HomeMy WebLinkAbout1988_06_28 Coastal Zone Management Commission Minutes• Town of Mamaroneck Village of Larchmont -� COASTAL ZONE- MANAGEMENT COMMISSION MINUTES A regular meeting of the Coastal Zone Management Commission (CZMC) was held on Tuesday, June 28, 1988 in the Court Room of the Town Center, 740 West Boston Post Road, Mamaroneck, NY. The meeting commenced at 8:05 P.M. Members Present: Robert S. Anthony Piliero, Automotive Service Enterprises Claudia Ng, Environmental Coordinator Barbara Cleary, Recording Secretary 21 Fenbrook Drive - Mr. & Mrs. Mitchell Cantor Mr. and Mrs. Cantor are requesting permission to build a bridge across the stream that bisects their property. They would also like to riprap the stream. As of this time, they do not have complete or definite plans for the Commission to review. Shirley Tolley, Mary Anne Johnson and Claudia Ng inspected the property. Mrs. Tolley explained that the Cantors first saw the property last September when the stream was full, now it is sluggish. The Cantors would like suggestions from the CZMC as to methods for improving their property and as to the types of plantings that should be used in this area. Mr. Cantor stated that he has asked the Planning Board if he could install a bridge over the brook, clean up the area and riprap. Address Correspondence to CZM Commission, 740 West Boston Post Road, Mamaroneck, NY 10543 (Phone 914-381-6133) CZMC minutes 6/28/88 Robert Schoenberger stated that riprapping might cause certain other sections of the brook to flood other areas. He further stated an engineer would have to inspect the site and render an opinion. Mary Anne Johnson said she believed the Soil and Water Board and the engineer had objected to the riprapping. Mr. Schoenberger proposed that the Commission write a letter to the Planning Board stating that it had an exploratory discussion with the Cantors, but since there were no specific plans to review at this time, the Commission could not yet render an opinion. Mr. Schoenberger noted that the letter should also request referral of the plans when they are available. Mrs. Tolley will assist with the letter. 209 Hommocks Road - Mr. Gene Pressman An application has been made by Mr. Gene Pressman to renovate his dock. The existing dock was severely damaged in a storm a few years ago. Mr. Jeff Hutchinson, architect, distributed photos and explained the proposed renovation. Mr. Hutchinson stated that the last 25 feet of the dock was severely damaged, one pier was torn down and the second needs to be replaced. The proposed renovation plans to use the existing gang plank and float. There will be no enlargement and no structural change, final dimensions of the dock will be the same as the previous dock. The proposed plans show lights on the dock as well as in the gazebo. Elinor Fredston stated that high voltage lighting has become a problem in the harbor. Howard McMichael agreed and asked if the lights could be shaded. Mrs. Tolley expressed concern about the handling of concrete and debris used during construction which might wash into the Sound. Mr. Hutchinson stated that the lighting could be shaded to be less offensive and that all concrete and construction debris will be disposed of properly using best management practices. Mr. McMichael made a proposal to go along with the proposed plans providing the lighting is restricted to the gazebo, where it will be shaded so that light does not glare out into the harbor. The dock may have electricity but no lighting. Ms. Tolley added that all construction debris be disposed of properly according to best management practices and not permitted to be washed into the Sound. Mr. Schoenberger said the renovation was consistent with the policies of the Local Waterfront Revitalization Project (LWRP) and all approved. Mr. Schoenberger will draft a letter to the Building Inspector reporting the Commission's findings. 37 Country Road - Mr. John Ward Mr. John Ward is requesting a building permit for a two level addition to his residence. Mr. Manusoff, his architect, explained the proposed plans. He stated the 1500 square foot addition would be on two levels and take up 750 square feet of ground space. Mr. Ward's property is adjacent to the Leatherstocking Trail. Ms. Ng inspected the site and said the addition would be built on the side of the house which is opposite the Trail. Ms. Ng observed that there might be a problem with drainage and water running off into the cul-de-sac, but there is some land at the bottom of the slope and there appears to be no other impacts. The Commission found no inconsistency with the proposed construction. -2- CZMC minutes 6/28/88 10 Old Colony Drive - Mr. Frank Longhitano Mr. Frank Longhitano is requesting a building permit for the construction of a single family residence at 10 Old Colony Drive. This application was submitted to the CZMC for review because it is in the flood zone and, also, it is waterfront property. Mr. Longhitano said that his 10,500 square foot lot was pre-approved as a building lot in a 1979 ruling, even though the areas has since been upgraded to a 15,000 square foot zone. The Commission reviewed the proposed plans. Mr. Schoenberger noticed that a 15-inch maple would have to be removed during the course of construction. Mr. Longhitano's partner said they plan to replace it with birches or pines. The plans also revealed that the sea wall would be raised to make it level with the other seawalls and that a dock would be put in. Mr. Schoenberger made a motion to find the application consistent with the LWRP, with the following recommendations: the large holes near the seawall be filled in with gravel, the maple tree be replaced with other trees if it can not be spared during construction, final ground contours should provide swales to avoid runoff on the two adjacent properties and that best management practices should be used. Mr. Schoenberger will write the letter to Larchmont Planning Commission to report the Commission's comments. Automotive Service Enterprises, Inc. Mr. Piliero is requesting a special permit for the alteration of a portion of his existing building to be used for an Auto Body Repair Shop. It is currently a repair garage. Mrs. Tolley and Ms. Ng inspected the site. Ms. Tolley is concerned that waste products could wash into the Pine Brook Drainage System. She also stated that the owners had agreed to seal off storm drains and cart away waste by-products. Mr. McMichael said that did not seem practical and he was also concerned with the runoff of solvents and paints washing into the drainage system. Mr. McMichael suggested a program to test all drains in the building to assure drippings do not go into storm drains. He also said he would like to see all commercial establishments in this area be checked for leaks. Ms. Ng remarked that the Town engineer should inspect the site and check all storm drains and perhaps come up with alternative methods to aid in the disposal of these by-products. Mr. McMichael made a motion that all drains in the building be checked to make sure they are not going into the storm drains or Pine Brook waterways. Mr. Schoenberger will notify the Planning Board as to the Commission's recommendations. 