FIRE COMMISSIONERS OF THE TOWN OF MAMARONECK, HELD ON
WEDNESDAY, SEPTEMBER 6, 1995 AT 8:15 PM IN THE COURT
ROOM OF THE TOWN CENTER, 740 W. BOSTON POST ROAD,
MAMARONECK, NY
CONVENE EXECUTIVE SESSION
The Executive Session of the Town Board to discuss certiorari matters was duly opened
at 6:30 PM in Conference Room A of the Town Center. On motion duly made and
seconded the Board adjourned at 8:15 PM to the Court Room to Reconvene the Regular
Meeting.
CONVENE REGULAR MEETING
The Regular meeting of the Town Board was called to order by Supervisor Price at 8:15
PM.

CALL TO ATTENTION
Supervisor Price pointed out to those assembled the locations of exits as required by law
for public gatherings.
BOARD OF FIRE COMMISSIONERS
The meeting was called to order by Commissioner Price at 8:55 PM in the Court Room.

Commissioner Weprin presented fire claims for authorization of payment , thereafter on his
motion, seconded by Commissioner Ryan, it was unanimously:
RESOLVED, that this Commission hereby authorizes payment of the following Fire
Department claims as approved by the Fire Chief and audited by the Comptroller's

There being no further business to come before the Commission, on motion of
Councilwoman O'Keeffe, seconded by Councilwoman O'Flinn, the Commission
unanimously adjourned at 8:35 PM.
PUBLIC HEARING - Parking Prohibition - Senate Place
On motion of Councilman Ryan, seconded by Councilwoman O'Flinn, the hearing was
opened unanimously.
The Supervisor stated that the purpose of this hearing was to address a problem that
exists in this area due to an enormous number of cars dropping off and picking up
children when school is in session and that the law would restrict parking on the south
side of Senate Place from Daymon Terrace to the end of the street.

The Supervisor then read the following letter into the record:
Dear Elaine:
I will not be able to attend tomorrow. I thank you and the Board for your
continued efforts to improve the emergency vehicle access and overall
traffic safety on Senate Place. I understand that you have the support of
the Fire Department on single side parking during school hours,which
was the original recommendation of the Traffic Committee. I hope that
this measure is finally enacted. We have been fortunate that there have
been no serious emergencies during school hours since the matter was
first raised.

There followed a prolonged discussion on the pros and cons of the sign and proposed
law.
After motion duly made and seconded, the hearing was closed.

On motion of Councilwoman O'Flinn, seconded by Councilman Weprin, the following law
was unanimously adopted:
LOCAL LAW NO. 9-95
This Local Law shall be known as Parking Prohibition, Senate Place

September 6, 1995
Section 1. Purpose:
The purpose of this Local Law is to correct a condition which exists on Senate Place due
to the large number of cars which park on Senate Place during school hours, resulting in
a danger to pedestrians.
Section 2. Parking Prohibited:
There shall be no parking on the south side of Senate Place from its intersection with
Daymon Terrace to its dead end during the hours from 8:00 am to 4:00 PM on all days in
which the Mamaroneck public schools are in session.
Section 3. Signs to be Erected:
The Highway Department shall erect appropriate signs implementing the provisions of
Section 2 of this local law.
Section 4. Fines and Penalties:
Violation of this local law shall be a violation punishable by a fine in an amount to be se
from time to time by Town Board resolution for parking violations.
Section 5. Severability:
Should any provision of this local law be declared invalid by a court of competent
jurisdiction, such declaration of invalidity shall not effect any other section of this local
law which may be otherwise capable of enforcement.
Section 6. Effective Date:
This local law shall take effect immediately
PUBLIC HEARINGS - - No Parking Here to Comer on Palmer Avenue - Intersection
of Mamaroneck High School Drive
On motion duly made and seconded the public hearing was opened.
The Administrator said that this request had been before the Traffic Committee
and they were recommending that parking be restricted on Palmer Avenue near
the intersection with Mamaroneck High School exit because it restricts the view
of oncoming cars.
Because of some dispute with the exact location of the restriction and because
there was no map included this item was deferred to the next meeting. Richard
Mari, a member of the Traffic Committee requested the reinterpretation.

2. Authorization -WJWW Capital Project
The Town Administrator explained that a request was being made by
Westchester Joint Water Works to install a water main on Purchase Street in
Harrison which is part of one of the joint capital projects that had been
recommended for 1995. He said that the total cost of the project would be
$544,000, with the Town's share amounting to $115,300 which represents 21.2%
of the project.
After a brief discussion, on motion of Councilwoman O'Flinn, seconded by
Councilman Weprin, it was unanimously
RESOLVED, that Westchester Joint Water Works Capital Project A-1104 -
Installation of 2400 feet of 30" Transmission Main on Purchase Street in the Town
of Harrison is hereby authorized in the amount $115,300, or 21.2% of the Total cost
of the project which is $544,000.
3. Authorization - Easement Agreement - Sherwood Drive
The Administrator explained that agreement was in response to a building permit
application that had been made by the applicant at 70 Sherwood Drive for a deck
that was constructed on a ten foot easement area running through the property.
He said that the Town's concern would be if it became necessary to repair the
drainage utilities in the easement area that access would be blocked by the deck,
and that this agreement was drafted allowing responsibility to the owners with no
repair or replacement responsibility should it be necessary to remove the deck to
access the pipes.
There was a question on costs, which the Administrator said would be borne by
the owners.
Thereafter, on motion of Councilman Weprin, seconded by Councilwoman
O'Keeffe, it was unanimously,
After a brief discussion, on motion of Councilwoman O'Flinn, seconded by
Councilman Weprin, it was unanimously
RESOLVED, that the Town Board does hereby defer action on this item to the next
meeting when more information can be given.
4. Authorization -Auction of Town Land - Jason Lane

