APRIL 17, 1996 MINUTES OF THE REGULAR MEETING OF THE TOWN BOARD OF THE TOWN OF MAMARONECK AND THE BOARD OF FIRE COMMISSIONERS HELD ON APRIL 17, 1996 AT 8:15 PM IN THE COURT ROOM OF THE TOWN CENTER, 740 W. BOSTON POST ROAD, MAMARONECK, NEW YORK PRESENT: Supervisor Elaine Price Councilman Paul A. Ryan Councilwoman Valerie M. O'Keeffe Councilman Barry Weprin Councilwoman Phyllis Wittner ALSO PRESENT: Patricia DiCioccio, Town Clerk Stephen V. Altieri, Town Administrator Steven M. Silverberg, Town Attorney CONVENE WORK SESSION The Board convened into a Work Session at 7:00 PM in Conference Room A of the Town Center to discuss with nonresidents the situation with relocating them from the Town Commuter lot. The Administrator explained that accommodations had been found for them on Baldwin Avenue and in Parking Lot 4 and that during the shutdown of Larchmont's lot, the Town would sell them special permits at$50 per month which is commensurate with the rate they currently pay. The nonresident commuters thanked the Supervisor for finding this solution and commented on how responsive the Town of Mamaroneck had been to them and that they appreciated the solution. Then on motion made and seconded the Board convened the Work Session and went into Executive Session to discuss contracts and personnel matters. On motion duly made and seconded the Board adjourned at 8:15 PM to the Court Room to reconvene the regular meeting. CALL TO ORDER The regular meeting of the Town Board was called to order by Supervisor Price at 8:20 PM, who then pointed out the location of exits. BOARD OF FIRE COMMISSIONERS April 17, 1996 The meeting was called to order by Commissioner Price at 8:25 PM in the Court Room. Fire Claims: Commissioner Wittner presented fire claims for authorization of payment , and stated there was a change to the total for the operating fund. There was a claim for Westchester Joint Water Works in the amount of$15,075.00 that was removed for further review. Other Business Commissioner Weprin read the monthly report of the Fire Department: The following report out lines responses to calls made during the month of February 1998. PUBLIC HEARING - Establish a Four Way Stop Intersection - Mountain Avenue/Rockingstone Avenue NOTICE OF PUBLIC HEARING PLEASE TAKE NOTICE, that a Public Hearing will be held by the Town Board of the Town of Mamaroneck on April 17,1996 at 8:15 PM or as soon thereafter as is possible, in the Court Room of the Town Center, 740 W. Boston Post Road, Mamaroneck, New York to consider adoption of the following Local Law. A Local Law to regulate traffic on Mountain Avenue and Rockingstone Avenue. On motion of Councilman Ryan, seconded by Councilwoman Wittner, the hearing was opened. The Administrator explained that this item would establish a four way stop intersection and the Traffic Committee had made this recommendation for the stop signs. The Supervisor asked if anyone wished to speak either in favor of against the adoption. There was no comment, thereafter on motion of Councilwoman Wittner, seconded by Councilwoman O'Keeffe, the hearing was closed and on the same motion and second, the following law was unanimously adopted: LOCAL LAW NO. 7 - 1996 This Local Law shall be known as "Four Way Stop Intersection - Mountain Avenue and Rockingstone Avenue". Section 1. Purpose: To regulate the traffic traveling on Mountain Avenue. Section 2. Regulation of Traffic on Mountain Avenue: Vehicles shall be required to come to a full stop at the southeast and northwest corners of Mountain Avenue at the intersection with Rockingstone Avenue. Section 3. Signs to be Erected: Appropriate signs shall be erected on the southeast and northwest corners of Mountain Avenue at the intersection of Rockingstone Avenue as provided in Section 2. 3 April 17, 1996 Section 4. Severability: Should any provision of the Local Law be declared invalid or unconstitutional by any court of competent jurisdiction, such declaration of unconstitutionality or invalidity shall not affect any other provisions of this Local Law which may be implemented without the invalid or unconstitutional provision. Section 5. Effective Date: This Local Law shall take effect immediately. PUBLIC HEARING - Establish Stop Intersection - Mountain Avenue/No. Chatsworth Avenue NOTICE OF PUBLIC HEARING PLEASE TAKE NOTICE, that a Public Hearing will be held by the Town Board of the Town of Mamaroneck on April 17,1996 at 8:15 PM or as soon thereafter as is possible, in the Court Room of the Town Center, 740 W. Boston Post Road, Mamaroneck, New York to consider adoption of the following Local Law. A Local Law to regulate traffic on Mountain Avenue at the merge point with No. Chatsworth Avenue. On motion of Councilwoman Wittner, seconded by Councilman Ryan, the hearing was opened. The Administrator explained that this stop sign would help to regulate traffic heading north on Mountain Avenue and that it would be replace the current yield sign. The Supervisor asked if anyone wished to