MINUTES OF THE REGULAR MEETING AND WORK SESSION OF THE TOWN BOARD OF
THE TOWN OF MAMARONECK HELD AUGUST 19, 2020 BEGINNING AT 4:30 PM.
PURSUANT TO THE GOVERNOR’S EXECUTIVE ORDER NO. 202.1, SUSPENSION OF LAW
ALLOWING THE ATTENDANCE OF MEETINGS TELEPHONICALLY OR OTHER SIMILAR
SERVICE:
Article 7 of the Public Officers Law, to the extent necessary to permit any public body to meet
and take such actions authorized by the law without permitting in public in-person access to
meetings and authorizing such meetings to be held remotely by conference call or similar
service, provided that the public has the ability to view or listen to such proceeding and that
such meetings are recorded and later transcribed;

On motion of Councilwoman Elkind Eney, seconded by Councilwoman Fiddelman, the Work Session was
unanimously opened at 4:30 p.m.
TAKEN OUT OF ORDER
Proposed Delinquent Tax Law
The Town Attorney, William Maker, explained that this proposed law will extend the length of installment
agreements for back taxes to a maximum of thirty-six months. Additionally, the Town Board set a 15% (the
minimum required by NYS) down payment. This was added to the regular agenda to set a public hearing for
September 9, 2020.
On motion of Councilwoman Elkind Eney, seconded by Councilwoman Katz, the Board unanimously agreed
to enter into an Executive Session to discuss candidates for various Boards and Commissions.

On motion of Councilwoman Elkind Eney, seconded by Councilman King, the Board unanimously agreed to
resume the Regular Meeting.
Communication Sustainability Collaborative - Leaf Blower Law
The Town Board reviewed a memorandum from the Sustainability Collaborative outlining recommended
steps to amend the Leaf Blower Law. Supervisor Seligson asked Councilman King to comment since he is
the liaison to the Sustainability Collaborative. Councilman King stated that these recommendations also
stem from discussions within the Village of Larchmont. The Village of Larchmont passed a resolution calling
for a total ban by 2022. The Village of Larchmont will begin a campaign to encourage landscapers to move
toward non gas fired equipment, as well as offer training to landscapers. Councilman King continued,

stating there are obstacles, such as added costs to the landscapers, as well as unknowns about the
efficiency of the electric equipment. The goal is to have consistent legislation throughout the three
communities. Supervisor Seligson asked the Board Members to consider questions for the Sustainability
Committee.
Amendment to the Rock Removal Law
Supervisor Seligson asked Mr. Altieri to explain the latest draft, specifically the 15 days of total rock
removal, and the suggested inclusion of drilling into those 15 days. The Town Board noted that residents’
are confused in the difference between drilling and chipping. The Town Board reviewed the comments
received. It was noted that this discussion is the beginning of a discussion of amending the Floor Area
Ration (FAR) law.
Set Public Hearing – “Drone Law”
There was not discussion. Setting of the Public Hearing is on the regular agenda for this evening
Racial Equality Task Force
Councilman King noted that the Task Force was not able to meet last week, but are confirmed to meet on
August 24. Councilman King is working on clarifying the role of the Town prior to the next meeting. The
members of the task force in preparation for their upcoming meeting are reading the Obama report. The
Town Board will need to consider how much involvement they would like, specifically with respect to
Executive Order 203. Councilman King will have more to report at the next Town Board meeting.
Financial Update
The Town Board reviewed a Fiscal Year 2020 Budget Projection Update, dated August 19, 2020.
Mr. Altieri noted that these financials do not include figures from the most recent storm. The Town
submitted a claim for $540,000, to the insurance company for costs related to storm damage to the
highway sign building.

to AIM and CHIPS funding.
Mr. Altieri reported that the Town Department Heads have received their 2021 Budget Worksheets and are
being asked to prepare Capital Budgets based on a non COVID environment. Operating Budgets are to
assume the Pandemic, at least through the first six months of 2021. Councilwoman Katz emphasized she
would like to see more remote access to municipal functions in the 2021 Budget.
New Business
Supervisor Seligson stated that due to concerns for safety, the Town will not hold a September 11
commemorative event. A Town resident has suggested we come together and take part in a lighting
ceremony where residents’ shine a light into the sky at 7:30pm.
On motion of Councilwoman Elkind Eney, seconded by Councilwoman Katz, the Board unanimously agreed
to enter into an Executive Session to discuss the employee history of a particular individual within the
Administrator’s Office and litigation with Save the Sound.

