The meeting was called to order at 8: 20 p.m. , Mr. Irwin in the chair. The minutes of the meeting of August 28 were duly approved without change. 2. The main business before the Committee was to finish work on Sections IV and V, and to review a draft of Section I (Boundary) written by Dan Shuster. This new draft, plus revisions of Sections IV and V to reflect earlier discussions, had been hand-delivered to members of the Committee the previous day. (See copy of Sept. 10 memo attached to the Minutes. Those lacking copies of the papers listed therein may obtain them from Mr. Irwin. ) Results of the discussion were as follows: Section I, Boundary: Dan Shuster' s draft was approved in substance, subject to editorial work. Section IV, Uses and Projects: A number of changes were agreed on, the most significant being: -- In IV-A-1, Golf Course Property, it was agreed to include "certain other large properties in the northern portion of the Town" (between the two northern golf courses) in the zoning and other measures proposed. -- In IV-A-3, Waterfront District, drafting- changes were agreed on to describe more precisely the existing land use patterns. -- In IV-A-5, the Reservoir property, it was agreed to footnote this item to note that it will require updating in the light of action by the Village of Larchmont on the dedication proposal. -- In B-2-1, "Selective Harbor Dredging, various technical and editorial improvements were suggested for accuracy and clarity. - 2 - Section V, Implementation: -- In A-2-b, New Local Laws, it was agreed that more specifics should be included in the description of the proposed law to eliminate illegal sewer connections. -- In B-3, the water monitoring program, it was agreed that the program should cover not only pollution sources but also water quality. -- Several changes were discussed in V-C, "Management Structure. " It was agreed to change paragraph 3-b to provide that the Commission should elect its own chairman from among the 10 appointed members, and that the chairman' s vote on any issue _ would be decisive in case of a tie. . . . In paragraph 3-c, Qualifications, Dr. Mason suggested that the appointing muni- cipalities should seek the suggestions of related bodies, such as the planning commissions and the CAC , on candidates for appointment. . . . In paragraph 3-d-6, it was agreed to add State agencies to the categories with which the Commission will maintain liaison for management of drainage basins. The Committee agreed that, after necessary editing of Sections I , IV and V, the first five parts of the draft Program should be presented without delay to the two municipal governments with the recommendation that they be forwarded to Albany for comment pursuant to the Work Program. 3. Next meeting. The next meeting of the Committee was set for Tuesday, October 2, at 8 p.m. in the Village Center. 4. Adjournment. There being no further business, the meeting adjourned at 11:20 p.m. Wallace Irwin Jr. Co-Chairman VILLAGE OF LARCHMONT TOWN OF MM,AMAROt ECK COASTAL ZONE MANAGEMENT COMMITTEE 4Akt '`i 405211111q of :•• ` �: o ,MGOgap�AT[O -. 1891 • •y , • Folsom T55-- Larchmont, NY 10538 Mamaroneck, NY 10543 September 24, 1984 MEMORANDUM TO: CZMC Members and Other Interested Persons SUBJECT: Village and Town Governments' Action on Sections I through V of the Draft LWRP Pursuant to the Committee' s decision at its September 11 meeting, after necessary editing the Committee-approved draft Sections I, IV and V were forwarded on September 14 to both municipal governments under a memorandum signed by both Co-Chairmen, recommending On the Committee' s behalf that Sections I through V, as drafted, be forwarded to Albany for review and comment in accordance with the Work Program. (Sections II and III had been seen earlier by the municipal governments, and some minor changes in Section III had been made in response to comments by Mayor Cumin and Trustee Anderson; these changes have been circulated to Committee members. ) The Larchmont Village Board considered our recommendation at its September 17 meeting, at which I represented the Committee. An objec- tion was raised by Trustee Anderson, who argued that the proposed Commission (Section V, "Management Structure") would have too much power in regard to the affairs of the Village, especially as to re- creation and public access along. the waterfront. The Board decided not to press the matter to a decision until its October 1 meeting. Meanwhile I was asked to try to work out a solution acceptable both to Mr. Anderson and to the Committee and the other parties involved in both municipal governments. After a series of discussions with Mr. Anderson, Mayor Curnin, Trustee Kean, Co-Chairman Shirley Tolley and Councilman Lerman, among others, a tentative formula emerged which I delivered to to the par- ticipating members of the Committee, and to both municipal governments, in my memorandum dated September 20. The gist of the change, you will recall, was to provide that where a matter before the Commission is in disagreement in the government-level Joint Coastal Zone Committee, the Commission will not act on that matter until the issue is resolved. In my September 20 memorandum I proposed that any Committee member who objects to the proposed change should so inform me by noon Monday, September 24; the Committee could then meet, if necessary, on September 25 to discuss the objection. The deadline has passed, no objection has been raised, and it will not be necessary for the Committee to meet on this question. I am informed by Mayor Curnin and Dr. Lerman_ that procedures are being worked out in the Village and. Town governments to expedite agreement to the new language and clear the way for forwarding Sections I to V to Albany. I would like to thank not only the officials mentioned above but also several Committee colleagues, especially Co-Chairman Shirley Tolley, for their good advice and encouragement in pursuing- this solution, which will enable us to move forward with our planning. Wallace Irwin J Co-Chairman 1 Summit Avenue Larchmont, NY 10538 April 30, 1984 MEMORANDUM to Barbara Wood, Village Clerk, Larchmont Dorothy Miller, Town Clerk, Town of Mamaroneck FROM: Wallace Irwin Jr. , Larchmont Chairman, Coastal Zone Management Committee SUBJECT: Public Notice of CZMC Meetings I understand that under New York State law meetings of official municipal bodies, such as the CZMC, must be open to the public, and that public notice of such meetings must be given in advance. Barbara Wood informs me that the usual means in the Village is: (1) to post notices of all committee meetings on the Village bulletin board outside the Municipal Building; and (2) to send or telephone the same information to The Daily Times. With this in mind, may I ask you please to note on the Village and Town calendars that the CZMC (which, as you know, is a joint body representing both municipalities) has adopted the following pattern of meetings for at least the months of May and June. 1. The Coastal Zone Management Committee meets on the first Tuesday of each month at 8 p.m. in the Village Center in Larchmont (behind the Larchmont Public Library) . The next two meetings accordingly are scheduled for May 1 and June 5. 2. The Committee of Committees of the Coastal Zone Management Committee meets on the third Tuesday of the month at 8 p.m. The location varies. The May 15 meeting will be held at 70 Chestnut Avenue, Larchmont (Lawrence Lowy' s house) . The June 19 meeting will be held at 3 Cedar Island (Elinor Fredston' s house) . The meeting pattern in subsequent months is likely to remain the same until our planning period ends in October, but there may be variations especially in July and August. We will keep you informed. It would be much appreciated if Barbara Wood would include the above information in her routine postings and calls to The Daily Times, and if Dorothy Miller would do likewise in her routine postings in the Town offices.
