MINUTES
MAY 23, 1989.
A regular meeting of the Coastal Zone Management Commission (CZMC) was held
on Tuesday, May 23, 1989 in Conference Room A of the Town Center, 740 West
Boston Post Road, Mamaroneck, New York. The meeting commenced at 8:15 P.M. 1.

The minutes for the meeting of April 25 were returned for corrections.
CHAIRMAN REPORTS
Larchmont Waterfront Area Planning Study - The Chairman reported about
the special CZMC meeting held on May 4, 1989 regarding this subject. Members

Richard Young, Chairman Phyllis Wittner, and Trustee Cheryl Lewy. Two
presentations were made at this meeting: the first by Joanne Meder
(Frederick P. Clarke Associates) and the second by Dan Shuster (Shuster
Associates). Ms. Wittner reported that Ms. Meder's presentation was good,
but that it•was expressed to her that the proposal's cost of $17,091 far
exceeded CZMC's budget. (As a result of this statement, Mr. David Portman, of
Fredrick P. Clarke Associates, subsequently called Ms. Wittner and told her
that they could lower the bid to $15,0.00 and if this new figure was feasible.
they would submit a revised proposal) . The Commission concurred that this
figure seemed inappropriate for the relatively limited size of this study.

O The Chairman reported that Shuster Associates proposed a cost range of
000 to $6,000. The Commission discussed this proposal and expressed that
ithey would like to see more creative ideas included. The Commission voted to
award the contract to Shuster Associates with a cap of $5,000. Ms. Wittner
will talk with Mr. Shuster. convey the Commission's views and obtain a
• contract from him to present to the Village Board.
Also noted by the Chairman was a conversation with James Staudt on
5/5/89. Mr. Staudt expressed the opinion that the Village needs this type of
Land Use Plan which might or might not recommend zoning changes.
Larchmont Reconnaissance Survey Grant Application - At the end of April,
Ms. Wittner learned of a NFS Of ice of Parks, Recreation & Historic
Preservation Grant. Therefore, she attended the Ilav lst. meeting of the
Tillage Board and requested and received permission to apply for a
Reconnaissance Level Survey Grant for the Village of Larchmont. The grant
would be used to hire personnel to do the survey which would form the basis
for a local preservation plan, possible Historic Places Registry and would be
applicable to land use in the waterfront area.
Waterfront Protection - Bay Constable Program - Ms. Wittner informed the
Commission that she formally presented the Bay Constable Program to the
Village Board at their May 1st. meeting. She stated that this item is still
very much under consideration by the Mayor. The Mayor and the Board
expressed the need to see facts and figures on the number of calls, thefts,
etc. . . that have occurred. Bruce Allan stressed the fact that movement on
this issue has been and will continue to be slow since the 3 area clubs are O
not in favor of the program. Robert Schoenberger interjected and stated that.
the CZMC has done a good job on presenting this program and needs help from
others concerned to help instate it..

Coastal Erosion Hazard Law - Village of Larchmont - Ms. Wittner reported
that after consultation with James Staudt he had stated that he sees no
reason for the Village of Larchmont to adopt its own Coastal Erosion Hazard
Law at this time. Ms. Wittner responded with an explanatory memo. She also
stated that she had been in contact with the Department of Environmental
ConSerkation (DEC) . They had said that implementation by the State would
take at least two years and that the County did not intend to implement it.
Large Tree Trunk Disposal. and Leaf Composting - The chairman informed the
Commission that large trees will continue to be cut into logs on site, but
rather than being dumped at Flint Park. will now be loaded onto trucks and
shipped directly to a private contractor in Croton. This contractor is in
the wood chip business and the cost to the Village will. be $1.00 per yard
($150 for their largest truck load) . Ms. Wittner also reported that the
t� remaining large articles in Flint Park are now in the process of being
removed.
Ms. Wittner stated that she had met with Mr. Kellogg, Mr. Rodrigues, Mr.
Fowler, and Mr. Schirmer as planned on 4/27/89. Mr. Rodrigues advised how to
setup the leaf composting area and discussed what the project would entail
(one man in charge). Ms. Wittner expressed that even though there is a lot
of work involved just to get the site ready, there was a spirit of

cooperation evident among those involved.

