HomeMy WebLinkAbout1987_06_23 Coastal Zone Management Commission Minutes WV-4 �_ r Town of Mamaroneck Village I�k of Larchmont 11 L\I' COASTAL ZONE MANAGEMENT COMMISSION MINUTES A regular meeting of the Coastal Zone Management Commission (CZMC) was held on Tuesday, June 23, 1987, at the Town Center, 740 Boston Post Road, Mamaroneck, N.Y. The meeting commenced at 8 : 05 P.M. Members present: Lawrence Lowy, Acting Chairman Wallace Irwin, Jr. Mary Anne Johnson C. Alan Mason Howard McMichael, Jr. Phyllis Wittner Others present: Charles Bernstein, CAC Robert Hohberg, Water Monitoring Consultant for CAC Geoffrey Young, liaison, Larchmont trustee Claudia Ng, Environmental Assistant Maria Mora, Recording Secretary Monitoring of East Creek Mr. Hohberg presented his past study of East Creek. He stated that the 1984 study has the most densified data; that there is base data in this 1984 study; and that the graph gives you concentration on particular parts of East Creek. He feels that the plans for both of the developments are well done. Also, that there is some oil flowing into manholes that should be tracked. Mr. Irwin suggested that there should be some outside independent monitoring. Mrs. Wittner asked Mr.Hohberg what kind of water monitoring program is being done now in the Town and Village routinely. Mr. Hohberg's reply was that he takes two or three of his classes from the school on a routine basis and shows them around but only what is safe. He stated that he has two courses at the station. The other one is during the summer. Mr. Lowy questioned Mr. Hohberg as to who pays for his services and who designates the courses. Mr. Hohberg replied that the i age and State pay for it and that he designates the courses. It was suggested that the findings of his services be combined with the Town and CAC as part of the contract. It was reported that East Creek has a tremendous amount of sewage inflow, and it was suggested that it be looked into. Also, that the Town is in process of trying to correct illegal sewers into storm-drain hookups. Mr. Hohberg is planning to do each area in order to finish compiling base data. However, he is open to changing and redoing East Creek if it is requested. Address Correspondence to CZM Commission, 740 West Boston Post Road, Mamaroneck, NY 10543 (Phone 914-381-6133) CZMC minutes - 6/23/87 Premium Feasibility Study Update - Mrs. Wittner reported that on May 27th the contract was prepared with revisions but it was not finalized. The Village of Larchmont passed the contract on June 1st, then the Town of Mamaroneck passed it on June 3rd, and the contract was essentially signed on June 4th. Mrs. Wittner and Mrs. Johnson met with Syrette Dym of New Rochelle D.O.D. , and left in her possession, after reviewing everything with her, documentations on the proposal of Malcolm Pirnie along with a memorandum confirming conference discussions. Mrs. Wittner informed CZMC that the L.W.R.P. of New Rochelle has been tabled until they form a citizens committee which is required. Mrs. Wittner and Mrs. Johnson met on June 12 with the Project Leader of Malcolm Pirnie, Jack Taylor. Mr. Taylor has a very good feel for this project and went over it with Mrs. Johnson. He prepared a draft statement which we can use to inform people of what is going to be going on in the area. They will begin the project in July and work on it for a whole year. It was agreed that the next thing that should be done, in rcgai-d-s- ZeAthis project, is to distribute notices to people in the surrounding area and enclose a Critical Environmental Area (CEA) sheet. Mrs. Wittner suggested that CAC receive it as individuals. She also has reed' the bird list on those in the area. Mrs. Johnson stated that this is just temporary, but Mr. Lowy feels that that is all that they will do. Many members of the CZMC feel that a summons should be issued to the owner of Tony's Nursary. They discussed options of influencing clean up and prevention. Mr. Irwin and Mrs. Johnson were designated to draft a letter noting the concern of the Premium a- -is- to be sent to the Village Board and the owner of Tony' s Nursgry. The letter will also state the protections that are afforded to the Premium as a CEA. The letter will include written documentation of corrective action to be taken. CEA Information Sheet Mrs. Wittner feels that this information sheet will help the people living in the CEA a lot. She suggested that it be sent out to people living