MINUTES OF THE REGULAR MEETING OF THE TOWN BOARD OF THE TOWN OF MAMARONECK AND THE BOARD OF FIRE COMMISSIONERS HELD ON DECEMBER 15, 1999 AT 8:15 PM IN THE COURT ROOM OF THE TOWN CENTER, 740 W. BOSTON POST ROAD, MAMARONECK, NEW YORK PRESENT: Supervisor Paul A. Ryan Councilwoman Valerie M. O'Keeffe Councilman Barry Weprin Councilwoman Phyllis Wittner Councilwoman Judith A. Myers ALSO PRESENT: Patricia A. DiCioccio, Town Clerk Stephen V. Altieri, Town Administrator Charlene Indelicato, Town Attorney CONVENE EXECUTIVE SESSION The Board convened into an Executive Session at 6:45 PM in Conference Room A of the Town Center to discuss personnel. On motion duly made and seconded the Board adjourned at 7:30 PM to the Court Room. FAREWELL RECEPTION -Supervisor Paul Ryan - Councilman Barry Weprin Valerie O'Keeffe, Supervisor Elect, introduced Debbie Chapin, who had recently taken office as the Mayor of the Village of Mamaroneck. Mayor Chapin presented proclamations to both Councilman Weprin and Supervisor Ryan. She said that Supervisor Ryan had been appointed to the seat vacated when her husband Steve had resigned because of business concerns, and she wished them both well. The Vice Mayor of Larchmont, Mary Ann Mumma, also presented them with proclamations. She said that Mayor Lewy was out of Town and regretted her not being here to wish Supervisor Ryan and Councilman Weprin farewell, but she sent her thanks for their years of service and declared it Barry & Paul Day in the Village of Larchmont. John Hock, Manager of Westchester Joint Water Works was introduced. He explained that when someone is elected to the position of Supervisor in the Town, they also inherit a seat on the Water Board. He said that he felt especially close to Paul Ryan, as his father-in-law, Tony Pergola_, had been his right hand man at the Water Works. He wished both Paul and Barry well. Congresswoman Nita Lowey's office also sent proclamations, as did Senator Suzi Oppenheimer. Diane Courtney, from the Larchmont Library thanked Paul and Barry for their cooperation, saying it had been a wonderful experience working with them, they have been supportive of her and of her staff. Councilman Weprin thanked everyone for the kind words, and he read a note he had received from former Supervisor Price. He said the experience had been enjoyable, and fit in with his background as his Father had been the Speaker of the House in New York and his two brothers were involved in politics and held elected positions. He said he hoped to continue to serve in the future on a volunteer basis. Supervisor Ryan.read a note received from Elaine Price also. He reflected on his last 10 years, saying he was proud to have served with former Supervisors Price, Silverstone, and Battalia and taking part in the work that had been accomplished from the former Larchmont Motel being turned into housing to the rezoning of country clubs, i.e.: Bonnie Briar. He introduced his wife Toni, his son Christopher, and mother-in-law Anna Pergola, thanking them for supporting him in his elected role. DECEMBER 15, 1999 Supervisor Elect O'Keeffe then presented him with a proclamation from the Town. She said that he was one of the most dedicated public servants she had ever worked with, thanked him for his involvement, help, and service to our Community and wished him well in future endeavors. CALL TO ORDER The regular meeting of the Town Board was called to order by Supervisor Ryan at 8:30 PM who then pointed out the location of exits. PROCLAMATION PAULA. RYAN WHEREAS, Supervisor Paul A. Ryan has unselfishly devoted his time and energy during his nine (9) year commitment as Councilman and then as Supervisor of the Town of Mamaroneck; and WHEREAS, Paul has made significant contributions to Town Government initiatives such as preserving and improving the unique quality of life in the Town of Mamaroneck by focusing on flood control, land preservation, noise abatement and beautification; ensuring the safety of our children on their way to and from school by working with the schools, police, and concerned citizens; creating long range plans to deal with proposed commercial development within the Town and adjoining communities; continuing to find non-property tax-based revenue streams and following through to recruit the best and most talented of our citizens to serve on Town volunteer boards; creating increased tolerance and understanding among all citizens; and WHEREAS; Paul has distinguished himself by his dedication and hard work as liaison to the Larchmont Mamaroneck Cable TV Board of Control and Recreation Commission and in a variety of other ways to maintain the quality of life and preserve and enhance the Town of Mamaroneck's natural and man-made assets. NOW THEREFORE, BE IT RESOLVED, that the Town Council of the Town of Mamaroneck, on behalf of its