HomeMy WebLinkAbout1986_11_25 Coastal Zone Management Commission Minutes • © T Town of Mamaroneck Village of Larchmont - COASTAL ZONE MANAGEMENT COMMISSION MINUTES A regular meeting of the Coastal Zone Management Commission (CZMC) was held on Tuesday, November 25, 1986, at the Town Center, 740 West Boston Post Road, Mamaroneck. The meeting commenced at 8:05 P.M. Members present: Robert Schoenberger, Chairman Elinor Fredston Wallace Irwin, Jr. Mary Anne Johnson Arthur Katz Lawrence Lowy C. Scheuer, Jr. , resident, 875 Fenimore Rd. , Mamaroneck Claudia Ng, recorder Approval of Minutes The minutes for the previous four meetings--Sept. 24, Sept. 30, Oct. 14, and Oct. 21--of the CZMC were approved. Inter-agency Cooperation Copies of two sets of memoranda were distributed (copies attached). The memorandum consisting of the minutes of an informal meeting with key officials of the Town of Mamaroneck and the Village of Larchmont to discuss best methods for facilitating consistency was quickly read by the members and approved for circulation. Approval of the other memorandum, which summarized the procedural guidelines for local consistency and presents some suggested procedures, will be delayed until Monday so that CZMC members can adequately review it and return comments to Mr. Schoenberger. [December 1, 1986 - No substantive comments were received. ] Several members expressed the view that it would be advantageous for CZMC to begin analyzing proposals at the pre-submission conference stage. Other members cautioned that a lack of professionalism at such a conference may hinder accurate analysis of the proposals. In the same regard, Mrs. Tolley Address Correspondence to CZM Commission, 740 West Boston Post Road, Mamaroneck, NY 10543 (Phone 914-381-6133) CZMC minutes - 11/25/86 ® reported that she had told the Town Planning Board that the CZMC would be requesting applications that are as complete as possible. It was noted that such a desire had already been included in the procedural recommendations. The CZMC wants to minimize additional delays in the application process. It was questioned whether a thorough application would be available to the CZMC in time for it to give a wise response. To facilitate the CZMC's effectiveness and the passage of applications, Mr. Irwin suggested designating one liaison person to follow through on each application or project, who would be available to the applicant for informal conferences to discuss CZMC concerns. Mrs. Wittner reported on the Town Planning Board meeting of November 12, pointing out that the CZMC, to be effective, needs to obtain news of new applications prior to its classification (as Type I action, Unlisted action, etc. ) at the planning board meeting. Referrals/Items of Information Scheuer Residence Additions - With the aid of his site plan maps, Mr. Scheuer gave a synopsis of his proposal to expand his home. The proposal consists of recontouring the grade around the house, relocation of the driveway, enlargement of the garage court yard, and corresponding alterations of the yard drain and roof leader system, which includes the redirection of his east drain pipe to spill out farther downstream where it is lower, so as to prevent his house from flooding, and adding a drain pipe on the north side of ® the house to accomodate the new additions. When asked whether runoff will increase due to the additions, Mr. Scheuer replied that he did not know because such a study had not been made. Dr. Mason, however, noted that the proposed addition of fill over the existing rocky substrate (to increase grade) would serve to reduce the property's runoff. Mrs. Wittner passed out copies of a letter she had drafted with the help of Cliff Emanuelson, the Town's conservation consultant, which identified potential problems and gave some suggestions. The suggestions included the realignment of his northern drainage system towards a natural drainage furrow leading into the creek and converting the proposed dry well into a catch basin, which would provide for times of overflow, and the installation of another catch basin along the east drain pipe to prohibit sediment from discharging into the stream with the water. Mr. McMichael raised the concern over the possibility of oil from the garage entering the stream. Mrs. Tolley felt that Mr. Scheuer had done an excellent job of complying with the Local Waterfront Revitalization Program (LWRP) and that the compliances far outweighed the potential inconsistencies. With Mr. Scheuer's consent to consider the said recommendations, the CZMC unanimously agreed that his application is consistent with the LWRP. Mrs. Wittner will revise the letter and send out CZMC's comments to the Town Planning Board on Monday. Mrs. Wittner and Mrs. Tolley were commended on their successful efforts in handling this referral in the constricted time frame. Larchmont Professional Center - This proposal for a two-story office condominium by Midland Construction, Inc. , at 1375 Boston Post Road had just undergone a pre-submission