23 Dillon Road - Mr. & Mrs. Robert DiBiccari Mr. & Mrs. Robert DiBiccari are requesting a zoning variance for a new front addition at their residence 23 Dillon Road. The Building Inspector said the proposed addition is within 100 feet of the Premium Marsh. Therefore it was referred to the CZMC for review by the Zoning Board of Appeals. Mr. DiBiccari explained that his enclosed porch collapsed when he was replacing windows and that the new proposed porch would be 11 feet wide instead of the previous porch width of 7 feet. Phyllis Wittner inspected the site and found that there was already a foundation which was the full size of the proposed extension. She did not -3- find any problem with the drainage, because any run off would drain into • another property owned by DiBiccari and not into the marshland. Mrs. Wittner was concerned however with the storage of an abandonned car and other metal refuse behind the garage which is adjacent to the Marshland. It was felt, that this application was not inconsistent with the LWRP and Mrs. Wittner will write the Zoning Board of Appeal noting same and with a request that offending car be removed providing the offending cars be removed. • Rezoning request for Rock Ridge Road from R-30 to R-7.5 The Commission reviewed a verbal proposal by Elaine Price to rezone the Rock • Ridge Road subdivision to R-7.5 from its present R-30 designation. The request for rezoning was made by residents of this subdivision who might • experience hardships because the rezoning has made all the lots nonconforming. Ms. Price explained some of the considerations of this• request. l.6" e Mr. Schoenberger noted that the CZMC would need more information on this • subject before making a recommendation. Therefore, he will request written information on the implications of the rezoning from the former LWRP . R Consultant, Dan Shuster, from the Town and Planning Board attorneys, and wi . ' C,ll advise the Town Council of this as our reason for deferring a reply. The Commission is sensitive to the hardships the residents of the Rock Ridge` :3. p� subdivision are experiencing but they are also concerned that frequent44 changes in rezoning could negate the beneficial effects that were intended b p�j✓° • the zoning changes. �,��_p This subject will be deferred until the next meeting. Upzoning in Village of Larchmont Mr. Schoenberger and Larry Lowy will schedule a session with the Village of Larchmont Board to discuss a CZMC request for R-40 zoning alont the waterfront. Mr. Schoenberger will inform the Commission about the outcome of this meeting. Master Plan • Mr. Schoenberger said the Commission would review Phase I of the Plan in July and Phase II in August. He requests that all members of the Commission read • the Plan so that it can be discussed at the next meetings. Elaine Price said the Master Plan will be reviewed before the Planning • Board and then open to Public Hearings. Mr. Schoenberger requested that Elaine Price keep the Commission informed • and updated on this subject. Long Island Sound - An Owner's Manual • Mr. Robert Komitor requested that CZMC read and review this manual and make �.� r recommendations for revising it. Ms. Ng explained that the CAC thought a ki-• i�"' revised version including protecr;o_n__of srreamsides should be undertaken by ,,,p.0qr,4� the CZMC, and sent to residents of the Town of Mamaroneck since they did not receive this mailing. Mr. Schoenberger felt this was not a productive use of the Commission's &J � time, but he also said he would be happy to speak with Robert Komitor and • discuss the possibility of employing someone to do it. • , New Business Bruce Allen informed the Commission that a showcase has been installed by the Larchmont Historical Society outside the Courtroom. He would like contributions from anyone having pertinent information, such as the History of the Sound, information relating to the Marshlands or Leatherstocking Trail. Mr. Allen also informed the Commission that Room 304 on the Third Floor of the Town Center now holds their archives. Public Awareness of Conservation Areas - Howard McMichael stated he believes that there is a lack of information and publicity concerning the Conservation Trails and he suggested the Commission get the information out to the Residents t_o mAe them aware of them. Ms. Ng informed the Commission that the Conservatfftrhas walkbooks which are available to the public. She also said the CAC was thinking of doing a small map for the residents. Coastal Erosion Haz,,ard Areas - Ms. Tolley expressed her interest in pushing for the filings Coastal Erosion Hazard Area Maps. She explained that once the map is filed by the State, local government can pass protection laws. Commission agreed it was a good idea and Mrs. Tolley will draft letter. Gardens Lake Dredging - Elaine Price explained that more testing is required before the dredging can get started. Right now the Town is trying to remove the "industrial waste" classification of the spoils and get the project going. She informed the Commission that tests found a hot spot near the New England Thruway and that was a cause for the delay. Nick Robinson, who was hired by the Town is optimistic with the new findings and believes the project could be started in two or three weeks. Sewer Repairs - Larchmont Gardens - Residents of the affected are are frustrated with the long construction. The streets are all ripped up and the contractors are often inconsiderate and starting work before 7:30 AM. This project needs help from such as a rotational enforcement Mechanism. The Town is holding the Contractor to its specifications, however, more enforcement is needed. Mr. Schoenberger noted that Commission Members could and should check up on it but advised that best watchdogs would be area residents.
