HomeMy WebLinkAbout1923_06_11 Town Board Minutes Special Meeting of the Town Board TOWN OF MAMARONECK held June 11th, 1923 at the Weaver Street School house. The meeting was called to order by Supervisor Burton at 8.30 P.M. (Daylight Saving Time.) Present: Supervisor Burton, Justices, Boyd; Collins, Dudley and Shafer. Town Clerk Sherman. Supervisor Burton stated that the meeting had been called, pursuant to Law and to a resolution of the Town Board adopted at a meeting held May 2nd, 1923, to act upon a petition duly filed with the Town Board requesting said Board to extend the present boundary lines of Sewer District No. 1 of the Town of Mamaroneck and the Sewer System therein, as now established, so as to in- clude in and make a part of said District the territory embraced within the said proposed extension, which is described in said petition. The Clerk reported that due notice of the time and place of holding the meeting had been given by posting and publishing, as provided by law and pursuant to resolution of this Board. The Clerk presented and read to the meeting a copy of the notice, together with affidavits of publication and posting. Upon motion duly seconded, it was RESOLVED, that the copy of the notice of the meeting and affidavits of publication and of posting be ordered filed. Supervisor Burton stated to the meeting that the petition received and filed by the Board had been signed by the owners of real property within the area of the said District to be served by the proposed extension to said system representing more than one half in value of the taxable real property within such area, as appears by the last preceding completed assessment roll, and that the said petition complied in form, substance, and in the manner of execution, so far as applicable thereto, with the requirements of the petition for the establishment of a sewer district and stated therein the maximum amount proposed to be expended for such extension or extensions, to wit: the sum of Five Hundred Thousand Dollars ($500,000.), and that said peti- tion had endorsed thereon the written approval of all of the members of the Board of Sewer Commissioners of Sewer District No. 1, and that there was presented with the said petition a map prepared by a competent engineer, showing the area proposed to be served by such proposed extension and such change or changes from the plans shown by the map and plan attached to the peti- tion for the establishment of the said Sewer District No. 1, which is prepared in the same manner as the original map and plan approved by the State Board of Health. The Supervisor stated that the Board would be glad to hear any person who desired to be heard prior to the Board taking action upon said petition. After discussion, all persons present being in favor of the adoption of a resolution by the Board authorizing the afore- said extension, it was, upon motion of Mr. Justice Dudley, seconded by Mr. Justice Collins, unanimously RESOLVED, WHEREAS petition signed and ack- nowledged by owners of real property in a proposed extension to the present Sewer Dis- trict No. 1, of the Town of Mamaroneck, re- presenting more than one-half in value of the taxable real property therein, as appears by the last preceding completed assessment roll, as is provided by Section 230 and 230-A of the Town Law of the State of New York, has been duly filed with this Board, which said petition describes the proposed extension to Sewer District No. 1 and states the maximum amount proposed to be expended in the construction of said proposed extension to the aforesaid Sewer System; that opposite the name of each petitioner appears the assessed valuation of the real prop- erty owned by him or her in such proposed extension to the said Seaver District, ac- cording to the last preceding assessment roll; and WHEREAS, there is annexed to and presented with and made a part of said peti- tion a map and plan of the proposed extension to the said Sewer District No. 1 and said Sewer System, with specifications of dimensions and connections and outlets to the Sewerage Dis- posal works and Outfall Sewer, which has been prepared by a competent engineer; and WHEREAS, said petitioners ask the Town Board to make an order establishing the Sewer District described in said petition and stating the amount proposed to be expended in the construc- tion of said Sewer System; and WHEREAS, in said petition asking for the establishing of a sewer system the petitioners likewise pray as provided under Section 230-A that the entire portion of the system in said proposed extension designed untimately to serve the entire proposed