PURSUANT TO THE GOVERNOR’S EXECUTIVE ORDER NO. 202.1, SUSPENSION OF LAW ALLOWING THE ATTENDANCE OF MEETINGS TELEPHONICALLY OR OTHER SIMILAR SERVICE: Article 7 of the Public Officers Law, to the extent necessary to permit any public body to meet and take such actions authorized by the law without permitting in public in-person access to meetings and authorizing such meetings to be held remotely by conference call or similar service, provided that the public has the ability to view or listen to such proceeding and that such meetings are recorded and later transcribed; PRESENT: Supervisor Nancy Seligson Councilwoman Abby Katz Councilwoman Jaine Elkind Eney Councilwoman Sabrina Fiddelman Councilman Jeffery L. Altieri, Town Administrator Connie Green O’Donnell, Deputy Town Administrator William Maker, Jr., Town Attorney CALL TO ORDER - REGULAR MEETING The Regular Meeting of the Town Board was called to order by Supervisor Seligson. Additionally Present: Lindsey Luft Assistant to the Town Administrator On motion of Councilwoman Elkind Eney, seconded by Councilwoman Fiddelman, the meeting was unanimously opened at 7:00 p.m. SUPERVISOR’S REPORT Early voting was very successful at the Town Center. We had close to 10,000 in-person votes and 1,000 absentee ballots delivered. Although there were long lines for early voters, I’m pleased to report that all of the voting was orderly. Surprisingly, no one had to wait inline to vote on Election Day. Now we just have to await the results. We had a wonderful Halloween Drive Thru Event this past Saturday, Halloween Day. Town staff and officials dressed up in costumes and decorated booths at the commuter parking lot to give out candy to residents and their children as they drove through the parking lot. Your Town Board members promoted themselves and dressed as Supreme Court justices. We had 3 RBG’s. Over 700 cars drove through to enjoy the holiday decorations, costumes and candy. Thanks to the Recreation Department and Fire Department for creating and executing the event. We continue to work on the proposed change to the solid waste law to curbside pickup of trash. We held a joint public hearing with the Village of Larchmont Board of Trustees on Monday October 26. We plan to have a joint board meeting to discuss it again on November 12. The meeting is for the boards to discuss if and how to move forward. It will not include a public hearing. I had the opportunity to participate in a Girl Scout Government Badge meeting last week. About 20 Girl Scouts met with elected officials via Zoom to learn about local, county and state government. As most people are experiencing, we’ve found that Town Board work sessions held via Zoom are not as productive or efficient for discussing Town business compared to in-person meetings. As such, the Town Board has decided to hold work sessions and budget meetings in-person (wearing masks and social distancing) at the Mamaroneck Senior Center in an effort to improve intra-board member communication and productivity. These meetings are open to the public. Members of the public will be required to wear masks and socially distance. The regular Town Board meetings will 1 November 4, 2020 continue to be held via Zoom. th  Saturday, November 7, a budget meeting from 8:30 am to 12:30 pm and will be conducted in- person at the Mamaroneck Senior Center, 1288 W. Boston Post Road. th  Monday, November 9, the work session begins at 6:00 pm and will be conducted in-person at the Mamaroneck Senior Center at 1288 W. Boston Post Road. th  Thursday, November 19, budget meeting from 5:00 pm to 7:00 pm, and will be conducted in person at the Mamaroneck Senior Center at 1288 W. Boston Post Road There are three open positions for volunteer boards:  Housing Authority: Two open positions. The Housing Authority is comprised of five members, each serving a term of five years. It was established in 1992 under the Public Housing Law of New York State to provide affordable housing within the Town, including the Hommocks Park Apartments. Candidates with property maintenance experience and financial expertise would be welcomed to apply.  Recreation Commission: One open position that requires a Village of Mamaroneck resident. The Recreation Commission is comprised of seven members, each serving a term of seven years. It was established in 1954 to review and recommend recreation programs, activities and the development or expansion of facilities for the unincorporated area of the Town of Mamaroneck. Meetings are held on the second Tuesday of every month. If you are interested in being considered to serve on one of these committees, please send a letter of interest and resume to me at supervisor@townofmamaroneckny.org PUBLIC HEARING – “2020 Revision of the Mechanical Rock Removal” Law The following Notice of Public Hearing is entered into the record as follows: NOTICE OF PUBLIC HEARING LEGAL NOTICE IS HEREBY GIVEN that pursuant to Section 130 of the Town Law of the State of New York, and further pursuant to Executive Order No. 202.1 Suspension of Article 7 Public Officers Law, and pursuant to a motion by the Town Board on October 7, 2020 this Public Hearing will be adjourned until Wednesday November 4, 2020 at 7:00 PM or as soon thereafter as is possible, to consider “2020 Revision of the Mechanical Rock Removal” Law, telephonically from the Town Center, 740 W. Purpose: The Town Board continues to monitor the impact of pulverizing and removing rock by mechanical means upon the health, safety and welfare of the Town’s residents with a goal of balancing people’s right to develop their properties with a neighborhood’s right to tranquility, to the extent possible. Among the concerns that have arisen are the need to mitigate the spread of dust and other particulates during both the drilling and pulverizing of rock and its removal from the site, the need to limit mechanical rock removal on smaller lots and the need to decrease the number of hours per day when such activities may take place. This revision in the law furthers the goal. BY ORDER OF THE TOWN BOARD OF THE TOWN OF MAMARONECK Published: October 23, 2020 On motion of Councilwoman Fiddelman, seconded by Councilwoman Elkind Eney, the Public Hearing was unanimously opened. 