The Meeting commenced at 8:05 P.M. Members Present: Phyllis Wittner, Chairman Bruce Allen Elinor Fredston Mary Anne Johnson Lawrence Lowy C. Alan Mason Howard McMichael Shirley Tolley Richard Young Others Present: Cheryl Lewy, liaison, Trustee, Village of Larchmont Elaine Price, liaison, Councilwoman, Town of Mamaroneck Board Steven Silverberg, Attorney to the Town Eric Zaidins, Attorney, Associate Claudia Ng, Environmental Coordinator Rene' Rathschmidt, Recording Secretary Minutes The minutes for the meetings of November 22, January 24, and February 28 were returned for corrections. The minutes for the January 1Oth meeting were approved. Chairman Reports 2nd Annual Report - The 2nd Annual Report of the CZMC was presented to the Town of Mamaroneck Board on March 15, and to the Village of Larchmont Board on March 16, 1989. Waterways Protection - The confirmed date for presentation of The Waterways Protection (Bay Constable) Program to the Village of Larchmont has been scheduled for May 1, 1989. CZMC Minutes - 3/28/89 Local Environment Quality Review (LEQR) - The LEQR Law and a cover letter dated March 23, 1989 which dealt with confusion over Critical Environmental Areas (CEAS) in both the Town and Village were sent to Steven Altieri for the IC: Town Attorney and to Village of Larchmont Attorney, James Staudt, asking for their input. The Chairman expressed thanks to Shirley Tolley for an incredibly well done job. 30 Park Avenue - The Chairman also expressed the Commission's gratitude to Mary Anne Johnson for a job well done. Larchmont Yacht Club - C. Alan Mason reported to the Commission the results of the Zoning Board Meeting with regard to the Larchmont Yacht Club Application. He said that he had expressed the Commission's concern regarding the lack of a consistency referral. He reported their response which was that this was an over-sight which they would try to see did not happen again. 1989 State of the Sound Conference - Ms. Wittner stated that she had attended the 1989 State of the Sound Conference which was held in Hamden, Connecticut. She reported the Conference dealt mainly with the Connecticut perspective of the Long Island Sound, and was interesting and beneficial to hear State of Coastal and Ocean Resources - The Chairman requested and gained the Commission's approval to attend the 3 day "State of Coastal and Ocean Resources" Conference in New York City, May 10-12, 1989 - registration fee: $195.00 Coastal Erosion Hazard Act - Bruce Allan asked the Chairman where the COVillage of Larchmont stands in regard to the Coastal Erosion Hazard legislation. Ms. Wittner responded that the Commission was asked verbally to reply to what the pros and cons are of the Village's implementing such a law. She stated that progress in the matter has been slow. Bruce Allen also asked to whose attention violations should be brought. Ms. Wittner replied: the Department of Environmental Conservation (DEC) . She also stated she will continue to follow through on the subject of Coastal Erosion Hazard legislation. Environmental Management Council (EMC) Meeting - Ms. Wittner attended the EMC Meeting on March 27, 1989, regarding county wide critical environmental area (CEA) designations. She reported that it was interesting to see the map of the projected 500 feet from the Long Island Sound CEA plus other areas. As an example she mentioned in New Rochelle, the border went up to Shore Road. She also stated that it has yet to be decided whether or not the criteria will be the 500 feet or whether they will use landmarks. She also said they are considering designating all Reservoirs and all water supply lands as CEAs. Also noted was that most of the suggestions of Ms. Wittner's letter of March 20 would be protected under the proposed 500 feet from Long Island Sound CEA. 1 -2- A CZMC Minutes - 3/28/89 I General - Slated for next meeting was a report from Richard Young regarding Erosion and Sediment Control Legislation and a report from Lucien Leone on Litter. Also the Chairman reported to the Commission that people continue to express an interest and seek appointment to the CZMC. Correspondence Banning Polystyrene and Polyvinyl - Ms. Wittner drafted a letter for the Commission's approval to County Legislator, Diane Keane re: banning polystyrene and polyvinyl products in Westchester County. Howard McMichael inquired as to whether or not supermarket bags were included. Ms. Wittner's response was yes. Memo to Town Staff and The Conservation Advisory Commission (CAC) - The Chairman sent a memo to the Town staff and the CAC reminding them of their obligations as detailed in the LWRP to deal with the degradation of the Premium Conservation