MINUTES OF THE REGULAR MEETING OF THE TOWN BOARD OF THE TOWN OF MAMARONECK AND THE BOARD OF FIRE COMMISSIONERS HELD ON OCTOBER 21, 1998 AT 8:15'PM IN THE COURT ROOM OF THE TOWN CENTER, 740 W. BOSTON POST ROAD, MAMARONECK, NEW YORK PRESENT: Supervisor Price Councilman Ryan Councilwoman O'Keeffe Councilwoman Winner ABSENT: Councilman Weprin ALSO PRESENT: Carol A.Acocella, Deputy Town Clerk Stephen V. Altieri, Town Administrator Charlene Indelicato, Town Attorney The Town Board met at 6:00 PM at the Hommocks Ice Rink for a Dedication Ceremony. CONVENE REGULAR MEETING The regular meeting of the Town Board was called to order by Supervisor Price at 8:20 PM. Order of Agenda was changed. Proclamations were read at the end of the meeting PUBLIC HEARING -Stop Sign Installation - Edgewood Avenue and Weaver Street The Deputy Town Clerk placed the legal notice of public hearing into the record: PLEASE TAKE NOTICE, that a Public Hearing will be held by the Town Board of the Town of Mamaroneck on Wednesday, October 21,1998 at 8:15 PM or as soon thereafter as is possible in the Court Room of the Town Center, 740 W. Boston Post Road, Mamaroneck, New York to consider the adoption of a proposed Local Law entitled "Stop Intersection - Edgewood Avenue and Weaver Street". The purpose of the Local Law is to change an existing "Yield Sign" to a "Stop Sign" because of increased traffic on Weaver Street. The Public Hearing opened on motion of Councilwoman Wittner and seconded by Councilwoman O'Keeffe. Town Administrator Altieri explained that the local law would involve changing an existing "yield" sign to a "stop" sign because of the dangerous conditions at this corner. Councilwoman O'Keeffe stated she was always amazed that there was not a stop sign in that location. Councilman Ryan stated that it was a logical move. On motion of Councilman Ryan, seconded by Councilwoman O'Keeffe, the hearing was declared closed. On motion by Councilman Ryan, seconded by Councilwoman Wittner the following local law was unanimously adopted. October 21, 1998 LOCAL LAW No. 9 - 1998 This Local Law shall be known as "Stop Intersection - Edgewood Avenue and Weaver Street". Section 1 - Purpose: To regulate the traffic on Edgewood Avenue by placing a stop sign on Edgewood Avenue where it intersects with Weaver Street. Section 2 - Regulation of Traffic on Edgewood Avenue: Vehicles shall be required to come to a full stop on Edgewood Avenue where it intersects with Weaver Street. Section 3 - Sign to be Erected: Appropriate signs shall be erected at the comer of Edgewood Avenue where it intersects with Weaver Street. Section 4-Severability: Should any provision of this Local Law be declared invalid or unconstitutional by any court of competent jurisdiction, such declaration of unconstitutionality or invalidity shall not affect any other provisions of the Local Law which may be implemented without the invalid or unconstitutional provision. Section 5 - Effective Date: This Local Law shall take effect immediately. On motion by Councilman Ryan, seconded by Councilwoman O'Keeffe the public hearing was closed. WESTCHESTER COUNTY UPDATE - George Latimer, Chairman, Board of Legislator Supervisor Price introduced.County Legislator George Latimer who then stated he appreciated being here to bring to the Town updates on all the activities happening at the County level. Here are a number of issues he reported on: 1. Agreement by the County on the Inflow and Infiltration Project which was made in September. Westchester County is going to be responsible for doing the construction work. 2 County has hired 2 new bond counsels, one being Wilkie Farr and Gallagher. 3. The County has decided not to opt into Westchester County's sales tax week. Shoppers will only receive the 4.2% state tax reduction. 4. He thanked LMCTV for covering the Board of Legislators meetings. 5. County Board will continue to look into earlier bar closings from 4:00 AM to 2:00 AM. 6. The County set November 7th, 1998 as Hazardous Waste Day at Playland Park. He stated that anyone who needed further information should call his office. Supervisor Price thanked George Latimer for coming and for referencing the Inflow and Infiltration Project. She mentioned that County Executive Andy Spano and the Westchester Municipal Officials Association worked very hard to achieve the desired result. A draft agreement has been worked out and a committee will be sitting down with technical people. Councilwoman Wiftner announced that the Town just received a grant for$50,000 for the Long Island Sound Intermunicipal Watershed Council which calls for a feasibility study of problems that can occur from correction of inflow. 2 October 21, 1998 BOARD OF FIRE COMMISSIONERS The meeting was called to order by Commissioner Price at 8:45 PM in the Court Room. Present were the following members of the Commission: PRESENT: Commissioner Price Commissioner Ryan Commissioner O'Keeffe Commissioner Wittner ABSENT: Commissioner Weprin 1. Fire Claims There were no fire claims submitted at this meeting. 