CALL TO ORDER - REGULAR MEETING
The Regular Meeting of the Town Board was called to order by Supervisor Seligson at
8:15 p.m.
Supervisor Seligson noted that the Town Board met for a worksession beginning at four thirty this evening.
SUPERVISOR’S SUMMARY REPORT
It has been an eventful month since our last Town Board meeting in July. Storm Isaias was a doozy. If
thth
you did not hear from me every day from August 5 to August 13 then we do not have your contact
information. We cannot reach you in an outage if you have not given us your cell phone number and
email address. Please go to the Town website, www.townofmamaroneckny.org and go to the red
Swift 911 button to input your cell phone number and email address.
The Town and the entire County were severely impacted by Storm Isaias with 75% of the Town
without power on the night of the storm. Con Ed is the utility responsible for the electric service in the
Town. Altice/Optimum is one of the internet and cable providers in the Town. No one was pleased
with the utilities response to the storm.
We participated in daily conference calls with Con Ed and, finally a week later, with Altice/Optimum
too, advocating for service restoration for our residents. I know how frustrating and distressing it is
to lose power because I also lost power for 5 days. It took too long for Con Ed to restore power to
Town residents and to all residents of Westchester County. The Public Service Commission of NYS
manages the utility companies in the state. The state legislature is holding a hearing regarding the
response of Con Ed and the telecom companies to Storm Isaias tomorrow. I compiled all the emails I
received from upset residents and presented a package of them to our state representatives,
Assemblyman Steve Otis and Senator Shelly Mayer as well as to the chair of the PSC, John X to
become part of the record. Please know that Town staff and officials worked seven days a week
following the storm to clear roads, pick up debris, and advocate for power restoration. We continue
to work with Altice/Optimum to push them to restore service to everyone. We also continue to work
with Con Ed on lingering power issues.
Despite the storm, there are other issues to report as well. The Town had a ratings meeting with
Moody’s Financial Services in advance of bond issuances and I am pleased to report that the Town
maintained its Aaa rating. As a result of our top rating, we received an interest rate of 1.1% for the
new bonds. That is an astoundingly low interest rate.
The Town Board held a meeting last week to interview candidates for openings on Town volunteer
boards and commissions. We interviewed six people and another two tonight during the work
session. The Town Board meeting was public, of course, but the interviews were conducted in
executive session as they are personnel matters.
I hope the next few weeks will be quieter and easier for everyone.
PUBLIC HEARING – “2020 Revision of the Mechanical Rock Removal” Law
The following Notice of Public Hearing is entered into the record as follows:
NOTICE OF PUBLIC HEARING
LEGAL NOTICE IS HEREBY GIVEN that pursuant to Section 130 of the Town Law of the State of New York, and
further pursuant to Executive Order No. 202.1 Suspension of Article 7 Public Officers Law, and pursuant to a
motion by the Town Board on July 15, 2020 this Public Hearing will be adjourned until Wednesday August
19, 2020 at 7:30 PM or as soon thereafter as is possible, telephonically from the Town Center, 740 W. Boston
Post Road, Mamaroneck, New York to consider, “2020 Revision of the Mechanical Rock Removal” Law.
Purpose:
The Town Board continues to monitor the impact of mechanical rock removal upon the health, safety and
welfare of the Town’s residents with a goal of balancing people’s right to develop their properties with a
neighborhood’s right to tranquility, to the extent possible. Among the concerns that have arisen are the
need to mitigate the spread of dust and other particulates during both the hammering of rock and its removal
from the site, and the need to decrease the number of hours per day when mechanical rock removal may
take place. Another concern is that on those occasions when the rock to be removed is more difficult to
break than could have been reasonably anticipated or when there are mechanical difficulties in the
operation, the developer must redouble its efforts since the 15-day life span of a rock removal permit
continues unabated. This additional effort has created situations where disturbance to peace and quiet is
exacerbated. The disruption in everyday life should be decreased if a developer is permitted to suspend the
rock removal permit in order to replace broken equipment, adjust to weather conditions, or to utilize

different modes for removing rock, such as drilling before hammering, while still allowing only 15 working
days of mechanical rock removal. This revision in the law furthers the goal.

On motion of Councilwoman Fiddelman, seconded by Councilwoman Elkind Eney, the Public Hearing was
unanimously opened.
Supervisor Seligson stated that this is the third public hearing regarding revisions to the rock removal law.
The Town Board has worked hard and heard from many residents regarding issues they have experienced
and suggested changes. Mr. Altieri gave a history of the revisions, outlining where the amendment
currently stands.
Supervisor Seligson asked Lindsey Luft, who is manning the emails for this evening’s public hearing, if she
has received any comments. Ms. Luft replied yes, and then proceeded to read emails from Maria
Michaels, Cordelia Derhammer-Hill and Christopher Derhammer-Hill.
Supervisor Seligson noted that the Town will adjourn this hearing and will issue an updated revision for
discussion on September 9.
On motion of Councilwoman Elkind Eney, seconded by Councilwoman Fiddelman, the Public Hearing was
unanimously adjourned until September 9, 2020.
CITIZEN’S COMMENTS
Supervisor Seligson asked Lyndsey Luft, who is manning the emails for this evening’s public comments, if
she has received any emails. Ms. Luft read an email from Patina Hahn, a rising Mamaroneck High School
Senior, and Catlin Carpenter, a Mamaroneck High School Junior, who are working to oppose the
Danskammer Power Plant, proposed to be built in Newburgh, New York. These comments also included a
proposed resolution in opposition. Supervisor Seligson responded that the Town Board would like to
review the proposed resolution and consider placing it on the next Town Board agenda.

