1. The meeting was called to order at 8:10 p.m. , Mr. Irwin in the chair.
i 41;) The minutes of the previous meeting (OCtober 1 , 1985) were approved as
written.
' 2. Mr. Irwin distributed to those present copies of the March 1986 revision
of the Draft LWRP, and a memorandum dated April 16 to the Town and Village
Boards containing a proposed timetable for completion of the local SEQR and
legislative process on the LWRP and related legislation before June 30. He
then reported to the Committee on developments in the LWRP process since
the Committee last met on October 1. No need had appeared for a Committee
meeting during the intervening months since the main part of the Committee's
work had been completed with the drafting and revision of the LWRP as cir-
culated in October. The focus of work since that date had been on preparing
draft legislation, required under Section V-A-2 of the LWRP as implementing
measures to be adopted by the Town and Village Boards. Under State regula-
tions this draft legislation, along with the LWRP itself, faces a complex
process of review (and likely further revision) both in Albany and locally.
That process, under the April 16 timetable, is to be completed by June 30.
Concerning the new draft of the LWRP, Mr. Irwin noted that a number of
small changes had been made in the text and maps as a result of further
study, but none of any substantial importance. However, it was already clear
that further changes would be necessary--in addition to any that may result
from the Albany review and the local SEQR hearings--and some of these would
affect substance. These would be distributed in draft to the Committee for its
comment before submission as a Committee memorandum at the local SEQR hearings,
with a view to inclusion in the final text. One of these changes would widen
III the area of rezoning to R-30 in the Town portion of the Hampshire-Hommocks
area to include the entire area southeast of the Post Road now zoned R-7.5.
In brief discussion of this subject there was general agreement that this change
was desirable. In any event, all further proposed changes would be distributed

to the Committee for comment before submission to the SEQR hearings.
QRegarding the new timetable, it was explained that two important considera-
tions had led the Town and Village Boards to conclude that the entire LWRP
process must be completed, the LWRP in final form adopted, and all essential
implementing legislation enacted, before June 30. Most important was the fact
that the Town "moratorium" law on consideration of new applications for devel-
opment, originally due to expire on March 1, had been extended six months to
September 1, 19.86., and could not be expected to be extended again. The main
purpose of the moratorium had been to allow time for the new land-use laws
proposed in the Draft LWRP to be enacted by the Town Board so that all pending
applications would be subject to an adequate and uniform set of rules. But if
these new laws were to be sufficiently researched, written, and enacted to
meet the new moratorium deadline, action in fact must be completed by the end
of June since July and August are customarily considered "dead" months for
hearings. on important legislation. And, for procedural ans well as substantive
reasons, it was important for the Village to act on the same timetable as the Town.
A second important consideration was that the Department of State, according
to Charles McCaffrey, would probably be able to include our two municipalities
in an early grant of financial aid for implementing measures such as the proposed
feasibility studies on the Premium and Sheldrake, provided our June timetable is
adhered to. Mr. McCaffrey had been highly cooperative and resourceful in helping
us find ways to accelerate the review process to meet the June 30 deadline.
Mr. Irwin observed that the need for this accelerated effort had not been
anticipated last fall, when it was expected that the legislative drafting could
Q be finished by early winter. The heavy work load of the two municipal attorneys
had made this impossible. The response was the Town Board's extension of the
moratorium law on February 27 and, from that date on, a concentrated effort by
the two Committee Co-Chairmen, working with the two Attorneys and with other
key municipal officials and CZMC members, to develop satisfactory working drafts
of all the implementing legislation (9 items for enactment by the Town, 6 by the
Village) slated for consideration in the review process. Drafting of the almost
wholly new Town Freshwater Wetlands law had been done mainly by Mrs. Tolley, who
had also played a central part in developing the key "local consistency" law
for both Town and Village. Also, special maps required for the zoning, wetlands,
and flood damage control laws had been, or were being, prepared with the help of
the Village and Town Engineers and Town Environmental Consultant Cliff Emanuelson.
Meanwhile, to speed the review process, Mr. McCaffrey had initiated the 60-day
State review of the draft LWRP without waiting for the draft implementing legis-
lation, which would follow as soon as ready. To further accelerate the entire
process., Mr. Irwin had been asked by the Mayor and Supervisor to coordinate the
process for both Village and Town and had been given a desk and telephone
(381-6133) in the Town Conservation Office for that purpose.
3. SEQR Hearings. It was noted that under the new timetable the local SEQR hearings
on the Draft Environmental Impact Statement for the LWRP (and, indirectly, for the
implementing legislation) to be held separately by the Village and Town Boards, must
be held between May 19 and June 5. [See the attached notices, issued during the
week of May 7, fixing the dates at May 28 for the Village and May 29 for the Town
• Committee members were encouraged to attend the hearings and, meanwhile, to lend

