MINUTES OF THE REGULAR MEETING OF THE TOWN BOARD OF THE TOWN OF MAMARONECK AND THE BOARD OF FIRE COMMISSIONS HELD ON WEDNESDAY, JUNE 19, 1996 AT 8:15 PM IN THE COURT ROOM OF THE TOWN CENTER, 740 W. BOSTON POST ROAD, MAMARONECK, NEW YORK CONVENE EXECUTIVE SESSION The Board convened into an Executive Session at 6:30 PM in Conference Room A to discuss personnel and contracts. On motion duly made and seconded the Board adjourned at 8:15 PM to the Court Room to reconvene the regular meeting. PRESENT: Supervisor: Elaine Price Councilman; Paul A. Ryan Councilwoman: Valerie M. Silverberg, Town Attorney CONVENE REGULAR MEETING The Regular meeting of the Town Board was called to order by Supervisor Price at 8:20 PM. CALL TO ATTENTION- Location of Exits The regular meeting of the Town Board was called to order by Supervisor Price at 8:20 PM who pointed out the location of the exits. PROCLAMATIONS - Penny Oberg - Ellen Freemen Supervisor Price read the proclamations for Penny Oberg and Ellen Freemen, who were being recognized for their service on the School Board. (At end of minutes) PUBLIC HEARING -Adoption of Local Law-Collection of Delinquent Taxes The following notice was entered into the record: PLEASE TAKE NOTICE, that the Town Board of the Town of Mamaroneck will hold a Public Hearing on Wednesday, June 19, 1996 at 8:15 PM or as soon thereafter as is possible in the Court Room of the Town Center to consider the adoption of a Local Law known as "Delinquent Taxes". The purpose of this local law is to authorize the payment of eligible delinquent taxes in installments of up to 24 months. June 19, 1996 Mr. Silverberg explained that this law would make it possible for taxpayers that are in arrears to make partial payments of the taxes, where before they would have to pay the whole bill at once. On motion made by Councilman Ryan, seconded by Councilman Weprin, the hearing was opened. The Supervisor asked if anyone wished to speak either in favor of or against the law. There being no comment, on motion made by Councilman Ryan, seconded by Councilwoman O'Keeffe, the hearing was closed, then on the same motion and second the local law was unanimously adopted: LOCAL LAW NO. 13 - 1996 Section 1. Purpose: The purpose of this local law is to authorize the payment of eligible delinquent taxes in installments of up to 24 months. Section 2. Definitions: (a) "Eligible delinquent taxes" means the delinquent taxes, including interest, penalties and other charges, which have accrued against a parcel as of the date on which an installment agreement is executed. (b) "Eligible owner" means an owner of real property who is eligible to or has entered into an installment agreement. (c) "Installment agreement" means a written agreement between an eligible owner and the Receiver of Taxes providing for the payment of eligible delinquent taxes in installments pursuant to the provisions of Section 1184 of the Real Property Tax Law and this Local Law. Section 3 Authorization to Enter into Installment Agreements: The Town Board of the Town of Mamaroneck is authorized to enter into an installment agreement providing for the payment of eligible delinquent taxes in installments with property owners. Such installment payment of eligible delinquent taxes shall commence upon the signing of an agreement between the Receiver of Taxes and the eligible owner. The agreement shall be kept on file in the office of the Receiver of Taxes. Section 4. Terms and Conditions: (a) The maximum term of the installment agreement shall be twenty-four months. (b) the payment schedule shall be monthly, bi-monthly, quarterly or semi-annually. (c) The required initial down payment if any, shall not exceed twenty-five percent of the eligible delinquent taxes. (d) Eligible properties shall include all properties within the Town of Mamaroneck. Section 5. Eligibility: A property owner shall not be eligible to enter into an agreement pursuant to Section 1184 of the Real Property Tax Law and this Local Law where: (a) there is a delinquent tax lien on the same property for which the application is 2 June 19, 1996 made or on another property owned by such person and such delinquent tax lien is not eligible to be made part of the agreement pursuant to Section 1184 of the Real Property Tax Law and this Local Law; (b) such person is the owner of another parcel within the Town on which there is a delinquent tax lien, unless such delinquent tax lien is eligible to be and is made part of the agreement pursuant to Section 1184 of the Real Property Tax Law and Local Law; or (c) such person was the owner of property on which there existed a delinquent tax lien and which lien was foreclosed within three years of the date on which an application is made to execute an agreement pursuant to Section 1184 of the Real Property Tax Law and this Local Law; or (d) such person defaulted on an agreement executed pursuant to Section 1184 of the Real Property Tax Law and this Local Law within three years of the date on which an application is made to execute an agreement pursuant to Section 1184 of the Real Property Tax Law and this Local Law. Section 6. Timing of Entering into Agreement: A property owner shall be eligible to enter into an agreement pursuant to Section 1184 of the Real Property Tax Law and this Local Law no earlier than thirty days after the expiration of the warrant from the Receiver of Taxes. Section 7. Amount Due: Payment of Installments: The amount due under an installment agreement shall be the eligible delinquent taxes plus the interest that is to accrue on each installment