MINUTES OF THE REGULAR MEETING AND WORK SESSION OF THE TOWN BOARD OF
THE TOWN OF MAMARONECK HELD SEPTEMBER 9, 2020 BEGINNING AT 5:00 PM.
PURSUANT TO THE GOVERNOR’S EXECUTIVE ORDER NO. 202.1, SUSPENSION OF LAW
ALLOWING THE ATTENDANCE OF MEETINGS TELEPHONICALLY OR OTHER SIMILAR
SERVICE:
Article 7 of the Public Officers Law, to the extent necessary to permit any public body to
meet and take such actions authorized by the law without permitting in public in-person
access to meetings and authorizing such meetings to be held remotely by conference call or
similar service, provided that the public has the ability to view or listen to such proceeding
and that such meetings are recorded and later transcribed;

CALL TO ORDER - WORK SESSION
On motion of Councilwoman Elkind Eney, seconded by Councilwoman Fiddelman, the Work Session was
unanimously opened at 5:00 p.m.
Update – Hommocks Ice Rink
Mr. Altieri stated that the ice making equipment and generator has arrived. This equipment is needed due
to the existing chiller breakdown. The Town is working on the agreement with the Mamaroneck Youth
Hockey Association (MYHA) for a rental agreement for use of the Hommocks Ice Rink. As the single largest
user of the Hommocks Ice Rink, an agreement with MYHA will ensure the Town receives sufficient funds
to cover the current expenses to open the rink.
With respect to the chiller that is not functioning, Councilman King asked if a warranty might apply. Mr.
Altieri replied that all the parties are involved, including the insurance company due to the oddness of the
breakdown after only six years.
Review – Rock Removal Law
The Town Board reviewed the latest revision to the law in preparation for this evening’s public hearing.
This review included a memo from the Town Attorney outlining the significant revisions. The Town
emphasized the importance of disallowing consecutive permits with no rest period in between in the same
neighborhood and discussed distance and time frame. Additionally, the Town Board noted that the
Town’s Floor Area Ratio Law (FAR) is pertinent in these discussions. Mr. Maker stated that simply adding
basements to the FAR would have an impact on chipping.
Update – Sanitation Commission
The Town Board reviewed a memo from Mr. Altieri outlining the current configuration of the Commission
and three scenarios for change. Mr. Altieri noted that the “catalyst for this review was the Village’s
decision to budget their share of the Commission’s 2020 budget based upon the ratio of assessments
between the Town and Village. The ratio is 60% Town and 40% Village.” Mr. Altieri provided a Comparison
of Sanitation Service Alternatives, which included scenarios for 1) the current garbage district budget 2)
the creation of a Town Sanitation Department 3) the expansion of the Town Garbage District into the
Village of Larchmont.

Parking Permit Changes
The Town Clerk is requesting changes to parking permit types and parking lot designations in preparation
of re-initiating the parking permit portal. Streamlining the current permits types will reduce software
development costs, and help manage the portal more efficiently. The Town Clerk is also requesting that
the Washington Square and the Lester Place residential permits, due to expire on September 30, be
extended through October 31. This will give the Clerk’s Office more time to develop the online permit
renewal portal.
Update – US Golf Open
Mr. Altieri gave a brief update, noting that the Town and the US Open are ready for the opening of the
event.
Danskammer Power Plant Resolution
The Town Board reviewed the prepared resolution. This approval is on the regular agenda for this evening.
New Business
Mr. Altieri explained that LMC Media had applied for a grant through Assemblyman Steve Otis’s Office, for
renovation of the Mamaroneck Fire House, in anticipation of that site being their new home. That grant
was repurposed for renovations to the Town Center as LMC Media’s new home. For that to be completed
a new grant application needs to be filed, and it is being requested that the Town be the applicant. The
Town will need to oversee the renovation project on a day to day basis. Mr. Altieri stressed that part of
the grant allows funds for a construction manager, adding this is an important point.
Supervisor Seligson wanted the Town Board to know that she was copied on an irate and upset resident
email, adding that she is aware of the extreme verbiage in the email.
On motion of Councilwoman Elkind Eney, seconded by Councilwoman Katz, the Town Board agreed to
enter into an Executive Session to discuss the Fire Fighters’ collective bargaining agreement.

On motion of Councilwoman Katz, seconded by Councilwoman Fiddelman, the Board unanimously agreed
to resume the Regular Meeting.

The Regular Meeting of the Town Board was called to order by Supervisor Seligson at
8:15 p.m.
Supervisor Seligson noted that the Town Board met for a worksession beginning at five o’clock this
evening. The worksession is open to the public and available for viewing through LMC Media.

