TOWN OF MAMARONECK
held April 12th, 1923.
The meeting was called to order by Supervisor Burton at
8.45 P.M.
PRESENT: Supervisor Burton
Justices Boyd, Dudley and Shafer
Town Clerk Sherman
Counsellor Gamble.
On motion duly seconded, it was VOTED that the minutes
of the meeting of March 21st, 1923, be approved as printed.
A communication from the Board of Assessors was received
and read, asking for refund of taxes amounting to $22.50 to Mary
E. Vermilye affecting Section 1, Block 67, Lots 18, 19, 20 and 21
same having been erroneously assessed. The matter was referred to
Counsel for his report.
A communication from the Board of Assessors was received
and read, asking for cancellation of the taxes of 1922 against
Frederick Cybel affecting Section 6, Block 27, Lot 2, the property
having been assessed twice upon the same assessment roll. The
matter was referred to Counsel for his report.
A communication from Ada V. Bird was received and read
requesting the refund of taxes of one-twelfth of the amount paid
since March 31st, 1883. The matter was referred to Counsel for
his report.
A communication from the Orange Screen Company was re-
ceived and read, quoting the cost of screens for the Weaver Street
building. Same was referred to the Building Committee.
The following resolution was presented by Justice Shafer
seconded by Justice Boyd, and was, upon ROLL CALL, unanimously
adopted:
WHEREAS, Mrs. L. T. Chayer, who has for some
years owned lots 89 and 90 on Map of First
Subdivision of Grand Park, in the Town of
Mamaroneck, has brought to the attention of
this Board that the assessment rolls on file
with the County Treasurer show the aforesaid
lots assessed to one J. R. Hays in the ass-
essment rolls of 1870 and 1871; and
WHEREAS, the original assessment rolls and
the Collector's books of record for said
years are not on file in the offices of the
Receiver of Taxes; and
WHEREAS, the Receiver of Taxes reports that
he is unable for this reason to correctly
check and determine the payment of said-
taxes; and
WHEREAS, from the evidence submitted it would
appear that said taxes had been paid and never
so marked, due to an error in the Town records
as of that date; and
WHEREAS, it seems equitable that said matter
should be adjusted in the interests of both
parties, inasmuch as all taxes thereafter
assessed have been paid and cancelled; and
WHEREAS, the Receiver of Taxes has so
recommended; therefore be it
RESOLVED, that the Receiver of Taxes be and
he hereby is authorized and empowered to
accept the flat amount of taxes as ass-
essed on the County Treasurer's records
on lots 89 and 90 on Man of First Sub-
division of Grand Park in the Town of
Mamaroneck for the years 1870 and 1871,
plus the cost of sales of said lots and
to waive and cancel penalties and int-
erest thereon; and it is further
RESOLVED that the Receiver of Taxes upon
the receipt of the aforesaid flat amount
of taxes and sales cost, be and he hereby
is authorized and empowered to mark his
records paid and cancelled and to issue
the necessary cancellation certificate to
the County Treasurer, Westchester County,
so that the sale will be properly can-
celled; and it is further
RESOLVED, that the Town Clerk be and he
hereby is authorized and empowered to
execute and deliver certified copies of
the aforesaid resolution.
The following resolution was presented by Justice Dudley
seconded by Justice Shafer, and upon ROLL CALL, unanimously adopted:
WHEREAS, Harold C. Pryer, as one of the
Executors of the Last Will and Testament
of Charles Pryer, deceased, has filed a
petition with this Board praying that
certain taxes appearing on the Tax records
of the Town of Mamaroneck be cancelled and
discharged of record, which petition alleges
as follows:
First.
That at the time of the decease of
Charles Pryer he was the owner of lots
15 and. 15a on a certain map entitled, "Map
of the Estate of John Pryer, Westchester
County, New York," made by George A.
Wheeler, City Surveyor, January 18, 1888,
and filed in the office of the Register of
Westchester County, September 30, 1888, as
map number 886; and which said lots as
shown on said map lie wholly in the City,
formerly town, of New Rochelle; and
That the lots appear on the assessment
roll of the Town of Mamaroneck for the year
1913 and a tax of $26.63 was imposed on said
lots for the year 1913, and that the Town
thereafter, on October 6, 1914, sold said
lots for non-payment of said tax.
S econd.