2. FIRE REPORT FOR THE MONTH OF SEPTEMBER 1998 Commissioner Ryan read the following Fire Report. This report outlines responses to calls made during the month of SEPTEMBER 1998. It summarizes the nature and origin of calls, the number of men responding and the total times spent at fire calls. AFFAIRS OF THE TOWN 1. Appointments - Planning Board Cable TV Control Board and Advisory Committee The Planning Board appointment was held over. Cable TV Control Board and Advisory Committee On motion of Councilwoman Wittner, seconded by Councilman Ryan, it was unanimously, RESOLVED, that William Littauer is hereby reappointed as a member of the Larch mont/Mamaroneck Cable TV Control Board 3 October 21, 1998 and Advisory Committee, to serve a term of office of two years, effective immediately, terminating on November 2000. 2. Submission of 1999 Tentative Town Budget Town Budget Officer, Steve Altieri presented the Tentative Budget for 1999. He said that the total budget amount is $19,413,230 with a $12,393,905 tax levy. Expenditures will increase by$616,690, and he recommended that there be no tax increase for 1999, for either the Town or the Villages of Larchmont and Mamaroneck. He continued that there would be no reduction in services and that copies of the budget document would be available in the Town Clerk's Office. Supervisor Price stated that "zero" was a great number to work with. She invited all residents to attend budget meetings and that she and Mr.Altieri would be happy to attend any Homeowners'Association meetings. Supervisor Price then read the dates of the Budget Calendar and the Board made changes on times and cancelled one meeting. Authorization - Inter-Municipal Agreement-Village of Larchmont Mr. Altieri explained the reason for this agreement was at the request of the Village of Larchmont who were renovating the Larchmont Village Hall which would begin soon. There was one area of the building that could not be brought into compliance with ADA law and that is the jail cells. Authorization was therefore being requested to allow the Village to use the Town's jail cells for disabled detainees. The Town's cells are handicapped accessible. The Village would provide appropriate supervision and assume all expenses related to the care of the detainees. On motion of Councilman Ryan, seconded by Councilwoman Wittner it was unanimously, RESOLVED, that the Town Board does hereby authorize entering into an Inter-Municipal Agreement with the Village of Larchmont for use of 4 October 21, 1998 the Town's ADA accessible jail cell at any time the Village is in need of such a cell; and BE IT FURTHER RESOLVED, that all costs are to be paid by the Village of Larchmont including indemnifying and defending any claims incurred against the Town; and BE IT FURTHER RESOLVED, that the Town Board authorizes the Town Administrator to execute the above-said agreement on behalf of the Town. 4. Salary Authorization - Recreation On motion by Councilman Ryan, seconded by Councilwoman Wittner it was unanimously, RESOLVED, that as provided for in the 1998 Town Budget, the Town Board does hereby authorize the payment of salary to the following: Ryan Clinton, Life Guard, Hommocks Pool, $6.75/hour, effective retroactive to 10/6/98. Cathy Cilento, instructor,Women's Fitness, $60/session, effective retroactive to 1015/98. Sarah Lanza, Instructor, Women's Fitness&Aqua Jog, $45/session, effective retroactive to 1015/98. Christine Pollak, Assistant Swim Team Coach, $4,000/season. Eli Graham, Swim Instructor, Hommocks Pool, $12/session, effective 10/18/98. Ana Barron, Cashier, Hommocks Park Ice Rink, $9/hour, effective retroactive to 10/2198. Differ Barron, Skate Guard, Hommocks Park Ice Rink , $7.50/hour, effective retroactive to 10/2/98. WRITTEN COMMUNICATIONS Supervisor Price read a letter from Mr. Stewart MacGregory of 122 West Brookside Drive, Town of Mamaroneck, who in his letter praised the Highway Department for the excellent job they did on restoring the crumbling wall of the Brook: Ms. Elaine Price Town Supervisor Town Center 740 W. Boston Post Rd. Mamaroneck, NY 10543-3319 Dear Elaine: When I met with you and Steve Altied on August 61 and we surveyed the crumbling wall,it concerned me greatly,as I thought there would be great construction work to get the wall back into shape. The Highway Department went to work immediately. Work progressed and now we have a sturdy fortification replacing the worn out sections. Crews were there every day making the tumble-down appearance disappear. Now we have a great and sturdy wall. All of us on Brookside Drive,East were so pleased with everything that was accomplished. What a splendid crew the Town has as members of the Highway Department. 