conference at the previous Town Planning Board meeting. Although the site is not within the control boundaries of C the Hommocks Critical Environmental Area, several members felt that the development could have a substantially adverse impact on the sensitive area due to its proximity. Mrs. Wittner had drafted a memorandum for the Planning Board, which she passed out to the Commission, identifying some -2- CZMC minutes - 11/25/86 Opotential inconsistencies with local protecitve provisions. Mr. D'Ortona, representative for the developers, presented a surveyor's map which indicated that the development site is neither within the horizontal control boundary designated in the Freshwater Wetlands and Water Courses law. Ms. Ng was assigned to determine if the site would fall under the vertical limits of this law (i.e. , within 5 feet of the high water mark of the East Creek from a once-in-ten-year frequency storm). Concern over the increased parking that would accompany the office development were raised. Dr. Mason said that the CZMC could consider stipulating that oil skimmers be installed in its stormwater drainage system, as had been required for a previous development proposal near Premium River. Dr. Mason will assist Mrs. Wittner in revising the memorandum. Mr. D'Ortona expressed his hope that the Planning Board will receive the CZMC's comments before its next meeting so as to avoid unnecessary delay. Mayer of Westchester, Inc. , Variance Request - Mayer of Westchester, Inc. , is requesting a variance from the Village of Larchmont to use the lot located beside the Village Yard as a parking lot. Mr. Lowy reported that a hearing for this application had already been held last Thursday. This site lies immediately adjacent to East Creek. It has become apparent that some changes in procedure as regards referrals from the Zoning Board of Appeals might be in order to protect the purposes of the LWRP. A potential inconsistency exists between the Town of Mamaroneck and the Village of Larchmont; similar actions may receive different classifications by each municipality. Mr. Lowy will follow up on this variance request in behalf of the CZMC. Golden Horseshoe Shopping Center Addition - The CZMC received copies of a Draft Environmental Impact Statement (D.E.I.S. ) and a Stormwater Management Plan for an expansion of this shopping center, which is located on the Scarsdale-New Rochelle boundary. Dr. Mason will review the documents. Other Business New Stationery - New stationery with a logo for the CZMC has been printed and was presented to the Commission. Fishing Site Inventory - A State DEC survey requesting information on fishing sites available in our area was sent to the Chairman. Bruce Allen was assigned to fill out the survey. Job Opening - Mr. Schoenberger announced the creation of a new full-time position for an environmental assistant with the Town of Mamaroneck. The Village of Larchmont will reimburse part of the salary for services rendered to the CZMC. Communications with CAC - A preliminary study for the dredging of Gardens Lake has begun. Mrs. Fredston informed the CZMC of the Conservation Advisory Commission's invitation to produce a joint annual report with them. She suggested that the Chairman confer with Robert Komitor, the CAC's chairman. • -3- CZMC minutes - 11/25/86 OState Funding Applications Ms. Ng was asked to call Albany to find out what was happening with the State LWRP implementation grant applications that had been mailed out in October. Unfinished Legislative Matters Mr. Irwin reported that there were two relevant legislations that had not yet been finalized: (1) Erosion and Sediment Control and (2) Interim Flood Damage. Mr. Irwin will call Gary Trachtman, the Town's engineering consultant, to determine his comments and the stage these legislations are at. He reported that Mr. Kellogg had recommended the City of Rye legislation on erosion and sediment control over the County's. Mr. Irwin will continue to follow up on the progress of the proposed local legislations. Water Pollution Control Mrs. Johnson informed the CZMC of a program entitled Project Riverwatch, which is dedicated to the protection of waters entering Long Island Sound. The operation provides assistance to local groups in helping them monitor their streams against pollution. The Friends of the Reservoir have already contacted this organization and will be receiving the services of Barbara Dexter. Mrs. Johnson suggested that the CZMC consider asking Ms. Dexter to look at the Mamaroneck and Premium rivers while she is in the area, as well. Another possibility would be to collaborate with the Hudson River Fishermen's Association, which is also making efforts to control water pollution in New York State. Next Meeting The next regular meeting was scheduled for Tuesday, December 16, 1986, so as to avoid complications with the holidays. By a vote, it was decided that meetings should continue to be held in Conference Room A of the Town Center. The meeting was adjourned at 10:40 P.M. 0 -4-
