Present: Supervisor Burton. Trustees Howell and Leeds Town Clerk Sherman Counsellor Gamble Upon motion, duly seconded, it was voted ,to dispense with the reading of the minutes of meetings not yet approved. A petition from the residents residing in the vicinity of I:yrtle Place was received and read, requesting the Police Dep- artment to take proper action to abate the nuisance of barking dogs at night. The petition was ordered received, placed on file and referred to the Clerk to take up with the proper authorities and who was authDrized to ascertain the _roper procedure that the Board may follow. An application was received from the 'destchestdr Opera Club, requesting permission to use the auditorium of the ':weaver Street Fire House for rehearsals. Upon motion, duly seconded, it was RESOLVED, that the application of the West- chester Opera Club for permission to use the auditorium hall of the Weaver Street Fire House, be and the same hereby is referred to the Fire House committee together with the Town Clerk with power to act in the premises. Counsel submitted a verbal report of his attendance before the Public Service Commission in the hearing for the application of buses on the Boston Post Road, from Dillon Park to its terminus in the City of New Rochelle , whereupon the following resolution was presented and upon roll call adopted® RESOLVED, that the Supervisor and the -members of this Boarok requested to attend the adjourned hearing upon the application of the County Transportation Company, for a bus franchise on the Boston Post Road,. from Dillon Park to its terminus in the City of New Rochelle , to be held before the Public Service Commission on Friday, August 1?th, at 10 A. H. The following resolution_ was presented by Counsel WHEREAS, a claim for a refund amounting to $9..62 has been made by Jeremiah Manning on Lot 71, Flap � of Washingtcnville for a tax on Lot 71 for the year 18771 which was sold to the Town, October 19 1878, said tax being in the amount of ; 1.62, plus interest and cost of redemption amounting to $9.62, and WHEREAS, it appears from the records and books of account in the office of the Receiver of Taxes that said tax was paid and redeemed by William Purdy on December 1st, 1879 , and said taxes and sale thereupon cancelled, and F,py, it QJ WHEREAS, said tax has therefore been paid twice and a refund should be made , now therefore, upon the recommendation of the Receiver of Taxes, be it RESOLVED, that the claim of Jeremiah Eanning of 15 Lorraine Street, Hamaroneck, Yaw York, of Q.62, for a refund of taxes heretofore paid on hay 19 , 1928, on Lot 71, Eap of T`aashingtorville , being taxes for the year 1877 , sold to the Town October 11 1878, be allowed, further RESOLVED, that the Supervisor be and he hereby is authorized, empowered and directed to make payment of said claim and that the Receiver of Taxes be authorized and directed to make what- ever changes, corrections and notations in their respective books of record as may be necessary and to issue such certificates as may be required in the premises. The question being t3.ken upon the foregoing resolutions, the same were upon rollcall8 unanimously adopted. Counsel advised the Board that heretofore the Board of Sewer Commissioners of Sewer District No. 1 of the Town of Eamaron- eck, had obtained an easement for sewer mains through certain lots in Larchmont Gardens and that said agreement dated November 98 1923, made between. the Larchmont Gardens Company and the Town of I,Iamaron- eck provided for an easement through certain parcels of land des gibed in said agreement and that parcel 1 covered Lot No. 14 in Block No.. 433 on a certain map entitled "Plan. of Lots called ,Larch- mont Gardens, " etc.. ; that said Lot, together with others had been thereafter transferred to Mamaroneck Lumber Supply Company and that said Company had constructed a house on said ]Lot No. 14 either through inadvertence or otherwise and over the portion of said Lot — through which it had been intended to ]ay the aforesaid sewer pipes. Said situation had been called to the attention of hamaroneck Lumber Supply Company and inasmuch as said Company also owned Lot Yo. 15 in said block, the lot contiguous to Lot No. 14, said Company had agreed to grant a like easement to the Board of Sewer Commissioners of Sewer District lo. 1 of the Town of Eamaroneck and/or the Town of Yamaroneck over and through Lot No. 15 and that said easement through Lot No. 15 could be used by the Sewer Commissioners in as satisfactory a manner as Lot No. 14. He stated the Sewer Commission, therefore , requested the Town Board to adopt a resolution authorizing the Supervisor to execute an agreement with Mamaroneck Lumber Supply Company whereby in consideration of said Company granting a new easement over the aforesaid Lot No. 15, that the Town cancel and extinguish the easement heretofore granted over Lot No. 14. After discussion, upon motion, duly seconded; it was RESOLVED, that the Town Board approves of the cancelling of the easement heretofore granted the Town of Yamaroneck to parcel No. 1 described in a certain agreement dat4d November 9, 1923, between Larchmont Gardens Company and the Town of Lamaroneck, which agreement was duly recorded in the office of the Register of Westchester County on December 292 1923 in Liber 2472 of Deeds, page 19£, in consideration of Eamaroneck Lumber Supply Company delivering to the Town of Mamaron- eck a like easement through Lot I,io. , 15 in Block 433 on a certain map entitled "Plan of Lots called Larchmont Gardens, situated in the Town of Iiamaron- eck, County of ',Westchester and State of New Yorke surveyed for Clifford B. Harmon & Co. , 42nd Street and Eadison Avenue, New York City, N. Y. , Subdivisions Nos. 1 and 2" by Long and Eiller, Civil Engineers, dated August 16, 1911, and filed in the Register's office of Westchester County on September 11, 19112 as Map No. 1949. I Further `EMSOLVE'D, that the Supervisor be and he hereby is authorized, empowered and directed to execute and deliver on behalf of the Town of ilamaroneck, a release of the aforesaid easement to Lot -Yo. 14 in Block 433 on said —, map upon delivery to him of an easement in form satisfactory to Counsel to Lot No.. 15 in -31ook 433 on said map and to take such other action and to execute and deliver such other documents as may be necessary to carry the aforesaid resolution into full force and effect.