2. Ratification – Stipulation of Settlement – Town of Mamaroneck Firefighters
On motion of Commissioner Elkind Eney, seconded by Commissioner Katz, it was
RESOLVED, that the Mamaroneck Board of Fire Commissioners does hereby approve the
Stipulation of Settlement between the Town of Mamaroneck and the Professional Firefighters

Association Local 898 of the International Association of Firefighters for the period January 1,
2020 through December 31, 2023, and
BE IT FURTHER,
RESOLVED, that the Mamaroneck Board of Fire Commissioners does hereby authorize the Town
Administrator to execute the agreement.

4. Other Fire Department Business
Commissioner Elkind Eney reported that she and the Fire Department are working with State Senator
Shelley Mayer to reconfigure the I95 entrance ramp. A feasibility study has been completed as well as
design development. Commissioner Elkind Eney will keep the Commission apprised.
There being no further business to come before the Commission, on motion of Commissioner Elkind Eney,
seconded by Commissioner Fiddelman, the Commission unanimously adjourned and the Town Board
reconvened.
SUPERVISOR’S SUMMARY REPORT
I know everyone is tired of living in the era of Coronavirus. I am too. It has been a difficult time
and a difficult summer. We have had to rethink how we live our daily lives and common
routines. Now, we have the added difficulty of figuring out how children go to school. But we
continue to function and reimagine our lives. We need to continue to protect ourselves and our
neighbors. There is a slight uptick in Covid cases in the community and in Westchester County.
We need to stay vigilant. Please wear a mask in public and keep socially distanced. Do not
gather in large groups and wash your hands frequently.
Each year on September 11th, the Town, along with the villages of Larchmont and Mamaroneck,
participates in a Tri-Municipal Memorial Ceremony at “Girl Scout Rock” in Memorial Park. The
Girl Scouts created the September 11th Memorial Rock, which lists the names of those
Larchmont-Mamaroneck community members who were lost on that tragic day. Hundreds of
people have attended this event every year since 2002. Unfortunately, this year the Tri-
Municipal 9/11 ceremony has been cancelled due to COVID-19.
We would like to encourage all residents to remember September 11th this Friday, as a
community, but safely, from the front steps or porch of your home, your apartment window,
your terrace or front yard by shining a flashlight (or two) up into the sky at 7:30pm on Friday,
September 11th. The Town Fire Department will be shining our emergency lights up in front of
the Fire House on Weaver Street.

It was wonderful to have the Hommocks Pool open for the most of the summer. The
Mamaroneck School District owns the pool and we are working with the school district to
determine the Town’s use of the pool during the school year. The situation needs a thorough
evaluation due to the continued COVID environment. Students start back in person on Monday,

September 14, and they need to get settled and make sure can do so safely. We will then take
a look at our options for pool use in the future.
Unfortunately, this is not a normal year and decisions will need to be made regarding how we
can provide the pool this fall and how it will be funded. We hope to have some answers on this
towards the end of the month.
There will be a Coastal Cleanup on Saturday, September 19 from 10 to 12:00 at the Hommocks
Conservation Area. Everyone must wear masks and keep socially distanced. Please see the flyer
on the website for more details.

Village of Larchmont elections are next Tuesday, September 15 for all eligible voters in the
Village of Larchmont. We will discuss important information about voting in the November
election as part of the Town Board agenda.
PLEASE complete the Census! The Town’s response rate is 73.2% which is pretty good, but still
below our 2010 response of 73.9%. We need to break 74%! Remember the Census numbers
determine the Town’s state and federal aid for our local government operations, and
collectively, the Census numbers determine our state’s representation in Congress. Go to the
Town’s website for easy instructions.
The Town 2021 budget preparations have begun. The tentative budget will be presented to the

Town Board on October 21.

The Shredder Mobil will be at the Maxwell Avenue Recycling Center on Saturday September 19.
Please remember that the Town Center is still only open to the public by appointment.

Purpose:
The Town Board continues to monitor the impact of pulverizing and removing rock by mechanical
means upon the health, safety and welfare of the Town’s residents with a goal of balancing
people’s right to develop their properties with a neighborhood’s right to tranquility, to the extent
possible. Among the concerns that have arisen are the need to mitigate the spread of dust and
other particulates during both from drilling and pulverizing rock and its removal from the site,
and the need to decrease the number of hours per day when such activities may take place. This
revision in the law furthers the goal.

period to 24 months until September of 2019 when an amendment to that law extended the
maximum installment period to thirty-six months. The purpose of this local law is to conform the
Town code to the state statute. It is hoped that since the additional twelve months will lower the
installment payment, taxpayers who cannot meet a twenty-four month amortization schedule may
now be able to enter into and keep up with installment agreements to pay off their back taxes.