4. Set Public Hearing – “Prohibition on Flying Drones near the Winged Foot Golf Club for ten days
during September of 2020” Law.
On motion of Councilwoman Elkind Eney, seconded by Councilman King, it was unanimously
RESOLVED, that the Mamaroneck Town Board does hereby set the date for a Public
Hearing on the “Prohibition on Flying Drones near the Winged Foot Golf Club for ten
days during September of 2020” Law, for September 9, 2020 at 8:00 p.m. at the Town
Center, 740 West Boston Post Road, and
BE IT FURTHER,
RESOLVED, that the Town Clerk is hereby authorized to publish the notice of said
hearing in a newspaper appointed as an official newspaper, and that said Notice, be
posted.
5. Authorization – IMA – Village of Mamaroneck Sewer Truck/Sewer Inspection
On motion of Councilwoman Fiddelman, seconded by Councilwoman Elkind Eney, it was
RESOLVED, that the Mamaroneck Town Board does hereby approve the Intermunicipal Agreement
between the Town of Mamaroneck and the Village of Mamaroneck for a shared service agreement
in connection with the purchase of a sewer television truck and the inspection of municipal sewers,
and
BE IT, FURTHER
RESOLVED, that the Town Administrator is hereby authorized to execute said agreement on behalf
of the Town.

6. Resolution – Adoption of New York State Retention Schedule LGS-1
On motion of Councilwoman Elkind Eney, seconded by Councilman King, the following was approved,
WHEREAS, on April 5, 1989, the Town of Mamaroneck adopted the New
York State Local Government Records Retention and Disposition Schedule (MU- 1) to be
implemented for Town use as the official records management tool for records retention and
disposition, and
WHEREAS, in August of 2020, New York State created a new records retention schedule titled the
Retention and Disposition Schedule for New York Local Government Records (LGS-1), issued
pursuant to Article 57-A of the Arts and Cultural Affairs Law, and containing legal minimum
retention periods for local government records.
NOW THEREFORE, BE IT

RESOLVED, that the Mamaroneck Town Board does hereby adopted for use by all officers and Town
employees in legally retaining and properly disposing of Town records, and

RESOLVED, that in accordance with Article 57-A: (a) only those records will be disposed of that are
described in Retention and Disposition Schedule for New York Local Government Records (LGS-1),
after they have met the minimum retention periods described therein; (b) are being retained
longer than described per authorization of the records management Officer; (c) only those records
will be disposed of that do not have sufficient administrative, fiscal, legal, or historical value to
merit retention beyond established legal minimum periods.

Understanding between the Town of Mamaroneck and Sustainable Westchester, Inc., to

10. Appointment – Assistant Court Clerk
On motion of Councilwoman Katz, seconded by Councilwoman Fiddelman, it was
RESOLVED, that the Mamaroneck Town Board does hereby appoint Dominique Patterson to
the full-time position of Assistant Court Clerk at an annual salary of $61,210, effective August
20, 2020.

11. Set Public Hearing – “Increasing the Installment Period for Paying Delinquent Taxes” Law
On motion of Councilwoman Elkind Eney, seconded by Councilwoman Fiddelman, it was unanimously
RESOLVED, that the Mamaroneck Town Board does hereby set the date for a Public
Hearing on “Increasing the Installment Period for Paying Delinquent Taxes” Law, for
September 9, 2020 at 8:00 p.m. at the Town Center, 740 West Boston Post Road, and
BE IT FURTHER,
RESOLVED, that the Town Clerk is hereby authorized to publish the notice of said
hearing in a newspaper appointed as an official newspaper, and that said Notice, be
posted.
12. Authorization – Appointment of Interim Town Administrator
On motion of Councilwoman Elkind Eney, seconded by Councilwoman Fiddelman, the following was
approved,
WHEREAS, the Town Administrator Stephen Altieri is retiring from Town effective August 29,
2020 after 38 years of faithful service to the Town as its Town Administrator; and
WHEREAS, the Town Board has determined that a true need exists for an Interim Town
Administrator until a successor Town Administrator is appointed by the Board; and
WHEREAS, the Town Board has determined that Mr. Altieri is best qualified to carry out the
duties of the Interim Town Administrator; and
NOW, THEREFORE, BE IT
RESOLVED, that, effective August 31, 2020, the Board authorizes the hiring of Stephen Altieri
at the gross biweekly rate of $7,340 inclusive of paid holidays, sick leave, vacation and other
paid time off consistent with Town policies; and be it

FURTHER RESOLVED, that the Town Supervisor is directed to execute and take all actions
necessary to effect the hiring of Mr. Altieri as Interim Town Administrator consistent with this
resolution.

the Board Minutes from the meeting of July 15, 2020.
REPORT OF COUNCIL
The Town Board Members reported on their various activities and meetings since the last Town Board
Meeting.
ADJOURNMENT
Supervisor Seligson closed the meeting in memory of Ray Bingman. Ray was the former Comptroller for the
Town. Our condolences go out to his family.
On motion of Councilwoman Katz, seconded by Councilwoman Fiddelman, the meeting was unanimously
adjourned at 10:00 p.m.