extension to said Sewer District No. 1 shall be constructed in the First instance, and have described the said portion or portions in their petition and indi- cated the same on the said map and plan annexed to said petition and have specified the maximum amount proposed to be expended in the construction of said portion or portions of the said system, and - said petitioners further ask that the Town Board may include in its order establishing the said Sewer District a direction that the Sewer Commis- sioners shall construct the entire portion of the said system in the said proposed extension design- ated in the said petition until extensions thereto- shall be authorized as provided by law; and WHEREAS, the Town Board is satisfied that the pe- titioners are owners of real property in the proposed district and own more than one-half in value of the taxable real property therein, and that all provisions of the law relating to the establishment of the proposed extension to Sewer District No. 1, have been complied with; and WHEREAS said proposed extension is described in said petition as follows: BEGINNING at a point on the easterly boundary line of Sewer District No. 1, of the Town of Mamaroneck as established, which point is the corner formed by the intersection of the north- erly side of Forest Avenue with the westerly side of Murray Avenue, (and continuing southerly along said easterly boundary line as fol- lows) : thence easterly and across Murray Avenue to the northeast corner formed by the intersection of said streets; thence southerly and across Forest Avenue to the Southeast corner formed by the intersection of said streets; thence easterly and along the southerly side of Forest Avenue 100 feet; thence southerly and parallel with said Murray Avenue, 525 feet; thence easterly 150 feet and across Senate Terrace to the easterly side of said street ; thence northerly along the easterly side of Senate Terrace 125 feet ; thence northeast- erly and parallel with Senate Place 425 feet ; to a point directly opposite the northerly end of said Senate Place, thence southeasterly and across the n atherly end of Senate Place and across Colonial Avenue 500 feet to a point which is 100 feet south of the easterly side of Colonial Avenue and 100 feet west of the westerly side of Weaver Street to land formerly of Senator Palmer (now Stieglitz) ; thence 100 feet northeasterly to the to the westerly side of Weaver Street, thence southerly along said westerly side of Weaver Street to the point or intersection with the northerly side of Chestnut Avenue; thence easterly across said Weaver Street on a line with the north- erly side of Chestnut Street, if prolonged, a total of 200 feet; thence easterly across said Weaver Street on a line with the north- from 150 to 100 feet easterly therefrom as it curves, to the northerly side of the N.Y.N.H. & H.R.R. Company's Right-of-way; thence straight across the said Right-of-Way of the said N.Y.N.H. & H. R. R. and southerly and still parallel with the easterly side of said Weaver Street across Palmer Avenue to a point 100 feet east- erly from the easterly side of Weaver Street and southerly from the southerly side of Palmer Avenue 100 feet, thence easterly and southerly in conformity with the easterly side of heaver Street and continuing approximately 100 feet easterly therefrom, to a point approximately 125Tfeet southeasterly from where the southerly side of Howell :-venue if prolonged across !'leaver Street and 100 feet easterly therefrom would intersect the aforesaid line, (at which point said proposed extension to Sewer District, No.l of the 'Town of Mamaroneck leaves the easterly boundary line of Sewer District No.l and proceeds easterly and northerly therefrom) ; thence easterly and at right angles to `,leaver Street 350 feet ; thence northwesterly 400 feet to a point 75 feet southerly from the south- erly side of Palmer Avenue, thence southwesterly , and parallel with Palmer avenue 1,000 feet to the intersection of the boundary line of the Town of 11amaroneck with the easterly boundary line of the Village of 11amaroneck; thence northerly and along the aforesaid boundary lines of the Towm of Mamaroneck and the Village of Mamaro- neck to a point approximately 110 feet northerly from the inter- section of said boundary line with the northerly side of Harmon Drive;: thence 450 feet westerly to the southerly side of South Brook Road, at a point approximately 25 feet northerly from the in- tersection of the westerly end of South Brook Road and the easterly end of Lake Side Drive ;. thence northerlyacross South Brook Road and North Brook Road and at -right angles to the northerly side of North Brook Road and 100 ;feet northerly therefrom; thence north and ap- proximately parallel with Rocky Road 225 feet; thence northwesterly 300 feet, crossing Rocky Road Drive at approximately right angles ; thence westerly and at right angles to the last aforementioned line 100 feet ; thence northwesterly and again at right angles to the last aforesaid line , 350 feet to the westerly side of Gray Stone Road which it intersects at a point approximately 125 feet northerly from the corner formed by the intersection of the westerly side of Gray Stone -Road and the northerly side of Garden Road; thence west- erly and approximately at right angles 100 feet; thence northwesterly 200 feet; thence westerly across Stony Side Drive to the northerly side thereof and at right angles thereto; thence northwesterly 175 feet to a point which would intersect the northerly side of Little Farms Road if the same were prolonged 375 feet easterly from the corner formed by the intersection of the northerly side of Little Farms Road and the easterly side of Edgwood Place; thence easterly and along the aforesaid prolonged line 200 feet; thence northwesterly and along the easterly side or boundary of the Developments or Sections known as "Larchmont Gardens" and "Colonial Park", respectively, and as shown on the respective recorded maps of said Sections to the westerly side of Rockland Avenue, (which point of intersection therewith is 125 feet easterly from the corner formed by the intersection of the easterly side of Forest Avenue and the westerly side of Rockland Avenue), thence continu- ing on the said line if prolonged across Rockland avenue 200 feet northwesterly therefrom, westerly and parallel with the easterly (northerly at this point) side of Rockland Avenue and at a dis- tance of 150 feet northerly therefrom to a point 150 feet easterly from the easterly side of Weaver Street; thence northerly 250 feet and parallel with the easterly side of Weaver Street and 150 feet easterly therefrom; thence westerly from said point last described crossing Murray Avenue at right angles to the westerly side thereof to a point 150 feet westerly therefrom; thence southerly parallel with Murray Avenue and 150 feet westerly therefrom 350 feet; thence southwesterly 275 feet so as to intersect Sewer District No. 1 of the Town of Mamaroneck at the northeasterly corner thereof, which point is 200 feet northerly from and at right angles to the north- erly side of Vine Road at the easterly end thereof, (and from which point the easterly boundary line of Sewer District No. 1 of the Town of Mamaroneck turns and goes directly south, thence joining and con- tinuing along the easterly boundary line of said Sewer District No. 1 of the Town of Mamaroneck, as follows): Thence southerly 500 feet and again easterly and parallel with Forest Avenue 400 feet to its intersection with the westerly side of Murray Avenue; thence south- erly 150 feet along said westerly side of Murray Avenue to the point of intersection of the northerly side of Forest avenue with the west- erly side of Murray Avenue, which is the point or place of beginning. All of which Proposed Extension to said Sewer Dis- trist No.1 of the Town of Mamaroneck is more specifically shown on a certain map entitled "Town of Mamaroneck, Westchester County N. Y. A., General Plan of Proposed Sewer in District No. 1, Section C, by L. E. Van Etten, Civil Engr., December 12, 1921." All of which aforesaid Proposed Extension to said Sewer District No. 1 of the Town of Mamaroneck joins and abuts upon Sewer District No. 1 of the Town of Mamaroneck, as now established along the easterly boundary line thereof. THEREFORE, BE IT RESOLVED, that the aforesaid petition be approved by this Board; and BE IT FURTHER RESOLVED, that the aforesaid described property and proposed extension be and the same hereby is established, annexed to, and made a part of said Sewer District No.1, of the Town of Mamaroneck; and BE IT FURTHER RESOLVED, that the present Sewer District No. 1 of the Town of Mamaroneck, to- gether with the extension thereof an herein es- tablished, continue to be known and designated as "Sewer District No. 1 of the Town of Mamaro- neck" and that the said District No. 1 and the extension thereto as herein authorized and hereby established, i.e., the original Dis- trict No. 1 and the extension thereto, be here- after bounded and described as follows : BEGINNING at a point on the westerly side of Chatsworth Avenue 110 feet south of the intersection of the southerly side of Myrtle Avenue and the westerly side of Chatsworth Avenue at