area entrance way. Discussions and Recommendations Larchmont Waterfront Zoning - Concern was expressed about obtaining a consultant as quickly as possible to conduct a planning study that would support the proposed waterfront zoning amendment. A list of possible vendors was distributed and several additions to the list were mentioned. May 1st was slated as the deadline for responses to the request for proposals. C. Alan Mason suggested verbal presentations should be conducted A. and all present concurred. Village of Larchmont Proposed Zoning Ordinances - Master Plan - Ms. Wittner noted that the zoning amendment deals strictly with the business district. The amendment proposes to: 1) add or change definitions of automotive sales and gasoline sales 2) to create a new retail zoning district to replace the current one on Boston Post Road and Palmer Avenue 3) set forth principle uses permitted in the new retail center zone 4) advance designs for buildings etc. . . Elinor Fredston noted the fifth dealt with parking regulations which has been tabled now. Ms. Wittner said that she felt the proposed legislation is consistent with the recommendations of the Master Plan Phases I & II. She also stated it is consistent with LWRP policy 5 and also serves policy 6. Ms. Wittner also raised the question as to whether or not the CZMC should recommend the use of oil collars or a similar device in the parking areas defined on page 5 (all areas not landscaped shall be paved with asphalt or similar material and grated and drained to prevent the accumulation of standing water) . Several CZMC members noted that the areas in question were actually quite small. Also voiced by C. Alan Mason was the mention of dry wells and Shirley Tolley expressed a need for a reasonable oil separator policy. Ms. Wittner will compose a letter, to be ready before the Village Board holds its next Public Hearing, stating the consistencies found and incorporating other comments made by the Commission. -3- CZMC - Minutes 3/28/89 Town of Mamaroneck Urban Renewal Plan - Ms. Wittner noted receiving a referral from the Town Council on March 28 for a draft Environmental Impact Statement (EIS) Boston Post Road/Weaver Street Urban Renewal Plan with a proposed zoning amendment. Elaine Price stated that the plan was an outgrowth of the revitalization concept which permeates Part II of the Master Plan Update. Inorder to revitalize that part of the Boston Post Road, the motel has been considered a blighting influence. The Urban Renewal Plan in effect, gives the Town a legal device in which to acquire the Motel. Shirley Tolley expressed concern over whether or not the relocation of the Motel's residents had been addressed. Ms. Price responded that this was and is an ongoing consideration. Steven Silverberg defined in detail the Urban Renewal Concept. Ms. Wittner expressed difficulty on the part of the CZMC in the timing of its consistency opinion. The Urban Renewal referral, which contains the same zoning amendment as is found in the Master Plan, is due on April 13 while the Master Plan is due on May 10. Town of Mamaroneck Generic EIS -Master Plan with proposed zoning amendment - This is a Planning Board referral. Shirley Tolley reported the results of the Planning Board hearing on the Town Master Plan. She addressed the zoning amendment in regard to the two proposed Mixed Use Business Zones, and also the environmental impact of the two areas discussed, on CEA'S. She expressed concern over the possibility of intensive development in the areas. Phyllis Wittner stated the focus should be placed upon areas that will be taxed by increased uses and higher density development. Numerous suggestions and comments were made by all those in attendance. The Chairman also suggested proposing changes with regard to the zoning amendment. She suggested the buffer zone concept could be called a set back. Elaine Price noted that it's stricter than the original plan. Lawrence Lowy suggested that the retail business uses should be more carefully restricted and protection of waterways and CEA'S should be addressed. The Chairman agreed to draft changes and address comments made by the Commission in letter form to be circulated to the Commission for comment since the foundation for both referrals are due before the next meeting. the next meeting. Mamaroneck Harbor Study - The Chairman agreed to write the comments on the study. Elinor Fredston suggested utilizing the County's Non-Point Pollution report. Elaine Price also suggested making strong recommendations as to monies for monitoring and enforcement. Next Meeting The next meeting of the CZMC has been scheduled for April 25, 1989.