Premium Area - Ms. Wittner reported that thanks to the Mayor and
Trustees, the absorbent boom which was placed in the Premium River will be a
permanent fixture at least until June 19$6. She also reported on-the site
• visit. of 4/26/89 which included Dominick Ninivaggi, Fred Mushacke, Joan
Hansen, and Hagop Shahabian. The visit lasted 4 hours. They also discovered
an arm of the river which will require a Town Crew to remove tree trunks and
other large debris blocking the flow. Ms. Wittner also noted that the Town
did a good job on the area clean-up.
The results of the Sample testing of the Premium River behind the
Larchmont Diner, which was conducted by Mr. Hohberg at CZMC's request, were
discussed by the Commission. It was concluded by all that since the testing
was done after 4 days of heavy rain, the results would have to be
re-confirmed by a new sampling. Ms. Wittner said that she would speak with
Mr. Hohberg and request another sampling and report of his findings.
• Local Environmental Quality Review (LEQR) - The Chairman reported that
the Town had submitted the Draft Law to the attorney in the beginning of
May. Ms. Wittner read a memo she sent to James Staudt dated 5/17/89
concerning the proposed Village Local Environmental Quality Review (LEQR)
legislation.
SUBCOMMITTEE REPORTS •
Erosion and Sediment Control - Richard Young stated that progress is slow •
in this area. He stated that. Mr. Trachtman had reviewed the draft and found

no reason for change to his original draft. However Mr. Trachtman is in the
process of trying to combine the City of Rye's law with the model ordinance. •
Mr. Young also stated that Mr. Trachtman suggested that the CZMC send the •
final draft to Laura Tessier for review.

ENVIRONMENTAL COORDINATOR REPORTS
Master Plan Update - Claudia Ng reported that the Town Planning Board had
recommended approval, with the following exceptions and additions, of the
Master Plan at their May 10th. meeting: 1) elimi nation_o_f the a2.4_ in mix d
(\Ad e) use business zone 2) recommendation of a mixed use business zone at Madison
an Maxwell Avenues 3) further study on a mixed use business zone for Boston
Post Road. Discussion followed Ms. Ng's statements and Mary Anne Johnson
) expressed the need to address drainage concerns. The Chairman suggested that
the final draft be reviewed by Shirley Tolley.
Sheldrake Watershed Study - Ms. Ng reported the results of the May 22,
1989 meeting she attended with Steven Altieri, Steven Tomecek, Steven
Goldstein, and Phyllis Wittner. She stated that Mr. Altieri will draft
another Request for Proposal. Discussed at this meeting was the topic of
single vs joint municipal study and less expensive ways to obtain a detailed
topographical map.' Ms. Ng also informed the Commission that a licensed
hydrologist should perform the Hydrological Study.

COLD/NEW BUSINESS
Chairman Correspondence - Ms. Wittner discussed the following
correspondence:
1) a letter from the Town of Mamaroneck (dated 5/8/89) re: smoke testing
- sanitary sewers
2) a letter from Fred Kellogg to Mr. Sinopoli (dated 5/17/89) re: the
back flow of water from the manhole located at Willow and Cherry
3-) "Fac s o Life in L hmont" - June Issue.
New Topics - Ms. Wittner posed the following questions to the Commssion:
1) should the Consistency Law be amended because of SEQRA and Type II
actions? Ms. Ng responded that the Town is revising its Code Book and if the
lCZMC would like to make changes they should draft and submit them soon.
2) Malcolm Pirnie guildlines for facilities to remove oil - 4/17/89: p,,
should Site Plan review be amended to contain regulations regarding oil? C- .c� S�, P�. `0
3) Reauthorization of Federal CZMA; also local revisions?
4) Is anyone interested in forming an Educational Policy Committee/Task
V1,4 Force with Conservation Advisory Commission (CAC). L.I.F.E Center, Sound
Watch and Long Island Sound (LISS)?
5) Ms. Wittner discussed briefly and handed out a synopsis of the
Conference she attended on Coastal & Ocean Resources (May 1--12).
CZMC Priorities - 1989-90 - Several ideas for priorities were suggested
by the members present. They included:

2) a study of the Hommocks - much like the
Premium Study
3) CZMC's perspectives on David's Island
Ms. Wittner distributed several booklets and pamphlets which she received
from the Conference of May 10-12. These articles were from other States and
agencies which provide suggestions for programs that CZMC or CAC could
utilize. Ms. Wittner also noted that the Federal CZM Act is due for
reauthorization in 1990. The State's CZM Programs are up for review, and our
local program will be due for revision too.