citizens offer our gratitude and appreciation to Paul for his many years of service. IN WITNESS WHEREOF, we have hereunto set our hand and caused the seal of the Town of Mamaroneck to be affixed this 15th day of December 1999. PROCLAMATION BARRY WEPRIN WHEREAS, Barry Weprin has conscientiously and diligently served as Councilman in the Unincorporated Area and the Villages of Larchmont and Mamaroneck; and WHEREAS, Town and Village residents recognized his value and elected him as Councilman for six (6) years from 1994 to 1999; and WHEREAS, Barry has made significant contributions to Town Government initiatives such as serving as Town Council Liaison to the Housing Authority, Board of Architectural Review, Ethics Board and Coastal Zone Management Commission, and as a Fire Commissioner and Police Commissioner; and 2 DECEMBER 15, 1999 WHEREAS, Barry contributed his knowledge and his expertise as an attorney; and WHEREAS, Barry balanced the pressures of a hectic schedule at Milberg Weiss Bershad Hynes & Lerach and still never failed to be a major contributor on all Town matters. NOW THEREFORE, BE IT RESOLVED, that 1, Paul A. Ryan, Supervisor, and the members of the Town Council of the Town of Mamaroneck on behalf of all Town and Village residents offer our gratitude and appreciation to Barry for his many years of service. Supervisor then reintroduced his mother-in-law Anna Pergola stating that she had recently received from Westchester County the honor of becoming a member of the Senior Citizens Hall of Fame. He then read the following: PROCLAMATION ANNA PERGOLA WHEREAS, The Town of Mamaroneck is especially enriched by the Town contributions which Senior Citizens make in all aspects of our community; and WHEREAS, ANNA and her late husband, ANTHONY, have spent most of their adult lives assisting residents of the Washingtonville area of the Village of Mamaroneck in a variety of ways; and WHEREAS; ANNA who, at the age of 62, learned how to drive so that she could get around more; and WHEREAS, ANNA, for the last seventeen years, has used her increased mobility for a variety of tasks to better serve her fellow man including being a steady and conscientious volunteer at the Mamaroneck Senior Center and at Red Cross Blood Drives throughout the County; and WHEREAS, ANNA PERGOLA has not only discovered the personal rewards that come from voluntary service but has encouraged others to do the same through her shining example; and WHEREAS, ANNA'S lifelong commitment to serving has enriched the lives of her family and friends and so many others that have come in contact with her over the years. NOW THEREFORE, BE IT RESOLVED that I, Paul A. Ryan, Supervisor, and the members of the Town Council of the Town of Mamaroneck hereby congratulate and extend our best wishes to ANNA PERGOLA for her outstanding achievement as recipient of this year's Senior Citizens Hall of Fame Award, an award which is voted upon by her peers. There being no further business to come before the Commission unanimously adjourned. AFFAIRS OF THE TOWN 1. Adoption of 2000 Town budget The Administrator said that the budget had been reviewed at many meetings and was now ready for adoption. He said there were only two changes from the preliminary budget which had been incorporated into the final document. He said the staff had done an excellent job on putting their department budgets together. Appointment- Recreation Commission Supervisor Ryan said that there was an opening on this commission caused by the resignation of Kathryn Parter. On motion of Councilwoman Myers, seconded by Councilwoman Wittner, it was unanimously, RESOLVED, that the Town Board does hereby appoint Kate Kean as a member of the Recreation Commission, to replace Kathryn Parter who resigned effective December 1, 1999, said term to take effect immediately, expiring May 2004. Councilwoman Wittner said that Ms. Kean is a extremely dedicated person and will be a 6 DECEMBER 15, 1999 tremendous asset to the Recreation Commission Councilwoman O'Keeffe asked how long the term is for on the Recreation Commission and was told the term was for seven years. She then said since the resume was just delivered on Saturday, there was not sufficient time given to review qualifications. She said that when someone is being considered for appointment to a board for such a long term, it might also be a good idea to interview them first. Supervisor Ryan said that since this was the last meeting of the year, it's important to have someone in place. 