Supervisor 3urton Justices Howell and Leeds Town Clerk Sherman Counsellor Gamble Upon motion, duly seconded, it i%ras voted to dispense with the reading of the minutes of meetings not yet approved. The Clerk presented the claim of iathaniel Baker for certain damages sustained by his car due to the condition -of the roadway in Harmon Drive. In view of the fact that it was uncertain as to whether the damage was caused within the jurisdiction of the Town of Lamaroneck or the village of I;Iamaroneck, the matter was referred to "Counsellor Gamble for his attention. A communication from lIr. Silas S. Clark was received and read requesting the cancellation of certain taxes upon property designated as section 99 block 54, lots 19 and 20. The communication was ordered received, placed on file ---- and referred to Counsellor Gamble for his report thereon. Justice Leeds reported in accordance with instructions from Supervisor Burton, he had attended vith Counsellor Gagliardi, the session of the legislature at ylbany in the interest of local legislation. Upon the Supervisor's recommendation, upon motion, duly seconded, it :.r as R9,301ED, that the expenses incurred by Justice Leeds and Counsellor 'Gagliardi, for attending the session of legislature at Albany, Y. , be and the sa.,.e hereby are made proper Town charSes, and the Board of auditors are requested. to audit the same upon the presentation of a proper claim therefor. Judge Leeds advised the Board that the Village of Larcnmont was about to construct on its '=rater ',`forks property adjacent to the reservoir a new filtration _olant and it had intended to construct rl- <-�,:nc within � '-,r f �`i tir Rochelle but that due t0 the in- ability�.,_. .. _ �h_n t�_e Gi �„ o _ e agility to obtain a proper foundation therefor, it had been found necessary to change the proposed location to a point which was within the Town of Yamaroneck that plans for same had been filed with tine - - Building Commission but that inasmuch as the property was zoned under the ]onina Ordinance a m s Residential A, the Building Comission tivould be unable to grant the necessary permit therefor.. He further stated that as the Board of Trustees were about to let the contract, they were anxious if y)ossible to have action taken by the Totem Board to expedite the granting of the permit. Supervisor Burton stated that he believed that inasmuch as tne -j�raperty in question was owned by ' he illags of Larchmont, as well as the contiguous property, as and for a municipal and public utility =purpose , to wit-. reservoirs and water wor'_vs property, and as the proposed filtration plant was located along side of the reservoir and at such a distance •rvresterly of Weaver Street that it could not i b L 7 be seen from the road, he believed action should be taken immediate- ly by this Board to authorize the granting of the necessary permit and to cooperate with the village of Larchmont to as great an extent as possible, they having complied wit'n the Building Ordinances and filed the necessary application and other papers therefor. Upon motion, duly seconded, it wras RESOLVED, W=—R AS, the village of Larchmont owns certain pro-perty within the Town of "iamaroneck lying.between the westerly side of 'leaver Street and the boundary 'line between the Town of TtTamaronecic and the City of ATew Rochelle mown as its 'aIater "Yorks property, which property is used by said Village of LarcPunont for a municipal and public utility purpose , to wit ; for its reservoirs , dams and accessories and constituting its -edater ':Yorks property, and maw^ the Village of Larchmont have riled tid'r�_�xS, with the Building Co=ission of the Town of :Tamaronecli plans and specifications for the construction of a new filtration plant on its said property contiguous toits reservoir and has endeavored to comply with said Ordinance of the Town of Pdamaroneck, and ' HFITAS, the Building Commission of tine Town of 1-7ameroneck is unable without the action of this Board to grant a permit for the construction of said filtration plant because said property on which it is proposed to erect the same is zoned under the Zoning Ordinance of the Torn of Idamaroneck as Residential A, and dHORTHAS, the _purpose for which -he property is to -be used is a municipal purposes therefore be it RESOLVED, that the Building Commission of the Town of IYamaroneck be and they hereby are authorized, empowered and directed to grant to the Village of Larclanont, a perrait to erect a filtration plant on its water works property located between the westerly side of Weaver Street and the boundary line between the Town of '1_`amaroneck and the City of TIew Rochelle at the location and in the -manner and in 'accordance with Application T-o. 1328 and plans and specifications accompanying the same , _provided said application, plans and specifications comply with the Building Ordinames of the Town of Lamaroneck, in all- particulars except those prov- isions of the 3uilding Code which may provide for compliance with the Zoning Ordinances of the Town of -Mamaroneck. as to location and use , which the yuilding co-_rmfiission is herein empowered to except therefrom. A communication from the Weaver Street spire Co. , was received and read, enclosing therein, a list of the active member- --- ship of tae 'Deaver Street =ii°e Co The communication was ordered received zx± placed on file , and upon motion, duly seconded, it was RE>SO- D, that the list of active ;members of tine ',ieaver Street Fire Company, be and the same hereby is ratified, approved and ordered placed on file.
