HomeMy WebLinkAbout1989_07_25 Coastal Zone Management Commission Minutes 4 Town of Mamaroneck — Village of Larchmont COASTAL ZONE MANAGEMENT COMMISSION TOWN CENTER: 740 West Boston Post Road, Mamaroneck, NY 10543 914-381-6133 MINUTES JULY 25, 1989 A regular meeting of the Coastal Zone Management Commission (CZMC) was held on Tuesday, July 25, 1989, in Conference Room A of the Town Center, 740 West Boston Post Road, Mamaroneck, New York. The meeting commenced at 8:05 P.M. Members Present: Phyllis Wittner, Chairman Bruce Allen Mary Anne Johnson Howard McMichael Shirley Tolley Richard Young Others Present: Benson Bieley, Sound View News Walter A. Chudson, Larchmont Resident Martha Gershr,-Larchmont Resident Claudia Ng, Environmental Coordinator Rene' Rathschmidt., recorder ADMINISTRATIVE MATTERS Approval of Minutes - The minutes of June 27, 1989 were approved pending minor corrections. Resignation - Phyllis Wittner reported that Lucian Leone has resigned from the CZMC. Ms. Wittner asked for recommendations for fulfilling the position from the members present emphasizing that a time commitment is necessary from all appointees. REFERRALS 385 Weaver Street - Ms. Wittner stated that this referral is a subdivision and since it is a subdivision it is considered a Unlisted Action. Ms. Ng showed a map locating the site to the Commssion and also informed them that the plans had gone to the Planning Board for approval. She said that the site had a R10 zoning and, therefore does not requirea variance. After studying the map and looking at the material submitted the Commission concluded that since there were actual development plans to be C seen, they could only make general comments. They recommended saving as many mature trees as possible and that drainage provisions be addressed since the slope of the property is steep and the property adjacent to it floods. They concluded that the referral neither advances nor is inconsistent with the Local Waterfront Revitalization Program (LWRP) . CZMC MINUTES-7/25/89 Kel Tech 20 North Avenue - Ms. Wittner reported that this referral is a partial 2nd floor addition with roof alterations. She stated that there will be a public hearing on this. August 14, 1989. Mary Anne Johnson noted that the drainage for the property goes into existing catch basins and dry wells which then goes into the Pinebrook drain which in turn drains into the Premium Marsh. She recommended that the dry wells be monitored. Howard McMichael commented that opposingr)dry wells may not be the answer since the drama o pro a y comes from the roof. Phyllis Wittner questioned as to where the trucks are stored now? Mr. Benson Bieley responded that the trucks are stored in different locations on the property. Some are within the building while others are stored outside on the unpaved and paved areas. He also noted that the Village proposed a stipulation that the building could not ever be converted into a two story retail establishment but, must remain as a storage facility. The Commission concluded that the company should be required to use best management practices to contain hydraulic (oil) leakage and that drainage from the servicing area not be allowed to go into the dry well. 1919 Palmer Avenue - Ms. Wittner noted that this also will go before the public on August 14, 1989. During the discussion that followed Shirley Tolley commented that the site has few provisions for parking (8 spaces) and expressed concern over the gas tanks that are located at the gas station. Mary Anne Johnson interjected and said that the gas tanks had been removed and also noted that the drainage of the property goes directly into the street. The Commission agreed to pass on this issue. Howard McMichael noted that the lot behind St. Johns Church would soon have an application submitted for it. CHAIRMAN REPORTS Local Environmental Quality Review (MEQR & LEQR) - Ms. Wittner reported that the Town Council opened a public hearing on July 12, 1989 to repeal the present law. Ms. Wittner said that since there were substantive changes they will renotice the proposed local law. The hearing is adjourned to August 16, 1989. Ms. Wittner requested that Shirley Tolley review the law by the 16th. Ms. Wittner also noted that a similar law will soon he proposed to the Village. Local Consistency Law - Ms. Wittner discussed with Shirley Tolley the prospects of revising the local consistency law. Shirley Tolley agreed to research Department of State Laws to see what rules they have with respect to CZMC referrals ane4,evielit further and report her finding to the Commssion. A Smoke Testing - Ms. Wittner stated that the Town Council has authorized a request for Westchester County to perform sewer smoke testing. Also noted was that the Sewer Use Ordinance has passed. During this Town Council meeting several questions were raised as to where household could dispose of turpentine, oil, etc. . . Ms. Wittner suggested researching this topic and publicizing the findings in the Town/Village Newsletter and other publications. All concurred and Bruce Allen agreed to begin the research. -2- • CZMC Minutes-7/25/89 