Town of Mamaroneck Village of Larchmont = IL ~4 COASTAL ZONE MANAGEMENT COMMISSION MINUTES SEPTEMBER 27, 1988 A regular meeting of the Coastal Zone Management Commission (CZMC) was held on Tuesday, September 27, 1988 in Conference Room B of the Town Center, 740 West Boston Post Road, Mamaroneck, New York. The meeting commenced at 8:05 PM. Members Present: Robert S. Schoenberger, Chairman Bruce Allen Elinor Fredston Mary Anne Johnson Paul Kean C. Alan Mason Howard McMichael Shirley Tolley Phyllis Wittner Richard Young Others Present: Cheryl Lewy, liaison, Village of Larchmont Board Mr. & Mrs. Carl Perler, Village of Larchmont Residents Claudia Ng, Environmental Coordinator Barbara Cleary, Recording Secretary Long Island Sound Study The Long Island Sound Study is being done by the Environmental Protection Agency (EPA) , which will include the study of Mamaroneck Harbor. The Town Board has requested that the CZMC review and comment on its findings. Phyllis Wittner attended a meeting concerning the Study. She advocates making recommendations that would be advantageous to the Local Waterfront Revitalization Project (LWRP) projects the Commission would like to see implemented. Alan Mason said the comments of the CZMC should be supportive. Both he and Mr. Allen feel enough studies have been done and its time to implement the recommendations. Shirley Tolley stated we should choose a project from the LWRP and proceed with it. Mr. Schoenberger suggested a task force be set up to monitor the progress of this project. Phragmites Vacant Lots Mr. Schoenberger said there was a petition signed by local Larchmont © Residents which supported the Phragmites stand on vacant lots near Old Colony Drive to remain. He asked the Commission if they would like to take a position on this. Ms. Fredston suggested that she and Bruce Allen write a letter to Mr. Kellogg and Mayor Curnin as individuals, citing appropriate Address Correspondence to CZM Commission, 740 West Boston Post Road, Mamaroneck, NY 10543 (Phone 914381-6133) I CZMC minutes-9/27/88 policies of the LWRP. Annual Report The production of the Annual Report must be started soon, since it is due for publication in November. The Commission discussed the possibility of hiring a consultant to write it. Shirley Tolley suggested we use the same format as last year and put in the new facts. She also said she would be willing to go through all the referrals and past minutes to gather information for the project. Mrs. Wittner said she would assist by writing about the Premium and Mr. Lowy also volunteered his services. Mr. Schoenberger said he would put all the information together. Budget Ms. Ng informed the Commission that it was time to submit the 1989 budget. She reviewed the actual expenditures for the year 1988. Mr. Schoenberger stated that expenses should be kept to a minimum so that more funds would be available for consulting fees. He estimated as much as $8000 would be needed for consultant fees this year. Ms. Ng said the Commission must provide her with specific projects so she can speak to Steve Altieri about appropriating the necessary funds. SEQR Law Mrs. Tolley spoke about the State Environmental Quality Review (SEQR) Law and about Type I and Type II actions. She stated she is working on a draft of the local environmental quality review laws in response to the 1987 revised State regulations. She requested that all members read over the draft carefully so it can be discussed at the next meeting. There will be a SEQR workshop held on October 20, 1988 at the County Courthouse. Harbor Security Mr. Carl Perler, a resident of Larchmont and member of Horseshoe Harbor, attended the CZMC meeting to question the proposed Bay Constable Program and the security of the Larchmont Harbor. Mr. Allen addressed many of his concerns. Mr. Allen said that the need for the bay constable program was determined by the LWRP on page 33 which found the Harbor was not secure. He said the program would help alleviate some vandalism, prevent the speeding of boats through the fleet, monitor the dumping of pollution in the Sound, and provide safety. He said a public meeting will be held on October 3, 1988 at the Larchmont Municipal Building to fully address all questions pertaining to the Bay Constable Program. He also said that the state puts up 3/4 of costs but the village must pay the balance. Only boat owners will be assessed based at approximately $2 per foot. R-40 Village of Larchmont Mr. Schoenberger said the LWRP originally recommended that the Village of Larchmont upzone the waterfront areas to R-50. At a subsequent review of the upzoning proposal, the Commission recommended R-40. Cheryl Lewy sees a problem with the proposal based on Sann's argument that there are only 4 or 5 lots which would be affected and the rest would be non-conforming. She stated that the Larchmont Yacht Club and Larchmont Shore Club should be talked to because there is nothing that precludes them from being subdivided. Dr. Mason feels that the area is ripe for secondary development in which two lots are combined in order to make three lot subdivisions. -2- CZMC minutes - 9/27/88 Mrs. Tolley suggested more creative zoning and advocated establishing a waterfront Coastal Zone. Mr. Allen is working on a project to have part of Manor Park be designated as historic. Mr. Schoenberger will form a task force with Larry Lowy and Elinor Fredston. Members should come to next meeting with ideas concerning this proposal and suggestions for creative consultants who can assist with the zoning. Ms. Lewy suggested a moratorium be put on the waterfront properties. New or Other Business Approval of Minutes- The minutes for July 26 and August 23, 1988 were approved with corrections. Inspections - Howard McMichael called saying there is major earth moving along stream near Fenbrook. Ms. Ng will have Mr. Jakubowsky investigate. The Bonnie Briar Country Club- It was noted that there were crushed pipe in the fill the were getting. They are trying to relocate a spot for the fill. There was a tour for Town Planning Board members and some CZMC and CAC members. Richard Young said that a Bonnie Briar homeowner's Association is being formed, which will seek to include people across Weaver, Roucken Glenn and Alan Mason suggested including those along the Sheldrake and Forest Avenues. Sheldrake Watershed - CZMC suggested putting a price limit on it. 69 Shore Drive- an inground swimming pool was approved by the Village of Larchmont Zoning Board without referring it to the CZMC. Mr. Schoenberger noted that Mr. DeVore called him to apologize for not sending it in advance. The Commission recommended that no water be discharged into the sound, that height of shrubbery be specified, and that pilings for support and low lighting be used as specified by village ordinances. 1919 Palmer Avenue - The location near Chatsworth, which was formerly Mallette Service Station, is being proposed for a mixed use facility. It will feature an arcade and 42 spaces below ground, although 80 spaces are required under regular zoning Laws. Mrs. Fredston went to the Village of Larchmont Planning Board meeting. She strongly recommended that oil traps be required in the parking lot. Appointment -Phyllis Wittner announced that Gail Shaffer was appointed Chairman on the Govenor's Task force on Coastal Zone. Search For Grants - Mrs. Wittner advised the Commission on the progress on her search for grants for implementation of the Premium Feasibility Study Recommendations. Under the EQBA of 1972 applications are being accepted for funding. Mrs. Wittner arranged for a pre-application site visit with a DEC official who said he thought there was a good chance of securing funds because it is a true preservation. He also informed her that the Premium was on acquisition for State Tidal Wetlands. It is a long process but progess is being made. Mrs. Wittner read a draft of a letter to the Secretary of State requesting the edentification of available funding. She noted that the Supervisor had given .her verbal approval to proceed with her search for grants. -3- fir CZMC minutes - 9/27/88 The Premium Feasibility Study Report will be formally presented to the 0 Village of Larchmont on October 3, 1988 as requested. Premium Celebration -Mary Anne Johnson said there will be a Premium celebration held on October 23 from 1-3 PM at Trinity Park. Long Island Sound Conference - There will be a Conference on Long Island Sound on November 5, 1988 at the Wainwright House. Meeting adjourned 10:35 0 0 -4-
