MINUTES OF THE REGULAR MEETING OF THE TOWN BOARD
OF THE TOWN OF MAMARONECK AND THE BOARD OF FIRE
COMMISSIONERS HELD ON JANUARY 27, 1999 AT 8:15 PM IN
THE COURT ROOM OF THE TOWN CENTER, 740 W. BOSTON
POST ROAD, MAMARONECK, NEW YORK

CONVENE EXECUTIVE SESSION
The Board convened into an Executive Session at 7:00 PM in Conference Room A of
the Town Center to discuss personnel and adjourned at 7:45 PM into a Work Session
to discuss parking.
On motion duly made and seconded the Board adjourned at 8:15 PM to the Court
Room.
CALL TO ORDER
The Regular meeting of the Town Board was called to order by Supervisor Price at
8:20 PM, who then pointed out the location of exits.
PROCLAMATION
The Supervisor introduced Margie Strauss' husband Charlie and daughter Barbara
and then read the following proclamation:
IN MEMORY OF
MARGIE STRAUSS
WHEREAS; that as Town Board Members of the Town of Mamaroneck,
we record this expression of our profound sorrow at the death of
MARGIE STRAUSS in the month of December in the year of 1998;and
WHEREAS;MARGIE served the League of Women Voters on their
Recreation Committee. MARGIE together with the Town of
Mamaroneck Recreation Superintendent initiated a recreation survey
resulting in a community sailing program; and
WHEREAS;she served as an active League of Women Voters member
for more than five (5) decades;and

WHEREAS;MARGIE as Director of the Life Center spearheaded the
preservation, of open space and was instrumental in the
Leatherstocking Trail, Hommocks Park and Premium Marsh being
named as conservation areas;and
WHEREAS;her clear judgment and wise advice were respected by all
those associated with her and set a standard for all who came in
contact with her. The memory of her kindly, lovable nature and high
character will live in the hearts of her friends.
RESOLVED, that we extend to her family our most heartfelt sympathy
in their bereavement
NOW THEREFORE, BE IT
RESOLVED, that a copy of this resolution be suitably endorsed, signed
by the Supervisor and Town Board Members and sent to her family, to
whom our deepest sympathy is extended.
IN WITNESS WHEREOF, I have hereunto set my hand and caused the
seal of the Town of Mamaroneck to be affixed this 27"' day of January
1999.
The Supervisor noted the new decor in the Court Room saying that the cut outs on
the wall behind her were copies of the environmental signs that are located at the
borders and/or entrances to the Town. She said the mural should be completed by
the next meeting.
Supervisor Price then announced that she would be resigning as Supervisor at the
end of next month. She said that she had accepted the position offered to her by the
County to run the Consumer Protection Agency. She added that she had mixed
emotions since this job was wonderful and difficult to leave. She noted that
Councilman Ryan as Deputy Supervisor would be assuming her position.
The Council members all congratulated her.
There then ensued a discussion on voting and Board vacancies and how it would
work. The Attorney stated that the Board would vote for the new Supervisor and for
the Councilman replacement. There was a question as to whether Councilman Ryan
could vote for himself to become Supervisor to which the Attorney said he could,
adding that they then would vote for his replacement.
BOARD OF FIRE COMMISSIONERS
The meeting was called to order by Commissioner Price at 9:00 PM in the Court
Room.

1. FIRE CLAIMS
Commissioner O'Keeffe presented fire claims for authorization of payment, thereafter
on Commissioner O'Keeffe's motion, seconded by Commissioner Ryan, it was

unanimously:
RESOLVED, that this Commission hereby authorizes payment of

2. Other Business
Commissioner Price said that the Installation Dinner at the Weaver Street Fire House
was one of the best parties she had ever attended. She said that they had set up the
main room to looked like a French bistro, and had cooked all the food themselves. It
was wonderful.
There being no further business to come before the Commission, on motion of
Commissioner O'Keeffe, seconded by Commissioner Wittner, the Commission
unanimously voted to adjourn.
Supervisor Price then introduced George Latimer, County Legislator and Chair of the
Legislature. Mr. Latimer told her how happy he was that she was joining the County
staff. He said that he knew of no one who works harder or was more dedicated than
Elaine. Her leadership on Bonnie Briar, Hommocks Park Apartments and other
projects has been incredibly astute and thorough.
The Supervisor thanked him.
AFFAIRS OF THE TOWN
1. Appointment- Board of Architectural Review
Supervisor Price recommended Sue Ellen Commender for the open position on the
Board of Architectural Review. She said that Ms. Commender did part-time work on
behalf of the Town and is a member of the Beautification Committee which she will
resign when appointed to this position. She will also recuse herself when Town
matters are before the BAR.

