Silverberg, Town Attorney CONVENE REGULAR MEETING The Regular Meeting of the Town Board was called to order by Acting Supervisor O'Flinn at 7:00 p.m., at which time on a motion duly made and seconded, the meeting was unanimously declared adjourned into an Executive Session in Conference Room A to discuss personnel. At 7:30 p.m. the Board convened into a Work Session to discuss recreation issues at Hommocks Field. On motion duly made and seconded the Work Session was adjourned. RECONVENE REGULAR MEETING The Regular Meeting of the Town Board was called to order by Acting Supervisor O'Flinn at 8:25 p.m. CALL TO ATTENTION Acting Supervisor O'Flinn pointed out to those assembled the locations of exits as required by law for public gatherings. . BOARD OF FIRE COMMISSIONERS - The meeting was called to order by Commissioner O'Flinn at 8:30 PM in the Court Room. Westchester Update - George Latimer, County Legislator IMr. Latimer spoke on: the sewer districting and the different impacts should their be no federal moneys to help alleviate the costs to upgrade; he spoke on the proposed salary increase for County legislators and that he was not in favor of an increase; he said that the repaving of Murray Avenue:would be beginning soon; and that he had put a proposal forth before the County that should they adopt legislation to amend election districts that they and not the local communities should be responsible for all costs involved with remapping. The Town Clerk thanked him. He said that he had spoken to State Legislators regarding repealing the Wicks Law and that they were not very responsive. The Board members queried him regarding the dissolution of the 1% sales tax surcharge, to which he replied that he would have to look further into the matter. Everyone thanked him for his attendance and report. 2 March 15, 1995 PUBLIC HEARINGS-Bond Resolution -Water District (File No. 82461-378P) -Amendment to Cellular Antenna Law -Fee Schedule On motion of Councilwoman O'Keeffe, seconded by Councilman Ryan, the hearing was opened. The Administrator explained that this item was a proposal to replace water tanks within Water District No. 1 in the Town. Acting Supervisor O'Flinn asked if anyone wished to speak either in favor of or against this matter. There being no response, on motion of Councilman Ryan, seconded by Councilman Weprin, the hearing was closed. On motion of Councilwoman O'Keeffe, seconded by Councilman Weprin, the following Bond Resolution was unanimously adopted: WHEREAS, pursuant to the proceedings heretofore duly had and taken in accordance with the provisions of Section 202-b of the Town Law, and more particularly an order dated May 3 , 1995 , said Town Board has determined it to be in the public interest to increase the facilities of Water District No. 1 in the Town of Mamaroneck, Westchester County, New York, by the replacement of water tanks at various water district locations, including original furnishings, equipment, machinery, apparatus, appurtenances, and incidental improvements and expenses in connection therewith, at a maximum estimated cost of $615, 000; and WHEREAS, said capital project, as proposed, has been determined to be a Type II Action pursuant to the regulations of the New York State Environmental Conservation promulgated pursuant to the State Environmental. Quality Review Act, which regulations stated that Type II Actions will not have a significant effect on the environment; and WHEREAS, it is now desired to provide funding for such capital project; NOW, THEREFORE, BE IT i RESOLVED,: by the Town Board of the Town of Mamaroneck, Westchester i County, New York, as follows : -Section 1 . For the specific object or purpose of paying the cost of the increase and improvement of the facilities of Water District No. 1 3 March 15, 1995 in the Town of Mamaroneck, Westchester County, New York, consisting of the replacement of water tanks at various water district locations, including original furnishings, equipment, machinery, apparatus, appurtenances, and incidental improvements and expenses in connection therewith, at a maximum estimated cost of $615, 000, there are hereby authorized to be issued $615, 000 serial bonds of said Town pursuant to the provisions: of the Local Finance Law.. Section 2 .. It is hereby determined that the plan for the financing of the aforesaid specific object or purpose is by the issuance of the $615, 000 serial bonds of said Town authorized to be issued pursuant to this bond resolution. Section 3 . It is hereby determined that the period of probable usefulness of the aforesaid specific object or purpose is forty years, pursuant to subdivision 1 of paragraph a of Section 11 . 