The meeting commenced at 8:10 P.M. Members present: Robert Schoenberger, Chairman Bruce Allen Elinor Fredston Wallace Irwin, Jr. Mary Anne Johnson Lawrence Lowy Howard McMichael, Jr. Phyllis Wittner Others present: Paul Kean, liaison, Village Board O Robert Armour, resident, 11 Salem Dr. , Scarsdale William Morgenroth, engineering consultant for Armour Claudia Ng, recorder Approval of Minutes Following minor corrections, the minutes for the meeting of November 25, 1986 were approved. Referrals/Items of Information Armour Subdivision - A proposal to subdivide Robert Armour's property, located between Salem Drive and Boulder Circle, Scarsdale, was designated as an "Unlisted" action and, therefore, referred to the CZMC. Mr. Armour would like to subdivide his property to allow for the construction of two additional houses next to his house. He has already submitted several alternative site plans to the Town Planning Board. The site, which is adjacent to the Fenbrook Subdivision,, drains into the east branch of the Sheldrake River and has a swale which is intermittently wet. Mrs. Johnson, who had recently visited the property, distributed a memorandum to the commission describing the property and the proposal, listing relevant LWRP policies and concerns (memo attached). She, also, read a letter by Gary Trachtman, the Town's engineering consultant, which stated his support for Mr. Armour's original site plan (copy attached). While discussing the physical features of the property, concern over potential 1100 erosion arose. Mr. Irwin pointed out the applicability of policy 14 of the LWRP, which is also backed by the Town's Site Plan Approval Law, whichadvocates zero increase in the rate of runoff. Mr. Morgenroth assured the Commission Address Correspondence to CZM Commission, 740 West Boston Post Road, Mamaroneck, NY 10543 (Phone 914-381-6133) yM CZMC minutes - 12/16/86 Qthat erosion would be minimal, because runoff would be checked not only by the retention gallery that will be built on the site, but again by the Fenbrook Subdivision retention facilities. Mr. Morgenroth further explained that the site receives no other rainwater, except that which falls directly on the site, to which Mr. Armour added that the stormwater drains will be adequate to handle the rainfall. Estimates of the hydrology are based on Soil Conservation Service (SCS) data. Mr. Morgenroth noted that the Town's engineering consultant could obtain the data from SCS to confirm the hydrology of this property . There will be catch basins, which the municipality will be responsible for monitoring, during construction. Mr. Irwin expressed his reluctance to provide an official advisory letter to the Planning Board at this time. Instead, he recommended that a memorandum consisting of criteria to be considered be sent to the Planning Board. It was agreed that the letter should indicate that CZMC finds no overwhelming inconsistencies with Mr. Armour's proposal in regard to the LWRP, yet several contingencies, such as zero increase in runoff and protective provisions against erosion during construction, must be ensured before CZMC will render a consistency approval. Mrs. Johnson and Mrs. Wittner will draft the letter, which Mr. Schoenberger will review and then send to the Town Planning Board before its next meeting set for January 14, 1987. Larchmont Professional Center - The proposal by Midland Construction, Inc. , to build an office condominium at 1375 Boston Post Road will be returning to the Town Planning Board at its next meeting. Another letter of referral was *Me special to the Chairman. Consideration of this proposal was deferred to a special meeting to be held before the next Town Planning Board meeting. Mayer of Westchester, Inc. , Variance Request - The variance request to use a lot adjacent to the Village Yard as an additional parking facility was denied by the Village Zoning Board. Mr. Irwin had attended the Zoning Board meeting in defense of East Creek. Mr. Lowy reported that, in talking with Jim Staudt, the Village attorney, the proposed action would most likely have reached CZMC despite approval by the Zoning Board, because the proposal must then pass through the Planning Board who would then refer it to CZMC for comment as required by the Local Consistency Law. Pinebrook Blvd. Land Transaction - Mr. Kean informed the CZMC of a potential sale of Village property. Joseph Salvatore, the owner of the land contiguous to this tract of land, wishes to purchase this property for landscaping purposes only. This property of less than one acre lies along a tributary of the Sheldrake River in New Rochelle. Mr. Kean distributed two letters regarding the issue, one from the prospective buyer to the Village Clerk and the other from the Village Engineer to the Vilage Mayor and Trustees (copies