speak either in favor of against the adoption. Councilwoman O'Keeffe commented that it would be easier to understand the locations of the signs if she were provided a map along with the proposed changes. There being no further comment, thereafter on motion of Councilman Ryan, seconded by Councilwoman O'Keeffe, the hearing was closed. On motion of Councilwoman O'Keeffe, seconded by Councilwoman Wittner, the following law was unanimously adopted: LOCAL LAW NO. 8 - 1996 This Local Law shall be known as "Stop Intersection - Mountain Avenue and No. Chatsworth Avenue". Section 1. Purpose: To regulate the traffic traveling north on Mountain Avenue by replacing the yield sign with a stop sign where Mountain Avenue merges with No. Chatsworth Avenue. Section 2. Regulation of Traffic on Mountain Avenue: Vehicles shall be required to come to a full stop on Mountain Avenue at its merge point with No. Chatsworth Avenue. Section 3. Signs to be Erected: Appropriate signs shall be erected at the merge point of Mountain Avenue with No. Chatsworth Avenue as provided in Section 2. 4 April 17, 1996 Section 4. Severability: Should any provision of this Local Law be declared invalid or unconstitutional by any court of competent jurisdiction, such declaration of unconstitutionality or invalidity shall not affect any other provisions of this Local Law which may be implemented without the invalid or unconstitutional provision. PUBLIC HEARING -Amendment to Parking Lot Law NOTICE OF PUBLIC HEARING PLEASE TAKE NOTICE, that a Public Hearing will be held by the Town Board of the Town of Mamaroneck on April 17,1996 at 8:15 PM or as soon thereafter as is possible, in the Court Room of the Town Center, 740 W. Boston Post Road, Mamaroneck, New York to consider adoption of the following Local Law. A_Local Law entitled Amendment to Chapter 54 of the Code of the Town of Mamaroneck Parking Lots. This laws to modify provisions for issuance of non-resident permits and transfer of parking permits. On motion of Councilwoman O'Keeffe, seconded by Councilman Ryan, the hearing was opened. The Administrator explained that this matter had been originally discussed at a meeting in January when non-residents were notified that they would have to relocate their cars from the Town commuter lot. This had come about because the Village of Larchmont were going to renovating there lots and had notified residents of the Town that they would not be able to park there during the period of construction. This has caused a domino effect, since it has now become necessary to displace non-resident parkers to allow for spaces for our residents. At the request of the Supervisor, we looked at alternative sites and found that we could make available 37 spots - 17 on Baldwin Avenue and 20 in Lot 4. The Supervisor thanked him and said that she thought it an equitable solution because it provides parking for our Town residents while continuing to accommodate those non- resident parkers who have been long time users. The Supervisor entered the following letter into the record: TO: Ms. Elaine Price, Supervisor Mr. Steve Altieri, Administrator Ms. Patricia DiCioccio, Town Clerk Mamaroneck Town Council Members RE. Non-Resident Parking Since I will be unable to attend your work session this evening, I wanted to go on record to thank you for the hearing given my neighbors and me at your March meeting. We appreciate the effort you are making on our behalf. While we realize the dilemma that you are facing, there were some suggestions that we hope you will pursue. Among them, consideration of utilizing some of the parking space around the perimeter of the park, on-street permits and, of course, simply expanding the roster of permits available for the lot itself since historically many permit holders do not use the spaces. 5 April 17, 1996 While.the capability of parking in a Larchmont/Town of Mamaroneck lot is vastly simpler for your near neighbors, an equally compelling reason, from your viewpoint, is our close and continuing relationship with the villages, economic and otherwise. In particular, we hope you won't leave us high and dry while you are trying to develop workable solutions. If you haven't found a viable alternative by May when our permits terminate, perhaps you will consider temporary permits for current non-residents. Issue six month permits to see how it actually works out when the added Mamaroneck residents are counted in, or to allow time to put some other solution in place. Again, thank you for your graciousness. I look forward to seeing you on April 17th. Claire K. Coleman Then on motion of Councilman Ryan, seconded by Councilman Weprin, the hearing was closed and on the same motion and second the following local law was unanimously adopted: LOCAL LAW NO. 9 - 1996 This Local Law is for the purpose of amending Chapter 54 of the Code of the Town of Mamaroneck originally adopted December 20, 1967. Section 1. Purpose: As a result of the limitations placed on available parking by