REGULAR MEETING OF THE TOWN BOARD AND THE BOARD OF FIRE COMMISSIONERS OF THE TOWN OF MAMARONECK, HELD ON WEDNESDAY, OCTOBER 25, 1995 AT 8:15 PM IN THE COURT ROOM OF THE TOWN CENTER, 740 W. BOSTON POST ROAD, MAMARONECK,NY CONVENE EXECUTIVE SESSION The Work Session of the Town Board was called to order at 7:15 PM to discuss commercial Garbage Collection Program then at 7:45 the Board adjourned to Executive Session to discuss personnel and real estate in Conference Room A of the Town Center. On motion duly made and seconded the Board adjourned at 8:15 PM to the Court Room to Reconvene the Regular Meeting. CONVENE REGULAR MEETING The Regular meeting of the Town Board was called to order by Supervisor Price at 8:25 PM. O'Keeffe Councilman Barry Weprin Also Present: Carol Acocella, Deputy Town Clerk Stephen V. Alfieri, Town Administrator Steven M. Silverberg, Town Attorney CALL TO ATTENTION Supervisor Price pointed out to those assembled the locations of exits as required by law for public gatherings. BOARD OF FIRE COMMISSIONERS The meeting was called to order by Commissioner Price at 8:25 PM in the Court Room. Present were the following members of the Commission: Commissioner: Elaine Price Commissioner: Kathleen Tracy O'Flinn Commissioner: Paul A. Ryan Commissioner: Valerie M. O'Keeffe Commissioner: Barry Weprin October 25, 1995 1. AFFAIRS OF THE TOWN The following item was taken out of order 2 October 25, 1995 4. Discussion- Commercial Garbage Collection The Administrator outlined the program and emphasized the point that collection of commercial garbage was increasing; that it would be necessary to purchase a new truck at a cost of$40,000 for a used vehicle or$100,000 for a new one; that it would be necessary to hire part-time help to assist with bookkeeping, paperwork and billing; that commercial route trucks would only carry two men rather than the usual four; and that all trucks would now carry three men rather than four. There followed a lengthy discussion on how best to accomplish the above. Councilwoman O'Keeffe voiced concern about the necessity of hiring someone for paperwork. Supervisor Price said that the cost would be offset by the billing to the businesses and that there was to be no increase in costs. They then returned to the correct agenda order 1. Submission of Tentative Town Budget Supervisor Price explained that this was an initial submission of a working document that would be reviewed by the Town Board at many work sessions, she outlined the necessity by State Law that the Budget be adopted by December 20th or before. The Administrator then presented an overview of the budget emphasizing that this document represented mostly budget submissions made by staff with their recommendations. He said that copies would be made available the next day in the Town Clerk's office. John Perone and Ernie Ordernia then questioned certain aspects of the budget. 2. Authorization - Easement Agreement- 70 Echo Lane The Administrator explained the easement agreement and they held a discussion regarding changes to be made to paragraph 6, to better clarify the word"premises and restoration of asphalt", which would then be reviewed by the Town Attorney. On motion of Councilman Ryan, seconded by Councilwoman O'Keeffe, it was unanimously, RESOLVED, that the easement agreement between the Town of Mamaroneck and Richard Martin for property located at 701Echo Lane, is hereby authorized by the Town Board with the provision that certain word changes be made in Paragraph 6 and conditioned that they final document be reviewed and approved by the Town Attorney. 3. Authorization Westchester County Police Mutual Aid Agreement The Administrator explained the agreement which has existed for many years that allows for aid in cases of emergency through use of equipment and manpower as is deemed necessary. He said that there are different severity's that are defined in the agreement and in terms of cost, the municipality that requests assist must reimburse the assisting municipality for all cost incurred for injuries or otherwise. He added that this agreement had been previously existed and the new one had been reviewed by the Attorney, Police Chief and himself and authorization to execute would now be necessary. 3 October 25, 1995 i RESOLVED, that the Town Board does hereby authorize the Town Administrator to execute agreement between the Town and the County for the Westchester County Police Mutual Aid Agreement. 5. Authorization- Settlement of Insurance Claims 1 Mr. Altieri explained that the Building Inspector had been involved in an accident in January of 1993 while driving a Town vehicle, a claim had been brought by a Mr. Wheelock who had damage to here car during the accident which totaled $205.65. On Motion of Councilwoman O'Flinn, seconded by Councilwoman O'Keeffe, it was unanimously, RESOLVED, 'that the Town Board does hereby authorize the payment of$205.65 for the settlement of claim brought by Ms. Wheelock for damages to her car on January 27, 1995. 6. Salary Authorization-Recreation Recreation Salaries RESOLVED, as provided for in the 1995 Town Budget, the Town Board does hereby authorize the payment of salary to the following: Kendra Langelotti, Alt.Key Attendant, Hommocks Pool, $4.75/hour, retroactive to 10/16/95. Mike Eggers, Asst. Swim Coach, Hommocks Pool, $11/hour, retroactive to 10/17/95. Billy Collins, Open House Alternate, $35/Sesion, Effective 10/20/95. WRITTEN COMMUNICATIONS The Supervisor read a letter from a M. Eldring in regard to the ban on leaf blowers. I 10/16/95 c: TB box-to be read in theTB 5 Byron Lane Larchmont, NY 10538 ' October 11, 1995 record (10/25/95) Town Administrator The Town Council Town of Mamaroneck Ladies and Gentlemen: I wish to thank you for imposing the ban on leaf blowers this summer, a great improvement in the standard of living in this community. ' 4 October 25, 1995 Perhaps you can read into the record that this action has * decreased dust and;dirt deposits on homes, as leaf blowers raise clouds of dust two stories high within two to three houses down the block * likewise has reduced the spread of dust-borne lawn chemicals and insecticides, a health hazard to children * reduced the spread lof pollen, dust, etc., a major benefit to the ever increasing section of the population, especially children, that suffer from asthma(it is strange that MDs have not as yet linked the increased use of leaf blowers over the last 15 years to;the increase in asthma) * reduced the likelihood of-spreading lead paint. particles, that currently are being released in our neighborhood by increasing numbers of houses being sanded by painters, a threat toll children's health. Again, you, and may I suggest that for the next year you could perhaps require performance bonds from all lawn services, to refrain from illegal leaf blowing, dumping of debris on town property, using the lawnmower to blow grass clippings into the street (where it winds up in the storm drains and the Sound),or not sweeping up clippings from the street. On small lots the use of bamboo rakes rather than blowers could be just as effective, if homeowners would insist --the lawn services certainly have enough workers compared to lawn services 5 or 10 years ago. With best wishes for the Town Legislators, M. Eldring ORAL COMMUNICATIONS Councilwoman O'Keeffe stated that she thought that there should be an adoption of legislation to change the makeup of the Board of Ethics to make it bipartisan. She suggested that two members be from a minority party. The Supervisor informed her that the original three members of the Ethics Board had • written the original law and that the Chair was a Republican and she had no knowledge as to the others political enrollment. She also invited the Councilwoman to submit names that would certainly be reviewed. Further discussion ensued.