Local Law No. 7 - 2020
This local law shall be known as the “Increasing the Installment Period and Setting the Minimum
Down Payment for Paying Delinquent Taxes” Law.
BE IT ENACTED by the Town Board of the Town of Mamaroneck
Section 1 – Purpose:
Section 1184 of the Real Property Tax Law authorizes a local government to adopt a local law
allowing delinquent taxes to be paid in installments. In 1996, the Town availed itself of that
authority by adding article V to chapter 195 of the Town Code. Section 1184 limited the installment
period to 24 months until September of 2019 when an amendment to that law extended the
maximum installment period to thirty-six months. The purpose of this local law is to conform the
Town code to the state statute. It is hoped that since the additional twelve months will lower the
installment payment, taxpayers who cannot meet a twenty-four month amortization schedule may
now be able to enter into and keep up with installment agreements to pay off their back taxes.
A second purpose of this law is to establish a minimum down payment for anyone wanting to
enter into an installment agreement. The Town’s current law makes the amount of the down
payment discretionary provided it does not exceed the cap on down payments contained in the
state statute. The Town Board finds that a fixed minimum is important because all persons wishing
to enter an installment agreement should be treated the same way.
Section 2 – Amendment of a current section of the Mamaroneck Code:
Section 195-15 of the Code of the Town of Mamaroneck hereby is amended by deleting the number
and word “24 months” and substituting the words “thirty-six months” in their place.
Section 3 – Amendment of a current section of the Mamaroneck Code:
Section 195-18 A. of the Code of the Town of Mamaroneck hereby is amended by deleting the
number and word “24 months” and substituting the words “thirty-six months” in their place.
Section 4 – Repeal and replacement of a current section of the Mamaroneck Code:
Section 195-18 C. of the Code of the Town of Mamaroneck hereby is repealed and the following is
substituted in its place:
C. The required initial down payment shall be fifteen (15%) percent of the eligible delinquent
taxes, however, at the eligible owner’s option, the initial down payment can be any percentage
between sixteen (16%) percent and one hundred (100%) percent.
Section 4 – Severability:
Should any provision of this Local Law be declared invalid or unconstitutional by any court of
competent jurisdiction, such declaration of unconstitutionality or invalidity shall not affect any
other provisions of this Local Law, which may be implemented without the invalid or
unconstitutional provisions.
Section 5 – Effective Date:
This Local Law shall become effective upon filing with the Secretary of State.

law prohibiting remotely controlled flying aircraft from flying within two miles of the Club grounds
prior to and during the tournament with the exception of such aircraft to be flown by enterprises,
such as television networks, that need to fly drones in connection with their performance under
contracts they have with the Winged Foot Golf Club and/or the United States Golf Association.
Due to the pandemic, the tournament was pushed back to mid-September 2020. This local law
amends the existing law on remotely controlled flying aircraft by moving the dates of the
prohibition to the ten days in September mentioned below.

Local Law No. 8 - 2020
This local law shall be known as the “Prohibition on Flying Drones near the Winged Foot Golf Club
for ten days during September of 2020” Law.

Section 2 – Amendment of an existing section of the Mamaroneck Code:
Section 122-8 of the Code of the Town of Mamaroneck hereby is repealed and replaced by the
following:
§122-8 Remotely Controlled Aircraft Prohibited within Certain Air Space during ten particular days
in September of 2020.
A. From September 12, 2020 to September, 21 2020, it shall be unlawful for any person to operate
an unmanned aircraft, or cause an unmanned aircraft to take off, land or fly within two miles of the
perimeter of the property owned by the Winged Foot Holding Corp. or the Winged Foot Golf Club,
Inc. and designated on the Tax Assessment Map of the Town of Mamaroneck as
Section/Blocks/Lots:

3-44-99,
3-45-1.4,
3-45-1.5,
3-45-1.7,
3-46-1.1,
3-46-1.2,
3-47-1../1,
3-47-1 .. /2 and
3-47-1.2.
For the purpose of this section, the term “unmanned aircraft” means a device, commonly referred
to as a ‘drone’, that is designed to navigate in the air without a pilot onboard, or an aircraft that is
operated without intervention by a human within the aircraft.
B. This section shall not apply to those enterprises with whom either the Winged Foot Golf Club
or the United States Golf Association will or have contracted to perform services in connection with
the 2020 US Open golf championship and whose names appear on a certification given to the Town
by either the Winged Foot Golf Club or the United States Golf Association that is received by the
Town Administrator on or before September 11, 2020.
Section 3 – Severability:
Should any provision of this Local Law be declared invalid or unconstitutional by any court of
competent jurisdiction, such declaration of unconstitutionality or invalidity shall not affect any
other provisions of this Local Law, which may be implemented without the invalid or
unconstitutional provisions.
Section 4 – Effective Date:
This Local Law shall become effective upon filing with the Secretary of State.