attached). Further consideration was postponed to the following regular meeting. Inter-agency Coordination Referrals and Replies - Discussion as to what an advisory letter should be ® led to a realization that some standardized forms needed to be drawn up. Mr. Irwin volunteered to draft up two forms, one for the planning boards' referrals -2- CZMC minutes - 12/16/87 and the other for CZMC's advisory response. Among the items suggested to be included in these forms are a section for engineers' comments explaining why the action was classified as a "Type 1" or "Unlisted" action, a checklist of LWRP policies that might pertain to such actions, and an entry to denote whether the CZMC's comments are precursory or the official advisory reply. The Chairman will arrange to meet with Sanford Bell, chairman of the Town Planning Board, after the forms have been drafted. In addition, Mr. Schoenberger felt that CZMC should sponsor an educational seminar with municipal engineers and lawyers, and chairmans and members of commissions. To minimize excessive questioning of proposals during CZMC meetings, it was suggested that members visit the proposed sites prior to each meeting. Liaison Assignment Modification - The need for relieving Mrs. Wittner and Mrs. Tolley from the exorbitant work inherent with being the designated liaisons to the Town Planning Board was recognized. Several suggestions were proffered. To the suggestion of assigning a member to each proposal, some felt that it would be inefficient because several CZMC members would end up at each planning board meeting. Another suggestion was to assign an additional member to the Town Planning Board that would be rotated, not per meeting, but after several meetings to allow for a measure of continuation. It was, also, noted that much information could be obtained by going directly to the developers or the engineers, if one could not attend a planning board meeting. To start with, the Chairman established an alphabetical rotation system whereby an additional CZMC member would attend one Town Planning Board meeting with Mrs. ® Wittner and Mrs. Tolley. Mr. Allen was, therefore, designated to attend the first meeting. Local Consistency Memorandum - Since no substantive comments were received regarding the memorandum on procedural guidelines for consistency, it was sent out as is. Legislative Matters Mr. Irwin reported on the status of several unfinished LWRP-related legislations (refer to attached memo). Town Freshwater Wetlands Map - Mr. Irwin has redrawn this map to incorporate the lower portion of the Town, which includes the Hommocks- Hampshire area, which had been accidentally disregarded in the official reproductions. The CZMC voted in favor of calling for an amendment to substitute the preexisting map (dated May 1986) with the new map (dated December 1986). Mr. Irwin will draft the letter for CZMC endorsement of the ammendment. Error in LWRP Map - Mrs. Wittner noted that there was an omission in the Fish and Wildlife Map of the LWRP. Village Freshwater Wetlands Law - A brief discussion arose as to whether CZMC should recommend that the Village of Larchmont adopt a freshwater wetlands law. The members decided to delay such a recommendation. Critical Environmental Areas (CEA) - Mr. Irwin proposed that the CZMC request the Town and Village to include the East Creek under the protection of CEA status. It was again decided that such a request be delayed. -3- • CZMC minutes - 12/16/86 State SEQR Law Revision - Ms. Ng was assigned to find out if the revised law has yet been issued. Oil Pollution Crabtree Ford - Discussion progressed into the existing dangers of oil contamination to East Creek as a result of the voluminous number of cars parked behind Crabtree Ford. Ms. Ng will try to obtain State laws, such as the State Bulk Storage Law, that might contain the necessary provisions to afford protection to East Creek. Gasoline Spill - On Tuesday, 200 gallons of gasoline spilled into the Premium-Pinebrook River as a result of overfilled storage tanks belonging to Amoco gas station. Fenbrook Subdivision-Scheuer Residence Area - Mrs. Johnson proffered the concept of a "use district" to provide a way for distributing the responsibility of managing the oil pollution that would result from the increased car usage in the Fenbrook Subdivision area. Other Business Harbor Patrol - Mr. Allen expressed his concern over the lack of protective provisions for Horseshoe Harbor and the adjacent coasts of Larchmont. He addressed the need for a qualified harbor patrol that would possess the authority to make arrests as well as the training to assist in accidental emergencies. The CZMC authorized Mr. Allen to conduct a study of the situation. Next Meeting The next regular meeting was set for Tuesday, January 26, 1987, at 8:00 P.M. in the Town Center.