On motion of Councilman Ryan, seconded by Councilwoman Wittner, it was
unanimously,
RESOLVED, that Sue Ellen Commender, 2 Dante Street,
is hereby appointed as a member of the Board of
Architectural Review of the Town of Mamaroneck to fill
the unexpired term of Lucian Leone who has resigned.
This term will expire December 1999.
The Supervisor said that Ms. Commender will help to bring stronger communication
between the Town and businesses, which is especially important because two new
stores would be opening shortly: 1-800-Flowers and Chinese Buffet.
2. Designation of Official Newspaper
Irving Scharf, said that he had heard the discussion of this matter at the previous
Board meeting and wanted to suggest that high school students be approached to
have them put together a community newspaper. He said that the "Journal News"
could be asked to insert the student newspaper.
Supervisor Price responded that the issue could be brought to the Youth Council for
discussion and that Judy Myers, a member of the Youth Council, who is here tonight,
see what could be started.
Councilman Weprin reiterated his disappointment with the Journal News. He said the
local coverage has been depleted. He has cancelled his subscription and wanted to
express the Town's concern about the lack of local coverage. He said that the
Soundview News has been excellent on local coverage, but had disappointing
editorial policies.
On motion of Councilwoman Wittner, seconded by Councilwoman O'Keeffe, it was
unanimously,
RESOLVED, that the "Journal News" and the "Soundview
News" be, and they hereby are, designated the official
newspapers of the Town of Mamaroneck for the purpose of
publishing legal notices during 1999.
3. Authorization - Easement Agreement
The Administrator explained that this was an Easement agreement between the Town
of Mamaroneck and Roger and Susan Marcon of 10 Sackett Circle. The Marcon's had
recently purchased the home and in the course of clearing title a discrepancy was
found between the actual conditions at the home and our building department
records. In our records, the driveway to the home is shown exiting onto Weaver
Street, however, the driveway actually exits onto Sackett Circle. In the front of the
home, on Sackett Circle, the Town has an existing easement for a storm drainage
pipe. The driveway has exited onto Sackett Circle for many years and we cannot
track down the reason for the discrepancy. Having the driveway on Sackett Circle is
clearly preferable considering the traffic on Weaver Street. Therefore, the Building
Inspector has issued a certificate of compliance for the current driveway location.
The Board must however amend the easement agreement to reflect the existence of
the driveway. He said the easement has been reviewed by the Town Attorney, and is
found to be in order. Authorization is requested to execute the easement agreement.
On motion of Councilman Ryan, seconded by Councilwoman O'Keeffe, the following
Resolution was unanimously adopted:

RESOLVED, that the Town Board does hereby authorize the
amended Easement Agreement between the Town of
Mamaroneck and Roger and Susan Marcon of 10 Sackett
Circle, Larchmont, New York, 10538 located within the Town
of Mamaroneck; and
BE IT FURTHER
RESOLVED, that the Town Administrator is hereby
authorized to execute said agreement on behalf of the Town.
4. Set Public Hearing -Senior Citizen Exemption
Mr. Altieri said that previously, this Board adopted legislation that extended to
Cooperative Owners the benefits of the Veterans tax exemption. Now the County has
adopted under section 467 -Senior Citizens tenant stockholders of cooperative
apartments are eligible to apply for county tax purposes. Since the Town has to
apply the exemption for County tax purposes, the Assessor recommends that the
Town adopt this legislation as well. He said that he had given the Board a breakdown
of the income limitations for the exemption and that the Town Attorney is now
.drafting proposed legislation for the Board's review.
On motion of Councilwoman Wittner, seconded by Councilman Weprin, it was
unanimously,
RESOLVED, that the Town Board does hereby set'the date for
Public Hearing on the amendment to Local Law 7-1998 of the
Town Code of Mamaroneck for February 10, 1999, at 8:15 PM;
and
BE IT FURTHER,
RESOLVED, that the Town Clerk be and hereby is authorized
to publish the legal notice of Public Hearing in an official
newspaper of the Town.
5. Authorization -South East Consortium Agreement
The Town Administrator explained that the 1999 Inter-Agency Agreement with South
East Consortium requires Town board approval subject to any modifications made by
the Town. This agreement is pursuant to the approved 1999 budget payment
schedule of services.
On motion of Councilwoman Wittner, seconded by Councilman Weprin, it was
unanimously,
RESOLVED, that the Town Board does hereby authorize the
1999 Inter-Agency Agreement with South East Consortium
for Special Services, Inc; and
BE IT FURTHER
RESOLVED, that the Town Administrator is hereby
authorized to execute said agreement on behalf of the Town.