That in the year 1917, a tax of $140.53
was levied against a plot of 24- 1/2 acres
assessed to the John Pryer Estate, and that
neither the said Charles Pryer nor any of the
other heirs of the late John Pryer owned any
plot of 24-1/2 acres and that petitioner holds
receipted tax bills from the Town of Mamaroneck
on each of the said plots owned by the said
Charles Pryer for the year 1917, and that all
other heirs or their assigns have paid the
taxes for the year 1917 on their respective
properties, and which said assessment on
the 24- 1/2 acres petitioner believes is a
double and erroneous assessment; and
WHEREAS, said petitioner respectfully re-
quests:
( 1 ) That the aforesaid tax or any other
taxes or assessments imposed by the Town
of Mamaroneck on lots 15 and 15a be can-
celled and discharged on the records of
the Town of Mamaroneck on the grounds that
the premises are not located within said
Town, and (2) that the assessment of the
24- 1/2 acres for the year 1917, amounting to
$140.53 be cancelled and discharged of
record for the reason that the same is a
double and erroneous assessments and
WHEREAS, the Receiver of Taxes and the Board
of Assessors have investigated the matters
alleged. in the petition and have recommended
that the prayer of said petition be granted;
therefore, be it
RESOLVED, that the Receiver of Taxes be and
he hereby is authorized and empowered to
cancel and discharge on the records of the
Town of Mamaroneck, the tax of $26.63 here-
tofore levied and assessed on the aforesaid
lots 15 and 15a on the assessment rolls of
the Town of Mamaroneck for the year 1913, and
any other taxes or assessments heretofore
imposed, if any, and that the sale of said
lots by the Town for non-payment of said tax
on October 6, 1914, be likewise cancelled and
discharged of record: and it is further
RESOLVED, that the Receiver of Taxes be and
he hereby is authorized and empowered to
cancel and discharge on the records of the
Town of Mamaroneck a tax of $140.53 levied
against a plot of 24- 1/2 acres for the year
1917 against the Estate of John Pryer; and
it is further
RESOLVED, that the Receiver of Taxes be and
he hereby is authorized and empowered to
make such entries on his books of record
and to take any other steps necessary to
carry this resolution into full force and
effect; and it is further
RESOLVED. that the Town Clerk be and he hereby
is authorized and empowered to certify copies
of the aforesaid resolution.
The following resolution was presented by Justice Boyd,
and seconded by Justice Dudley, and upon ROLL CALL, was unanimous-
ly adopted:
WHEREAS, Lot 1-a, block 80, Section 8 of the
Town of Mamaroneck was assessed in 1921 for
the tax of 1922 against the Mackintosh Com-
pany; and
WHEREAS, the same lot was erroneously ass-
essed for $3,500. against Louise P. Gilbert
the tax thereon being $8.80; and
WHEREAS, the aforesaid tax was paid by the
Mackintosh Company,
THEREFORE, upon the recommendation
Board of Assessors in the Town of Mamaro-
neck, be it
RESOLVED, that the Supervisor, Receiver of
Taxes and Board of Assessors, be and they
hereby are severally directed, authorized
and empowered to make such entries of re-
cord as may be necessary to cancel the
aforesaid assessment on Lot 1-a, Block 80,
Section 8, of the Town of Mamaroneck in
the year 1921, and to take such other
action as may be necessary in the premises
to remove said assessment and the ensuing
tax in said records.
A communication from the Board of assessors was received
and read requesting the purchase of a map affecting property called
Larchrnont Shores and Parkside. The matter was laid over until the
next meeting.
A communication from Frederick P. Boehm John F. Kane and
Austin K. Griffen, representing Michael Orennan, who resides on
Myrtle Avenue, was received, objecting to the erection of a store
on Wood Street by the contractor who is constructing a sewer on
Myrtle Avenue. The communication was ordered noted in the minutes,
and placed on file, and the matter was referred to the Supervisor
to take up with the Sewer Commissioners.
A delegation from the Woods of Larchmont appeared before
the Board and took up several matters affecting that section in the
Town, namely the gas question, the condition of the roads, etc.
The Supervisor told the gentlemen present that steps are being
taken in the different matters, and a conference was arranged for
Sunday next with Mr. J. Henry Esser, to take up the gas situation.
The policy for the Kelly-Springfield truck used in the
Highway department was referred to the Superintendent of Highways
for his recommendation.
A communication from the Building Cormission was received
and read, requesting the appointment of a Building Inspector.
Upon motion, duly seconded, it was
VOTED, that the recommendation of the
Building Commission for the appointment
of a Building Inspector be approved and
the matter held over for the Commission's
further report.
A communication from the Weaver Street Fire Company was
received and read, submitting the views of the company as to the
operation and control of the now building erected in that District.
A communication from Mr. R. C. Heather was received and
read, making application to have a street light placed on Garden
Road, 250 feet east of Weaver Street.
Upon motion duly seconded, it was
RESOLVED, that the Westchester Lighting
Company be and it hereby is authorized,
requested and directed to install a street
light on Garden Road, 250 feet cast of
Weaver Street; and it was further
RESOLVED that the Clerk be and he hereby
is authorized and empowered to forward a
copy of this resolution to the Westchester
Lighting Company.
Justice Shafer presented a communication from George P.
Forbes notifying the Ward that he has sold his building at 68 Post
Road, where Justice Shafer's office is located, to Mrs. Frances
Sachs and her brother Louis Steckler, both of #5 West 119th Street,
New York City. The communication was ordered noted in the minutes
and placed on file.
Justice Shafer also presented a communication from Mr.
Clarence D. Rogers on behalf of the Village of Larchmont, relating
to the Zoning Ordinances, and also tax matters. The communication
was referred to Counsel for reply.
The Supervisor reported in relation to the several
hearings on the increase of fares on the New York and Stamford
Trolley line.
Upon motion, duly seconded, it was
RESOLVED, that special counsel be employed
in conjunction with the village of Mamaro-
neck to oppose the increase of fares on the
New York and Stamford Trolley line.
Upon motion the meeting adjourned at 12.12 A.M.