3. Authorization -,Stop DWI Patrol Reimbursement Agreement The Administrator said approval was necessary to renew the agreement with the County of Westchester which provides reimbursement for enforcement of DWI regulations. The agreement will increase the payment to the Town by $2700, which means they will pay us a total of$11,400 in the year 2000. He recommended approval. On motion of Councilwoman Wittner, seconded by Councilwoman Myers, it was unanimously, RESOLVED, that the Town Board does hereby approve the agreement between the Town and the County of Westchester as amended to receive reimbursement for enforcement of DWI regulations; and BE IT FURTHER RESOLVED, that Westchester County will reimburse the Town to a maximum of$11,200 in 2000. NOW THEREFORE, BE IT FURTHER, RESOLVED, that the Town Administrator is hereby authorized to execute said agreement on behalf of the Town. 4. Authorization - Employees Assistance Program Agreement Mr. Altieri said authorization was being requested for the renewal of the Westchester County -Employee Assistance Program. The cost will remain $25 per employee, which amounts to $2,875 for the coming year. The program provides consultation and counseling to employees who may be experiencing personal or work related problems caused by financial difficulties, alcohol, and drugs. It's confidential, and employees can either be referred or contact them directly for assistance. He added that the cost is included in the personnel budget. On motion of Councilwoman Myers, seconded by Councilwoman O'Keeffe, it was unanimously RESOLVED, that the Town Board does hereby approve the agreement between the Town and the Westchester County Employee Assistance Program for the 1999 calendar year; and BE IT FURTHER, RESOLVED, that the cost for this program is $25 per employee, at a total cost of$2,875 for 115 Town employees. NOW THEREFORE, BE IT FURTHER, RESOLVED, that the Town Administrator is hereby authorized to execute said agreement on behalf of the Town. 7 DECEMBER 15, 1999 5. Authorization - Use of Voting Machines - Mamaroneck School District The Town Clerk said she had received a request from the Mamaroneck Union Free School District for use of voting machines in preparation for the Special School District Election Vote on January 12, 2000. There was some discussion about the purpose of the vote, which was for a 17 million dollar bond issue to renovate and build an addition at the Hommocks School. The Clerk said the request was for voting machines and had no connection with the Town beyond that. The Town was taking no stance on the issue; it was a pro forma request that the school makes for any election and one in which the Town always grants permission. The cost of setting up, moving and conducting the election are all paid for by the school district. On motion of Councilwoman O'Keeffe, seconded by Councilman Weprin, it was, RESOLVED, that the Town Board does hereby authorize the use of 13 voting machines by the Mamaroneck Union Free School District. Ayes: Myers, Weprin, O'Keeffe, Ryan Nays: Wittner 6. Authorization -Transfer of Funds Fire Department The Town Administrator said that in the 1999 fire department budget, funds were appropriated for the installation of a new air exhaust system for the Firehouse. There has been an accumulation of diesel engine fumes generated by the fire trucks. Authorization is being requested to transfer funds to establish Capital Project#99-03 to purchase and install an exhaust system in the amount of$35,000. On motion of Councilwoman Wittner, seconded by Councilwoman O'Keeffe, it was unanimously, RESOLVED, that the Town Board hereby authorizes the Comptroller to transfer$35,000 into account#H-3497-4-3410- 5005 for Capital Project#99-03 for the installation of a new air exhaust system in the Weaver Street Firehouse. 7. Report of Bids -Street Painting - Fuel Oil - Diesel Fuel - Police Uniforms Street Painting On motion of Councilwoman Wittner, seconded by Councilwoman O'Keeffe, it was unanimously, RESOLVED, that the Town Board hereby authorizes the contract for street painting be awarded to M & S Striping, the lowest responsible bidder at a cost of$.06 a foot for reflectorized paint and $.04 a foot for non-reflectorized paint; and BE IT FURTHER, RESOLVED, that the Administrator is hereby authorized to 8 DECEMBER 15, 1999 execute said contract on behalf of the Town. Fuel Oil On motion of Councilwoman Myers, seconded by Councilwoman O'Keeffe, it was unanimously RESOLVED, that the Town Board hereby authorizes the contract for fuel oil for heating be awarded to Lawrence Heat& Power, the lowest responsible bidder at a cost of $.8545 per gallon; and BE IT FURTHER, RESOLVED, that the Administrator is hereby authorized to execute said contract on behalf of the Town. Diesel Fuel The Administrator said that this item had increased by 35 cents a gallon which had been anticipated and incorporated into the 2000 budget. " On motion of Councilwoman Myers, seconded by Councilwoman O'Keeffe, it was unanimously RESOLVED, that the Town Board hereby authorizes the contract for diesel fuel be awarded to Lawrence Heat& Power, the lowest responsible