State Mrs . Curnin called the meeting to order at 8 : 15 p.m. APPROVAL OF MINUTES On motion of Allan Mason, seconded by Lawrence Lowy, and carried , the minutes of the meeting of October 4, 1983 were approved as written. MEETING WITH MR. McCAFFREY 411) Mr. Charles McCaffrey, Coastal Resources Specialist, appeared to discuss the Local Waterfront Revitalization Program with the Committee. Wallace Irwin advised that he contacted Albany seeking direction in the policy area of the LWRP. He reported that he had reviewed the State of New York Coastal Management Program and Final EIS with James Lotto . There are 44 policies for review, not all of which are relevant to Larchmont. Mr. Lotto felt that it is premature at this time to write policies . Mr. McCaffrey explained that when the LWRP is finished, it will be the policy for Larchmont. He stated that the Committee must make the policies relfect specific instances for Larchmont. Mr. Irwin C asked if some of the State policies will remain the same for Ta rch- mont. Mr. McCaffrey stated that if the Committee wishes some policies to remain the same, they only need to be repeated in this document. ® State policies are considered to be the minimum possible. Lawrence Lowy asked if the Committee has to expand each State policy. Mr. McCaffrey stated that it is not necessary. Mr. Irwin noted that State policies on flooding and siltation do not apply to upstream flooding. Mr. Lotto questioned whether upstream flooding is related to the coast and should CZM be involved with this . Wallace Irwin stated that Larchmont has been extremely inter- ested in boundaries, such as those that Mamaroneck has proposed establishing for itself. Mr. McCaffrey stated that it will be up to the Secretary of State whether or not to extend the boundaries . Mrs . Curnin asked Mr. McCaffrey if Larchmont can inform other communities of local policy and ask their cooperation in upholding these policies. He felt that there are areas in the State that ® should be included in the State boundaries , and the State could work with the communities to address these problems . Mr. McCaffrey said that there is only one community that is in the Coastal Zone that is not on some waterfront. Mr. McCaffrey explained that if a State action is proposed which would have an effect on the Coastal Zone, that action is subject to the program. Any major action will require a permit. The State will have to grant approval in compliance with the local program. Mr. Irwin asked if a local program can be more strict than State policies . Mr. McCaffrey advised that it may be . Mr. Allen questioned how the State is going to use this infor- mation. Mr. PyicCaffrey advised that the State has to make sure that ® there are no conflicts with its policies . He noted that the State - 2 - will review this plan and may make recommendations to Larchmont. __ Wallace Irwin asked what would happen if another government agency does not adhere to the policies set forth in this document. Mr. McCaffrey replied that other agencies must certify that their actions conform to the L'°JRP. Mrs. Fredston asked who would be notified if policies were not followed. Mr. McCaffrey advised that the Village would have to take the offender to court, whether it be a government agency or an individual. James Lotto asked if the Committee is free to make policies as specific as possible for Larchmont, even if it might be conflicting with another policy. Mr. McCaffrey advised that policies should not conflict. Mr. Lotto asked if Larchmont is locked into the pro- gram once it is set up. Mr. McCaffrey stated affirmatively. His office wants to make this document easy for other agencies to use . so that it will in fact be used . Mr. Lotto asked if in the future additional grants will be available. Mr. McCaffrey advised that about twice as much as this grant will be available for engineering, design, detailed refinements and activities, beginning January 1, 1984. Larchmont will not be eligible for this but may be able to apply for a grant in July, 1984. Mr. McCaffrey stated that Larchmont may extend the date due for the first set of tasks , but it is advisable that the end date remain the same. Mr. Irwin asked why County governments were left out of this project. Mr. McCaffrey explained that the Mate was more interested in involving local governments . • Howard McMichael asked if the Board of Trustees could amend 3 - . these procedures in the future if it is necessary. The answer was affirmative, but a major change would require a public hearing and a vote. Mr. McCaffrey noted that the Village may withdraw from the program at any time, and State policies would then apply. Mr. McCaffrey recommended that the Committee contact the DEC and the DOT through their regional offices. Mr. McCaffrey recommended that the resources needing protection be outlined in detail in case of an emergency. Mr. Irwin noted that critical wildlife areas have not yet been mapped. Mr. McCaffrey stated that it was done by the Fish & Wildlife office. Mr. Irwin noted that 1,200 gallons of oil from a New Rochelle apartment complex leaked into the Premium River. Discussion was held on establishing an emergency plan. Mr. Irwin asked if policy could be written as administrative procedures. Mr. Allen asked what happens if policies need to be changed after 1984. Mr. McCaffrey siad that his office will probably require an annual report. He requested that he be notified of major actions. The State will probably conduct a major review every five years . Discussion was held on beginning work on the next tasks. Mr. Irwin promised to send a memo to members this week listing all policies and the sub-committees involved. NEXT MEETING The next meeting will be held on Tuesday, December 6, 1983 at 8 p.m. in the Village Room of the Village Center.