00 of the Local Finance Law. It is hereby further determined that the maximum maturity of the serial bonds herein authorized will exceed five years . Section 4 . Subject to the provisions of the Local Finance Law, the power to authorize the issuance of and to sell bond anticipation notes in anticipation of the issuance and sale of the serial bonds herein authorized, including renewals of such notes, is hereby delegated to the Supervisor, the chief fiscal officer. Such notes shall be of such terms, form and contents, and shall be sold in such manner, as may be prescribed by said Supervisor, consistent with the provisions of the Local Finance. Law. Section 5 . The faith and credit of said Town of Mamaroneck, Westchester County, New York, are hereby irrevocably pledged to the payment of the principal of and interest on such obligations as the same respectively become due and payable. An annual appropriation shall be made in each year sufficient to pay the principal of and interest on such obligations becoming due and payable in such year. Section 6 . Such bonds shall be in fully registered form and shall be signed in the name of the Town of Mamaroneck, Westchester County, New York, by the manual or facsimile signature of the Supervisor and a facsimile of its corporate seal shall be imprinted or impressed thereon and may be attested by the manual or facsimile signature of the Town Clerk. 4 March 15, 1995 Section 7 . The powers and duties of advertising such bonds for sale, conducting the sale and awarding the bonds, are hereby delegated to the Supervisor, who shall advertise such bonds for sale, conduct the sale, and award the bonds in such manner as she shall deem best for the interests of the Town; provided, however, that in the exercise of these delegated powers, she shall comply fully with the provisions of the Local Finance •Law and any order or rule ' of the State Comptroller applicable to the sale of municipal bonds . The receipt of the Supervisor shall be a full acquittance to the purchaser of such bonds, who shall not be obliged to see to the application of the purchase money. Section 8 . All other matters, except as provided herein relating to such bonds, including determining whether to issue such bonds having substantially level or declining debt service and all matters related thereto, prescribing whether manual or facsimile signatures shall appear on said bonds, prescribing the method for the recording of ownership of said bonds, appointing the fiscal agent or agents for said bonds, providing for the printing and delivery of said bonds (and if said bonds are to be executed in the name of the Town by the facsimile signature of its Supervisor, providing for the manual countersignature of a fiscal agent or of a designated official of the Town) , the date, denominations, maturities and interest payment dates, 'place or places of payment, and also including the consolidation with other issues, shall be determined by the Supervisor. It is hereby determined that it is to the financial advantage of the Town not to impose and collect from registered owners of such serial bonds any charges for mailing, shipping and insuring bonds transferred or exchanged by the fiscal agent, and, accordingly, pursuant to paragraph c of Section 70 . 00 of the Local Finance Law, no such. charges shall be so collected by the fiscal agent. Such bonds shall contain substantially the recital of validity clause provided for in section 52 . 00 of the Local Finance Law and shall otherwise be in such form and contain such recitals in addition to those required by section 52 . 00 of the Local Finance Law, as the Supervisor shall determine. 5 March 15, 1995 Section 9 . The validity of such bonds and bond anticipation notes may be contested only if : 1) Such obligations are authorized for an object or purpose for which said Town is not authorized to expend money, or 2) The provisions of law which should be complied with at the date of publication of this resolution are not substantially complied with, and an action, suit or proceeding contesting such validity is commenced within twenty days after the date of such publication, or 3) Such obligations are authorized in violation of the provisions of the Constitution. Section 10 . This resolution shall constitute a statement of official intent for purposes of Treasury Regulations Section 1. 150 - 2 . Other than as specified in this resolution, no monies are, or are reasonably expected to be, reserved, allocated on a long-term basis, or otherwise set aside with respect to the permanent funding of the object or purpose described herein. . I Section 11. This resolution which takes effect immediately shall be published in full in the Daily Times , the official newspaper, together with a notice of the Town Clerk in substantially the form provided in. Section 81. 00 of the. Local Finance Law. 1 1 6 • March 15, 1995. PUBLIC HEARING --Amendment to Cellular Antenna Law On motion of Councilman Weprin, seconded by Councilman-Ryan,.the hearing was opened The Town Attorney explained that the purpose of this proposed local law was to clarify the particulars of an adopted local law which regulates the installation of cellular facilities within the Town. IActing Supervisor O'Flinn said that the Town had received a communication from the County Planning Department which read: Stephen V.Altieri Town Administrator Town of Mamaroneck 740 West Boston Post Road Mamaroneck, NY 10543-3319 RE: MMT 95-001 Dear Mr.Altieri: Thank you for notification of the proposed zoning text amendment to Local Law No. 3 of 1995, Regulations for Cellular Telephone Facilities. Having reviewed this matter under the provisions of Section 239 L, M, and N of the General Municipal law and Section 277.61 of the county Administrative Code,we find that this is a,matter for local determination in accordance with your community's planning and zoning policies, subject to the following comment: The