NOVEMBER 22, 1988 A regular meeting of the Coastal Zone Management Commission (CZMC) was held on Tuesday, November 22, 1988 in Conference Room A of the Town Center, 740 West Boston Post Road, Mamaroneck, New York. The meeting commenced at 8:05 PM. Members Present: Phyllis Wittner, Chairman Bruce Allen Elinor Fredston Mary Anne Johnson Lucian Leone Larry Lowy Howard McMichael Robert S. Schoenberger Shirley Tolley Richard Young Others Present: Mr. Pierleoni, Horseshoe Harbor Yacht Club Claudia Ng, Environmental Coordinator Barbara Cleary, Recording Secretary Appointments Mr. Lucian Leone was welcomed to the Commission. He will be replacing Norma Jacobson who was appointed to the Town Planning Board. Howard McMichael has been reappointed for another 3 year term. Next Meeting The December meeting has been cancelled for the holidays. The next scheduled meeting will be January 24, 1989. A special meeting will be held on January 10, 1989 in the Larchmont Village Center (see Waterfront Zoning) . Minutes The minutes for the meeting of October 25, 1988 were returned for correction. Reports by Chairman Sheldrake Watershed Study - The Commission concurred at its previous meeting, that. the Request For Proposals be re-written with tighter parameters. However, Ms. Wittner said she was invited to attend a meeting on November 7, 1989 with Steven Altieri, Town Administator, Steve Tomecek, CZMC minutes - 11/22/88 Consultant, Irma Volk, CAC representative, and Claudia Ng. Mr. Tomecek advised that it may not be necessary for the Town to purchase the entire project from outside sources. He advised that all that is needed to know now is how much water goes in, how much water comes out, what the water does, how deep it is and how much of it sits on golf courses now. He said that water retention capabilities is a project appropriate for the Soil and Water Board. Mr. Tomecek said the main concern should be placed on sound planning. He suggested the Army Corps of Engineers re-evaluate the present data on the Sheldrake River, including the Reservoir. He also noted that any developer would be required to do a hydrologic study. The Town already has an aerial map which includes the Bonnie Briar and Winged Foot properties. Using these aerial maps the Town could hire a surveying firm to draw up topographic maps; Steve Tomecek and Claudia Ng could do field checks. Therefore, the maps can be prepared less expensively and the data could be turned over to the Soil and Water Board to perform the computer analyses. The Town Administrator has assumed responsibility for this study. Sheldrake Area - Ms. Wittner reported that the Town Council meeting November 2, 1988, that the Town will be getting a scope of services and costs from the Landscape firm, TPA Associates, as an addendum to Gardens Lake, to plan the aesthetics and restore the area as rapidly as possible. It was also revealed that the Army Corps is looking at new flow data since the reservoir valve has recently been installed. They are trying to complete the project by year's end. The sewer project, including rebanking, is to be completed by spring. Zoning Board of Appeals Letter Regarding Kluge Decision - Mrs. Wittner read a letter written by Joel Negrin, chairman of the Town Zoning Board, which arrived before she mailed her letter approved by the CZMC on October 25, 1988 concerning the Kluge referral. He explained that the previous transmittal was not an official reply concerning ZBA's over-riding CZMC finding of inconsistency because they are still waiting for the official transcript. LEQR - Mrs. Wittner thanked Shirley Tolley for doing a great job on revising the Local Environmental Quality Review laws. It is now ready to go to the Building Inspector, Engineer, and the chairmen of the Planning and Zoning Boards. They were asked to respond before December 15, 1988 so that it could be forwarded to the respective Boards. Premium Area - Elaine Price was asked by Mary R. Carlson if we could recommend a small piece of land that could be purchased by the Westchester Land Trust for the creation of open space. Mrs. Wittner said she would like to receive suggestions of available land. Mrs. Johnson said there are some small pieces along streams and Mrs. Wittner sent Mrs. Carlson (Westchester County Dept. of Planning) the material the CZMC submitted on 2/10/88 to the Town Board requesting a buffer zone(open Space) on 3 parcels along Dillion Road. Mrs. Wittner reported that she had a meeting with Syrette Dym, Deputy Commissioner of Planning in New Rochelle, and her assistant. She gave them copies of the Premium Feasibility Study and aquainted them with the area. After the meeting, Mrs. Wittner received a letter, dated November 4, from Ms. Dym to City Manager Kissinger saying they would like to continue to work with -2- CZMC 11/22/88 Larchmont and Mamaroneck by designating this Critical Environmental Area and disignating the Pryer Manor Marsh as a Park. Copies of the Premium Feasibility Study were submitted for circulation to the New Rochelle Mayor and Council. Emerson Point Estates -Development of this 4 1/2 acre site in New Rochelle would effect the Town residents and tidal wetlands. The developer wants to build 15 homes. He was required to do a full Environmental Impact Statement. Mrs. Wittner received personal correspondence regarding the latest developer's submission and has transmitted the information to the Town Administrator and Engineering