HomeMy WebLinkAbout1991_03_20 Town Board Regular Minutes MINUTES OF THE REGULAR MEETING OF THE TOWN BOARD AMID BOARD OF FIRE COWaSSIONERS OF THE TOM OF MAMARONECK, HELD ON THE 20TH DAY OF MARCH 1991 IN THE COURT ROOM OF THE TOWN CENTER, 740 WEST BOSTON POST ROAD, MNMRONECK, NEW YORK i CONVENE REGULAR MEETING The Regular Meeting of the Town Board was called to order by Supervisor Silverstone at 7:00 p.m., at which time the Board recessed into a Work Session. The Work Session held in Conference Roan A to discuss Assessment Administration and the LEIS document was, on motion duly made and seconded, unanimously declared adjourned at 8:25 p.m. RECONVENE REGULAR MEETING The Regular Meeting of the Town Board was called to order by Supervisor Silverstone at 8:34 p.m. Present were the following members of the Board: Supervisor Caroline Silverstone Councilwoman Elaine Price Councilman John McGarr Councilwoman Kathleen Tracy O'Flinn Councilman Paul Ryan Also present were: Patricia A. DiCioccio, Town Clerk Stephen V. Altieri, Town Administrator Steven M. Silverberg, Town Counsel Paulette Gabbriellini, Assistant to the Town Administrator CALL TO ATTENTION Supervisor Silverstone pointed out to those assembled the locations of exits as required by law for public gatherings. BOARD OF FIRE COPISSIONERS The meeting was called to order by Commissioner Silverstone at 8:36 p.m. in the Court Room. Present were the following members of the Commission: Commissioner Caroline Silverstone Commissioner Elaine Price Commissioner John McGarr cmmissioner Kathleen Tracy o mina commissioner Paul Ryan March 20, 1991 1. Fire Claims Commissioner Price presented fire claims for authorization of payment and upon her motion, seconded by Commissioner McGarr, it Was unanimously RESOLVED, that this Commission hereby authorizes payment of the following Fire Department claims as approved by the Fire Chief and audited by the Comptrollerts Office: AAA Emergency Supply Co., Inc. $324.32 A. S.. A. P., Inc. 50.00 Brewev s Hardware 7.58 Clinton Kearney Door Co., Inc. 50.00 Lanier Worldwide, Inc. 427.35 Olson & Gordon Stationers, Inc. 5.99 Town of Mamaroneck Professional Fire Fighters Association 94.32 960.45 There being no further business to coarse before this Commission, on motion by Commissioner Ryan, seconded by Commissioner McGarr, the meeting was unanimously declared closed at 8:40 p.m. AFFAIRS OF THE TOWN At this time the order of the Agenda was changed and item #2 under AFFAIRS OF THE TOWN was taken up. 2. Authorization - Renewal of Parking Violations Management Agreement The Town Administrator briefly detailed how Complus Data Innovations provides the Town with a violations management system, and he went on to field questions from Board members. At this time a motion was made by Councilwoman Price, which was not carried, and a somewhat lengthy discussion ensued with general consensus being to table this matter for further research. This item was held over to the next meeting. At this time the order of the Agenda was resumed and Item #1 under AFFAIRS OF THE TOWN was taken up. 1. Authorization - Settlement of Small Claim Taxes and Assessment Matters Town Counsel, Steve Silverberg, explained that although the assessment had been sustained, the Assessor felt the arbiter had not considered all factors presented by the owner and that, based upon data filed, a reduction is appropriate, and litigation of article 78 counter productive. He went on to say that he had worked out a settlement which was satisfactory to both the owner and the Assessor. 2 s March 20, 1991 On motion by Councilwaanan Price, seconded by Councilman McGarr, it was unanimously RESOLVED, that this Board hereby grants approval for reduction of assessed valuation to $23,000 on the single family hams located at 42 Country Road, Block 315 Lot 529. 3. Resolution - CmuRmity Development Block Grant Application The Administrator reviewed, same discussion followed and, on motion by Councilwoman Price, seconded by Councilwoman O'Flinn, the following resolution was unanimously adopted: URBAN COUNTY BLOCK GRANT APPLICATION LARC MONP MOTEL WHEREAS, the Town Board has previously adopted a resolution authorizing the preparation and submission of an Urban County Block Grant Application; and WHEREAS, the grant application seeks funding for costs related to the construction of affordable housing at the site of the former Larchmont Motel; and WHEREAS, it is in the best interest of the Town to encourage the construction of affordable housing to