® their support in the community to the adoption of the LWRP; also, to inform
Mr. Irwin promptly of any errors or flaws in the revised (March) text of the
LWRP which they feel should be corrected.
4. Land use issues. Several pending land use issues in this and neighboring
communities were discussed. It was pointed out that early adoption of the LWRP
would strengthen the community's ability to deal systematically with these
matters in keeping with sound environmental principles.
5. Adjournment. There being no further business, the Committee adjourned
at 9:25 p.m. , subject to the call of the chair.

Title of Action: Adoption by the Village of Larchmont of a Local Waterfront Revi-
talization Program (LWRP) pursuant to NYCRR Chapter XIII, Part 601, and
enactment of certain items of legislation in partial implementation of the
said program.
Description of Action: The Draft LWRP was prepared underguidelines of the New York
State Department of State and, upon approval by the Secretary of State, will
comprise an element of the State Coastal Management Program. It was written as
a joint program with the Town of Mamaroneck, pursuant to Sec. 915 of Article 42
of the Executive Law which provides in part that "two or more local governments
acting jointly" may, if both are contiguous to State coastal waters, submit a
LWRP for approval by the Secretary of State. Section IX of the Draft LWRP con-
sists of a Draft Environmental Impact Statement (DEIS).
The basic purpose of the Draft LWRP for the Village is to protect and enhance,
or restore where necessary, the coastal resources of the Village. Embraced in
this purpose are control of flooding, erosion and pollution, preservation or
restoration of natural features-, and preservation of waterfront access, recrea-
tional opportunities, and historic, cultural and scenic landmarks. The program
includes specific policies and implementing actions, including enactment by the
Village of laws on (1) management structure for the LWRP, (2) local consistency
with its policies, (3) site plan approval amendments on stormwater runoff rates,
(4) a new R-50 zone along the waterfront, (5) designation of two Critical Envi-
ronmental Areas , and (6) erosion and sediment control (Best Management Practices).

Potential Environmental Impacts:; .As the DEIS indicates, the most. significant impacts,
will be beneficial: establishing coherent policies and plans for the use and pro-
tection of the waterfront and the adjacent coastal area, including guidelines for
subsequent land-use and other relevant actions. Other benefits will flow from adop-
tion of implementing laws, regulations, and other actions called for in the LWRP,
and from establishment of a management structure to coordinate implementation and
of procedures to assure local consistency with the policies of the LWRP.
The impact of each specific physical action recommended by, or permitted under, the
LWRP, whether such impact be beneficial or adverse, will be evaluated as part of
the site-specific environmental review of the particular action. Some possible
impacts are discussed in Part C of the DEIS. No unavoidable adverse impacts are
anticipated from adoption of the LWRP or of the legislation listed above, whose aim
is to guide waterfront actions and programs in accord with sound land use and
environmental management practices. Specific proposed actions will be reviewed
to evaluate possible impacts and will be subject to local, state, and federal
environmental protection regulations.

Attached is atimetable for the above work based on a discussion April 15 here
in the Town office with Charles McCaffrey, Steve Altieri and Steve Silverberg.
The main aim is to get the Town's land-use legislation on the books before the
end of June so as to meet the September 1 moratorium deadline without going into
the summer months .
At some points, especially between June 13 and June 30, the timetable is very
tight and will make unusual demands on all 'of us; but if the two Boards are
willing I don't see why it can't be done. Charles McCaffrey's willingness to
work with us will be immensely helpful.
An additional incentive for moving on this fast track is financial. If we
cross the finish line in, say, early July (assuming Secretary Shaffer is
prepared to sign then, our work being done)--Charles McCaffrey tells me we
will thereby be one of the first 12 LWRP communities in the State. (Incidentally,
we will be the first to do a bimunicipal program, although there are a dozen
such elsewhere in the State that have been started. ) Our being among the first 12
will put us in line for early State financial assistance to help implement the
program--for example , perhaps a grant to help pay for the Premium feasibility
study recommended in Section IV-? (1).
Since the State's pool of grant money for the Coastal program is not large ,
this could be an important reason for moving as fast as we can.