5 October 21, 1998 With some apprehension,as there is always the chance of leaving out some of the personnel-I am going to live dangerously and jot down some of the gentlemen who comprised the working crew. Right away the first day-the tree drew arrived and AL CIRILLO,KEVIN LEDDY and RONNIE REEDY cleared all of the trees that were growing out of the walls of the brook(the Sheldrake River). The first contingent of the re-construction crew arrived and started on the repairs to the stone work. There was JOHN BARETO, STEPHEN DI FIORE, JOHN BIANCO and JOHN PHILLIPSON. Later on JOHN BIANCO and JAMES GUIONE joined the crew. Later there was a crew that worked on the big section of wall near the bridge at Lansdowne. TONY BONANO,LARRY LANCIA and JOE TUNNO were added. Then one day when a section of the black top had to be replaced near the edge of the wall JOHN BIANCO and three men mentioned above came with equipment to cut out the outline of the old black-top to make space to add new macadam and that crew came with a roller and the area cut out was filled with binder and new black-top and rolled to a smooth surface. The Highway Department Foreman Joe* (now I go blank arrived numerous times during the month to check the progress. All the crew members seemed to take pride in repairing the tumble down section. I probably have missed some names,but everyone including a few I did not know would stop by to leave off materials etc. Everyone should know what a great job was accomplished,and I wanted you and Steve to know that everything was handled in "apple-pie"condition. One day in talking with the foreman Joe * (still having a loss of memory) or a "Senior moment';I told him that I wanted to get the names of the crew members. His answer was "then you'll have to say the entire Highway Department" That's true to be sure,but I know that some members whose names I am familiar with were on other assignments for the Department. If I have inadvertently left off the names of anyone-let me know and I write an addendum to the letter. My hat is off to the entire Highway Department for a tough job, very well done. And to you,Elaine,and Steve-for all your help. Sincerely, Stewart MacGregory *Joe's full name is Joseph Paterno, who is a long-time employee of the Town. SUPERVISOR REPORTS Supervisor Price stated she was misquoted in an article in last week's paper regarding reassessments. She went on to explain that a reporter had taken a story done previously and combined it with his new story. She regretted it had been published because it erroneously compared a Town and Village of Larchmont house assessment and she had never made this comparison. Safe Rides was using our Community Room and now they are using the Rollerdome. The Supervisor stressed what an important organization it is. Judy Myers, Barnard Road, thanked the Board for giving Safe Rides the space. ORAL COMMUNICATIONS 6 October 21, 1998 Ernie Odierna came into the meeting and immediately got up to speak. He wanted to know if a decision had been made with recycling on Wednesdays during holiday a week. Mr. Altieri answered that this was being looked into. He asked again about a Code Enforcement Officer. COUNCIL REPORTS Councilman Ryan commented on the dedication of the new locker rooms at the Hommocks Park Ice Rink and the new Zamboni machine. He stated that everyone will benefit from the improvements. Councilwoman O'Keeffe added that Town can be proud of it. PROCLAMATIONS -School Recognition Week - United Nations Week Supervisor Price summarized the two proclamations. PROCLAMATION SCHOOL RECOGNITION WEEK WHEREAS, the members of New York's local school boards are an invaluable resource as local decision makers; they respond to the respective needs of their communities, serving the interests of schoolchildren and preparing them for the future; and WHEREAS, the men and women serving the people of the Empire State as members of school boards devote many hours of service to public education and continually strive for improvement, quality and progress in education; and WHEREAS, members of local boards of education throughout New York State merit recognition and commendation for their dedicated service to the people and children of our State;it is fining to support this annual celebration. NOW THEREFORE, BE IT RESOLVED, that 1, Elaine Price, Supervisor of the Town of Mamaroneck and the Town Board members hereby proclaim the week of October 261 through October 301h, 1998 to be SCHOOL BOARD RECOGNITION WEEK PROCLAMATION UNITED NATIONS WEEK WHEREAS, 1998 is the fiftieth anniversary of the adoption of the Universal Declaration of Human Rights, drafted by the first United Nations Human Rights Commission, chaired by Eleanor Roosevelt; and WHEREAS, the United States was one of the founding members of the United Nations, and continues to be a leader In supporting democratic values, including the rights of citizens of all countries; and 7 October 21, 1998 WHEREAS, if the United Nations is to continue its important work of advancing human rights,protecting the environment,preventing and resolving conflict and promoting human and democratic values; it must have support from both the United States government and American citizens. NOW THEREFORE, BE IT RESOLVED, that 1, Elaine Price, Supervisor of the Town of Mamaroneck and the Town Board members hereby proclaim the week of October 18', 1998 as UNITED NATIONS WEEK APPROVAL OF MINUTES -September 16, 1998 On motion by Councilwoman Wittner, seconded by Councilman Ryan the minutes were accepted with corrections as noted. RESOLVED, that the Town Board does hereby approve the Board minutes from the meetings of September 16, 1998, as amended.
