MINUTES OF THE REGULAR MEETING AND WORK SESSION OF THE TOWN BOARD OF
THE TOWN OF MAMARONECK HELD SEPTEMBER 23, 2020 BEGINNING AT 5:00 PM.
PURSUANT TO THE GOVERNOR’S EXECUTIVE ORDER NO. 202.1, SUSPENSION OF LAW
ALLOWING THE ATTENDANCE OF MEETINGS TELEPHONICALLY OR OTHER SIMILAR
SERVICE:
Article 7 of the Public Officers Law, to the extent necessary to permit any public body to meet
and take such actions authorized by the law without permitting in public in-person access to
meetings and authorizing such meetings to be held remotely by conference call or similar
service, provided that the public has the ability to view or listen to such proceeding and that
such meetings are recorded and later transcribed;

CALL TO ORDER - WORK SESSION

On motion of Councilwoman Elkind Eney, seconded by Councilman King, the Work Session was
unanimously opened at 5:00 p.m.
Rock Removal Law / Rock Removal Moratorium
Supervisor Seligson stated that many residents are calling for a moratorium on rock removal while the
Town is addressing amendments to the law; especially while adults are still working from home and
students are doing a blend of in school and school on line. It was noted that there is a pending permit for
5 York Road, but it is for a new driveway and should not be as extensive.
On motion of Councilwoman Fiddelman, seconded by Councilwoman Katz, to enter into a closed session to
receive advice of Counsel.
On motion of Councilwoman Katz, seconded by Councilwoman Elkind Eney, the Town Board reconvened
the Worksession.
The Town Board continued their discussion of a moratorium on rock removal, determining it should be
until January 1, 2021. This can be accomplished initially through the Supervisor’s powers under the State of
Emergency. Mr. Maker will research if, moving forward, it should be done by local law or by resolution.
The Town Board returned to the amendments to the law, specifically, the concept of a monitor. The Town
Board discussed what the qualifications would be required of this individual and who would select the
individual and pay the cost. The Town Board asked that the resting period between permits in a similar
neighborhood be 60 days and not 45. There was a lengthy discussion of the Saturday exemption for what is
being referred to as the ‘weekend warrior’. It was determined that this exemption did not accomplish what
the Town Board had intended and it will be removed.
Cellular Tower Moratorium
The Town Board reviewed the Town of Mamaroneck Sustainability Collaborative’s response to the Town
Planning Board with respect to the proposed cell tower at Bonnie Briar Golf Club. There is currently an
application before the Planning Board by Bonnie Briar Golf Club. There was discussion of a moratorium.