2 November 4, 2020 Supervisor Seligson asked Mr. Maker to review the two major changes to the current draft. Mr. Maker noted the changes to the threshold for requiring a Monitor and the limiting of rock removal on sites that are 10,000 square feet or less. Mr. Maker then recapped comments received from the Town of Mamaroneck Planning Board. The Town Board noted they had not yet received the comments of the Planning Board. The Town Board discussed the 10,000 square foot threshold, and the percentage of lots that would be effected. It was further discussed the volume of rock being removed as a threshold. Mr. Altieri will discuss further with Rich Polcari the Building Inspector the questions raised by the Town Board this evening. Supervisor Seligson asked Lindsey Luft if the Town has received any new emails or if any viewers had (virtually) raised their hand to speak and Ms. Luft responded no. On motion of Councilwoman Elkind Eney, seconded by Councilwoman Katz, the Public Hearing was th unanimously adjourned until November 18. On motion of Councilwoman Elkind Eney, seconded by Councilwoman Fiddelman, the public hearing was unanimously closed. On motion of Councilwoman Elkind Eney, seconded by Councilwoman Katz, the following was adopted; Local Law No. 9 - 2020 This local law shall be known as the “Change in the Permit Expiration Date and Elimination of the Part- Year Permit” Law 3 November 4, 2020 BE IT ENACTED by the Town Board of the Town of Mamaroneck Section 1 – Purpose: The purpose of this law is to change the annual expiration date for resident parking permits from September 30 to October 31 and to eliminate the part-year resident parking permit. Section 2 – Amendment of a current section of the Mamaroneck Code: Section 219-63 D. of the Code of the Town of Mamaroneck hereby is repealed and the following substituted in its place: “D. The Town Clerk shall collect the amount shown in § A250-1A for each resident parking permit which shall be valid until the last day of October in the first October after the permit is issued.” Section 3 – Repeal of a portion of a section of the Mamaroneck Code: The entry in §A-250-1 that provides Code Subject Fee or Section Deposit 219-63 Residential parking permit issued in the months of April, May, June, July, $10 August or September is repealed. Section 4 – Severability: Should any provision of this Local Law be declared invalid or unconstitutional by any court of competent jurisdiction, such declaration of unconstitutionality or invalidity shall not affect any other provisions of this Local Law, which may be implemented without the invalid or unconstitutional provisions. Section 5 – Effective Date: This Local Law shall become effective upon filing with the Secretary of State. BOARD OF FIRE COMMISSIONERS The Meeting was called to order by Commissioner Seligson, and then on motion of Commissioner Elkind Eney, seconded by Commissioner Katz, the Board of Fire Commissioners was unanimously declared open. Other Fire Department Business Commissioner Elkind Eney read the Fire Report for the Month of October as submitted by Chief Russo as follows: October 2020 ALARM TYPE NUMBER Generals 24 Minors 15 Stills 3 Out of Town (Mutual Aid) 4 EMS 43 Drills 3 TOTAL 92 Total number of personnel responding: 475 Total time working: 45 hours and 41 minutes 5 November 4, 2020 Commissioner Elkind Eney stated that the Fire Council recently met, and they reported that the basement at the Firehouse is coming along nicely. The Department hopes to be able to resume their Thanksgiving meal delivery this year. Commissioner Elkind Eney reminded residents that at daylight savings it is time to change the batteries on your detectors. There being no further business to come before the Commission, on motion of Commissioner Elkind Eney, seconded by Commissioner King, the Commission unanimously adjourned and the Town Board reconvened. AFFAIRS OF THE TOWN 1. Report – Larchmont Mamaroneck Joint Garbage Disposal Commission (LMJGDC) Review The Town Board received the Minutes of the LMJGDC meeting on October 29, 2020. The Town Board also received a compilation of the comments regarding side/back door pick up. There are 29 residents in favor of curbside pickup, 22 against, and 9 residents potentially exempt. It was reported that the Village of Larchmont is in favor of establishing a District, and the Village has asked Mr. Altieri to provide more detail on this proposal. Supervisor Seligson noted that the Town and Village met jointly again on November 12 to continue discussions. Supervisor Seligson reported that the Town was given a copy of the petition that was circulated, and referenced by Wendy Weinstein. There are 303 names but no addresses. It appears that 100 names are of persons who live outside of the Town of Mamaroneck. Supervisor Seligson stated that due to this, it would be difficult to consider this petition. Mr. Altieri is in the process of preparing two Commission Budgets, one with back/side pickup, and one with only curbside pickup. Mr. Altieri is also receiving feedback from a law firm that specializes in creating Districts. REPORT OF COUNCIL The Town Board Members reported on their various activities and meetings since the last Town Board Meeting.
