FIRE COMMISSIONERS OF THE TOWN OF MAMARONECK, HELD ON
WEDNESDAY, DECEMBER 6, 1995 AT 8:15 PM IN THE COURT ROOM

CONVENE EXECUTIVE SESSION
The Executive Session of the Town Board to discuss certiorari matters was duly opened
at 7:30 PM in Conference Room A of the Town Center. On motion duly made and
seconded the Board adjourned at 8:15 PM to the Court Room to Reconvene the Regular
Meeting.

The Regular meeting of the Town Board was called to order by Supervisor Price at 8:20
PM.

CALL TO ATTENTION
Supervisor Price pointed out to those assembled the locations of exits as required by law
for public gatherings.
PROCLAMATION - Sunny Goldberg
The Supervisor introduced Sunny Goldberg to everyone and then read the following
p °L:amation to her.
PROCLAMATION
WHEREAS, Sunny Yeddis Goldberg has served as President of the
Larchmont\Mamaroneck Community Television (LMC-TV)for 7 years; and
WHEREAS Sunny's heroic and consistently innovative fund-raising efforts enabled
LMC-TV to grow over the years from a single channel with a part-time staff and

occasional programming-to a media servicing three municipal governments and two
school districts with two studio programming on three channels; and
WHEREAS, her commitment to LMC-TV and our residents has been repeatedly
demonstrated by her professionalism and aim to heighten community awareness and
increase community participation through the making and viewing of community
television, and to encourage programming reflecting the concerns, interests and
activities of our community.
NOW THEREFORE, BE IT
RESOLVED that I Elaine Price, Supervisor, and the members of the Town Council of the
Town of Mamaroneck present this Proclamation to Sunny Goldberg for her
professionalism and extraordinary service to our community. We are looking forward to
her continued input as current chair of the LMC Emeritus Board, for which (we are all
deeply grateful). That she will continue serving our community and LMC-TV Emeritus
Board.
IN WITNESS WHEREOF, I have hereunto set my hand and caused the seal of the Town of
Mamaroneck to be affixed this 16th day of November 1995.

Supervisor Price then presented her with the proclamation commemorating her service
to the community and all the Board members added their thanks.
Ms. Goldberg spoke on the history of LMC and said that she had enjoyed helping adding
that it had provided an opportunity to know this community on a different level, and that
more people should take advantage of the program work on LMC.

There being no further business to come before the Commission, on motion of
Councilwoman O'Keeffe, seconded by Councilwoman O'Flinn, the Commission
unanimously adjourned at 9:01 PM.
PUBLIC HEARING - 1996 Preliminary Budget
The Public Hearing was opened on motion of Councilwoman O'Keeffe, seconded by
Councilwoman O'Flinn.
The Town Clerk presented the following notice of PUBLIC HEARING on the PRELIMINARY
BUDGET FOR 1996 for the record:
TOWN OF MAMARONECK, NEW YORK
NOTICE IS HEREBY GIVEN that a Public Hearing will be held by the Town Board of the
Town of Mamaroneck, New York on Wednesday, December 6, 1995 at 8:15 PM in the
Court Room of the Town Center, 740 W. Boston Post Road, Mamaroneck, New York to
consider the preliminary budget for the calendar year commencing January 1, 1996 and
ending December 31, 1996. All citizens (especially senior citizens) are invited to attend
and provide the Board with written and oral comments and ask questions concerning the
Town's.entire preliminary budget. The entire preliminary budget can be inspected by the
public from 8:30 AM to 4:30 PM, Monday through Friday in the Town Clerk's Office, Town
Center, 740 W. Boston Post Road, Mamaroneck, New York.
PLEASE TAKE FURTHER NOTICE, that the proposed salaries of the members of the
Town Board are as follows: Supervisor, $21,000; Town Council, (4) $5,000 each, and the
proposed salary for the Town Clerk is $51,810 and the Town Justices (2) $18,055.
Supervisor Price then thanked everyone who had worked on this budget, saying that this
document had been looked at, and reviewed at many meetings held at night, morning
and on weekends, and that she thought it was solid, but that more review was always an
option, she then requested that the Administrator do the actual presentation.
The Administrator reported that the budget for 1996 is the work plan for the delivery of
services and programs for the Board and staff, and that many questions were raised
each year such as the type of services required by safety &welfare, and the services that
are demanded by the public. He said that these items are reviewed with the sense of the
most cost effective as well as efficient way to provide those services. He noted that there
are also mandates that are presented by federal, state, and county government that must
be_ adhered to that cost dollars.
Mr. Altieri said that under this budget plan the real property tax rate in the Town wide
portion of the budget will not increase for 1996; the tax rate for the Unincorporated area
will be $150.80 per$1000 of assessed valuation, which represent an increase of$7.15 or
4.9 from 1995.
He outlined the following:

The Administrator also explained that revenues for 1996 are expected to stay stable with
the exception of the ambulance district, noting that the Town would not be receiving any
significant increase in revenues from the State. He spoke also of the economy,
department income, expenditures, contract negotiations with the unions, and
emphasized that the biggest increase in expenditures is in the amount of property tax
refunds, adding that coupled with the reduction in assessments the impact on the tax
rate is significant.
He noted the following: appropriations for the Townwide budget increased by $124,840
or 2.4% over the current year, which reflects the services and programs provided to the
entire Town including villages; Unincorporated budget would increase by $315,535 or
5.6%, which includes police services, building inspection services and other services,
with an increase of$80,000 toward tax refunds which now is $100,000; that the
Larchmont Library budget was increased by $25,000 which is an estimated increase. Mr.
Altieri cited the budget amounts for Highway funds, fire district, Larchmont/Mamaroneck
Joint Sanitation District and the Ambulance District as well as the Capital Projects to
replace equipment, restore infrastructure and to maintain facilities, the total of which is
$1.8 million.
Mr. Altieri ended his presentation by saying that this budget was a reflection of much
work by the staff, Town Board, and resident input, and thanked them all.
The Supervisor thanked him and asked if anyone wished to speak in favor of or against
the budget.
Richard Murphy questioned certain items, and asked why constant refund in taxes were
being made when prices of houses were increasing.
Supervisor Price replied that prices are not increasing, adding that the Town has an
Assessment Review Board and a consultant that reviews these suits for reductions, and
complicated formulas are used in evaluating, but that there seems to be no end in site,
that she has been in touch with our legislators regarding the reassessment issue, that is
necessary but is stalled, she urged Mr. Murphy to join in urging the issue of
reassessment.
Mr. Murphy also spoke on: rent control, cooperative apartments, condominiums, and
that assessment seems to be the largest issue facing the Town.
Bill O'Gorman, who said he had attended the budget work session, stated that the one
item he would look at would be highway & police department overtime, but that this
seemed to be a good budget.
Odierna said that he had also attended most of the work sessions, and
commended the Board members for their diligence.
The Supervisor thanked him. She said that the budget would be voted on at the next
meeting and thanked staff members and everyone involved in the process.
On motion of Councilwoman O'Flinn, seconded by Councilman Weprin, the hearing was
closed at 9:30 PM.
PUBLIC HEARING - Senior Citizen Tax Exemption
The Public Hearing was opened on motion of Councilman Ryan, seconded by
Councilwoman O'Keeffe.
The Administrator explained that the purpose of the hearing was to amend the guidelines
for exemptions for Seniors increasing the limits.

The Supervisor asked if anyone wished to speak in favor or against the amendment to
the law.
Mr. O'Gorman stated that he was in favor of a law that would help seniors to realize
exemptions that would enable them to stay in this community.
There being no further comment, except from the Supervisor who said that these were
stabs mandated guidelines, on motion of Councilman Ryan, seconded by Councilwoman
O'Flinn, the meeting was closed and on their motion and second the law was adopted
unanimously as follows:
LAW NO. 13-1995
The local Law shall amend Local Law No. 12 of 1993, Senior Citizen Tax Exemptions.
Section 1. Purpose:
The purpose of this local law is to amend Section 74-7 of the Code of the Town of
Mamaroneck to conform with recent amendments to the enabling provisions of Real
Property Tax Law Section 467.
Section 2. Amendments:
Section 74-7 shall be amended to read as follows:
Real property owned by persons sixty-five (65) years of age or over shall be exempt from
Town taxes, except district taxes, to the extent of fifty per centum (50i) of the assessed
valuation or such lesser per centum of assessed valuation as hereinafter specified,
subject to the following conditions:
A. The owner or all of the owners must file an application annually in the Assessment
office of the Town in which the real property is located. Applications must be filed in the
Assessor's office on or before the taxable status date of the Town assessment roll, which
is June 1 of each calendar year for taxes payable in the following calendar year.
B. In order to be eligible to apply for a partial exemption in the amount of fifty per
centum (50%) of the assessed valuation, the income of the owner or the combined
income of the owners must not exceed seventeen thousand five hundred dollars ($17,
501 00) (M)from all sources as set forth in such Section 467, as amended, for the twelve
(12) consecutive months prior to the date that the application is filed. where title is vested
in either the husband or wife, the combined income may not exceed such a sum.
C. The owner or all of the owners of real property located in the Town, who are sixty-
five (65) years of age or older and whose income or combined income from all sources
for said twelvemonth period exceeded the maximum amount set forth in Subsection B by
less than seven thousand five hundred dollars ($17,500.00) shall be eligible to apply for a
partial exemption as set forth in the following table, in which M stands for the income
specified in Subsection B.

