The meeting will be at Mrs. Fredston' s house, 3 Cedar Island, at 8 p.m. The full CZMC will hold its regular July meeting on Tuesday, July 10 at 8 p.m. in the Village Center. Kean, Liaison Trustee, Village of Larchmont Daniel Shuster, Consultant 1. The meeting was called to order at 8: 15 p.m. The agenda (attached) was adopted. 2. The minutes of the meeting of May 1 were approved without change. J 3. The planning process. The Committee had before it two earlier / papers and one new paper, all by Mr. Shuster, as follows: (1) the"matrix" paper of May 1: this paper, and the responses of six membels.-71 to it, had been discussed at the May 15 CC meeting (see Irwin memo of May 22) . (2) The "Policy Development Framework" paper of May 14, distributed at the May 15 CC meeting. Subcommittee chairmen were to propose policy initiatives, based on the State list of 44 policies, within their respective fields. The chair reported few and incomplete responses thus far. (3) An 8-page paper dated June 4, entitled "Outline--Sections III , IV, and V, Local Waterfront Revitalization Program. " (Note: Citations below refer to sections of the outline in this third papers copies of which are available in the Larchmont Village Clerk' s office.) - 2 - In discussion of the above, these points were made: Boundary: Several members spoke in favor of a coastal zone boundary coextensive with the political boundaries of the Unincor- porated Area and the Village of Larchmont. Mrs. Tolley and Dr. Mason stressed the Town' s interest in flood control and related problems in the northern part of the Town. Mrs. Tolley noted that the narrower alternative "B" outlined by Mr. Shuster at the May 1 meeting would include one golf course (Bonnie Briar) but exclude another (Winged Foot) . Mrs. Price reported that a court had recently ruled that "consistency" rule, under which outside agencies may not act contrary to an approved LWRP, does not apply to actions beyond the boundaries of the affected municipality. As a result of this discussion, a motion was made by Dr. Mason, seconded and unanimously adopted, as follows: That the Committee intends to propose a Coastal Zone Boundary coextensive with the political boundaries of the Village of Larchmont and the Town of Mamaroneck, plus that portion of the Larchmont Reservoir property located in New Rochelle; and that planning will proceed on that basis. Zoning: (Part V, item A-2-a-l-a) Mr. Shuster explained his suggestion of amending the zoning regulation to permit mandatory cluster provisions in areas zoned R-30, noting that this would ease traffic and flooding problems. He pointed out that a newly enacted State law empowers municipalitiQs to require a cluster pattern instead of leaving the option to the builder. The suggestion for a waterfront zoning district (V-A-2-a-l-b) could serve the convenience of clubs while helping to guard against subdivision under the present R-30 zoning. It would be possible, Mr. Shuster said, to create such a zoning category without specifying the district' s location on the map, leaving it to clubs to request such zoning if they wish. Several members commented that the problem of aggravated runoff and other adverse effects through subdivision of large properties, permissible in many parts of the Town and Village under existing zoning ordinances, must be dealt with in the plan. Dr. Mason pointed out that a planning group of which he is a member is considering this problem as part of its current assignment to draft revisions of the 1966 Master Plan for the Town and Village. SEQR designation (V-A-2-a-2) : Designation of the listed areas under the State Environmental Quality Review Act would make it virtuaaertain, Mr. Shuster said, that an environmental impact statement (EIS) would be required for any project likely to affect them. Erosion and sediment control ordinance (V-A-2-b-1) : Several members commented that the main difficulty is not in passing such ordinances but in enforcthem. Mrs. Price commented that numerous Federal and State laws controlling development in sensitive ateas are being ignored. Mr. Buchman noted that in th , New Rochelle has permitte z operations a s ould clearly have been forbidden. Mrs. Johnson observed that County "best management prac- tices" can be enforced on large construction projects , but to do so on small ones is difficult. Elimination of illegal storm drain connections (V-A-2-b-2) : Dr. Wilson presented a 2-page paper dated May 26 entitled "Illegal Sewer - 3 - Wiat,K�-S ,ate¢ip-J .� Cv,G-14'ti Connections" (attached to Minutes) , urging that local initiative be taken by the Town and Village to eliminate such connections on pro- perties of the municipal governments as well as of private owners, and stating his intention to raise the issue with the Town Council. Mr. Shuster noted that one technique that has worked elsewhere is to tguire elimination of such connections as a condition of granting any building permit. As a result 0 is discussion the Committee adopted the following motion: The Committee favors a Larchmont-Town of Mamaroneck program to eliminate illegal storm drain connections, and authorizes Dr. Wilson so to inform the Town Council. Lack of time prevented detailed discussion of the remainder of the Shuster paper of June 4. It was noted that items V-B, "Other Non-Physical Public Actions," contains ideas of major significance, and that this as well as the two following headings (xtmanagement structure" and "financial resources" will require careful study and discussion. 