maintain diversity in the cammmiity by providing housing opportunities; and WHEREAS, the Town of Mamaroneck is applying for $700,000 in Conmimity Block Grant funding to assist in the development of affordable housing; and WHEREAS, it is not econamically feasible to construct affordable housing at the site without financial assistance fram the Town; and WHEREAS, in order to be eligible for Commmiity Block Grant construction funds, a qualified not-for-profit corporation must be established; NOW THEREFORE, BE IT RESOLVED, that the Town shall contribute to the project an amount equal to $420,000; and BE IT FURTHER RESOLVED, that this amount shall be contributed through an in-kind reduction of the cost of the land at the time of transfer to the not-for-profit owner/operator of the affordable housing facility in the amount of $400,000 and in the provision of in-kind staff services and fees in the amount of $20,000 and the not-for-profit yet to be established shall reduce the total development costs by passing the value.of the write-down,of the_ land costs in the amount of $400,000 to the project sponsor. AYES: Ryan, O'Flinn, McGarr, - Price, Silverstone NAYES: None 3 March 20, 1991 At this time the order of the Agenda was changed and items #7 and #8 under AFFAIRS OF TIE TOWN were taken up. .7. Authorization - troller to Conduct nduct Tax Lien Sale Comptroller, Carmine DeLuca, requested authorization to hold a tax lien sale and, on motion by Councilwoman Price, seconded by Councilman McGarr, it was unanimously RESOLVED, that this Board hereby authorizes a Tax Lien Sale to be held on Friday, May 24, 1991 beginning at 10:00 a.m. 8. Authorization - Collect Town and County Property Taxes On motion by councilwoman Price, seconded by Councilman McGarr, it was unanimously RESOLVED, that this Board hereby authorizes the Deputy Receiver of Taxes for the Town of Mamaroneck, to collect 1991 State, County, Town and Special District taxes and water rents which become a lien on January 1, 1991; and be it further RESOLVED, that in accordance with provisions of Section 500 of the Westchester County Administrative Code, the Deputy Receiver of Taxes shall publish in the official newspaper of the Town of Mamaroneck, the "Notice of Collection of State, County, Town and Special District Taxes and water rents;" and be it further RESOLVED, that in accordance with the provisions of Section 550 of the Westchester County Administrative Code, the Town Board does hereby direct the Deputy Receiver of Taxes and Assessments to mail to each taxpayer of the Town of Mamaroneck, whose address is ]mown to said Deputy, Receiver of Taxes and Assessments, a tax bill for all taxes and water rents, the expense thereof to be a Town charge. (See tax warrant on page 5) 4 March 20, 1991 STATE OF NEW YORK ] COUNTY OF WESTCHESTER ] SS: TOWN OF MAMARONECK ] THE PEOPLE OF THE STATE OF NEW YORK To Carmine A. DeLuca, Receiver of Taxes of the Town of Mamaroneck in said County: You are hereby commanded pursuant to the provision of the Westchester County Tax Law, Article 16, Chapter 852, Laws of 1948. as amended. and also pursuant to resolution of the Town Board of the Town of Mamaroneck adopted March 20, 1991, by authority of Chapter 313 of Laws of 1934, to receive and collect from the several persons named in the Assessment Roll hereunto annexed and herewith delivered to you, together with penalties prescribed by the Westchester County Tax Law, Article 16, Chapter 852 of the Laws of 1948, as amended, for the neglect to pay the State, County, Town and Town District Taxes, charges for services and exemptions removed after the levy thereof as follows: Judicial and County Taxes - $22,613,925.02 Town and Town District Taxes - 9,439,200.00 Charges for Service - -0- Exemptions removed - -0- $32,053,125.02 And you are hereby directed to deposit to the credit of the Town of Mamaroneck in the Bank of New York, County Trust Region, all of such monies so collected by you by virtue of this warrant. And you are further commanded to make and file with the undersigned, the Supervisor of the Tom of Mamaroneck, as required by the Westchester County Tax Law, Article 16, Chapter 852, Laws of 1948, as amended, the reports provided for therein. And you are further directed and commanded to proceed as directed and authorized by said Westchester County Tax Law, Article 16, Chapter 852. Laws of 1948, as amended. And in case any person named in said Assessment Roll shall neglect or refuse to pay his taxes or penalties (after giving the