1. Presentation – Voter Information
Supervisor Seligson reported on plans set in place for voting in the upcoming General Election. Supervisor
Seligson informed residents that there are a number of ways you can vote, by early voting at the Town
Center, on election day, or by mail. The Town’s web site has a lot of valuable information with links to the
Westchester County Board of Elections and to the NY State Board of Elections. Supervisor Seligson stated
the importance of having a voting plan.
2. Appointments to Boards and Commissions
On motion of Councilwoman Elkind Eney, seconded by Councilman King, it was unanimously
RESOLVED, that Galit Lopatin Bordereau be appointed as one of the three Town Members to
the Larchmont Mamaroneck Library Board, and
BE IT FURTHER
RESOLVED, that the foregoing appointments shall be effective immediately upon the appointees
taking and subscribing the oath mandated by section 25 of the New York Town Law and shall expire
on May 30, 2025.
On motion of Councilman King, seconded by Councilwoman Fiddelman, it was unanimously
RESOLVED, that Susan Healey be appointed as an Alternate Member to the Town of
Mamaroneck Board of Architectural Review, and
BE IT FURTHER
RESOLVED, that the foregoing appointments shall be effective immediately upon the
appointees taking and subscribing the oath mandated by section 25 of the New York Town
Law and shall expire on December 31, 2020.
On motion of Councilwoman Fiddelman, seconded by Councilwoman Katz, it was unanimously
RESOLVED, that Ellen Lee be appointed as Alternate Member 2, to the Town of Mamaroneck
Board of Assessment Review, and

9. Resolution – Danskammer Power Plant
On motion of Councilwoman Elkind Eney, seconded by Councilwoman Fiddelman, the following was
approved,
WHEREAS, climate change requires immediate action, we need to stop incrementally expanding
fossil fuel energy generation and fully ramp up on renewables and we need to make tough choices
in the face of entrenched, narrow, short-term interest; and
WHEREAS, these seemingly small and scattered decisions that extend fossil fuel dependency are
neither small or insignificant, as they cumulatively add up to the whole system that supports and
reinforces the continuation of our reliance on fossil fuels, and we need to diverge from this path;
and
WHEREAS, Danskammer, LLC is seeking to build a new, baseload year-round fracked natural gas
and diesel-burning power plant in Newburgh, New York, increasing emissions of methane and
carbon dioxide, and so accelerate climate change; and
WHEREAS, according to Food and Water Watch, “The Danskammer would be a massive 550 MW
fracked gas plant posing significant risks to the air and water of the local community – and
worsening our climate crisis by burning dirty fossil fuels around the clock”; and
WHEREAS, science research clearly shows the need to transition to clean, green economy to
decelerate climate change and its destabilizing effects on our ecosystems and communities; and
WHEREAS, the Danskammer, LLC build out proposal is against the stated goals of our Governor,
laid out in the Climate Leadership and community Protection Act, is wrong for our economy, our
health and the environment; and
WHEREAS, there is no proven need for gas to meet our energy needs. The 2018 Reliability Needs
Assessment of the New York Independent System Operator (dated October 2018) found no
statewide gap in power generation or transmissions capacity in the next decade, notwithstanding
the impending closure of the Indian Point nuclear power plant; and
WHEREAS, Westchester County is committed to growing the investment and workforce in clean
energy, including a $250 million grant provided by the state this year to free up existing natural
gas capacity and incentivize more energy efficient measures; and
WHEREAS, The Town of Mamaroneck, New York, as a certified Climate Smart Community, is
committed to continuing its efforts to combat climate change, lower greenhouse gas emissions,
and increase climate resiliency efforts; and
WHEREAS, the Danskammer plant has already flooded once during Hurricane Sandy and is at risk
of flooding again due to sea level rise. Containments including, but not limited to, aqueous
ammonia and diesel on site stand to pollute the Hudson River if Danskammer’s expansion were to
be approved; and
NOW, THEREFORE, BE IT RESOLVED, that The Town of Mamaroneck, New York, calls upon the
Public Service Commission to reject the Danskammer application; and be it further
RESOLVED, that the Mamaroneck Town Clerk is directed to submit this statement to the Public
Service Commission and to send a copy of this Resolution to New York State Governor Andrew M.
Cuomo, U.S. Senator Kirsten Gillibrand, U.S. Senator Charles Schumer, U.S. Congressman Elliot
Engel, New York State Senator Shelly Mayer, New York State Assemblyman Steve Otis,
Westchester County Executive George Latimer, and Westchester County Legislator Catherine
Parker.