6. Authorization -Sale of Surplus Equipment
The Administrator explained that the authorization would enable him to offer the
below listed equipment for sale to Town employees or allow for disposal should
there be no interest in the equipment. He said most of the computer equipment was
quite old.
On motion of Councilman Ryan, seconded by Councilwoman Wittner, it was
unanimously,
RESOLVED, that the Town Board does hereby authorize the
sale of the following surplus computer equipment:

7. Report of Bids -Street Painting
-Cleaning of Police Uniforms
- Fuel Oil #2
The Administrator said that the Bids had been publicly opened and read for the
following items: street painting, cleaning of police uniforms, and Fuel Oil #2. The
recommendation to the Town Board is that the above contracts be awarded to lowest
responsible bidders.
Street Painting
On motion of Councilman Ryan, seconded by Councilwoman O'Keeffe, it was
unanimously,
RESOLVED, that the Town Board does hereby authorize that
the contract for street painting be awarded to M &S Striping,
who submitted the only bid for$.06 per foot(reflectorized
paint) and $.02 per foot(non-reflectorized paint); and
BE IT FURTHER,
RESOLVED, that the Administrator is hereby authorized to
execute said contract on behalf of the Town.
Cleaning Police Uniforms
On motion of Councilwoman Wittner, seconded by Councilwoman O'Keeffe, it was
unanimously,
RESOLVED, that the Town Board does hereby authorize that
the contract for cleaning of police uniforms be awarded to
Flamingo Cleaners, who submitted the lowest responsible
bid for$5.25 per uniform in 1999 and $5.45 in 2000; and
BE IT FURTHER,
RESOLVED, that the Administrator is hereby authorized to
execute said contract on behalf of the Town.
Fuel Oil #2
On motion of Councilman Ryan, seconded by Councilwoman Wittner, it was
unanimously,
RESOLVED, that the Town Board does hereby authorize that
the contract for fuel oil #2 be awarded to Valley Oil Company,
who submitted the lowest responsible bid at$.5445 per
gallon; and

BE IT FURTHER,
RESOLVED, that the Administrator is hereby authorized to
execute said contract on behalf of the Town.

8. Salary Authorizations - Police Department

POLICE DEPARTMENT
A communication was received from the Police Chief requesting salary authorization
for Michael Atkins as Probationary Police Officer, who was replacing Nelson Flores,
who had been promoted to the Detective Division and Brendan Ward who also was
replacing a vacant position as Probationary Police Officer. Both Officers were
selected from candidates on the Westchester County Department of Personnel
eligible list for the position of police officer.
On motion of Councilman Ryan, seconded by Councilwoman Wittner, it was
unanimously,
RESOLVED, that the Town Board does hereby authorize the
appointment of Michael Atkins, to the position of
Probationary Police Officer at the annual salary of$35,478,
effective January 21, 1999; and
BE IT FURTHER,
RESOLVED, that the Town Board does hereby authorize the
appointment of Brendan Ward, to the position of
Probationary Police Officer at the annual salary of$35,478,
effective January 21, 1999
RECREATION
On motion of Councilman Ryan, seconded by Councilwoman Wittner, it was
unanimously,
RESOLVED, that as provided for in the 1999 Town Budget,
authority is hereby given for the payment of salary to the
following:

effective 1/25/99.
Patrick McLaughlin, Alternate Skate Guard, Hommocks Park Ice Rink, $5.50/hour,
retroactive to 1/13/99
Kim Rosenthal, Alternate Skate Guard, Hommocks Park Ice Rink, $6/hour, effective
retroactive to 1/12/99.
Heather Waters, Lifeguard, Early Morning Swim, $39/session, effective retroactive to

