P at COASTAL ZONE MANAGEMENT COMMISSION MINUTES SEPTEMBER 26, 1989 APPROVED A regular meeting of the Coastal Zone Management Commission (CZMC) was held on Tuesday, September 26, 1989, in Conference Room A of the Town Center, 740 West Boston Post Road, Mamaroneck, New York. The meeting commenced at 8:05 P.M. Members Present: Phyllis Wittner, Chairman Bruce Allen Elinor Fredston Mary Anne Johnson Howard McMichael Shirley Tolley Richard Young Others Present: Cheryl Lewy, Trustee, Liaison, Larchmont Claudia Ng, Environmental Coordinator Josh Rickenbach, Reporter, Sound View News Ann Gunsalus, Resident Bill Gunsalus, Resident Rene' Rathschmidt, Recording Secretary ADMINISTRATIVE MATTERS Approval of Minutes - The minutes for August 22, 1989 were returned for corrections. Resignation - Mary Anne Johnson has decided not to accept reappointment to the Coastal Zone Management Commission. All members in attendance expressed their gratitude for all the assistance and knowledge Mrs. Johnson has rendered as a member to the CZMC. Ms. Wittner conveyed to Mrs. Johnson that she will be sorely missed and expressed the hope that Mrs. Johnson would continue to be available for consultations in areas of her very special . expertise. Mrs. Fredston requested that the Chair write Mrs. Johnson on behalf of the CZMC. Address Correspondence to C7M Commission, 740 West Boston Post Road, Mamaroneck, NY 10543 (Phone 914-381-6133) CZMC Minutes - 9/26/89 CHAIRMAN REPORTS CZMC Appointments - The Chairman reported the following make-up of the Commission: Phyllis Wittner, Chairman (member until 1991) Lawrence Lowy (member until 1992) Shirley Tolley (member until 1992) Robert Schoenberger (member until 1990) Bruce Allen (Member until 1990) C. Alan Mason (member until 1990) Elinor Fredston (member until 1991) Howard McMichael (member until 1991) Richard Young (member until 1991) 1 ^^ening - Town 1 opening - Village Liaison Appointments - Ms. Wittner reminded the Commission of its obligation under CZMC's Law to "maintain liaison with related municipal bodies. . . .and with appropriate civic groups to insure the implementation of the program". With that in mind she asked for volunteers to fill liaison positions. The following was the result of the discussion that ensued: Howard McMichael - Friends of the Reservoir and the Harbor Commission Elinor Fredston - Village of Larchmont Planning Board Lawrence Lowy - Village of Larchmont Planning Board Robert Schoenberger - Village of Larchmont Zoning Board Richard Young - Conservation Advisory Commission CORRESPONDENCE Use of Best Management Practices - Ms. Wittner stated that she had received a reply to the letter she had sent to Mr. Matarazzo (8/17/89) re: use of Best Management Practices for the Mamaroneck Harbor Sewer Treatment Plant construction. Ms. Wittner reported that Mr. Matarazzo called to say that the contractor is now complying with washing off the truck tires and is currently using a sweeper at the site. She also stated that Mr. Matarazzo is available to answer any and all questions that the CZMC may have. County Critical Environmental Area Designations (CEA) - Ms. Wittner read a reply from Diane Keane re: her letter dated 8/24/89 regarding County CEA -2- C CZMC Minutes - 9/26/89 Designations. A proposed Public Hearing is scheduled for Monday, Oct 16, 1989 at 7:30 P.M. in White Plains. Also noted was the fact that the James Johnson Conservatory, the Reservoir, and the Premium Complex as well as a "cultural boundary" (encompassing the Boston Post Road in some areas) of the Long Island Sound Shore were to be included. Ms. Wittner passed out maps delineating these locations as well as others and said she would send another letter to Diane Keane restating the CZMCs position regarding intermunicipal notification procedures. OTHER TOWN Council Meeting (9/6/89: - Ms. Wittner informed the Commission that the Town Council had received a petition for a zoning change re: The Loyal Inn Bowling site. She noted that by Town Law the Council was obligated to refer the matter to the Planning Board, which in turn has to approve or disapprove the change within 45 days. She noted that this is an application that the CZMC will be interested in. Ms. Wittner also stated that the Town receives from the County the highest allowed reimbursement for snow removal because the Town employs the use of best management practices recommended by the County for salt storage, etc. . . Bonnie Briar - The Chairman informed the Commission that the Board of Governors of Bonnie Briar along with counsel, Robert Funicello, and engineer, Frank Fish, are in the process of producing a marketing video of Bonnie Briar. The purpose of this project is to show an objective viewpoint of Bonnie Briar. Bruce Allen interjected to say that Mr. Funicello has asked for historical background to include in the video. VILLAGE Larchmont Waterfront Land Use Study - A progress report was received from Shuster Associates regarding the Land Use Study. The report was distributed and Ms. Wittner requested that all members to read and give their input before the next scheduled meeting. She noted that Mr. Shuster will be on hand at this meeting to discuss the study in detail. Bay Constable Program - Ms. Wittner's scheduled meeting (September 9, 1989) with the Police Chiefs was cancelled. The chairman read an overview of police calls and their responses to these calls as they related to the Bay Constable Program. In summary the Village of Larchmont had received few calls during the past year. The Village of Mamaroneck also recorded about six assistance aided calls for the Village of