Mr. Altieri reported that the Town had held an auction of Town owned land and
that one lot on Gate House Lane had sold, and the other on Jason Lane did not
sell, he therefore was requesting that the minimum price for the Jason Lane lot
be reduced from $125,000 to $110,000, adding that the auction would be held in
October.
On motion of Councilwoman O'Flinn, seconded by Councilman Ryan, it was
unanimously
RESOLVED, that the Town Board does hereby reduce the minimum sale price for
the Jason Lane lot from $125,000 to $110,000.
5. Authorization - Deferred Compensation Plan
The Administrator outlined the deferred compensation plan for the Town and
reported that proposals had been received from nine companies and that a
committee had been formed of the following people to review the proposals:
Charlie Reilling, CSEA Ray Bingman, CSEA
Mike Cindrich, PBA John Infelice, PBA
Bill Premorosa, PFFA Bill Zimmermann, Management
Bill Jakubowski, Management Paulette Gabbriellini, Administration
He said that after the review that it had been decided to select PEBSCO, which
had been decided for many reasons: it had been endorsed by the Conference of
Mayors; its a subsidiary of nationwide Insurance Company, and it is geared
entirely toward deferred compensation programs.
Following discussion, on motion of Councilwoman O'Keeffe, seconded by
Councilman Ryan, they adopted the following resolution
WHEREAS, the Town of Mamaroneck has considered the establishment of a
deferred compensation plan to be made available to all eligible Town employees
and elected or appointed officials pursuant to Federal legislation permitting such
plans; and
WHEREAS, the Town committee for deferred compensation advertised for
proposals and having received same, evaluated the various proposals and
recommended the plan submitted by PEBSCO, AKA Public Employees Benefit
Services Corporation; and
WHEREAS, the Public Employees benefit Service Corporation (PEBSCO) as Plan
Administrator, agrees to hold harmless and indemnify the Town of Mamaroneck, its
appointed and elected officers and participating employees from any loss resulting
from PEBSCO's failure to perform it duties and services;
NOW THEREFORE, BE IT
RESOLVED, that the Town Board of the Town of Mamaroneck hereby adopts
PEBSCO's Deferred Compensation Program and its attendant investment options
and hereby establishes the Town of Mamaroneck Deferred Compensation Plan for
the voluntary participation of all eligible Town employees and elected or appointed
officials; and

BE IT FURTHER
RESOLVED, that the Town Administrator is authorized to execute a contract with
PEBSCO subject to final approval by the Town Attorney.
6, Authorization - Maintenance Contract - Hommocks ice Rink
The Administrator said that it is being requested that the contract for
refrigeration maintenance at the Hommocks Ice Rink with RAM Mechanical
Contractors be approved. He noted that the contract provides for scheduled and
unscheduled maintenance (at 40 hours per year) of the refrigeration and
dehumidification systems which will cost $6,600, exclusive of parts and fluids
etc., which incur extra cost.
After a brief discussion, on motion of Councilwoman O'Flinn, seconded by
Councilman Weprin, it was unanimously
RESOLVED, that Town Board does hereby authorize the contract with RAM
Mechanical Contractors at a base cost of$6,600 per year, and authorizes the Town
Administrator to execute same.
PROCLAMATION - Constitution Week - September 17 - 23, 1995
The Supervisor read the following:
PROCLAMATION
Constitution Week
WHEREAS, The Constitution of the United States, the guardian of our
liberties, is a product of reflection and choice, embodying the principles of
limited government in a Republic dedicated to rule by law, not by men; and
WHEREAS, September 17, 1995 marks the two hundred and eighth
anniversary of the signing of the Constitution of the United States of America by
the 1787 constitution Convention; and
NOW THEREFORE, BE IT
RESOLVED, that I, Elaine Price, Supervisor and the members of the Town Council
of the Town of Mamaroneck do hereby proclaim that the week of September 17
through 23, 1995 is hereby proclaimed as
Constitution Week
in the Town of Mamaroneck, and all of our citizens are urged to display the flag
and express gratitude for the privilege of American citizenship in our Republic
functioning under the superb body of laws - The Constitution of the United States
of America.
IN WITNESS WHEREOF, I have hereunto set my hand and caused the seal of the
Town of Mamaroneck to be affixed this 6th day of September 1995.

ADJOURNMENT
Supervisor said that she wanted to adjourn this meeting in memory of Leo Goldsmith a
former Town Supervisor that had recently passed away.
Upon unanimous vote the meeting was therefore adjourned in his memory at 9:48 PM.
