MINUTES
OCTOBER 24, 1989
A regular meeting of the Coastal Zone Management Commission (CZMC) was held
on Tuesday, October 24, 1989 in the Senior Center of the Town Center, 740
West Boston Post Road. Mamaroneck. New York. The meeting commenced at 8:05
P.M.

LARCHMONT WATERFRONT LAND USE STUDY
Daniel Shuster of Shuster Associates was on hand to present and answer the
Commission's questions regarding the Progress Report - Larchmont Waterfront
Land Use Study which was distributed at the
previous CZMC meeting in
September. A copy of the report was sent to the Mayor and Trustees, Frank
Devore and the respective chairmen of the Zoning Board of Appeals,
Architectural review Board, Planning Commission, and the Conservation
Advisory Commission (CAC) on October 5. The Commission scrutinizeethe
1 contents of the report and addressed certain segments in order to emphasize
specific concerns. Mr. Shuster provided the Commission with a visual display
of an overlay map which answered additional questions. The core of the
discussion centered around the proposed zoning options:

Also discussed were Mr. Shuster's "Preliminary Conclusions" which pointed
out that existing Village regulations were deficient in providing procedures
( and guidelines to protect the waterfront.
At the conclusion of the discussion Ms. Wittner asked Mr. Shuster to come
back with specific recommendations to implement the proposed options.
Specifics should be provided for amendments to existing Zoning Law, Site Plan
approval, Subdivision Regulations and Architectural Review. As a result of
an eloquent reminder from Dr. Mason regarding the mandate of the CZMC Mr.
Shuster was asked to zero in on 3 of the proposed zoning options:
Recreational Use District and R40 with Overlay Zone.
ADMINISTRATIVE MATTERS
Approval of Minutes - The minutes for both August. 22 and September 26
were approved.
CHAIRMAN REPORTS
Boaters Education - Ms. Wittner reported that immediately following the
statement she made to the Village of Larchmont Board on 10/2/89 re: a Bay
Constable Program, Mr. Carl Pierleoni volunteered to act as liaison for the
"clubs" and the CZMC. She also stated that the Conservation Office received
of 700 copies of each of the Department of Environmental Conservation
pamphlets entitled "If You See It-Report It" and "Stow It-Don't Throw It".
She noted that these would be given to Mr. Pierleoni for distribution to the
club members along with two other educational pieces which are in the process
of being rewritten for brevity.
Ms. Wittner also raid that at the 10/2/89 Board Meeting, the idea of the
CZMC looking into the topic of pumpout stations was raised. After discussion
with Mr. McMichael Ms. Wittner agreed to act only as a source and conduit of
Marine Sanitation, other anti-water pollution information, and "No Discharge
Zones" for Mr. Pierleoni and others who express interest in the subject.
Proposed Long Island Sound (LIS) Improvement Act 1989 - Ms. Wittner read
excerpts of the proposed law which provided the following information to the
Commission:
1 . Continues the Management Conference of the Long Island Sound Study
(LISS) which will bring the study through implementation of its
hypoxia phase and enable them to continue and study toxics.
2. Formation of a bistate LIS Program Office. The Director will be
appointed by the Environmental Protection Agency (EPA) Administrator
with a committee from EPA Regions I and II - New York DEC and
Connecticut DEP Offices to be located on or near the sound -
alternating every 5 years between New York and Connecticut. )

