923 were received, read, ordered placed on file and
are as follows:

The report of the Police Department for the months of May and
June 1923 were received and read, showing for the month of May 81
arrests, total amount of fines $1275.00 and for the month of June
87 arrests, and total amount of fines, $1213.00. The reports were
ordered noted in the minutes and placed on file.
The report of the Town Clerk for the months of May and
June 1923 were received, read, ordered placed on file and are as

A communication from Grace L. O'Grady was received and read,
in relation to a claim for exemption of taxes on property purchased
with pension money by her father a Civil War Veteran. The communica-
tion was ordered placed on file and the matter referred to Counsel
for report.
A communication from W. F. Edwards was received and read
in relation to unpaid taxes on portions of his property situated on
Edgewood Avenue. The Communication was ordered placed on file and the
matter referred to Counsel for report.
A communication from the Winged Foot Golf Club was received
and read, requesting the appointment of Thomas F. Delaney of 400
East 161st Street, New York City as Special Officer for the Club,
The Communication was ordered placed on file and the Clerk was re-
quested to instruct Mr. Delaney to appear before the Town Board at
its next meeting for examination.
Communications were received from the Woods of Larchmont
Association and J. J. Saxelby complaining of the nuisance of the
garbage dump on Forest Avenue and Bungalow Road in the woods of
Larchmont. The Clerk reported that he had taken it up with the gar-
bage contractor and that he had promised that the nuisance would
stop. The communications were ordered received and placed on file
and the Clerk was requested to reply thereto.
Mr. John F. Fairchild presented a claim on behalf of
Messrs. Potter, Harding and Fairchild in relation to the services
rendered to the joint Union Water Committee representing the Town of
Mamaroneck and the Town of Harrison, and the Villages of Pelham and
Mamaroneck, said claim being in the amount of $2100. one fourth of
said amount namely $525. being chargeable to the Town of Mamaroneck.
Upon motion duly seconded it was
VOTED that the claim of Messrs. Potter
Harding and Fairchild be approved in the
amount of $525. and that the same be
presented to the Board of Auditors for
audit.
A communication from the Weaver Street Fire Company was
received and read, recommending to the Town Board the removal of
two trees situates, at the driveway in front of the Fire House on
Weaver Street. It being there contention that these trees might
be an incumbrance to the driver of the apparatus, especially in
bad weather. The communication was ordered placed on file and the
Clerk was instructed. to reply stating that the Board would take
the matter under consideration.
A Communication was also received from the Weaver Street
Fire Company recommending to the Town Board that the Board purchase
an American La France Hook and Ladder apparatus fully equipped.
They stated that they had the privilege of receiving tests on
several makes of apparatus and it was their contention that the
American La France passes all makes in performance. The communi-
cation was ordered noted in the minutes and solaced on file.
The Clerk reported that Capt. Nichol had requested the
purch-.se of two iol drip pains to be used under the apparatus floor.
the matter was left in the hands of the Clerk to take care of same.
Mr. Gagliardi reported on the action brought by the
Village of Larchmont against the Town of Mamaroneck, restraining
the Town from enforcing its zoning ordinance against the water
works property owned by said Village, and stated that a motion
for judgment on the pleadings made by the attorney for the Village
of Larchmont had been granted by Mr. Justice Frank L. Young. After
the matter was discussed at some length, upon motion of Justice
Dudley, seconded by Justice Collins, the following resolution was
unanimously adopted:
RESOLVED that it is the sense of this Board
that an appeal be taken from the judgment on
the pleadings granted by Mr. Justice Frank L.
Young, in the action brought by the Village of
Larchmont against the Town of Mamaroneck, to
permanently enjoin the Town of Mamaroneck from
enforcing its zoning ordinance against the
water works property of said Village of Larch-
mont, and be it further
RESOLVED, that Clark, Close and Davis be and
hereby are requested to take whatever steps
may be necessary to prosecute said appeal with
a view to obtain a favorable determination by
the Appellate Division.
The Building Commission was present and brought to the
attention of the Board the need of office and clerical help, and
upon their recommendation it was, upon notion duly seconded,
RESOLVED that the sum of $100. be appropriated
to the Building Commission for defraying the
necessary expenses in securing office and
clerical help.
The Town Clerk requested a leave of absence for a
period of ten days for himself and Assessor Mulcahey. Same was
granted.
A communication was received from the Board of Assessors
calling attention to the erroneous amount as set forth in the reso-
lution adopted by the Town Board at a previous meeting and upon
their recommendation the following resolution was adopted:
WHEREAS, Lot 1-a, block 80, Section 8 as shown
on the assessment map of the Town of Mamaro-
neck, was assessed in 1921 for tax of 1922
against the Mackintosh Company, and the tax
so levied thereon paid by the said Company;
WHEREAS, the same lot was erroneously assessed
for $3,500. against Louise P. Gilbert, the tax
thereon being $48.06;
THEREFORE, upon the recommendation of the
Board of Assessors of the Town of Mamaroneck,
BE IT RESOLVED, that the Supervisor be and he
hereby is authorized and empowered to author-
ize and direct the Receiver of Taxes and the
Board of Assessors to make such entries in
their books of record as may be necessary to
cancel the aforesaid assessment on Lot 1-a,
Block 80, Section 8, as shown on the Assess-
ment map of the Town of Mamaroneck for the
year 1921 Taxes of 1922 and to take such
other action as may be necessary in the pre-
mises to remove said assessment and the
ensuring tax in said records.
Upon motion the meeting adjourned at 10.30 P.M.
