HomeMy WebLinkAbout1988_10_25 Coastal Zone Management Commission Minutes Town of Mamaroneck Village of Larchmont I1L COASTAL ZONE MANAGEMENT COMMISSION MINUTES OCTOBER 25, 1988 A regular meeting of the Coastal Zone Management Commission was held on Tuesday, October 25, 1988 in Conference Room A of the Town Center, 740 West Boston Post road, Mamaroneck, New York. The meeting commenced at 8:05PM. Members Present: Phyllis Wittner, Chairman Bruce Allen Elinor Fredston Norman Jacobson Mary Anne Johnson Howard McMichael Robert S. Schoenberger Shirley Tolley Others Present: Elaine Price, liaison, Town of Mamaroneck Board a'') Cheryl Lewy, liaison, Village of Larchmont Board Mayor Curnin, Mayor of Larchmont Claudia Ng, Environmental Coordinator Barbara Cleary, Recording Secretary Changing of the Guard Mayor Curnin and Elaine Price expressed their gratitude to Mr. Robert S. Schoenberger for doing a wonderful job during his term as Chairman of the Coastal Zone Management Commission. The Commission welcomed Ms. Norma Jacobson as a new member and congratulated Mrs. Phyllis Wittner as the Commission's new Chairman. Approval of Minutes The minutes for September 27, 1988 were approved with corrections on pages one and two. Referrals Mr. and Mrs. Ciregna of 87 Griffen Avenue submitted an application requesting permission to build a retaining wall and add fill in order to level off their property. Claudia Ng and Shirley Tolley inspected the property and noted that it was adjacent to a brrook and that there were sweetgum trees along the border. The commission agreed that the project as proposed is inconsistent. Shirley Tolley will draft the advisory opinion letter citing the application is inconsistent with Policy 44 of the LWRP unless the buffer zone is 20 feet from the stream. The tree commission will also have to review and give their approval because trees might be destroyed in the leveling off process. Address Correspondence to CZM Commission, 740 West Boston Post Road, Mamaroneck, NY 10543 (Phone 914-381-6133) f CZMC minutes-10/25/88 Reports from the Chair Mamaroneck Harbor EPA Study - The Town Council advised at it October 5, . 1988 meeting that Elaine, Price would appraise federal government agencies of the previous studied done by the Town. There seems to be lack of coordination amongst government agencies. Commission members advised that they should he informed of the LWRP policies and projects already identified and suggest the use of Best Management Practices. Elaine Price commissioned C. Alan Mason to work with the EPA to make these concerns known and to see that the work that was previously done is acknowledged. Elaine Price stated it would he better if the monies available were used for implementaion of previous study recommendations instead of additional studies. Phyllis Wittner queried whether we could suggest using some of the money for implementation of a Town Project , such as a catch basin at East Creek. Leaf Disposal - Mr. Schoenberger wrote a letter to Fred Kellogg about. the leaf disposal area at Flint Park Encroaching on the CEA, and that it should be corrected immediately by removing and restoring the area to its original state. Mr. Kellogg's reply to this letter said he agreed that another alternative would be better but the village is running out of area for the leaf decaying process, and does not know how he could do it inexpensively. Ms. Wittner read a draft of a letter in reply to Mr. Kellogg's letter. It stated that all large debris should be hauled out and disposed of at an upcounty land fill and that proper, current copmosting procdures be used which would reduce the area needed for leaf disposal. A conference with Tom Leddy and the CAC chairman was suggested. Commission 11, Members made other suggestions including a recommendation by Mrs. Fredston citing the site is against the policies of the LWRP. This letter with suggestions incoporated was approved by the CZMC. Zoning Board of Appeals - Ms. Wittner drafted a letter in response to the Kluge transmittal verbatim transcript. The letter informed the Zoning Board that the CZMC rendered a decision addressing an inconsistency: specifically, a substandard lot in R-50 zone which the ZBA did not respond to. Phragmites Stand Vacant lots Griffen, Shore and Old Colony Drives - A draft of a letter written by Ms. Fredston was submitted to the Commission for review. Corrections were made and the revised approved letter will be sent to the Mayor and Engineer, Village of Larchmont . Referral: - A letter to Frank DeVore, Building Inspector, Village of Larchmont, concerning the construction of a pool at 69 Shore Drive, a Type I action. Conditions regarding lighting, shrubber. limitation of disposal of pool water and use of Best Management Practices were recommended. The approved version will be mailed out. The Commission decided to investigate what are the Best Management Practices regarding the disposal of pool waters. Ms. Ng will call the DEC and get the information. New Members Kit - was prepared by Mrs. Wittner to acquaint new members with the informational neccessities of a CZMC Member. Included. in the kit is a LWRP, a summary list of policies, local laws frequently referred to by the CZMC, maps, the First Annual Report, CZMC Members Names, addresses and 111 liaison assignments and other pertinent information. -2- v CZMC minutes-10/25/88 Jay Property - Commission Members are urged to write to Westchester County and New York State officials