notices and waiting the time as specified in said Act) you are hereby authorized to collect the said taxes and penalties with the costs and charges of such collections in the manner provided by the Westchester County Tax Law, Article 16, Chapter 852 of the Laws of 1948, as amended, and for so doing this shall be your sufficient warrant. CAROLINE SILVERSTONE, SUPERVISOR 5 March 20, 1991 At this time the regular order of the Agenda was resumed and Item #4 under AFFAIRS OF THE TOWN was taken up. 4. Set Public Hearing - Parking Ordinance-Murray Avenue On motion by Councilwoman Orrlinn, seconded by Councilwoman Price, it was unanimously RESOLVED, that this Board hereby sets April 3, 1991 as the date for a Public Hearing on a proposed local law to regulate the hours of parking on Murray Avenue so as to - allow for regular street cleaning; and be it further RESOLVED, that the Town Clerk be, and she hereby is authorized to publish in an official newspaper of the Town, the Notice of said Hearing as required by law. 5. Authorization - Waiver of Fees-Monroe School Following a brief explanation by the Administrator, on motion by Councilman McGarr, seconded by Councilwoman Price, it was l- unanimously RESOLVED, that this Board hereby waives all building permit fees and Planning Board fees required for repairs and improvements to the Monroe School in preparation of a day care operation. 6. Authorization - Agreement for Spring Fling Carnival The Administrator capsulized the terms and agreements and some discussion ensued among the Board, after which, on motion by Councilwoman Price, seconded by Councilman McGarr, it was unanimously RESOLVED, that this Board hereby authorizes the Town Administrator to execute, on behalf of the Town, the agreement with S&S Amusements, Inc. to operate a "Spring Fling Carnival" during the period from March 30th through April 7th, 1991 at Hommocks Park Ice Rink. 6 March 20, 1991 9. Request for Use of Voting Machines - Board of Education The Town Clerk informed the Board that the School District has requested use of 15 voting machines. A brief debate among the Board occurred, after which time, on motion by Councilman McGarr, seconded by Councilwoman Price, it was unanimously RESOLVED, that this Board hereby grants the request of the Mamaroneck Union Free School District for use of 15 voting machines during the Annual School District Election and Budget Vote to be held on Wednesday, May 22, 1991 as follows: 4 Central School 3 Mamaroneck Avenue School 4 Chatsworth Avenue School 4 Murray Avenue School 10. Salary Authorization - Records Management On motion by Councilwoman Price, seconded by Councilman Ryan, it was unanimously RESOLVED, that this Board hereby appoints Carl Gard to work on a part-time basis in records management/organization for the Town Clerk, effective 3/11/91 at $7.50/hour through the Records Mangement Grant received from New York State. THE SUPERVISOR Supervisor Silverstone commented that she had discussed with the Comptroller the question of increasing the pension for older, pre State pension police widows, who receive about $300.00 per month, an amount which has not been raised in about 15 years and which is embarrassing to think about. She asked the Board, together with Carmine DeLuca, to follow up on this. The Supervisor mentioned that she had received a letter from Phyllis Wittner stating that New Rochelle has placed trees on its side of the Post Road, Larchmont's Parks and Trees Committee is placing trees on the Post Road to the Town line, but the small portion between both which belongs to the Town has not been authorized to receive any attention. She authorized Councilwoman O'Flinn, together with her Beautification committee, to review this situation and return with recommendations. 7 March 20, 1991 REPORTS OF THE COUNCIL r Councilwoman O'Flinn informed the Board that Bob Hexber of the DEC is coming on April 2nd at 1:00 p.m. and will bring some Arbor Day posters for distribution to people who participate during Beautification Day. She noted that he will also outline the requirements for becoming a tree city. The Supervisor noted that Town Leddy is having a party on April 19th, and that it would be a nice gesture for the Board to plant a tree in his honor and announce it that night. She asked that the Board donate whatever they wish toward the $100.00 needed and she would make up the remainder. TOWN CLERK REPORTS The Town Clerk presented the Monthly Report of the Town Clerks Office for the month of February 1991.