which the intereection of the boundary lines of the Village of Larchnmont and the Town of Mamaroneck converge, running thence s southerly and along said westerly side of Chatsworth Avenue which is also the boundary line of said Village of Larchmont and Town of Mamaroneck 125 feet to the northerly boundary line of the Vil- lage of Larchmont running thence westerly along the northerly boundary line of the Village of Larchmont 2400 feet to a point where the said Village line if continued would intersect the easterly boundary line of the City of New Rochelle, thence northerly along said boundary line between the Town of Mamaro- neck and the City of New Rochelle, 5600 feet to a point 625 feet north of the northerly side of Forest Avenue at which point For- est Avenue intersects the aforesaid boundary line, thence east- erly 1150 feet and nearly parallel with said Forest Avenue, thence northerly 200 feet; thence northeasterly 300 feet, (which point is the present northeasterly corner of Sewer District No.1 as now established and at which point it joins the proposed extension hereby provided to be included in said Sewer District); thence northeasterly 275 feet from said point last described to a point 150 feet westerly from the westerly side of Murray Avenue; thence northerly and parallel with Murray Avenue (and Weaver Street after they join) and 150 feet westerly therefrom, 350 feet; thence east- erly crossing Weaver Street at right angles to the westerly side thereof to a point 150 feet easterly from the easterly side of said Weaver Street thence southerly and parallel with Weaver Street and 150 feet easterly therefrom 250, to a point 150 feet northerly from the easterly side (northerly at this point ) of Rockland avenue; thence easterly and parallel with Rockland Avenue and 150 feet north- erly therefrom, 1425 feet; thence southeasterly to the westerly side of Rockland Avenue intersecting the same at a point 125 feet easterly from the corner formed by the intersection of the east- erly side of Forest Avenue with the westerly side of Rockland Ave- nue; thence southeasterly and along the easterly side or boundary of the Development or Sections known as "Colonial Park" and "Larchmont Gardens", respectively, and as shown on the respective recorded maps of said sections, 1400 feet, to the northerly side of Little Farms Road which point is 150 feet easterly from the corner formed by the intersection of the northerly side of Little Farms Road and the easterly side of Edgwood Place; thence easterly 200 feet along the northerly side of Little Farms Road if the same were prolonged; thence southeasterly, and at right angles to said line just described, to the northerly side of Stoney Side Drive; thence southeasterly 200 feet crossing Stoney Side Drive and a right angle to the northerly side thereof; thence southerly 200 feet; thence southeasterly and to the westerly side of Grey Stone Road intersecting the same at a point 125 feet northerly from the corner formed by the intersection of the westerly side of Grey Stone Road and the northerly side of Garden Road; thence southeasterly 350 feet, crossing the easterly side of Greystone Road and the northerly side of Garden Road, intersecting the said streets at ppints 50 feet northerly and 25 feet easterly, respec- tively from the corner formed by the intersection of the easterly side of Greystone Road and the northerly side of Garden Road; thence easterly and at right angles to the line just described, 100 feet; thence southeasterly 300 feet crossing Rocky Road Drive at a right angle to the northerly side thereof; thence southerly, and approximately parallel with Rocky Road Drive, 225 feet; thence easterly and crossing North Brook Road and South Brook Road, at right angles thereto, to the southerly side of South Brook Road, intersecting the latter at a point 25 feet northerly from the in- tersection of the westerly end of South Brook Road and the easter- ly end of Lake Side Drive; thence 450 feet easterly to the bound- ary line of the Town of Mamaroneck which is also the easterly boundary line of the Village of Mamaroneck, intersecting the same at. a point 125 feet northerly from the intersection of said bound- ary lines with the northerly side of Harmon Drive; thence southerly and along the aforesaid boundary line of the Town of Mamaroneck and the easterly boundary line of the Village of Mamaroneck, cross- ing the Right-of-Way of the N. Y. N. H. & H. R. R. and Palmer Avenue to a point on the aforesaid boundary lines 175 feet south- erly from where it crosses the southerly side of Palmer Avenue, thence southwesterly and parallel with Palmer