other nearby communities and the limited available _parking within the Town, the purpose of the Local Law is to restrict the issuance of parking permits in Town owned parking Lots 1 and 3 to residents of the Town. This law further makes minor administrative changes in the provisions for placement and transfer of parking permits. Section 2. Resident Parking: Section 54-8 shall be amended by adding a new Section C which shall read as follows: C. The Town Clerk may only issue permits to residents of the Town for parking in Lots 1 and 3. At'the time of.application for a parking permit for either Lot 1 or Lot 3, the applicant shall submit proof of residency to the Town Clerk. Section 3. Attachment of Decal: Section 54-9 (A) and (B) are amended to read as follows: A. The Town Clerk, upon issuing a permit, shall also issue a decal, which can be affixed to the rear bumper, bearing the permit number assigned, the name of the Town, the lot number for which it is issued and the expiration date. B. The decal issued by the Town Clerk must be affixed to the left rear bumper of the automobile for which it is issued. Section 4. Transfer of Ownership: Section 54-11 is amended to read a follows: Upon the sale or other transfer of an automobile for which a permit has been issued, the permittee shall remove the decal, return it to the Town Clerk and upon proper application 6 April 17, 1996 and payment of a fee to be fixed by Town Board resolution, have a replacement assigned for the unexpired term of the original permit. Under no circumstances shall the fee for the unexpired term be refunded. Section 5. Severability: Should any provision of the Local Law be declared invalid or unconstitutional by any court of competent jurisdiction, such declaration of unconstitutionality or invalidity shall not affect any other provisions of this Local Law which may be implemented without the invalid or unconstitutional provision. Section 6. Effective Date: This Local Law shall take effect immediately. AFFAIRS OF THE TOWN 1. Appointment - Human Rights Commission The Supervisor said that the nominee for the opening on the Human Rights Commission, was Robin Nichinsky, a neighbor and friend and it was with great pleasure that she offered her name as a member. Then on motion of Councilwoman O'Keeffe, seconded by Councilwoman Wittner, it was unanimously, RESOLVED, that the Town Board hereby appoint Robin Nichinsky, 22 Rockridge Road, as a member of the Human Rights Commission, effective immediately, said term to expire May 1999. 2. Designation of Polling Places The Town Clerk said that the designation of polling places by the Town Board was required by State Law. She said there was one change in District 18, which is presently located at the Volunteer Ambulance Corps, has to be relocated to the Weaver Street Firehouse. After discussion, on motion of Councilman Ryan, seconded by Councilwoman O'Keeffe, it was unanimously, RESOLVED, that the Town Board does hereby designate the following locations as Polling Places: ELECTION DISTRICTS - LOCATION.& NUMBER DISTRICT#1 VM DISTRICT#15 T MAMARONECK AVE. Authorization -Settlement of Litigation -Sarah Neuman Nursing Home Supervisor Price recused herself from this matter, stating a prior affiliation. Deputy Supervisor Ryan then was requested to act as Supervisor regarding this matter. Mr. Silverberg reported that a final settlement had been agreed to regarding this matter, he outlined that: the nursing home will reimburse the Town $183,000 payable in two payments annually for(7) seven years for a total of$150,000, then over the next(3) three years $11,000 each year commencing in 2003. In the year 2006, the pilot payment of $11,000 a year will commence. There will however be no gap in payments as the additional payments sought by the Town will be made during the years 2003 through 2005. The nursing home will go on the exempt roll for the 1993 assessment year, the school will reimburse the Town the amount of remaining taxes which is approximately 8 April 17, 1996 $220,000. This will be paid back over a (3) three year period through adjustment in tax warrants as determined through the Tax Receiver's office. The balance of funds paid by the Town to the County on the 1993 assessment will be ordered refunded by the Court as part of an Order issued by the Court approving this settlement. There were questions regarding the exemptions and payments, which were explained. Acting Supervisor Ryan noted that this agreement had been worked on by many people and thought it was a good compromise. On motion of Councilwoman Wittner, seconded by Councilwoman O'Keeffe, it was RESOLVED, that the Town Board does hereby authorize the execution of the settlement agreement for taxes between the Town of Mamaroneck and Sarah Neuman Nursing Home as follows: $183,000 payable in two payments annually for(7) seven years for a total of$150,000, then over the next(3) three years $11,000 each year commencing in 2003. Report of Bids - Contract TA96-1 -Traffic