,,.., 3. The Office will be responsible for implementation, enforcement,
grants, research and planning. Studies will be required on many
topics including adequacy of wastewater treatment facilities to
wetlands, citizen education, outreach and demostrative projects,
etc. . .
4. The Senate recommends 3 million dollars a year plus a "LIS Fund"
(fines collected by federal government against LIS polluters under
the Clean Water Act) . The House will be asking for an increased
appropriation.
CORRESPONDENCES
Outgoing - Ms. Wittner reported the following outgoing correspondences:
1. McCaffrey & Resler at NYDOS, Police Chief Keresey re: Outcome of the
Bay Constable Program.
2. Mary Anne Johnson re: resignation and appreciation.
3. Assemblyman Ronald Tocci and Senator Suzi Oppenheimer re: requesting
support for Premium Grant.
4. Diane Keane re: County Designated Critical Environmental Areas
(CEAs) . Reiterated need for procedures for intergrated review.
Asked that local CEA (Hampshire CC) be included in mapped boundary.
5. Lt. Governor Stan Lundine re: Taskforce on Coastal Resources and
keeping CZMC informed.
OTHER
1. Village of Larchmont's Newletters - "Facts of Life" re:
1-800-TIPPDEC.
2. Public Forum 10/15/89. When that forum was cancelled submitted
statement on Davids Island.
Ms. Tolley has volunteered to be the CZMC liaison to Save Davids
Island group and to head the CZMC's Davids Island Committee. Ms.
Wittner asked for additional volunteers to work with Ms. Tolley.
3. Commissioner of Parks and Recreation-Town of North Hemstead re:
number of boats in their harbor and the possible effect of the David
Island development.
Incoming - Ms. Wittner reported the following incoming correspondences:

2. Congressman Nita Lowey re: recruiting the following members for the
Federal Coastal Management Taskforce for reauthorization of the
Federal CZMACT: Phyllis Wittner, Howard McMichael, Wally Irwin,
Mayor Curnin, and Elaine Price.
MEMBER REPORTS
Visual Inspection East Creek/Hommocks Complex - A report prepared by Jack
Taylor Jr. entitled "Visual Inspection Hommocks Conservation Area" was
distributed in the last CZMC member mail packet. The report was discussed in
length The specific location, method of monitoring and implementation, and
the cost of the recommendation. Once all facts and recommendations are
finalized Ms. Wittner said she will funnel the recommendations through the
proper channels in order to achieve approval and implementation.
Country Club Land Use Study - Ms. Wittner reported that the Town is in
the process of finalizing legislation on this topic and public hearings will
be scheduled.

- -7 6 Stelford Place - Elinor Fredston reported on the results of the last
Planning Board Meeting and Ms. Fredston indicated that the Board had found
that the property sits very high up causing excessive water runoff. She also
noted that the application concerns a small lot with 2 dry wells.
Ms. Fredston also said that the Manctville property applicant is applying for
a special permit from the Village of Larchmont Zoning Board to convert this
office building into a car dealership
ENVIRONMENTAL COORDINATOR REPORTS
Pryer Manor Bridge Repair - Claudia Ng informed the Commission that
Steven Altieri had reported that no structural damage has been found as of
yet concerning the Pryer Manor Bridge. She said that Mr. Altieri had also
indicated that, in conjunction with the City of New Rochelle, a
reconstruction project would be underway some time during the spring or early
summer 1990 subject to available funds. Phyllis Wittner indicated that she
will continue to monitor this topic and wants the CZMC to see the bridge
plans at its next meeting.
Sheldrake Watershed Study - Ms. Ng updated the Commission on the status
of the Sheldrake Watershed Study. She indicated that the Planning Board had
also agreed that a 100 to 200 ft scaled map at 1 to 2" contour intervals
would also be helpful for their studies. Ms. Ng will advise the members of
any new information that arises.
NEW OR OTHER BUSINESS
Ms. Wittner reported the following:
1. The Premium River/Pine Brook Preservation Association and
the L.I.F.E. Center held a Coast Weeks Event on 10/15 at the
Trinity Retreat.

2. The Gardens Lake Dedication was held on 10/15.

3. Representative Nita Lowey's Coast Guard Hearing re: OIL SPILLS
was held on 10/16 and was very informative. Dr. Weisbrod of the
DEC testified about the excessive amount of lubricating oil (400
million gallons) is disposed of illegally in storm drains. Ms.
Wittner gave Ms. Ng an article entitled "Stencil the Town
Fishery" to see if scouts and schools would help with a project
to make citizens aware that storm sewers drain into Long Island
Sound. .
4. Long Island Sound Taskforce Environmental
Conference is scheduled for 11/4 in Stamford.
Next Meeting - The next meeting was scheduled for Nov 28, 1989 at 8:00
P.M. Please Note: THE DECEMBER MEETING HAS BEEN CANCELLED.