D. The real property tax exemption provided herein on real property owned by
husband and wife, one (1) of whom is sixty-five (65) years of age or older, once granted,
shall not be rescinded solely because of the death of the older spouse so long as the
surviving spouse in at least sixty-two (62) years of age.
E. Title to the property must be vested in the owner or, if more than one (1), in all the
cvnors for at least twenty-four(24) consecutive months prior to the date that the
application is filed.
Section 3. Effective Date:
This local law shall take affect immediately.
PRESENTATION - Hommocks Pool Improvements
The Supervisor introduced William Zimmerman, Superintendent of Recreation, who
presented the proposed improvements to the Hommocks Pool. There then ensued a
lengthy discussion regarding possible options.
AFFAIRS OF THE TOWN
1 . Appointment - Cable TV Board of Control Administrator
On motion of Councilman Ryan, seconded by Councilman Weprin, it was unanimously,
RESOLVED, that the Town Board does hereby reappoint Joseph P.
Fraioli, to the position of Administrator for the Cable TV Board of
Control for a term of two years, said term to expire November 1997.
2. Transfer of Funds - Firehouse Renovations
The Administrator requested the Board to approve a transfer of funds in the amount of
$11,500 from the trust account to capital fund for the planting of trees and shrubs at the
firehouse that was required by both the Board of Architectural Review and the Planning
Board.

On motion of Councilwoman O'Flinn, seconded by Councilman Ryan, it was
unanimously,
RESOLVED, that the Town Board does approve the transfer of
funds in the amount of$11,500 from trust account T-97 to the
capital fund for Project 93-4 - Renovation of Fire Headquarters, the
funds are for the planting of trees and shrubs at the renovation
site.
3. Westchester Joint Water Works -Water Charge Arrears
The Administrator advised the Board that in order for the arrears charges to appear as
an additional charge on a tax bill this item would have to be approved by the Town
Board, and in response to a question replied that there were only two bills belonging to
the same person at different addresses.
On motion of Councilwoman O'Flinn, seconded by Councilman Ryan, it was
unanimously,
RESOLVED, that the Town Board does hereby authorize the
inclusion of water arrears in the 1996 tax levy of the Town of
Mamaroneck for aggregate amount of$804.38 for the following:

4. Authorization - Insurance Claim Settlement
Mr. Altieri said that this was a request to settle a claim in the amount of$5,000 to
Reliance Insurance Company our carrier, who settled for that amount with David Sparano
for an incident when Mr. Sparano fell at the Ice Rink on March 3, 1989.
On motion of Councilman Ryan, seconded by Councilman O'Flinn, it was unanimously,
RESOLVED, that the Town Board does hereby authorize the
settlement of claim brought by David Sparano, who fell at the
Hommocks Ice Rink on March 3, 1989, the settlement is for$5,000
to be paid to Reliance Insurance Company who settled the claim on
our behalf.
5. Authorization - Settlement of Certiorari Matters
This item was held over.
6. Authorization - Sale of Land - Block 109, Lot 326
On motion of Councilman Ryan, seconded by Councilman O'Flinn, it was unanimously,

WHEREAS, the Town currently owns a parcel of property, located
at Locust Ridge Road near Knollwood Drive, of approximately 200
square feet, and known and designated as Block 109, Lot 306.
WHEREAS, the property is adjacent to a lot owned by Edward and
Mary Grace Erbacher who require its use for their driveway.
RESOLVED, that the Board hereby declare Lot 109, Block 306, on
Locust Ridge Road surplus property no longer required by the
Town:
RESOLVED, based upon information supplied by the Town
assessor to the value of similarly situated properties in the Town of
Mamaroneck, that Block 109, Lot 306 should be sold for a price of
$350.00 to Edward and Mary Grace Erbacher; and
AND BE IT FURTHER
RESOLVED, subject to the provisions of permissive referendum
the Supervisor is authorized to execute a deed and any other
necessary documents for the purpose transferring ownership to
Edward and Mary Grace Erbacher for$350.00.
6. Salary Authorizations - Recreation Department
On motion of Councilman Ryan, seconded by Councilwoman O'Keeffe, it was
RESOLVED, that as provided for in the 1995 budget the Town
Board does hereby approve the authorization of salary to the
following:
John Chevalier, Youth Hockey Coach, $ 1 1/hour, off active retroactive to 11/18/95.
Melissa Mirabile, Alternate Life Guard, Hommocks Pool, $6/hour, effective retroactive to
11/25/95
Joseph Farah, Alternate Life Guard, Hommocks Pool, $7.75/hour,
effective retroactive to 11/25/95.
Eric Sokoloff, Alternate Key Attendant, Hommocks Pool, $4.75/hour, effective retroactive
to 11/25/95.
Yir Li, Alternate Key Attendant, Hommocks Pool, $5.50/hour,
effective retroactive to 11/25/95.
Kathryn Brannigan, Alternate Key Attendant, Hommocks Pool, $5.25/hour, effective
retroactive to 11/25/95.
Bobby Lunde, Alternate Skate Guard, Hommocks Park Ice Rink, $6/hour, effective

ADJOURNMENT
Supervisor said that the next Board meeting would be held on December 20, 1995 and
on motion of Councilwoman O'Flinn, seconded by Supervisor Price the meeting was
adjourned in Memory of Phyllis Burs at 11:54 PM.