Signal - Murray & Forest Avenues The Administrator reported that five bids had been received for this contract as follows: Warde Election $46,499.75 Congers, NY Verde Electric $47,274.25 Mt Vernon, NY Yonkers Electric $49,517.50 Yonkers, NY Herbert Martin Inc. $61,230.00 Yonkers, NY Powerline Constructors $61,612.50 Clinton, NY He recommended that the contract be awarded to the lowest bidder meeting specifications, which was Warde Electric, and that the project budget include a 10% contingency to allow for excavation work to install support poles for the signal, resulting in a project budget of$51,500, said funds to be borrowed through a short term bond anticipation note. 9 April 17, 1996 On motion of Councilman Ryan, seconded by Councilwoman O'Keeffe, it was unanimously, RESOLVED, that the Town Board does hereby award the contract TA-96-1 for a Traffic Signal located on Murray And Forest Avenues to Warde Electric, Congers, New York, the lowest responsible bidder meeting specifications, said bid submitted is $46,499.75; and BE IT FURTHER RESOLVED, that a project budget be allotted in the amount of $51,500 to allow for a 10% contingency for excavation work to allow for support poles for the traffic signal, funds to be borrowed from a short term bond anticipation note; and BE IT FURTHER RESOLVED, that the Town Administrator is authorized to execute this contract behalf of the Town, subject to review by the Town Attorney. 5. Set Date for Public Hearing -Amendment to Tree Law Councilwoman Wittner explained that the amendment will allow the addition of two people to the Tree Commission and would enable the Commission to prepare reports and to keep a current inventory of trees. On motion of Councilman Ryan, seconded by Councilwoman Wittner, it was unanimously, RESOLVED, that the Town Board does hereby set the date for public hearing for the amendment to the Tree Law for May 1, 1996; and BE IT FURTHER RESOLVED, that the Town Clerk be authorized to publish notice of same in an official Town newspaper. 6. Authorization - Insurance Settlement The Administrator explained that this claim had been instituted by Laura Cornish, who in 1992, injured her back, when the car she was a passenger in, hit a sewer grate in the Town's parking lot. She received $35,000 from her own insurance company, and Reliance Insurance, the Town's Insurance Company, settled her claim in the amount of $2,500. On motion of Councilman Ryan, seconded by Councilwoman Wittner, it was unanimously RESOLVED, that the Town Board does hereby authorize the payment of$2,500.00 to Reliance Insurance Co., for full settlement of a claim brought by Laura Cornish, who injured her back. 10 April 17, 1996 7. Authorization Increase to Parking Meter Fees The Town Clerk explained that she was proposing that fees for the parking meters in the Town Commuter lot be increased from 25 cents for two hours to 25 cent for 1 1/2 hours. It was noted that the fees had not increased in five years and that it was the same fee charged by the Villages of Larchmont and Mamaroneck. Ernie Odierna objected, saying that its just another tax, that there's no reason why we had to charge the same as the villages, and thought the increase onerous. The Town Clerk replied that keeping pricing near or the same as neighboring communities kept our lot from becoming a more popular option because it was less expensive, and she also reiterated that it was a fair increase, not overly onerous, reflecting usage fees and the given maintenance costs were borne by the specialty group through a user fee, rather than to have that cost added budget-wide to all residents. Ernie threatened to join the Tax League, he was informed by the Clerk that the League was very much in favor of more reflective user fees, rather than tax increases. On motion of Councilman Weprin, seconded by Councilwoman Wittner, it was unanimously, RESOLVED, that the Town Board does hereby authorize the increase to parking meter fees from the present 25 cents per two hours to 25 cents for one and one-half hours. 8. Authorization -Transfer of Funds The Administrator said that in order to purchase computers and vehicles, that had all been previously approved for purchase, it would be necessary to transfer funds in the amount of$58,000. The breakdown is $5,000 for computers and $53,000 for vehicles. On motion of Councilwoman Wittner, seconded by Councilwoman O'Keeffe, it was unanimously, RESOLVED, that the Town Board does hereby authorize the Town Comptroller to transfer funds in the amount of$5000 to Capital Project# 94-01 - Purchase of Computers; and BE IT FURTHER, RESOLVED, that the Town Board does hereby authorize the Town Comptroller to transfer funds in the amount of$53000 to Capital Project# 91-01 - Purchase of Vehicles. 9. Salary Authorization - Recreation On motion of Councilman Ryan, seconded by Councilwoman Wittner, it was unanimously RESOLVED, that the Town Board does hereby authorize the payment of salary to Danielle Severino, Alt.