"..,,, 0 . The schedule below is based on a consensus arrived at on April 15 in a meeting of
Charles McCaffrey (Department of State) , Steve Altieri, Steve Silverberg and m
Its object is to complete the LWRP process, including the land-use-related legisla-
tion to be enacted by the Town of Mamaroneck in implementation of the LWRP, before
the end of June--thereby assuring that this legislation will be on the hooks before
expiration of the Town moratorium law on September 1, but without the necessity of
holding public hearings on the legislation during July or August.
Note: Although the Town moratorium, strictly speaking, requires this accelerated
timetable only on the implementing legislation contemplated for action by the Town,
as a practical matter--given the bi-municipal nature of the LWRP and the close
linkage between it and the entire legislative package--it is highly desirable that
the entire LWRP process, including not only adoption of the LWRP but also enactment
of. the implementing legislation of both municipalities, be completed at the same time.
THIS SCHEDULE IS A WORKING DRAFT SUBJECT TO CHANGE BY THE TOWN BOARD, THE V LIAGE
BOARD, OR, IF NECESSARY FOR TECHNICAL REASONS, BY THOSE AT THE WORKING LEVEL.

Subject: Rapid handling of the LWRP resolutions and letter
of transmittal
Because time is of the essence in our LWRP process, and I have to
be out of town this Thursday, I suggest the steps outlined below.
I am assuming that the draft resolution authorizing submission of
the LWRP and associated draft legislation will be adopted on schedule
tonight, Tuesday, by the Village Board and tomorrow night, Wednesday ,
by the Town Board. I will be present at both meetings.
1 . When the Village Board meets this evening (Tuesday) , Barbara
Wood will have ready for signature by Mayor Curnin
--the letter of transmittal already prepared for her
signature and that of Supervisor Battalia, addressed
to Secretary of State Shaffer in Albany; and

one except for name of municipality adopting it) , the Supervisor

5 . The originals of all three items--two resolutions and one
letter of transmittal--will then be handed to me (I assume
this can be done while the Board meeting is in progress)
in an envelope large enough to contain them without folding,

Stone Ridge, NY 12484. I will photocopy all three, leave the
copies on Pat Di Cioccio' s desk, and seal and mail the original
that same night. (I assume the copier in the Town Office will
be available and in working order! )

Dear Secretary Shaffer:
Pursuant to prescribed procedures for the review and approval of Local
Waterfront Revitalization Programs, we submit to you herewith 50 copies
of the Draft Local Waterfront Revitalization Program of the Village of
Larchmont and the Town of Mamaroneck for review by the Department of
State and other State and Federal agencies as may be appropriate. Also
attached are copies of the required resolutions adopted by the governing
bodies of our two municipalities authorizing this submission.
Our two municipalities are preparing, and will submit to you for the
same review process at the earliest possible date, drafts of implementing
legislation called for by the draft LWRP.
In the meantime, we urgently request that the Department of State inform
us, pursuant to the procedures established by it, of the opening date of
the 60-day review period within which our local SEQR hearings on the LWRP
and associated draft legislation must be held. For local reasons which
have been discussed with Mr. Charles McCaffrey of your staff, it is very
important that the SEQR hearings be scheduled not later than the month of
April. Time is therefore of the essence in fixing exact dates for the
review period.
Although obviously some details may change, we believe that the enclosed
draft embodies a well-thought-out program which is consistent both with
State coastal policies and with local :conditions in our two municipalities;
and which, with appropriate support and cooperation from State and County
agencies, we at the local level have the capability and the will to im-
plement.

bodies, with neighboring municipalities and County agencies, and with the
Department of State and the Department of Environmental Conservation of
New York State, and after diligent research and extensive discussion, has
prepared a draft of the said Local Waterfront Revitalization Program and has
recommended that it be duly submitted to the Secretary of State for review
with a view to early finalization and approval; and
WHEREAS, Attorneys for the Town and Village have presented to the Town
Board drafts of certain legislation designed to implement provisions of the
said Program; and
WHEREAS, the above mentioned drafts appear to the Town Board to be close
enough to final and acceptable form to warrant submission for review by the
Secretary of State;