requesting them to initiate condemnation of the property. Mrs. Wittner said she had written letters to Govenor Cuomo . and County Executive O'Rourke. The Commission agreed it would be a good idea to send out letters individually as well as on behalf of the CZMC. Announcements from the Chair : December 6, 1988 - Sheldrake Flood Conference - West Branch walk was held on October 16, 1988 and the East Branch walk was held on November 19, 1988 November 20, 1988 - Robert Kennedy Jr. will speak at the Bonnie Briar Country Club concerning the Long Island Sound and the effects of Pollution. Reports by Commission Members: Local Environmental Quality Review revisions were given to Mrs. Tolley for writing of our final draft. As soon as proposed legislation is compiled, it will be forwarded to Town & Village engineers, building inspectors, planning and zoning board chairmen for their comments. Mrs. Fredston, Mrs. Tolley, Mrs. Wittner and Ms. Ng attended the SEQR Conference on October 20, 1988. Village Planning Commission - Mrs. Fredston informed the Commission about the proposed plans for a building to be constructed at 1990 Palmer Avenue, Larchmont (formerly the Mallette Service Station) . The building will be used for retail and business and will feature an arcade. The building lot is over 10,000 square feet which normally requires that 80 parking spaces be S provided. Mrs. Fredston said she informed the Planning Board of the CZMC's concerns but it is too early en the process to make formal recommendations. The CZMC can make recommendations after reviewing the Environmental Impact Statement. Another issue that was discussed at the Planning Commission meeting was that the Zoning and. Planning Boards met with Uan Schuster to discuss the creation of a retail zone to prohibit additional auto service stations. Bay Constable - Bruce Allen Suggested holding a special meeting for the • public and for the Yacht Clubs to provide them with information on the Bay Constable Program. He also mentioned that the Village of Larchmoat Board held a meeting on October 3, 1988 where he briefed all in attendance about the program. Two representatives from the State Waterfront Revitalization Program were also in attendance. He said the public and the clubs are still not clear on what the program is all about. Mayor Cumin also agrees the CZMC should hold a meeting to educate the public about this program. Those invited should include the Manor Park Society, Larchmont Yacht Club, Larchmont Shore Club and Horseshoe harbor. Mr. Allen then told about a recent incident which demonstrated the necessity of such a program, when just recently a motor boat ripped its bottom and it took 40 minutes before help arrived. Charles McCaffrey, Head of Local Programs at the Department of State suggested Bruce Allen write up navigation laws for the Village of Larchmont. Mr. Allen agreed it was a good idea. The Commission concurred to make a full public presentation. Mrs. Fredston asked if it was possible and practical to combine the Village of Mamaroneck Pay Constable. program with the Village of Larchmont. Projected date for this project is Sprinnng of 1990. • -3- .. r CZMC minutes-10/25/88 Annual Report - The creation of the Annual Report is in progress. Mrs. Tolley will review the chapter on. implementation, Mr. Lowy will review the chapter on Commission recommendations and Mr. Schoenberger will integrate the Report. Mr. Wallace Irwin volunteered to edit it. The target date is set for mid-November. Village Waterfront Zoning - Mr. Schoenberger suggested hiring a consultant with expertise in zoning law. to liik at the zoning proposal and. avise the Commission on special use zoning. Mr. Schoenberger will check the Manor Park deed to see if it has adequate protection from subdivision. The R-40 subcommittee consists of Mr. Schoenberger, Mr. Lowy, and Mrs. Fredston. Reports From the Environmental Coordinator: Sheldrake Watershed Study - Ms. Ng informed the Commission that she has received 3 proposals from Parsons, Bromfield, Redniss and Mead, and Walter B. Saitterthwaite Associates, and Malcolm Pirnie. She also said that the CAC originally had thought they would be able to pay for the mapping of the Sheldrake but later realized they would need the support of. the CZMC. Mr. Schoenberger sent a letter of cooperation to Mr. Robert. Komitor (Chairman of the CAC) . Ms. Ng informed the Commission that she realized the scope of the RFP was quite extensive. She said she had asked the companies to breaaak down costs for specific projects. It was also realized that there is not enough money to do the complete proposal. Mr. McMichael pointed out that much of the topography and maps have been already don and questioned how the Commission was planning to use the information. Mrs. Wittner recommended rewriting the RFP and make it more concise. Ms. Ng also stated that the Army Corps is also making studies. She also ' advised that the Town Board is considering and investigating many options including a revision of the zoning. Shirley Tolley and Elinor Fredston will serve on a subcommittee to assist in this area. New or Other Business - Erosion and Sediment Control Legislation - Mrs. Wittner thought she might request the assistance of Richard Young and ask for his recommendations. Davids Island - Elaine Price informed the Commission that the County Legislators sent the bill to the Budget and Appropriations Committee. The home rule request must be sent on to the Senate.