proposed addition to the cellular telephone towers zoning text under "inspection,"specifying annual inspection for structural integrity and continued compliance with thresholds,appears to be a reasonable amendment to the Local Law. Thank you for calling this matter to our attention. Respectfully, WESTCHESTER COUNTY PLANNING BOARD by: (SIGNATURE) Jerry Mulligan. for: Deputy Commissioner JM/NS/ns The Acting Supervisor then said she had received a resolution from the Town's Planning Board which reads as-follows: CERTIFICATION from the Planning Board of the Town of Mamaroneck It is hereby certified that the following resolution was adopted by the Planning board of the Town of Mamaroneck unanimously from among the members present and voting at its meeting of March 8, 1995: WHEREAS,the Town board has referred the proposed amendment to the Cellular Antennas Law to the Planning Board pursuant to Section 89-80 of the zoning Ordinance of-the Town of.Mamaroneck; and WHEREAS,this Board is required to make a recommendation to the Town Board with respect to its referral of the proposed amendment to the law, it is RESOLVED,that the Planning board finds that the proposed amendment to the Cellular Antennas Law is in harmony with the comprehensive plan of land use for the Town and would be in furtherance of the purposes in Section 89-1 of the Town Zoning Ordinance, and it is further 7 March 15, 1995 RESOLVED,that the Planning,:Board requests, however,that the Town Board consider-in Section 2, Line 7 changing the word indicating"to Including"so it is clear that regular reports of inspections are made of the towers whether or not repairs are necessary. (Sign ature) Marilyn S. Reader, Chair ILeslie Snyder, Attorney for NYNEX suggested that the requirement for a yearly inspection is both burdensome and selective in scope. Bill O'Gorman,a Town.:resident said that a yearly inspection seemed reasonable to him. There being no further comment, on motion duly made and seconded the hearing was closed. Thereafter, on motion of Councilman Ryan, seconded by Councilman Weprin, the following was unanimously adopted: RESOLVED, that the Town Board does hereby declare this matter a Type I action; and BE IT FURTHER, RESOLVED,that this action is hereby defined as a negative declaration; BE IT FURTHER, RESOLVED, that the Amendment to Local Law No. 3-1995 be adopted with the requested change made by the Planning Board as follows: ILOCAL LAW NO. 4 -1995 This Local Law shall be known as "Amendment to Local Law No. 3-1995, Amendment to Zoning Ordinance Establishing Regulations for Celllular Telephone Facilities" Section 1. Purpose: The purpose of these regulations is to clarify the provisions of the recently enacted Local Law No. 3-1995, which established regulations for the placement of cellular telephone facilities in the Town of Mamaroneck. Section 2. Amendment: Section 89-19.1 (g) of the Town of Mamaroneck Zoning Ordinance shall be amended to read as follows: (g) Inspection - Towers shall be inspected annually for structural integrity and continued compliance with the thresholds in subparagraph 89-19.1 (e) by a licensed professional engineer. A copy of the inspection report shall be submitted to the Town Building Inspector including repairs made. Section 3. Severability: IShould any provision of this.Local Law be declared illegal or unconstitutional by a court of competent jurisdiction, to the extent that the other provisions of this Local Law can be implemented without such illegal or unconstitutional provision, such other provisions shall remain in effect. Section 4. Effective Date: This Local Law shall take effect immediately. 8 ' March 15, 1995 • PUBLIC HEARING - Fee Schedule On motion of Councilwoman O'Keeffe, seconded by Councilman Ryan, the hearing was opened. This item had been distributed and discussed at an earlier work session. Councilwoman O'Keeffe questioned the necessity of raising fees for the parking, to which the Administrator replied that the cost of maintenance and service keep increasing, as well as demand for space. The Town IIIClerk noted that the fees are in line with those charged by surrounding communities, and in fact were lower. She added that should the Town's fee be much lower that those around us, the demand for permits would then Increase. Councilwoman O'Keeffe did not thin t os k h e were good reasons to raise fees, following further discussion, the hearing was declared closed. Authorization -Southeast Consortium Agreement The Town Administrator explained that the Southeast Consortium was a group consisting of nine Imunicipalities that provide funding for recreation for both physically and mentally disabled children and adults. He said that the Town's share of that budget for 1995 is $12,705 which allows residents of both villages as well as the Town to utilize the Consortium's services, and in order to execute the agreement, authorization would be necessary. On motion of Councilman Ryan,seconded by Councilwoman O'Keeffe, it was unanimously RESOLVED, that the Town Board does hereby approve the agreement between the Town and Southeast Consortium which stipulates payment of$12,705 for their services to provide recreation to residents in the Town of Mamaroneck, including the Villages of Mamaroneck and Larchmont for 1995; and BE IT FURTHER, RESOLVED,that