bidder at a cost of$.8025 per gallon; and BE IT FURTHER, RESOLVED, that the Administrator is hereby authorized to execute said contract on behalf of the Town. Police Uniforms On motion of Councilwoman Wittner, seconded by Councilwoman Myers, it was unanimously, RESOLVED, that the Town Board hereby authorizes the contract for supplying police uniforms be awarded to New England Sportswear, the lowest responsible bidder at a cost of$484.95 per officer; and BE IT FURTHER, RESOLVED, that the Administrator is hereby authorized to execute said contract on behalf of the Town. 8. Y2K Update The Administrator reported that all departments had been checked and rechecked for Y2K readiness and everything that could be done had been. It's a wait and see matter, but it appeared that we are okay, and all should work well on January 2, 2000 when we return to work. He said there will be staff on call, as well as two ambulance crews in case of emergency. The firehouse is available as a center as is St. Thomas' Church. 9. Salary Authorization - Recreation On motion of Councilwoman Wittner, seconded by Councilwoman Myers, it was 9 DECEMBER 15, 1999 unanimously., RESOLVED, that as provided for in the 1999 Town Budget that the Town Board does hereby authorize the payment of salary to the following: Gregory Christian, Youth Hockey Program, increase in salary to $6.50 per hour, effective retroactive to 11/13/99. Richard Leahy, Assistant Instructor, Youth Hockey Program, $5.50 per hour, effective retroactive to 11/13/99. ADDED ITEM Web Committee The Supervisor said that he wanted to appoint a web committee consisting of at least four members and a maximum of seven. He proposed the committee be chaired by Ernie Odierna and appointed Patrick Boyle, Luis Quiros, and Pat DiCioccio as members. He said the purpose would be to develop an internet site for the Town, and to explore the possibility of having LMC the vehicle through which the web site is operated and funded. He suggested the site be bi-lingual to accommodate all members of the community. Councilwoman Wittner said the concept was fine but suggested there be more time allowed to discuss the framework. Supervisor Ryan said he had spoken to the Administrator earlier and it was time to get the ball rolling. There then ensued a discussion on the term, the appropriate number of people to serve, and the mission of the committee and what it should be called. Councilwoman Myers said the committee was a good idea but was uneasy approving a mission statement for them that wasn't formed by the committee itself. The Supervisor replied the mission is to get them started, it's not formal, but it does give a starting point. The proposed name for the committee was the Town of Mamaroneck Organization Committee for the Web Page. On motion of Councilwoman Phyllis Wittner seconded by Councilwoman O'Keeffe, it was unanimously RESOLVED, that the Town Board of the Town of Mamaroneck does hereby appoint Ernie Odierna as chair of the Town of Mamaroneck Organization Committee for the Web Page and Patrick Boyle, Luis Quiros and Pat DiCioccio as members of said committee. ORAL COMMUNICATIONS George Gold, Leafy Lane resident said that he had watched the last meeting of the Board on LMC and had heard a resident complain about the sanitation department. He was here to say that he thinks they do a great job under grueling conditions. They work in 100 degree weather and below zero weather and the level of appreciation is nil. He said in his 24 years in the Town, his pickup had been missed twice, which is an astounding record. He said that Senator Proxmire had gone out with garbage men for a week and had given them accolades for enduring such a job. The Supervisor thanked him for his comments, adding that the garbage men are definitely an unappreciated group, they begin their day at 6:00 am and for 5% hours they don't take a break. 10 DECEMBER 15, 1999 Ernie Odierna said he appreciated the commentary regarding the sanitation department. It was nice to hear good things for once. REPORTS OF COUNCIL Councilwoman Myers said the Youth Council sponsored event at the Larchmont Theater had been a great success and she thanked Bill Zimmerman and Toni Ann Guagliano for all their help and support and also thanked the Larchmont Police and Victor Zappata for arranging the taxi service. Councilwoman Wittner thanked Barry Weprin and Paul Ryan for their service to the community and said how great the Board had been with them on it . Councilwoman O'Keeffe added her thanks and wished them well, she reminded everyone there would a swearing in ceremony held on January 2 here at 4:00 PM. ADJOURNMENT The Supervisor said that the next scheduled meetings would be January 12 and January 26, 2000. On motion of Councilwoman Wittner, seconded by Councilman Weprin, the meeting was adjourned.
