The meeting commenced at 8:10 P.M. Members present: Robert Schoenberger, Chairman Bruce Allen Wallace Irwin, Jr. Mary Anne Johnson C. D.E.C. , White Plains Theodore Strauss, Applicant, 32 Deane Place Lois Weitzner, League of Women voters of Westchester Kathy Mickey, Daily Times Claudia Ng, Environmental Assistant Approval of Minutes The minutes of January 27, 1987 were corrected and approved. New York State Coastal Erosion Management Program Representatives from New York State Department of Environmental Conservation explained the State's developing Coastal Erosion Management Program (literature attached). Created to protect coastlines from erosion so as to provide a buffer zone against life- and property-threatening natural occurances, the Coastal Erosion Hazard Areas Act provides for the delineation of areas which would be subject to special control. Preliminary maps have been drafted. Development of any structure from the blue line and seaward on these maps will be strictly regulated. A set of maps for our area was left to be given to the Town Clerk for public review. A hearing for these maps was tentatively scheduled for April 7, 1987, at 7 P.M. , in the Town Center Court Room. All owners within the concerned areas will be notified and they, plus the CZMC, will be able to comment on the designation of controlled areas n.a.a 1,, C7X 4 Cmmnik inn 74f) West Roston Post Road. Mamaroneck, N1Y 105-13 (Phone 91-1-381.6133) CZMC minutes - 2/24/87 then. The D.E.C. officials estimated that final drafts of the maps will be completed by July. Municipalities will then get six months, with the possibility of an additonal six months extension, to develop a local program for monitoring/enforcing the designated erosion hazard areas. Weaver Street Corridor and Upper Sheldrake River Joint Planning Study Mr. Altieri described the proposal for a creation of a generic, inter-municipal Draft Environmental Impact Statement for any development along the Weaver Street corrider, particularly those that impact traffic and/or the Sheldrake River drainage. The Village of Scarsdale initiated this proposal to coordinate planning with the City of New Rochelle as well as the Town of Mamaroneck. New Rochelle has yet to commit itself to this collabortation, however. The County, also, has yet to commit funding to the project. The Town of Mamaroneck communicated to the County of its desire to complete the project by this summer. Referrals Strauss Additions - Mr. Strauss, the prospective owner of 32 Deane Place, would like to make additions on the house, which involves expanding the rear of the house to create a new kitchen, master bedroom, and a wood deck. He noted that hay bales will be placed around the property during construction and that he plans to terrace and landscape the rear yard with evergreen shrubs. Some small trees will be removed, but large trees will remain, he said. Bruce Allen checked the site and drafted a preliminary letter. Although it would be nearly impossible to completely prevent erosion and surface runoff because of the declining topography of the area, a dry well was suggested to help mitigate the effects of diminishing groundsurface. The Commission agreed that it could render a favorable opinion if the conditions of adding plantings to the rear yard and a dry well were included. Mr. Strauss willingly acquiesced to these conditions. Mrs. Tolley will revise the CZMC memo. Mrs. Wittner then raised the issue of illegal dumping and littering that have been occurring behind the houses on Deane Place, in the Premium Marsh Critical Environmental Area. Mr. Strauss was made aware that such acts were strictly prohibited. Pine Brook Blvd. Land Transaction - CZMC members expressed many negative comments to the sale of the Village-owned parcel to developers. Dr. Mason warned that the extremely steep slope from the developer's proposed subdivision site creates a very detrimental situation. In addition, he found that if the developers could add that parcel of land to their present property, they could make eight subdivisions, although they presented plans for just four houses. The alternative of selling the land with severe restrictions was considered. However, the Commission concluded that in order to ensure adequate protection of the stream, the property rights must be retained. Specific reasons cited included: the special sensitivity of waterways to erosion and contamination, its direct link to the Larchmont Reservoir, and its importance as a habitat. The difficulty in enforcing maintenance once sold was another factor taken in account. Periodic inspections would have to be remembered. Mr. Schoenberger will write a letter to the Village Board relaying CZMC's advice. -2- • CZMC minutes - 2/24/87 Mayer of Westchester, Inc. , (Volvo) proposal - After having conferred with Cliff Emanuelson, Town Conservation Consultant, Mr. Irwin