payment up to and including the date on which each payment is to be made. The agreement shall provide that the amount, due shall be paid, as nearly as possible, in equal amounts on each payment due date. Each installment payment shall be due on the last day of the month in which it is to be paid. Section 8. Interest and Penalties: Interest on the total amount of eligible delinquent taxes, less the amount of the down payment made by the eligible owner, if any is required, shall be that amount as determined pursuant to Section 924-a of the Real Property Tax Law. The rate of interest in effect on the date the agreement is signed shall remain constant during the period of the agreement. If an installment is not paid on or before the date it is due, interest shall be added at the rate prescribed by Section 924-a of the Real Property Tax Law for each month or portion thereof until paid. In addition, if an installment is not paid by the end of the fifteenth calendar day after the payment due date, a late charge of five percent of the overdue payment shall be added. Section 9. Default: (a) The eligible owner shall be deemed to be in default of the agreement upon: (i) non-payment of any installment within thirty days from the payment due date; (ii) non-payment of any tax, special ad valorem levy or special assessment which is levied subsequent to the signing of the agreement by the Town, and which is not paid prior to the expiration of the warrant from the Receiver of Taxes; or (iii) default of the eligible owner on another agreement made and executed pursuant to Section 1184 of the Real Property Tax Law and this Local Law. 3 June 19, 1996 (b) In the event of a default, the Town shall have the right to require the entire unpaid balance, with interest and late charges, to be paid in full. The Town also shall have the right to enforce the collection of the delinquent tax lien pursuant to the applicable sections of law, special tax act, charter or local law. (c) Where an eligible owner is in default and the Town does not either require the eligible owner to pay in full the balance of the delinquent taxes or elect to institute foreclosure proceedings, the Town shall not be deemed to have waived the right to do so. Section 10. Notification of'Potential Eligible Owners: (a) Within forty-five days after the expiration of the warrant from the Receiver of Taxes, or as soon thereafter as is practicable, the Receiver of Taxes shall notify, by first class mail, all potential eligible owners of their possible eligibility to make installment payments on such tax delinquencies. The Receiver of Taxes shall add one dollar to the amount of the tax lien for such mailing. (b) The failure to mail any such notice, or the failure of the addressee to receive the same, shall not in any way affect the validity of taxes or interest prescribed by law with respect thereto. (c) The Receiver of Taxes shall not be required to notify the eligible owner when an installment is due. Section 11. Effect of Agreement on Tax Lien: The provisions of Section 1184 of the Real Property Tax Law and this Local Law shall not affect the tax lien against the property except that the lien shall be reduced by the payments made under an installment agreement, and that the lien shall not be foreclosed during the period of installment payments provided that such installment payments are not in default. Section 12. Severability: Should any provision of this Local Law be declared invalid by a court of competent jurisdiction, such declaration shall not invalidate any other provision which may otherwise be given effect. Section 13. Effective Date: This Local Law shall take effect immediately. A copy of this Local Law shall be filed with the State Board of Real Property Services within thirty days after its enactment. Other Business Commissioner Ryan read the monthly report of the Fire Department: The following report out lines responses to calls made during the month of May 1996. It summarizes the nature and origin of calls, the number of men responding and the total times spent at fire calls. AFFAIRS OF THE TOWN 1. Approval of Certiorari Settlements The Board received a communication from George Derderian, the Town Consultant on certiorari matters reporting that Hapco Realty, H. &A. Oen, Dance Cavise, and Chef Vincent's had been scheduled for trial and a settlement had been negotiated subject to approval by the Board. The Supervisor pointed out that the reduction of taxes is a continuing problem in the Town and in the County and that she has called upon the State and County to rethink reevaluation and that it must be done on a county-wide basis. Thereafter, on motion of Councilman Ryan, seconded by Councilwoman O'Keeffe, it unanimously: RESOLVED, that the Town Board does hereby authorize the settlements of certiorari, as recommended by George Dederian, Consultant for certiorari matters, for the following properties: 613 Waverly Avenue, Village of Mamaroneck 8261366 Assessment: $71,300 Years under appeal: 1992 through 1995 Year Assessment Reduced to Amount of Reduction 1992 $71,300 $39,200 $32,100 (45%) 1993 $71,300 $39,200 $32,100 (45%) 1994 $71,300 $39,200 $32,100 (45%) 1995 $71,300 $39,200 $32,100 (45%) The loss in taxes to the Town based on this settlement is $1,600. The Village Assessment was $63,400 for the years under appeal. They have agreed on a similar settlement based on the same full value. The Village Assessor is recommending the Village approve a settlement based on this same value of $900,000. The Village has an'assessment of$114,800. The assessment in the Village was lower than the Town and not appealed. 