Item Added to Agenda - Designation of Delegate to Association of Towns meeting
The Supervisor said that since she was resigning her position it would be more
appropriate to send another delegate to the Association of Towns' meeting.
On motion of Councilman Ryan, seconded by Councilwoman O'Keeffe, it was
unanimously,
RESOLVED, that the Town Board does hereby appoint
Councilwoman Phyllis Wittner as its delegate to the
Association of Towns' meeting to be held February 14
through 17, 1999 in New York City.
ORAL COMMUNICATIONS
Bill O'Gorman, a Town resident, complained about snow trucks driving through his
neighborhood at a high rate of speed.
The Supervisor suggested that the Police be called and if the exact time is noted it
will help to determine who was driving.
WRITTEN COMMUNICATIONS
Supervisor Price read the following letter from Ernie Odierna, President of the
Larchmont Gardens Civic Association.
Dear Elaine:
Sorry I can't be here in person tonight, but a trade show in
Washington, D. C. has me out of town for a few days.
It is with mixed emotions that I learned of your decision to accept a
position as Head of our County Consumers Affairs Department. Our
loss here is also our gain there, so if you are pleased with the
opportunity to serve the residents in a new capacity, then we should
all come out ahead. All of us from the Larchmont Gardens Civic
Association wish you the best of luck with your new challenges.
Before you go however, a few problems which we thought had been
corrected some time ago, seem to have cropped up again.

The street light on Myrtle Blvd. opposite Carls; at the foot of the
ramp to the Metro North parking lot is now, and has been for the
past month, out again.
The snow removal and salting during and after the last snow and ice
storm last January 14th, 15th, and 16th left a lot to be desired, at
least in the Gardens area-It took about 14 hours, from when the
precipitation ended, before we saw the first real salting truck on
High Ridge Road, and on the other nearby local streets.
Hilly streets in the community should, where at all possible,
especially on "work"days, get an early plowing and/or salting, so
residents who need to can get out and get to work. Similar
treatment for the evening return home commute should also be
priorities. Many of our L.G.C.A. board members also let us know
that sidewalk clearing of snow and ice was practically non-existent
in the community for days after the storm ended, with no evidence
of any enforcement efforts. While this storm may have been
particularly difficult with its rain, freezing rain, thawing and re-
freezing cycles, early post storm action by residents, or the people
they contract with for snow removal services, would have mitigated
a bad and dangerous situation. Perhaps in your next newsletter, if
there is one, or a special note to residents, you can remind
everyone of their obligation to get the snow and ice off the
sidewalks in a timely fashion.
Just think, in a few weeks you'll be able to look out at the snow, and
simply enjoy it, not see the piles of inappropriately placed garbage
or recycling materials, the street lights that are out or any of the
other myriad of, minor to some but major to others, suburban
problems. Remembering, hopefully fondly, where you're from, the
place where most of the "real'consumers were geese, we trust and
expect your involvement in the "Town"and it's affairs will continue
for many more mutually enjoyable years.
Thanks for all your help in the past and genuine concern about the
Town and all its residents.

The Administrator responded that sanders were out but Highridge would have been
one of the last plowed, but not 14 hours later.
Supervisor said that the street light near Carl's would be fixed.
Mr. Altieri said that he had received calls about the color of the water in the brook
turning emerald green. He said that it was being caused by dye testing of the storm
drains being performed by New York State, which were not harmful. He said that the
Town had not been notified in advance that the testing was to be done.
ADJOURNMENT
On motion of Councilwoman Wittner, seconded by Councilwoman O'Keeffe the
meeting was adjourned at 9:30 PM into an Executive Session to discuss personnel
and litigation.
