HomeMy WebLinkAbout1989_11_28 Coastal Zone Management Commission Minutes Town of Mamaroneck Village of Larchmont 1L COASTAL ZONE MANAGEMENT COMMISSION MINUTES NOVEMBER 28, 1989 A regular meeting of the Coastal Zone Management Commission (CZMC) was held on Tuesday November 28, 1989 in the Court Room of the Town Center, 740 West Boston Post Road, Mamaroneck, New York. The Meeting commenced at 8:05 P.M. Members Present: Phyllis Wittner, Chairman Bruce Allen Elinor Fredston Larry Lowy C. Alan Mason Howard McMichael Robert Schoenberger Shirley Tolley Richard Young Others Present: Cheryl Lewy, Trustee, Village of Larchmont Denise Fletcher, Village of Larchmont Zoning Board Mary Anne Johnson Claudia Ng, Environmental Coordinator Rene' Rathschmidt, Recording Secretary LARCHMONT WATERFRONT LAND USE STUDY At the request of the CZMC Dan Shuster returned with a draft of proposed amendments to the Village of Larchmont Zoning Law. Mr. Shuster went on to discuss in detail the proposal and to answer questions posed by the members. Mr. Shuster proposed that a new Waterfront District be established encompassing the property directly fronting on the open waters of Long Island Sound and Larchmont Harbor. He also suggested that a Coastal Overlay District be •established to include all of the property fronting on Long Island Sound, Larchmont Harbor, Little Harbor Sound, East Creek, Premium Mill Pond, the Premium River and Pine Brook. 1. The draft's legislative intent is "to implement the recommendations and policies of the Local Waterfront Revitalization Program adopted by the Village Board on June 30, 1986 by establishing standards and criteria to • preserve and protect the natural environment, developed character and visual quality of the coastal area". This would be accomplished with amendments to the following sections of the zoning: Districts, the Zoning Map, the Schedule Controlling Buildings and Land. including Permitted Principal Uses. Address Correspondence to CZM Commission, 740 West Boston Post Road, Mamaroneck, NY 10543 (Phone 914-381-6133) CZMC MINUTES - 11/28/89 Permitted Accessory Uses, Uses Permitted Subject to Special Permit, Lot Area, Yards, Coverage, Height, etc. . . , Off Street Parking Spaces, and other requirements. The creation of a "Coastal Overlay District" (COD) would necessitate the following in the zoning law: Standards including Set-backs from the Water's Edge, Maintenance of Natural Buffers, Visual Impact, Actions subject to review and Review Criteria and others. During the course of the discussion Mr. Shuster displayed a map of the Overlay Zone. The members then pointed out a few areas which they had felt had been over looked. Ms. Wittner suggested that Mr. Shuster actually drive thru the proposed overlay area so that he would be sure that all areas pertaining to the Waterfront were included. Ms. Denise Fletcher Chairman of the Larchmont Zoning Board interjected with her opinions on the proposal. She stated that the proposed waterfront district had a very narrow perspective and should include a far greater area. A brief discussion followed where the members defended the area size with concrete reasoning. Ms. Wittner requested that Mr. Shuster return to the January meeting with a revised proposal which will include the suggested changes proposed by the CZMC members during the course of his presentation. Further clarification of limits was requested for the section on natural buffers. ADMINISTRATIVE MATTERS Approval of Minutes - The meeting minutes of October 24 were approved pending minor corrections. CHAIRMAN REPORTS Premium Grant - Ms. Wittner informed the Commission that the CZMC had received a contract from the New York State Department of Environmental Conservation (NYSDEC) for the Town and Village on 11/17/89 in order "to restore tidal circulation in a river-marsh system which has become filled with sediment". The contract for $618,965.00 was signed by the Town acting as lead agency and returned. She also noted that it will probably be late December before it is returned with the necessary State signatures. The municipality has 90 days to advertise and receive Project bids and 45 days after opening bids to award them and 1 year (unless otherwise agreed to) to complete. The target date set for dredging is November 1990. Malcolm Pirnie will prepare an Environmental Impact Statement (EIS) , which will be referred to the CZMC. Malcolm Pirnie will also be responsible for bid documents, evaluating bids, administering the project, preparing a presentation for public hearing, etc. . . Local Waterfront Revitalization Program (LWRP) Revision - Ms. Wittner reminded the Commission of their previous discussion in which she noted the need for an update of the LWRP. She noted that Randy Lanza, Department of State (DOS) , had stated that the DOS is looking for page insert revisions rather than a new document. In light of this new information she felt that extensive footnoting would be required and therefore, she approached Mr. c Wallace Irwin to see if he was interested in undertaking the project. Mr. Irwin has agreed to do the revisions for the sum of $1,000.00. The Commission approved the fee and Ms. Wittner will send a memo to Mr. Altieri and Mr. Deluca requesting funds be set aside. -2- 6 CZMC Minutes 11/26/89 Pryer Manor Bridge Repair - The topic was tabled until next meeting. MEMBER REPORTS Hommocks Conservation Area - Ms. Wittner requested that the Taylor Report, which dealt with recommendations for the Hommocks Conservation Area be sent to the members of the Conservation Advisory Commission (CAC) , the Town Supervisor, the Town Council, the Town Administrator, the Superintendent of Highways, Mayor Curnin and Trustees, the Village Engineer, and Carol Hayes for the annual report. Attached to the report Ms. Wittner will include an implementation memo which will request that the specific recommendations of the report be acted upon. Ms. Elinor Fredston noted while walking through the Hommocks playing field, the area contained several manhole covers which she believes drain into the East Creek. She expressed concern over where the water comes from, whether the source of the water is from the parking areas, pools, and such. She she feels it requires further investigation. Update on the Sheldrake - Tabled. Erosion and Sediment Control - Tabled. ENVIRONMENTAL COORDINATOR REPORTS - Items Tabled. NEW OR OTHER BUSINESS Marine Planners Conference - Ms. Wittner informed the Commission that she will be attending the Conference on 11/29/89. Village of Larchmont Subdivision - 41 Beach Avenue (St. John's Church) - Elinor Fredston reported on the discussion which centered around this issue at the last Village Planning Board Meeting. She noted that the Church property is located on Beach Avenue and that the Church has an application for Subdivision Approval. She also noted that the Church did not have immediate plans for the property at this time. Ms. Fredston said that the reason a recommendation was made for a archeological study of the property was because it was believed that the area is likely to have historical value because of early settlements in that particular area. Mr. McMichael noted that after research, he discovered that an archeological study of the area would involve a lot of time and that the cost attached to such as project was high. He also wanted to know what position the CZMC would be taking on this issue. Ms. Tolley noted that Policy # 23 was involved. Ms. Wittner then replied that the Commission was under obligation to support the LWRP's policies and recommendations in a situation as this. It was agreed that the CZMC request that the Planning Commission agree to postpone our consistency review until the applicant returns for Site Plan Review. It was agreed that further investigation into techniques and costs should be obtained. CNext Meeting - The December meeting has been cancelled and the next meeting was scheduled for January 23, 1990.