Larchmont. Ms. Wittner also read a draft of recommendations which she will be giving to the Larchmont Village Board on October 2, 1989. Howard McMichael also suggested that the CZMC's view of the program should also be part of the public record. Ms. Tolley emphasized that the public realize that the CZMC will stay with the boater education aspect. -3- CZMC Minutes - 9/26/89 Phragmities - Ms. Wittner informed the Commission that Mayor Curnin had referred a complaint regarding a Phragmities Stand located at Griffen, Shore and Old Colony Roads. Ms. Wittner said that the complaint came from a resident who lives across the street from the site. The resident was fearful of conditions which could arise from the shelter that the Phragmites provide, and would like the stand removed. Ms. Wittner stated that she had visited the site and found that not only were Phragmites evident but the area contains other plants which form a wildlife habitat. She noted that because of the other factors involved, such as the fact that cutting down would do nothing to prevent regrowth, removing the stand would not be appropriate. She also said the consensus of the neighborhood was against the removal. The Commission voted to draft a letter to the Mayor recommending that the Phragmites not be disturbed. MEMBER REPORTS East Creek/Hommocks Complex - Elinor Fredston reported that she, Robert Schoenberger and Jack Taylor toured the East Creek/Hommocks area at both low and high tides. Ms. Fredston noted that they had found syringes among the debris located on the south side of the Complex. Mr. Taylor will have a report of his findings ready for the next scheduled meeting. Beach Clean-Up Day 1989 - Elinor Fredston reported that she, along with Bruce Allen, Claudia Ng, and John Zappala participated in Beach Clean-Up Day. She stated that all in all about 30 people were in attendance for the clean up of Dog Beach, at the end of Beach Avenue, and Manor Beach and that the results were good. Mrs. Johnson suggested organizing next years date earlier in the school year in order to encourage more students to become involved. Village of Larchmont Planning Board - Ms. Fredston reported that she attended the last meeting of the Village of Larchmont Planning Board. She noted that 41 Beach Avenue was approved and that the New Use Application (auto dealership) for Boston Post Road at the Mandeville Office Building would require more research into the proposed underground parking facility. ENVIRONMENTAL COORDINATOR REPORTS Sheldrake Watershed Study - Claudia Ng reported the results of the last Conservation Advisory Commission (CAC) meeting regarding the subject of the Sheldrake Watershed Study. Ms. Ng noted that the CAC voted to try to obtain a 100 to 200 foot scaled map at 2 foot intervals in order to preserve the resolution of slopes, wetland boundaries, and flood zones. She also said that the CAC would be asking for support from other Boards, such as the Planning Board, because a map of this kind could be very useful in their decision making. Ms. Ng stated that the cost of the original proposal would be altered because of the change in the scale of the map. Informational Brochure of the CAC and CZMCs - No Update. NEW OR OTHER BUSINESS -4- CZMC Minutes - 9/26/89 Underwater Lands Study - Ms. Wittner informed the Commission that she had received the Underwater Lands Study from The Village of Mamaroneck CZMC Chairman, Paul Ryan. She stated the reasons the study was conducted: to obtain maximum legal jurisdiction over tidal waters to maximum point; to determine private, Village, and State ownership; to implement goals & policies of the Local Waterfront Revitalization Program (LWRP) . Third Annual Report - Editing fees of $350.00 were approved. Facts of Life in Larchmont - Ms. Wittner informed the Commission that the deadline for information to be include in the Newsletter is October 6, 1989. She asked for ideas and volunteers to provide articles for the publication. Shirley Tolley suggested the topic of litter and Mary Anne Johnson suggested posters and polluters. Federal Coastal Management Taskforce - Ms. Wittner noted that Mayor Curnin received an invitation form Nita Lowey to join the Federal Coastal Management Taskforce. Department of State (DOS) Conference - Ms. Wittner also noted that she and Claudia Ng attended the DOS Conference on 9/26 in Melville, New York. The Topic: "Your Coast, Your Choice, Your Future" . Ms. Wittner reported that it was an interesting conference and that she will have a more in depth summary at the next meeting. Town of Mamaroneck - Code Book Revisions - Ms. Wittner suggested the following changes to the current Code Book be looked into: 1. Regulating the area of impervious surface per lot as a way to control increased runoff - Jakubowski recommendation. 2. Buffer zones: distances from mapped wetlands & CEAs and also commercial development producing pollutants. 3. Improve local pollution control - Malcolm Pirnie Guidelines for Facilities to Remove Oil - 4/17/89. Manor Park Beach - Bruce Allen reported that Manor Park Beach has closed for the season. Mr. Allen expressed fears that the Beach would not be able to reopen next season because of financial difficulty. Cheryl Lewy interjected and said that she and the Mayor had met with the Manor Park Society over the summer and offered help if that was indeed the case. Ms. Lewy reported that the Society had refuse help except for more Police coverage of the area at night. Next Meeting - The next meeting is scheduled for October 24, 1989 in the SENIOR CENTER IN THE TOWN CENTER. MEETING ADJOURNED AT 10:45 P.M. 5