On motion of Councilwoman Elkind Eney, seconded by Councilman King, to enter into a closed session to
receive advice of Counsel.
On motion of Councilwoman Elkind Eney, seconded by Councilwoman Katz, the Town Board reconvened
the Worksession.
The Board continued their discussion of the cell tower. Supervisor Seligson recapped, stating that a
moratorium will not be put in place, and the Town Attorney has been instructed to review legislation, and
to speak with the attorney who is advising the Planning Board to possibly advise the Town Board in
drafting legislation. Supervisor Seligson will speak with Mitch Green and thank him for the Collaborative’s
response.
Supervisor Seligson will speak with Ralph Engel to let him know of the Town Board’s interest in what
knowledge the Planning Board is receiving from their consultant.
Racial Equity Task Force
Councilman King reported that the Task Force met and is beginning their work. They are working on a
mission statement, as well as what their designation will be, and the possibility of forming an advisory
board to the Town for a voice with respect to policing. The aim would be to increase the level of
cooperation between the community and the Police. The Task Force is working on a format to reach out to
the community whether it be in email or an open forum. They would also like to increase their members;
currently they have four to five members. Councilman King is speaking with Wade Hardy of the
Westchester-Rockland Guardian Association and Damon K. Jones, co-owner of BlackWestchester.com.
Damon K. Jones is also the New York Representative of Blacks in Law Enforcement of America. The Town
Board discussed whether the Villages had formed tasks forces and the benefits of Town and Village
cooperation especially for an open forum. The Town Board will continue to receive updates from
Councilman King.
Intermunicipal Agreement (IMA) Village of Mamaroneck – Hommocks Road Sanitary Sewer
The Town Board reviewed a detailed memo from Mr. Altieri, as well as the IMA, specifically,
“the proposed inter-municipal agreement with the Village of Mamaroneck concerning the construction of a
new sanitary sewer line on Hommocks Road. A resident at 203 Hommocks Road in the Village of
Mamaroneck wishes to abandon the septic system currently at the home and construct a sanitary sewer.
The new sewer line would be located primarily in the Village of Mamaroneck and connect to a Town sewer
line at the intersection of Eagle Knolls Road and Hommocks Road.” The resident of 203 Hommocks Road
would pay the cost. Supervisor Seligson noted that any change from septic is a huge benefit to the
environment. Mr. Altieri noted that the homeowners will be required to install macerators as well as
generators. The Village of Mamaroneck approved the IMA at their meeting the previous Monday evening.
Budget Administration Policy
The Town Board reviewed the proposed policy for the preparation and administration of the Town Budget,
including guidelines for transfers of funds for the operating and capital budgets. The approval of the policy
is on the regular agenda for this evening.
Westchester County Mobility Focus Group
The Town Board was informed that the Supervisor and Town Administrator have been invited to
participate in a focus group sponsored by the County of Westchester to participate in looking at new trends
in transportation. Supervisor Seligson asked the Town Board if they would have any concepts that she
should bring back to the focus group.
Affordable Housing/Floor Area Ratio Review
The Town Board reviewed a memo from Mr. Altieri, dated September 18, addressing affordable housing
with respect to the Comprehensive Plan and Floor Area Ratio. Norma Drummond of the Westchester
County Planning Commission will be coming to an October Town Board meeting to bring the Town up to
date on the Housing Settlement.

New Business
Councilwoman Katz reported on the recent meeting of the LMC Media Board of Control. LMC Media had
previously engaged Susan Buske for community outreach and a comprehensive plan. Discussions have
taken place with Ms. Buske to help explain the franchise agreement negotiation process. Councilwoman
Katz briefed the Town Board on details of LMC Media’s meeting with Ms. Buske.
Supervisor Seligson gave an update on the recent Sanitation Commission meeting. Supervisor Seligson
stated that the Village of Larchmont Mayor, Lorraine Walsh would like to take the three scenarios created
by Mr. Altieri and apply them to the Village budget. Supervisor Seligson made it clear to the Village that the
Town did not agree with the apportionment concept for the Village’s budgeting. They discussed curbside
pickup, with some form of exemption. This would require a local law. A local law will be drafted with a joint
public hearing. Mr. Altieri elaborated on the shortfall being created by the Village’s apportionment concept
and how that could be addressed.
Supervisor Seligson gave an update on the Westchester Joint Water Works. They are currently working
through the SEQR process with respect to the UV Treatment and the Filtration Plant. The Harrison Planning
Board has not been responsive to questions being addressed in the SEQR process.
Councilwoman Elkind Eney reported on the United Westchester Committee, of which she is a member of
the Executive Board. The committee formed after the abysmal response by Con Ed and NYSEG to the
storms of March 2018. The committee has been revitalized by Assemblywoman Amy Paulin to address the
current response to Storm Isaias. Assemblywoman Paulin has divided the committee into sub committees
of which Councilwoman Elkind Eney is co-chair of the Con Ed committee as well the committee working
with the Westchester County of Emergency Management.
On motion of Councilwoman Elkind Eney, seconded by Councilwoman Fiddelman, the Board unanimously
agreed to enter into an Executive Session to discuss salaries and a license agreement.

