Village Center, Larchmont, April 29, 1985

1. The meeting was called to order at 8:10 p.m. , Mr. Irwin in the
chair. The minutes of the March 12 meeting were approved
without change.
2 . County "consistency" re Maxwell Avenue facility: Dr. Mason
reported that the Westchester County EIS on the Maxwell Avenue
solid waste transfer station notes serious coliform and other
pollution conditions , terme3 "not desire':,'e" by the Dunty' s own
evaluation. Dr. Mason believes these conditions will impact
seriously on Town and Village waters and may raise a question
of conformity with local freshwater wetland laws and State
tidal wetland laws. In discussion, a further question was
raised as to whether such conditions in a County installation
would also be subject to the LWRP consistency rule once the
LWRP is adopted.
3.= New Rochelle project on David' s Islands Mr. Irwin and Mrs. Tolley
reported receiving an inquiry from Mayor Curnin about the David' s
Island development plan and its potential impact on Village inter-
- ests. Mrs. Price, who had volunteered to look into the matter for
the Committee, had talked that same day with Richard Grayson,
chairman, and Dr. Green, member, of the New Rochelle Conservation
Commission; with Louise Leaf, city planner; and with officials
of the U. S. Coast Guard. The Coast Guard has assumed the role of
lead agency regarding the proposed bridge between the island and
the mainland, and says a full EIS on the bridge project will be
required; papers on this will be sent to Mrs. Price. From the dis-
cussion with Louise Leaf it was not clear whether New Rochelle
intends to follow SEQR procedures on the David' s Island develop-
ment, which is reported to call for 5 or 6 apartment buildings
each 55 stories high. An environmental planning group- on the pro-
ject has been appointed by the city and is expected to report in

a few months. Mrs. Price will continue to report on this matter to
the Committee.
S 4. Pryer Manor Marsh. Mr. Irwin reported on discussions with Mr. Buchman
and Mrs. Johnson on the status of this 5*-acre marsh, which is owned
by the City of New Rochelle and is formerly connected with the Pre-
mium Marsh. Mr. Buchman and other members of the Pryer Manor Associ-
ation are anxious about the possibility that it may be sold for de-
velopment. The issue goes back several years, and recent discussions
on it between the Association and City officials have been inconclu-
sive. Since some members of the Association are Town residents, Mr.
Irwin is gathering information on the matter to brief Town officials.
5. LWRP: Procedure and timetable: It was noted that copies of the April
1985 revised working draft of the LWRP--the result of two drafting
sessions of the Committee of Committees on April 2 and 3--had been
distributed to most Committee members, to all members of the Town
t and Village Boards, and to the Town and Village attorneys , under a
memorandum by Mr. Irwin dated April 16, copies of which were also sent
to the entire membership of the Committee.
The Committee is scheduled to brief the Village Board at its May 6
meeting, and the Town Board at its May 15 meeting, on the draft LWRP
and the related legislative proposals. It is hoped that both Boards
will be able to approve the forwarding of the draft to Albany for
full review by the end of May. Meanwhile both Boards must also declare
themselves lead agencies for public hearings on the Draft Environ-
mental Impact Statement (Section IX of the draft LWRP) as it relates
to their respective jurisdictions. Hearings on the DEIS could then
410 be held during the 60-day Albany review period, although a later
date for the hearings would be possible if deemed advisable.
6. LWRP: Amendment to text of Section II. Mr. Vandernoot, referring to
the April revision of the LWRP, raised an objection to the revision
of the footnote in the Inventory (page II-4) concerning ownership of
the beach adjacent to the foot of Beach Avenue. After some discussion
there was still no agreement on how the footnote should read. Mr. Kean
then suggested that the footnote be deleted, and that the sentence in
the text to which the footnote refers be revised by deleting the named
streets, making the sentence read: "In addition, the dead ends of
several Village streets abut the waterfront or the Premium estuary. "
The Committee agreed unanimously to this suggestion. The municipal
governments will be informed of this change in the text recommended
by the Committee.
7. Town "moratorium" law on development. Dr. Lerman briefed the Com-
mittee on a draft law to be acted on by the Town Board on May 1,
under which action by the Town zoning and planning boards on devel-
opment proposals in the Unincorporated Area would be suspended until
March 1, 1986 in order to leave time for the Town to consider new
zoning and land use proposals expected to be made by the Joint
Planning Committee with the Village of Larchmont and by this Committee.
Committee members welcomed this proposed action as an important means
of assuring the effectiveness of the LWRP.
0 8. Next meeting The next meeting of the Committee was set for Tuesday
evening, May 21, at 8 p.m. in the Village Center.
9. Adjournment. There being no further business, the Committee adjourned
at 10:05 p.m.