reported that he had relayed to Ettoire Coiro, architect for the proposed development of an auto sales and service center at 2001 Boston Post Road, some recommendations which included the installation of a stormwater drainage treatment system similar to the one developed by Midland Construction, Inc. , for Larchmont Professional Center. Although Mr. Coiro did not adopt such a system, he did include an additional mitigation measure, but both Mr. Irwin and Dr. Mason expressed doubts to its efficacy. Mrs. Johnson noted that attention should also be placed on oil treatment within the building, pointing out that cars will be serviced subterraneously. CZMC decided that it would be beneficial to have the applicant and his representatives present to elaborate on these plans. If an extension for comments to the Village Planning Commission cannot be arranged, CZMC will hold a special meeting in two weeks. Davids Island Project Mr. Schoenberger reported on the public hearing which was held on February 18, 1987 for the DEIS of the proposed Davids Island Project in New Rochelle. It was extremely overcrowded and only three statements were made before the disorder forced them to postpone the meeting and to find larger accomodations. The three that spoke before the hearing was adjourned were an engineer for the proposed project, Mayor Curnin of Larchmont, and a representative for the Suffolk County Power Company. The latter two spoke against the proposed project. Mr. Schoenberger will revise his statement and submit it at the rescheduled hearing. Other concerns that were discussed included the problems of backup flooding in Larchmont when the New Rochelle sewer lines are overburdened, potential obstruction of flight patterns, and the aesthetic impairment of the horizon. CZMC considered contacting the FAA and other communities along the Long Island Sound shore. LWRP Projects Premium Feasibility Study - Mrs. Johnson suggested that CZMC should be prepared to begin the Premium Feasibility Study as soon as the funding comes through. However, it was noted that we may need to wait to find out what kinds of constraints will come with the grant. It was advised that Charlie McCaffrey be contacted to determine the conditions and procedures for this LWRP implementation grant so that we could inform consultants. Other Business NYS Division of Coastal Resources & Waterfront Revitalization - Charlie McCaffrey and Randy Lanza arranged a meeting with representatives from Westchester municipalities with or in the process of developing a local waterfront revitalization program. Messrs. Schoenberger and Irwin, Mesdames Tolley and Wittner, and Ms. Ng attended the meeting for the Town/Village CZMC. The purpose of the meeting was to discuss the needs and the direction of the Coastal Management Program. We asked for technical and informational assistance from the State division. They wanted to promote intermunicipal CZMC cooperation. -3- CZMC minutes - 2/24/87 The need for additional funding of LWRP programs was realized. The Chairman will arrange lobbying efforts to encourage the State to contribute funds. Army Corps of Engineers Flood Control Plan - Mrs. Tolley had attended the meeting on this plan, which involves a four-year construction period. They are still awaiting the appropriations for implementing such improvements. The plans call for removing one bridge and replacing six others, and constructing a flume for part of the Sheldrake-Mamaroneck River System. Caroline Silverstone, Town Councilwoman, recommended that the Town Administrator and Engineer ask Sam Tocci of the Army Corps of Engineers if a scaled down plan could be proffered. Mrs. Tolley suggested that members of the CZMC should be present to inform them of LWRP policies. She was given authority to write a letter to Caroline Silverstone to request that CZMC be kept informed. Exceptional Planning Document Award - Mr. Altieri had said that the Town/Village LWRP will be submitted to the Westchester Municipal Planning Commission, who is giving an award for the "best" planning document created in 1986. Soil and Water Board - Westchester County Soil and Water Board is in need of additional staff assistance and has requested the support of agencies using their services to endorse this addition. They asked if we would be willing to pay fees for services rendered. The Chairman will write a letter to the Town and Village endorsing such service, but the consent to pay for the services must be made by the municipalities. Legislation Update on Unfinished Legislation - Mr. Irwin reported that the Town had approved the incorporation of East Creek in the Hommocks-Hampshire Critical Environmental Area. However, they did not yet accept the revised map for the Freshwater Wetlands and Water Courses Law. Announcements Long Island Sound Conference - will be held on March 12, 1987 at SUNY Purchase.