On motion of Councilwoman Katz, seconded by Councilman King, the Board unanimously agreed to resume
the Regular Meeting.
CALL TO ORDER - REGULAR MEETING
The Regular Meeting of the Town Board was called to order by Supervisor Seligson at
8:00 p.m.
Supervisor Seligson noted that the Town Board met for a worksession beginning at five o’clock this
evening.
SUPERVISOR’S SUMMARY REPORT
The Town and County have been closely monitoring the 2020 Census response rates of residents.
I’m pleased to report that the Town has met one of its goals of reaching the 2010 Census
response rate of 73.9%. I ask the remaining 26% of residents who have not responded yet to
please join us in responding because our population numbers will determine our state and federal
funding aid and representation in Congress for the next ten years. To give you an idea of how
much money is at stake for our community, it 100 people do not respond and are not included in
the Census, the Town will lose $250,000 in aid. Please respond to the Census as soon as possible
as there is only one more week to fill out the information. You can go to the Town’s website to
get all the information you need to fill it out or you can call the Town offices at 381-7810 to get
assistance.
The US Open, held at Winged Foot Golf Club, concluded last Sunday and I’m pleased to say all
went very smoothly. Thank you to the Town Fire Department, Police Department and Ambulance

Corps for providing protection for the tournament. It was a very different event than originally
envisioned due to the Coronavirus precautions mandated by the NYS Department of Health. No
spectators were allowed which was very disappointing. I hope everyone got to see some of the
television or newspaper tournament coverage which highlighted Mamaroneck.
Congratulations to Village of Larchmont Mayor Lorraine Walsh, Trustee Bubba Fanelli and
th
Trustee Sarah Bauer who were all reelected in Village of Larchmont elections September 15.
The Town held its annual Fall Coastal Cleanup as part of International Coastal Cleanup Day this
past Saturday in Hommocks Conservation Area. Over 60 people participated, masked, staggered
and socially distanced of course. Volunteers picked up 190 pounds of material and cleaned up the
entire area. Volunteers keep track of what kind of material they pick up, which we then total and
send to the Ocean Conservancy for inclusion in a global effort to limit marine debris. Thank you to
Town staff Sue Odierna and Liz Aitchison for their work organizing and thank you to the students,
families, Lions Club members and residents who participated.
The Hommocks Ice Rink will open for limited use this week and we’re working with the
Mamaroneck School District to try to figure out how to open the Hommocks Pool.

York, and further pursuant to Executive Order No. 202.1 Suspension of Article 7 Public Officers Law,
and pursuant to a motion by the Town Board on September 9, 2020 this Public Hearing will be
adjourned until Wednesday September 23, 2020 at 8:00 PM or as soon thereafter as is possible, to
consider “2020 Revision of the Mechanical Rock Removal” Law, telephonically from the Town Center,
740 W. Boston Post Road, Mamaroneck, New York.

Purpose:
The Town Board continues to monitor the impact of pulverizing and removing rock by mechanical
means upon the health, safety and welfare of the Town’s residents with a goal of balancing people’s
right to develop their properties with a neighborhood’s right to tranquility, to the extent possible.
Among the concerns that have arisen are the need to mitigate the spread of dust and other particulates
during both from drilling and pulverizing rock and its removal from the site, and the need to decrease
the number of hours per day when such activities may take place. This revision in the law furthers the
goal.

Supervisor Seligson stated that the Town Board would like to enact a Moratorium on rock removal until
January 1, 2021. This will give the Community a break and give the Town time to refine the law. A
moratorium would not affect the permit currently on file.

CITIZEN’S COMMENTS
Lindsey Luft read an email from Elka Raved, representing the Larchmont Garden Civic Association. Her
comments were on basketball hoops in Town right-of-ways, curbside garbage pick up, trick or treat
protocols in Town and the Ragamuffin Parade.

Management Commission, and

2. Authorization – IMA Village of Mamaroneck – Hommocks Road Sewer

RESOLVED, that the Mamaroneck Town Board does hereby approve the Intermunicipal
Agreement between the Town of Mamaroneck and the Village of Mamaroneck,
concerning the construction of a new sanitary sewer line on Hommocks Road, per the
terms and details as outlined by the Town Administrator in his memo to the Town
Board on September 23, 2020, and

RESOLVED, that the Town Administrator is hereby authorized to execute said
Intermunicipal Agreement on behalf of the Town.

of Agreement between the Town of Mamaroneck and the Local 1000 Civil Service Employees
Association for the period January 1, 2021 through December 31, 2024, and

Town of Mamaroneck and the County of Westchester for an Unmet Needs with respect to the
contract for overserved transportation services that were provided under the Title III-B executed
contract.