in the CEA and some parts of New Rochelle. CZMC approved Mrs. Wittner's draft of CEA Information Sheet on the Premium. CAC Chairman has given his support already on it. Mrs. Johnson mentioned that she is thinking about doing a paper similar to the one for the Premium but for the Sheldrake-Leatherstocking CEA. She stated that she might get Mrs. Volk involved to do some work on it, even if it is long distance 7 Mr. Lowy agreed and suggested that they start on it right away. -2- CZMC minutes - 6/23/87 Dredging of Gardens Lake Ms. Ng reported on the status of the Dredging study. She stated that at last night's Town Board meeting Mr. TracmanV( presented his final report on the alternatives for the ,Cardenslake and his recommendati n on it. She reported that the dragline dredging without de.waterin :lake would be 6,000 c.y. Also, that the dredging cost was estimated to be $22,000 . She reported that the Town Board accepted the report and authorized Mr. Trac mane' to work with Mr. A1tFeri. Ms. Ng stated that it would probably be more expensive to maintain the pond than toy install some catch basin upstream. Mrs. Johnson also 7 stated thatgn very expensive to transport. CZMC would like to comment on it when the alternatives have beer drafted. Mr. McMichael suggested the possibility of dumping it out mn the Sound at a certified dumping site. He said that it might be cheaper than filling up the holes. Mr. Katz feels that it would take up too much time to do this. Mr. Irwin noted that in Section 4B, of Project 9 in the LW RP it mentions dumping in the Sound.P 9 Fenbrook Subdivision/Cohenca Application - update Ms. Ng reported that Cohenca had their public hearing sometime last month. The Planning Board decided to reject CZMC's finding of Q inconsistency and approved the granting of FWWC permit. Mr. Irwin commented that this is the first time that a consistency opinion of a commission has been rejected. He suggested that there be code restrictions and Mr. Mason replied that there are code restrictions in the deed. Mr. Mason opinionated that we preserve our condition by making it a requirement that they restore the 20 feet rather than permitting them to build within the 20 feet of the existing stream. He feels that the lots upstream will cause a greater impact. Mr. Mason also stated that he thinks that Cohenca might have to return for site an review. It was stated that the Cohenca property was built before the permit law was passed and that is why they never got a permit for it. Ms. Ng explained that building permits have been issued without having to go to the Planning Board. The Planning Board director, Mr. yri ba„k has stated that he is not going to continue issuing permits until he knows what to do. Ms. Ng feels that a policy of(establishment) should be issued for handling any subsequent development in this subdivision. Ms . Ng read a letter from the building inspector addressed to Mr. Schoenberger. Referrals for construction of open decks were discussed. Ms. Ng reported that the Planning Board plans to make a policy statement at their next meeting. She also reported that she spoke to Mr. Peterson of Soil & Water. Ms. Ng and Mrs. Johnson are to draft a letter expressing CZMC' s comment on this issue. LCA c) Annual Report j504 Mr. Irwin r_a_ d the annual report and asked that Ms. Ng circulate it along with the minutes to CZMC (copy on file) . Mr. Irwin feels that the time schedule for it should be from September to September, being finished by December. -3- CZMC minutes - 6/23/87 Other Business 1. Minutes - the minutes were approved after corrections. 2. Harbor Security - Mr.Irwin reported for Mr. Allen that the Yacht Clubs gave a negative reaction to the Bay Constable program. Mr. McMichael reported that he spoke to some of the members of the Yacht Club. He explained that the harbors are much more congested and more problems exist despite the security in the Yacht Clubs. The proposed program will be more for daytime patrol. 3. Flood Damage Prevention Revisions - Mr. Lowy and Mr. Irwin reviewed the flood damage prevention revisions. Ms. Ng reported that the Village of Larchmont has already made their revisions. Mr. Lowy stated that more has been left in the hands of the municipal engineer. 4. Kerr Killelea - It was discussed whether it is appropriate to put in shru s that might block the view of shore of a neighbor. 5. Next Meeting - The next meetings are as follows: July 28 , August 25, September 22. 6.