the Town Administrator is authorized to sign and execute the Agreement on behalf of the Town. I2. Waiver of Building Permit Fees - Hommocks Ice Rink Alterations On motion of Councilwoman O'Keeffe, seconded by Councilman Ryan, it was unanimously, RESOLVED, that the Town.Board does hereby waive all fees in regard to the alterations that are being made at the Hommocks Ice Rink Facility 3. Authorization -Tax Lien Sale 10 March 15, 1995 Mr. Altieri said that this was a routine item which calls for authorization for the Receiver of Taxes to sell those taxes that are outstanding as of May 18, 1995. In response to a question, he said that no one other than the Town actually buys the lien which simply means that the Town would then be entitled to interest that accumulates on the original tax amount at the rate of 12% per year. On motion of Councilman Weprin, seconded by Councilman Ryan, it was unanimously, RESOLVED, that the Town Board does hereby authorize the Receiver of Taxes to conduct an auction of all outstanding Tax Liens on Thursday, May 18, 1995 beginning at 10:00 a.m. 5. Authorization -Collection of Real Property Taxes County of Westchester! Town of Mamaroneck The Administrator said that this also was a routine item calling for authorization to collect taxes for both the County and the Town. On motion of Councilwoman O'Keeffe, seconded by Councilman Ryan, it was unanimously RESOLVED, that the Receiver of Taxes of the Town of Mamaroneck is hereby authorized to receive and collect taxes as follows: STATE OF NEW YORK COUNTY OF WESTCHESTER ) SS: TOWN OF MAMARONECK THE PEOPLE OF THE STATE OF NEW YORK To Carmine A. DeLuca, Receiver of Taxes of the Town of Mamaroneck in said County: You are hereby commanded pursuant to the provision of the Westchester County Tax Law, Article 16, Chapter 852, Laws of 1948, as amended, and also pursuant to resolution of the Town Board of the Town of Mamaroneck adopted March 15, 1995, by authority of Chapter 313 of Laws of 1934, to receive and collect from the several persons named in the Assessment Roll hereunto annexed and herewith delivered to you, together with penalties prescribed by the Westchester County Tax Law, Article 16, Chapter 852 of the Laws of 1948, as amended, for the neglect to pay the State, County, Town and Town District Taxes, Water Arrears and exemptions removed after the levy thereof as follows: Judicial and County Taxes - $23,184,321.00 Town and Town District Taxes - 11,501,840.00 Charges for Service - 0.00 Exemptions removed - 2,261.29 Water arrears 1,962.88 $34,690,385.17 And you are hereby directed to deposit to the credit of the Town of Mamaroneck in the Bank of New York, County Trust Region, all of such monies so collected by you by virtue of this warrant. Set Public Hearing - Parking Ordinance Senate Place Mr. Altieri reported that the Traffic Committee had been reviewing traffic patterns around Murray Avenue School, and were concerned about the number of vehicles that park on Senate Place during the school day. He said that many of the residents from that area had attending the meeting to voice their concerns. He said that in order for the Town to implement these changes a public hearing date would have to be set and he then outlined the following recommendations made by the Traffic Committee: I 1.) On Daymon Terrace, fifteen feet from Senate Place (northeast corner) NO PARKING/STANDING OR STOPPING FROM HERE TO CORNER 2.) On Senate Place, fifteen feet from Daymon Terrace (northeast corner) NO PARKING/STANDING OR STOPPING HERE TO CORNER 3.) No parking on north side of Senate Place from the corner of Daymon Terrace to the dead end between the hours of 8:00 am to 3:30 p.m. school days. On motion of Councilman Ryan, seconded by Councilwoman O'Keeffe, it was unanimously RESOLVED, that the Town Board does hereby set the date for the Public Hearing on Parking Restriction Law for Senate Place for April 15, 1995 at 8:15 p.m. or as soon thereafter as possible; and BE IT FURTHER RESOLVED, that the Town Clerk is hereby authorized to publish and post a notice of the Public Hearing in a Official newspaper stating the date and time of the hearing. I 7. Authorization - Use of Voting Machines - Mamaroneck Union Free School District The Clerk requested authorization to allow the School District the use of 15 voting machines for their yearly budget and trustee election. On motion of Councilman Ryan, seconded by Councilwoman O'Keeffe, it was unanimously RESOLVED, that the Town Board does hereby authorize the use of 15 voting machines for the School Board and Budget Vote set for May 1995. 8. Salary Authorization - Recreation Recreation RESOLVED, that the Town Board does hereby authorize the payment of salary to the following as provided for in the 1995 Recreation Budget: Wilma DeLeon, Alt Life Guard, Hommocks Pool, $7/hr, retroactive to 3/1/95 12 March 15, 1995 Ernie Odiema -He questioned whether the Hommocks field study had been completed, and if is was, had the Recreation Committee reviewed it; whether he could see the land use study, and when sidewalk repairs would be started. The Administrator replied that the study hadn't been completed, yes he could see the land use study; and that he would have a better idea of when sidewalk repairs would begin by the next meeting and would report on it then.
