TOWN OF MAMARONECK
held May 2nd, 1923.
The meeting was called to order by Supervisor Burton at
11 P.M.
PRESENT: Supervisor Burton
Justices Boyd, Collins and Shafer
Town Clerk Sherman
Counsellor Gamble.
Upon motion, duly seconded, it was VOTED that the minutes
of the meeting of April 12, 1923 be approved as printed.
The report of the Receiver of Taxes for the month of
March, 1923 was received, read, ordered placed on file and is as
follows:
April 2nd, 1923.
SIR:
Pursuant to Section 23 of the Westchester County Tax Law, I
hereby respectfully report the amount of State, County, Town,
School, Highway and Special District taxes, together with the
interest and penalties thereon, collected by me during the month
of March 1923.

The police report for the month of March 1923, was re-
ceived and read, showing 21 arrests, and fines amounting to $300.
The report was ordered noted in the minutes and placed on file.
The report of the Town Clerk for the month of March, 1923
and of the Building Commission, was received, read, ordered
placed on file and is as follows:

of March 1923, of fees collected in this office, during said

The Supervisor reported that he had been served with
papers in an injunction proceeding instituted by the Village of
Larchmont against the Town of Mamaroneck for the erection of a
tool house on their water works property, and further reported
that he had referred same to Messrs. Clark, Close and Davis of
White Plains to protect the interests of the Town. The Board
voted that the action of the Supervisor be approved.
A communication from the Board of Appeals was received
and read in relation to letter they had received from the Village
of Larchmont, asking for a permit for their pump house on the
water works property. The members of the Board of Appeals recom-
mended to the Town Board that the Building Commission issue a
permit for such construction. After considerable discussion the
matter was laid over.
The following resolution was presented by Justice
Collins, seconded. by Justice Boyd:
WHEREAS, the Village of Larchmont erroneously
paid to the Receiver of Taxes of the Town of
Mamaroneck, School Taxes for the year 1922,
which were taxes against the Larchmont
Water Company, new the Village of Larchmont,
and
WHEREAS, pursuant to law said property was
exempt from taxation under the provisions of
Sec. 4, sub-division 3, of the Tax Law;
therefore be it
RESOLVED that upon the receipt of a proper
voucher, the Supervisor be and he hereby is
authorized and empowered to refund to the
Village of Larchmont the sum of $325.72,
erroneously paid to the Receiver of Taxes
on September 28, 1922 for the following
taxes:

3,500 ft. pipe 29.52
3,000. ft. pipe 25.30
75 hydrants 15.81 $325. 72
being hydrants and pipes within the Village
of Larchmont, and be it further
RESOLVED, that the Supervisor, Receiver of
Taxes and Board of Assessors be and they
hereby are authorized and empowered upon
the payment thereof to have said taxes
stricken from the records and to take such
other action as may be necessary in the
premises to cancel the same.
Counsellor Gamble reported upon the petition to extend
the present sewer district and after full discussion the follow-
ing resolution was upon ROLL CALL unanimously adopted:
WHEREAS, there has been presented to this
Board a petition requesting this Board to
extend the present boundary lines of Sewer
District No. 1 of the Town of Mamaroneck;
and
WHEREAS, pursuant to law this Board must
give notice of the meeting at which it will
act on said petition, therefore be it
RESOLVED that a special meeting of this
Board be held on June 11, 1923, at 8.30
o'clock,P.M. daylight saving time (7.30
P.M., standard time), at the Weaver Street
School House, Weaver Street, Town of Mama-
roneck, New York, at which time and place
it will meet to act on the aforesaid peti-
tion to extend the present Sewer District
No. 1 of the Town of Mamaroneck, and the
Sewer System therein, as now established,
so as to include in and make a part of
said District the territory embraced within
the said proposed extension, which is de-
scribed in said petition; and be it further
RESOLVED that the Clerk give due notice of
such special meeting by posting, and publish-
ing, as provided by law.
A communication from the Board of Assessors was received
and read requesting permission to attend a hearing before the
State Board of Tax Commissioners in relation to franchise tax
matters. The Board voted that permission to attend be granted.
The matter of the publication of the tax sale list was
taken up and after discussion it was
RESOLVED that the publication of the tax
sale list be published in the Mamaroneck
Paragraph in the manner as provided by law.
Communications were received from the Weaver Street
Fire Company requesting the purchase of supplies, and also re-
questing permission to construct a tennis court on the property
adjoining the Fire House on the Hillcrest Avenue side. The
Supervisor stated that quite some attention being needed for the
new fire house, he thought it advisable for a committee to be
appointed to take up all such matters. He thereupon appointed as
such Committee Messrs. Sherman, Collins and Burton.
The following communication was received from the Board
of Appeals which was ordered received, read, spread upon the min-
sites, and is as follows:
April 28, 1923.

Dear Mr. Sherman:
At a meeting of the Board of Appeals held on April 26th
1923, at its offices, 8 Elm Street, Mamaroneck, the following
resolutions were adopted:
RESOLVED, That the Board of Appeals recommend to the
Town Board that the appeal of E. K. Ortiz to erect a
garage on the Murray Avenue School property, forty
feet from the east side of Forest Avenue within a
residence (A) district be granted, and the decision of
the Building Commission be reversed.
RESOLVED, That the Board of Appeals recommend to the Town
Board that the appeal of Michael Doherty to erect a one-
family residence on the west side of Premium River Road
within fifteen feet of the street line be granted, and
the decision of the Building Commission be reversed,
provided that the setback is at least as great as the
houses on either side.
RESOLVED; That the Board of Appeals recommend to the Town
Board that the appeal of Michael Doherty to erect a one-
family residence on the east side of Premium River Road
200 feet south of Locust Terrace, within twelve feet of
the street line be granted, and_ the decision of the
Building Commission be reversed.

The following resolution was offered and unanimously
adopted:
WHEREAS the Board of Appeals of the Zoning
Commission have acted upon and have recommen-
ded to the Town Board that the appeal of E.
K. Ortiz to erect a garage on the Murray
Avenue school property forty feet from the east
side of Forest Avenue within a residence (a)
district, and that the decision of the
Building Commission be reversed, therefore be
it
RESOLVED, that the Town Board pursuant to Article 5,
Sec. 26 of the Town Law, hereby consents to and
confirms the action of the Board of Appeals
in reversing the decision of the Building
Commission, and be it further
RESOLVED that the Town Clerk sign for the
Secretary of the Board of Appeals certified
copy of this resolution.
The following resolution was offered and unanimously
adopted:
WHEREAS the Board of Appeals of the Zoning
Commission have acted ubon and have recom-
mended. to the Town Board that the appeal of
Michael Doherty to erect a ane family resi-
dence on the west side of Premium RiVer
Road within fifteen feet of the street line
be granted and that the decision of the
Building Commission be revers;
provided that the setback is at least as
great as the houses on either side,
therefore be it
RESOLVED that the Town Board pursuant to
Article 5, Section 26 of the Town Law,
hereby consents to and confirms the
action of the Board of Appeals in