8. Resolution – Amend Vehicle and Traffic § 219-44
On motion of Councilwoman Elkind Eney, seconded by Councilman King, the following was approved:
WHEREAS, the Town of Mamaroneck Vehicle and Traffic Chapter 219, § 219-44 stipulates that
from time to time by resolution or local law, the Town Board shall establish the fee, days, times
and methods of payment for permitted use of the parking lots.
NOW THEREFORE, BE IT
RESOLVED, that the Mamaroneck Town Board does hereby establish the following fees, days,
times and methods of payment for Town Lots A through G as follows:
Lot A - (i) a Daytime Parking Permit is established and required from June 1, 2020 through
December 31, 2021, for an annual fee of $900.00 per year (ii) a Meter Parking Permit is
established from June 1, 2020 through December 31, 2021 for a fee of $110.00 per year (iii) for
Meter Permit holders a meter fee of $.60 per hour is required Monday through Friday between
the hours of 5:00 am and 6:00 pm (iv) no parking is allowed from 3:00 am to 5:00 am Tuesday
through Thursday (v) no permit or fee is required beginning Fridays at 6:00pm until Sundays at
10:00 pm.
Lot B - (i) a 24 Hour Parking Permit is established and required from June 1, 2020 through
December 31, 2021 for an annual fee of $1,000. The Senior rate will end on Jan 1, 2021. (ii) 24
Hour Parking Permit holders may park 24 hours per day, 7 days per week, including all holidays
(iii) an Area Business Permit is established from June 1, 2020 through December 31, 2021 for an

annual fee of $700.00 per year (iv) Area Business Permits issued for Permit Numbers 20 and
above, may not park in Lot B during a severe storm event, as noticed by signs erected at Lot B.
Lot C - (i) an Overnight Parking Permit is established and required from June 1, 2020 through
December 31, 2021 for an annual fee of $450.00 per year (ii) Overnight Parking Permit holders
may park beginning at 7:30 pm Monday and must vacate the following morning by 7:30 am,
Monday through Thursday (iii) Parking is permitted weekends beginning at 7:30 pm on Friday and
ending Monday at 7:30 am.
Lot F (formerly Lot 7): (i) designated for Town of Mamaroneck Highway Employees and Larchmont
Mamaroneck Joint Garbage Disposal Commission Employees only (ii) parking is allowed at all
times.
Lot G (formerly Lot 8): RESERVED, and
BE IT, FURTHER,
RESOLVED, that Permits for Lots A through G may be refunded for a prorated amount, minus a
service fee of $25.00, and can be re sold from the Town Waitlist to a new resident for a prorated
amount, and
BE IT, FURTHER
RESOLVED, that the Mamaroneck Town Board does hereby establish (i) annual parking permits to
be issued semiannually (except for Meter Parking Permits) for a service fee of $35.00 (ii) a permit
may be reissued for a replacement fee of 10.00, and
BE IT, FURTHER
RESOLVED, that the Mamaroneck Town Board does hereby allow parking except when said Lots
are being, in whole or in part, closed for repairs, maintenance and/or improvement, upon
reasonable notice being given to the permit holders.

9. Set Public Hearing – Re-designation of Town Parking Lots
On motion Councilwoman Elkind Eney, seconded by Councilman King, it was unanimously
RESOLVED, that the Mamaroneck Town Board does hereby set the date for a Public
Hearing on an “Re-designation of Town Parking Lots” Law, for October 7, 2020 at 8:00
p.m. at the Town Center, 740 West Boston Post Road, and
BE IT FURTHER,
RESOLVED, that the Town Clerk is hereby authorized to publish the notice of said
hearing in a newspaper appointed as an official newspaper, and that said Notice, be
posted.

RESOLVED, that the Mamaroneck Town Board does hereby approve
the Board Minutes from the meeting of August 19, 2020.