4. Liaison with other communities and agencies. (a) New Rochelle: The Committee was briefed on a working-level meeting held May 24 in New Rochelle with Laurie Saccardi, a planner in the city department of development planning, and New Rochelle's LWRP consultant, Robert Geneslaw of Raymond, Parish, Pine & Weiner. Participants for the CZMC were Mr. Irwin, Dr. Mason, Mr. Altieri, Mrs. Wittner and Mr. Shuster. The meeting had been requested in order to acquaint New Rochelle authorities with our own LWRP process and to invite their cooperation on matters of common concern in the Pine Brook-Premium and Sheldrake watersheds. They had received a copy of our Inventory paper. Mr. Geneslaw stressed the importance of intermunicipal cooperation, including the trimunicipal structure proposed in New Rochelle' s 1980 coastal—Z.-One repo171. In dahii Livh to our concerns in the Premium area (including the Fifth Avenue oil spill incident) , he was informed of our concern over the Cherry Lawn development project on Quaker Ridge Road, already the subject of exchanges between Dr. Mason as CAC chairman and New Rochelle officials. It was agreed that afurther meeting with the same New Rochelle offi- cials will be held on June 26 at 10 a.m. in the Town of Mamaroneck , - ffice. (b) Rye drainage basin meeting. Mr. Irwin reported a discussion with Laura Tessier of the Soil and Water Board about the reported May 18 meeting in Rye among communities interested in flood control along Beaver Swamp Brook. Mrs. Tessier said no effort had been made to broaden the scope of the group to include other watersheds; but she wrote promising to keep the Committee informed of possibilities for SWB study of the Pine Brook-Premium watershed. She also enclosed a paper (copies sent AM, LL, MAJ, EF, DS) on legal and administrative procedures for creating an intermunicipal drainage district. (c) Scarsdale-"Hutch" project. Mrs. Johnson reported on her effort to get the Town of Mamaroneck on record favoring safeguards to assure that the planned reconstruction of the Hutchinson River Parkway interchange near the East Branch of the Sheldrake in Scarsdale will not have adverse effects downstream in the Town. - 4 - 5. Public information. Mr. Irwin reported that an item on the work of the CZTY?C will appear in the June issue of the Larchmont newsletter "Facts of Life. " The long delayed questionnaire for local residents will appear as a paid advertisement in the Thursday, June 7 issue of The Daily Times. Copies will also be sent to heads of local organizations to encourage their members to respond. 6. Expenditures. Mr. Shuster' s invoice for the month of May (copy attached) was approved for payment in the amount of $2,185. The cost of the questionnaire advertisement ( see above) was $390. No other significant expenses were incurred during the month. 7. Next meetings. For times and places of the next meetings of the CZMC and CC , see the note at the head of the Minutes. In addition, it was agreed that the evening of July 24 would be reserved for a meeting of the CC if a meeting of that body during July proves necessary. 8. Adjournment ILLEGAL SEWER CONNECTIONS The CZMC has amassed a considerable body of knowledge concern- ing sewage problems in the Town of Mamaroneck and the Village of Larchmont. I believe that the time has come to employ this information to stimulate and encourage the municipalities to take corrective measures. Some problems are complex, arise in areas beyond their jurisdictions and require the cooperation of other municipalities, County and State agencies if they are ever to be solved. Nevertheless, strong efforts should be made to start the process. We should begin with a problem that is important, clearly de- fined and that can be dealt with on a local level. Such a problem is the matter of illegal sewer connections, which are responsible for basement and street flooding during heavy rains. The flood water, contaminated by raw sewage, ends up in the waters of Long Island Sound. The sewer backups damage property, distress our residents and constitute a serious health hazard. Above all, these connections are illegal. They interfere with the separation of the sanitary and storm drainage systems. Failure to enforce the law cannot be excused. Moreover, this problem can be solved at little cost. The violators are the municipalities and some owners of homes, apartment houses and business buildings. They have been ident- ified by Westchester County's recently completed Sewer System Evaluation Study (SSES) . While the findings have not yet been made public, the Engineers of the various municipalities have received the part of the report affecting their area. For ex- ample, the Village Engineer of Larchmont on December 12, 1983 reported to his Board that 95% of the illegal sources in the village was due to inflow from sump pumps, driveway dratas, roof leader connections and some public drain connections as catch basins. The remaining 5% was due to infiltration from pipe joint leakage. The cost of repairing illegal connections in the Village was .estimated to be S215,300. of which ;124,700 is for public facilities and $90,600 for private connections. Private re- pairs would be at the owners' expense but the municipality's cost would be reimbursed 75% by federal and state monies (82,5% if it can get on the State ' s priority list before October 1, 1984) . The alternative to rehabilitating existing facilities is to in- crease the capacity of sewer mains, pumping stations and the New Rochelle sewage treatment plant, which would be far more expensive and would not separate sanitary wastes from rain water. -2- I am planning to ask the Town Board, at its next meeting, to make public the results of the "smoke tests" that were perform- in the Town by the SSES and to proceed with corrective measures. With 100% compliance in correcting illegal sewer connections, some sucharging of the sanitary sewers may occur due to upstream inflow - exactly how much is not known. Nevertheless, a very significant improvement can be expected by eliminating illegal connections in the Town and Village. By taking the initiative now, we would be setting a good example for other communities (which have similar problems) to follow.