2. Authorization -Transfer of Funds - Premium Marsh Project There was a request from the Town Comptroller for authorization to transfer funds in the amount of$97,000 to allow for payments on the Premium Marsh Dredging Project. On motion of Councilwoman Wittner, seconded by Councilman Ryan, it was unanimously, 7 June 19, 1996 RESOLVED, that the Town Board does hereby approve the transfer of$97,000 from the unreserved fund balance in the general Town fund for the Premium Marsh Dredging Project. 3. Authorization - Retainer Agreements for Legal Services The Administrator explained that authorization was necessary to retain two firms. The first is for Charlene Indelicato, Koelsch and Indelicato, who will act as Town Attorney, providing legal advice to the Supervisor, Town Board, Town staff, and committees, commissions and Boards established by the Town Board, at the annual rate of$45,000. The second retainer is to hire the firm of Robinson Silverman Pearce Aronsohn & Berman, for them to provide legal services to the Planning and Zoning Boards for the basic annual retainer of$28,000, with the additional provision that should the Boards meet more than once per month a fee of$500 per added meeting shall be paid. The Administrator said that Judy Gallant from the firm will be the principal attorney attending the meetings. Following discussion, on motion of Councilwoman Wittner, seconded by Councilman Weprin, it was unanimously, RESOLVED, that the Town Board does hereby authorize the retainer agreement with Charlene Indelicato, Koelsch and Indelicato, for legal services as outlined in said agreement, at a cost of$45,000 annually, payable bi-weekly, effective August 1, 1996; and BE IT FURTHER, RESOLVED, that the Town Board does hereby authorize the retainer agreement with Robinson Silverman Pearce Aronsohn & Berman, for them to provide legal services to the Planning and Zoning Boards for the basic annual retainer of$28,000, plus $500 per meeting should there be more than one per month, effective July 1, 1996. 4. Set Public Hearing -Adoption of Town Code - Parking Restrictions - Leafy Lane The Administrator said that the Leafy Lane parking restriction is being proposed and recommended by the Traffic Committee. The Town Code hearing is necessary to incorporate all the changes that have been made to the Code of Ordinance for the Town. Mr. Altieri said that in order to adopt the changes it would be necessary to approve one law encompassing all the changes. He said that this had been in the works for a few years, and input had been given by every department, committee, commission as well as Town Board members. Then, on motion of Councilman Ryan, seconded by Councilwoman Wittner, it was unanimously, 8 June 19, 1996 RESOLVED, that the Town Board does hereby set the date for public hearing on the adoption of the Town Code for July 17, 1996; and BE IT FURTHER, RESOLVED, that the Town Board does hereby set the date for public hearing on Parking Restriction on Leafy Lane for July 17, 1996; and RESOLVED, that the Town Clerk be and hereby is authorized to publish the legal notice of Public Hearings in an official newspaper of the Town. 5. Salary Authorization - Recreation - Conservation -Ambulance District Recreation On motion of Councilwoman Wittner, seconded by Councilwoman O'Keeffe, it was unanimously, RESOLVED, that the Town Board that as provided for in the 1996 budget, authorization is hereby granted for payment of salary to the following: Rachel Farber-Kaiser, Tennis Instructor, $12 1hour, effective retroactive to 6110196. On motion of Councilwoman O'Keeffe, seconded by Councilwoman Wittner, it was unanimously, RESOLVED, that the Town Board does hereby authorize the payment of salary to the following workers for the Conservation Department, at the rate of$6.50 per hour, effective July 1, 1996: Gregory Altman David Edelstein Kathleen Flynn Kevin Graham Joanna Korn Matthew Oberg Brian Tracy David Wagstaff Ambulance District A memorandum was received from Ed McCormack, Ambulance District Administrator, requesting authorization to hire paramedics Sal DiMeglio at an hourly rate of $16.00 and Patty Nadoiske at an hourly rate of$15.00 effective June 19, 1996. These per diem appointments bring the total number of paramedics to twenty four. Sal Dimeglio previously completed probation, and Patty Nadoiske will be probationary until January 19, 1997. Sal DiMeglio was previously appointed with civil service status, then he had left to attend school, and our initial plan was to maintain his status as inactive, however he was inadvertently dropped from payroll, so reauthorization is necessary. On motion of Councilwoman O'Keeffe, seconded by Councilwoman Winner, it was unanimously, RESOLVED, that the Town Board does hereby authorize the payment of salary to Sal Dimeglio, Paramedic, at$16.00 per hour, effective June 19, 1996; and BE IT FURTHER, RESOLVED, that that the Town Board does hereby authorize the payment of salary to Patty Nadoiske, for her services as a Paramedic, at an hourly rate of$15.00 effective June 19, 1996, she will be probationary until January 19, 1997. APPROVAL OF MINUTES - March 6, 1996 -April 2, 1996 On motion of Councilwoman Winner, seconded by Councilman Ryan, it was unanimously, RESOLVED, that the Town Board does hereby approve the minutes of March 6, 1996. 10 June 19, 1996 On motion of Councilwoman Wittner, seconded by Councilman Weprin, it was unanimously, RESOLVED that the Town Board does hereby approve the minutes of April 2, 1996 as presented.