Avenue and 150 feet southerly therefrom 1000 feet; thence southerly 400 feet; thence westerly and at right angles to the easterly side of Weaver Street 350 feet, to a point approximately 125 feet southeasterly from where the southerly side of Howell avenue if prolonged across Weaver Street and 100 feet easterly therefrom would intersect the last aforementioned line (at which point the said proposed exten- sion joins the easterly boundary line of Sewer District No. 1 as now established); thence southerly in conformity with the easterly side of Weaver Street and continuing approximately 100 feet easterly therefrom to a point 100 feet southeast from where the south- erly side of Caerleon avenue would intersect the easterly side of Weaver Street; thence across said Weaver Street to the cor- ner formed by the intersection of the southerly side of Caerleon Avenue with the said Westerly side of Weaver Street; thence south- erly 150 feet along the westerly side of Weaver Street, thence easterly and parallel with said Caerleon Avenue 400 feet, then again southerly and parallel with Weaver Street and crossing the westerly end of Beech Street, 300 feet, thence westerly 75 feet, thence southeasterly to the northerly side of the Boston Post Road to a point approximately 500 feet from the corner formed by the intersection of the westerly side of Weaver Street and the north- erly side of the Boston Post Road, thence straight across said Boston Post Road at right angles with said north side of same, to a point 100 feet southerly from the southerly side of said Boston Post Road, thence westerly and parallel with the southerly side of the Boston Post Road 800 feet to the point of intersection of said boundary line of the Town of Mamaroneck with the easterly boundary line of the Village of Larchmont, said point being about 100 feet southerly from the south side of the Boston Post Road, thence northerly and along said easterly boundary line of the Village of Larchmont and across the Right-of-Way of the N. Y. N. H. & H. R. R., to the junction of said easterly boundary line of said Village of Larchmont with the northerly boundary line of said Village, thence westerly, northerly and westerly and along said northern boundary line of the said Village of Larchmont to the point or place of beginning; and all of which said proposed Sewer District and the extension thereto is more specifically shown and set forth on two certain maps entitled "Town of Mamaroneck, Westchester Co., New York, a general plan of proposed sewers in certain districts the outlet from which is through District No. 1, Larchmont, by L. E. Van Etten, Civil Engineer, February 7th, 1919", and "Town of MAmaroneck, West- chester County,N.Y.A. General Plan of Proposed Sewers in District No .1, Section C, by L. E. Van Etten, Civil Engr., December 12, 1921." and be it FURTHER RESOLVED; that the Sewer Commission- ers of Sewer District No. 1 are hereby direct- ed and empowered to construct, attain by purchase agreement or otherwise in the first instance the entire portion of the said sewer system in said proposed extension designated ultimately to serve the entire proposed exten- sion to Sewer District No. 1, as described here- in and as designated in the said petition at a cost of not to exceed $$500,000., until extent sions thereto shall be authorized: as provided by law, and it is FURTAR RESOLVED, that for all purposes of tax- ation and assessments this resolution and the Certificate herein authorized to be filed shall take effect immediately, and BE IT FURTHER RESOLVED, that the aforesaid ex- tension to Sewer District No. 1 herein authorized and established shall hereafter, for all purposes be regarded as a part of the original system, here- tofore established, and shall be constructed and maintained by the Sewer Commissioners of the said Sewer District No. 1 of the Town of Mamaroneck, and the cost of construction thereof shall be provided for by the issuance and sale of Town bonds in the same manner as provided in Sec. 237 of the Town Law and by Chapter 422 of the Laws of 1922 of the State of New York (or so much thereof as is applic- able) for the payment of the cost of the original system, which said bonds shall be a Town charge and the principal and interest thereof, together with the cost of maintenance of such extension or exten- sions, shall be collected from the real property within the said District by the aforesaid Sewer Com- missioners in the same manner as though said exten- sion or extensions had formed a part of the original system constructed in said Sewer District No. 1, Upon motion the meeting adjourned, 9.45 P.M.