Consultant on her personal stationery. Premium Feasibility Study - Mr. Martin Quigley wrote letters to Mayor Curnin, Supervisor Battalia and to Mrs. Wittner as Chairman of the CZMC, which strongly recommended using a tidal gate procedure instead of dredging. He also recommended using dredged material to create an island in Larchmont Harbor. The Chairman conferred with Jack Taylor of Malcolm Pirnie, Inc. and sent a letter in response to Mr. Quigley. Sub-committee Status Reports Waterfront Zoning - Robert Schoenberger and Lawrence Lowy had the topic of R-40 zoning put on the Agenda for the December 5, 1989 Village Board meeting. They have met as a sub-committee with Elly Fredston. The proposal would call for upzoning the clubs and Manor Park area to be zoned for recreational use only. Mr. Schoenberger discussed the proposed upgrading with Mayor Curnin to clarify that the CZMC would be asking for a policy decision from the Village and not suggesting that the CZMC offer zoning expertise. Mr. Schoenberger said he would like to have a well thought out package before making the presentation. Mr. Lowy feels that we should put something in writing for the meeting. Mr. McMichael suggested that we keep a watch on Manor Park and make it an regular agenda item. The Commission agreed that preserving Manor Park is an important priority and suggested having an attorney look at the Manor Park Deed. It was agreed that this topic should be removed from the Village Board's agenda of 12/5/88. Annual Report - Wallace Irwin cannot edit the report this year because he was recently made President of the Friends of the Reservoir. Shirley Tolley reviewed the actions which were implemented and recommendations made during the year. Mr. Lowy and Mr. Schoenberger assisted in the review. Mrs. Wittner recommended hiring someone to edit. She interviewed one editor who would charge a fee of $350 which includes final typing and delivering the report ready for printing. The Commission voted in favor of contracting out the editing job. Waterways - Bay Constable - Bruce Allen has been working on the Bay Constable Program for nearly 2 years. Mayor Curnin asked the CZMC if they would hold a special meeting to present the information and answer questions about the program, specifically for members of the Manor Park Society, Horseshoe Harbor Yacht Club, Larchmont Yacht Club and Larchmont Shore Club. Bruce Allen and Phyllis Wittner wrote a draft proposal "Waterways Protection in the Village ofLarchmont" which includes a Bay Constable Program. This will be distributed with an invitation to the special meeting -3- CZMC 11/22/88 to the leaders of the above mentioned groups for dissemination to their members. The meeting is scheduled for January 10 at the Larchmont Village Center and will give the public the opportunity to state their opinions. Reports from Environmental Coordinator Disposal of Pool Water - Ms. Ng reported that the DEC said that anyone wishing to discharge pool water into the Sound needs a letter permit. They also said that pool owners are not allowed to discharge filter backwash. She also informed the Commission that if the water is allowed to stand untreated for a while the chlorine will dissipate. Ms. Ng was asked to find out where pool service companies dispose of the pool water as mentioned in the Pressman application and to notify the building inspectors, zoning boards and planning boards of the procedures. Flint Park Leaf Dump - According to the DEC, the Village of Larchmont must have Tidal Wetlands permit to use that area for leaf composting. Ms. Ng was asked to write a letter to Fred Kellogg informing him of this law and to request a response to CZMC's suggestions made in a previous correspondence. Copies of Communications - Copies of any communications can be obtained by contacting Ms. Ng at the Conservation Office. New or Other Business Sewer Hookups - 280 Larchmont Village residents were sent a letter from Fred Kellogg, Village Engineer, advising them of a smoke test which identified illegal sewer hook ups and advised them to correct the problem. Should the homeowner neglect to correct this violation he will be issued a warning then a summons. Mr. Schoenberger suggested the Town do the same. Ms. Ng was requested to send a copy of the letter to Steven Altieri. 87 Griffen Avenue Referral - Shirley Tolley said the Consultant Engineer and Planning Board agreed with CZMC's recommendation of providing a 20 foot buffer strip from the streambank at the property on Griffen Avenue. Jay Property - Mrs. Johnson said the Jay Coalition requested Commission members to attend meeting and raise their voices in order to preserve the Jay property. Rezoning Old Colony Dr. - Mrs. Fredston said the Village Zoning Board will hear a request to downzone Old Colony Dr. She informed the CZMC that this area floods regularly, Mrs. Fredston said she will request that they hold on to present zoning at the next zoning board meeting. Mrs. Wittner suggested Mrs. Fredston have a prepared statement. Community Groups - Ms. Wittner reported on the "Cooks Group" meeting with George Stafford, Director of Coastal Management Division. At this meeting og concerned citizens, three objectives were outlined: (1) work for a more effective authority, especially at state level to protect Long Island Sound, (2) assist DOS in its drive for centralized consistency, (3) Support Govenor's Task Force on Coastal Resources.