Scarsdale Manor Subdivision - Ms. Wittner read a copy of a letter which was sent to Mr. P.C. Van de Water, of the Village of Scarsdale, from Steven Altieri re: Scarsdale Manor Subdivision. The letter included attachments of comments, made in letter form, by the CZMC and the Town's Consulting Engineer, Gary Tracliian Mr. Altieri's correspondence asked for a reply to the CZMC's and Mr. Trac man's comments indicating how their concerns would be addressed. ^ Bay Constable Program - Ms. Wittner received authorization from the Mayor and Trustees of the Village of Larchmont to provide an outline for the Bay Constable Program. This program would involve developing an agreement with the Village of Mamaroneck Bay Constable to extend their services to the Village of Larchmont to received State approval. Ms. Wittner stated that she will meet with the police chiefs and the Town Attorney once the proposal for the program has been composed and State approval has been received. Ms. Wittner said she was also asked to present it to the Village Board for approval. )' 1) Woodchipperl- Ms. Wittner reported that the woodchipper has arrived and the remaining wood has begun to be chipped. She noted that any trimmed or fallen trees and branches will be chipped at a bin on site, therefore eliminating the need for wood dropoffs at Flint Park. Ms. Wittner also noted that the chips will be stored at the end of the mini parking lot located at the end of Birch Lane. She also noted that one of the remaining goals is to rent a leaf composting machine in order to mix the wood chips and leaf compost together to result in a higher grade of compost. Larchmont Waterfront Study - Ms. Wittner read a copy of the contract received from Schuster Associates re: Larchmont Waterfront Study. After a short discussion on the part of the members Ms. Wittner suggested including a clause, very similar to the one found in the Macolm Pirnie proposal, which allowed leaiway for cancellation if the Commission deemed necessary. Shirley Tolley also suggested public hearings on the topic. Ms. Wittner responded that she thought public hearings on this issue before results of the study were available would be premature and suggested postponing them until the recommendations were made ready. Richard Young noted that the clause involving monthly billing be expanded to read itemized monthly billing and suggested imposing a time frame for the study to follow. All concurred with the above mentioned comments and Ms. Wittner will revise and summit the contract to Shuster Associates for their approval. Grant Status - Ms. Wittner stated that she was hopeful that the status of the Premium Grant would be available by he end of August. She also noted that an extension was not applied for rthe Coastal Erosion Hazard Area Law. She said that local legislation can be submitted for separate review in the future if necessary. SUBCOMMITTE REPORTS Erosion and Sediment Control Law - Richard Young requested additional help on this project stating that the topic is very extensive. He said he 1.16 ., felt that more expertise was needed to review and give input on all the documents involved in order to have complete and accurate results. -3- CZMC MINUTES - 7/25/89 • Ms. Wittner sug gested giving the documents to Gary Tract an and William Jakubowski. Mr. Young agreed and stated that once Ms. Ng had a chance to review the recent editing comments he would submit the documents to them and report their comments to the Commission. Litter - Ms. Wittner reported that the issue is at a standstill since Mr. Leone's resignation. Other - Mr. McMichael mentioned that Underwater Land Grants were being utilized by the Village of Mamaroneck CZMC. Ms. Wittner stated that the Commission would be interested in their findings. ENVIRONMENTAL COORDINATOR REPORTS Sheldrake Watershed Study - Ms. Wittner suggested changes to the draft proposal. Shirley Tolley questioned the intent of the proposal. Ms. Ng responded that a computer model is needed in order to better show flooding impacts. Ms. Ng said that once that is done more appropriate regulations for controlling flooding would be feasible. NEW OR OTHER BUSINESS Water Quality - Ms. Wittner reported that she has requested that C. Alan Mason form a subcommittee to start a program similar to River Watch. She also asked for volunteers for the project. Mary Anne Johnson noted that the /„'"" Conservation Advisory Commission (CAC) is working on a similar project and she thought contacting them would be appropriate. County Critical Environmental Area (CEA) Meeting - Ms. Wittner stated that a Public Hearing is slated for August 8, 1989. The Major Issue: designation of Long Island Sound and 500 feet f .m its shore line as a CEA. National Celebration of the Outdoors - Ms. Wittner also noted that J> 4/22-4/29/90 has been designated as the National Celebration of the Outdoors .4-- Week and suggests that CZMC, CAC, & L.I.F.E. Center members become involved. Projects - Ms. Wittner requested that all members give thought on what projects they would like to work on and report their ideas to the Commission at the next meeting.
