Approval of Minutes There were some additional corrections for the minutes of October 25, 1988, which were approved subject to these corrections. Referrals Auffarth, 20 Edgewood Avenue - Subdivision - Ms. Ng investigated the site for the Commission. She reported that the area was already highly developed beyond zoning limits, but aside from the usual concern over reduction of permeable ground surface, she could not find an applicable Local Waterfront Revitalization Policy. The CZMC, therefore, found the proposal to neither advance nor be inconsistent with the LWRP. Richbell Realty Corp. , 30 Park Avenue - Site Plan - Mrs. Johnson reported Q that she and Mrs. Wittner met with Steven Silverstein, builder for the applicant, in regard to this property which is located in the flood zone. She identified LWRP policies 11, 14A, 23, and 25 as being relevant. She IMEMMEMMEhim CZMC Minutes - 2/28/89 • noted that this area has historical significance in the way of Indian artifacts and the old Victoria Hotel. Mr. Silverstein explained that he had spoken with 4iittidit.n Kennedy from Westchester County Planning Department who said that according to a study done in 1979, it was not found to have any historical or archeological significance to the County and that they would not be involved with the survey work. Mrs. Johnson replied that more recent maps indicate the site's historical/archeological potential. Mike Csenge, architect for the applicant, noted that they are attempting to save the existing large maple tree by changing their terracing plans, as well as the existing holly. Drainage was not shown on the original plans, but the representatives said that they are planning to use swales to prevent runoff. In response to a question on lot coverage, Mr. Csenge said that only 19% will be covered, where 25% is allowed, and that the driveway and terrace will be gravel porous. Dry wells were considered, but the representatives said that because of the flood zone, the whole development would have to be elevated. Mr. Csenge said that the elevation already will be high to avoid extra excavation for putting in the garage. The Village of Larchmont Planning Board will be hearing the application again on March 13. Mrs. Johnson will draft the CZMC's response letter. High Tech Car Wash, 2434 Boston Post Road - Site Plan & Special Permit - Mrs. Tolley explained the location and site. She reported that the car wash claimed to be using a water recycling system indoors, where washwater is collected in tanks, filtered and reused. They said that pollutants are taken out from the reclamation tanks twice a year by a separate contractor at a • cost of $1500 per year and that biodegradeable soap is used. The applicant said that there are no governmental regulations for the system or the cleaning out of the system. The CZMC questioned the cleanliness of the outdoor water runoff, both in the front and back of the property. Dr. Mason noted his observation that the attendants had an open can of gas outside which is used to remove road tar from the cars. Mr. McMichael felt that the drains should be monitored. At this point, their Attorney, Mr. Mazin emphasized that the application being made was simply for a small addition to the building, general facelifting, and that they were willing to remove the gas tanks if required. However, the latter would then require a zoning variance. When asked about whether they steam clean motors, they stated that they did not. However, the signs are still there for it. The applicants also stated that the final rinse uses freshwater, but they did not know where it discharged. Mrs. Wittner felt that the Building Inspector should be requested to inspect the system and that Robert Hohberg should be requested to do a water quality sample test at a point near the Premium. CZMC concluded that they should recommend zero water runoff from inside the building, proper closing of tanks, and appropriate handling of outside runoff. Abrams, 2434 Boston Post Road - Subdivision - Mrs. Tolley also reported on the adjacent lot proposed for subdivision. The lot would be approximately 67 ft. x 106 ft. , 0.88 acres, leaving the car wash with 16,445 square feet. Both Mrs. Johnson and Mrs. Tolley noted past drainage and flooding problems. Other than that, the CZMC felt that there were no additional comments. -2- CZMC Minutes - 2/28/89 Reports by Chairman Premium Implementation Grant - The grant application for funding for the implementation of the Premium Feasibility Study was approved by the Village of Larchmont and Town of Mamaroneck on February 6 and 15, respectively. The Town of Mam' rneck will act as lead agency and the application was sent via Federal Express to the NYS Department of Environmental Conservation on February 23. A copy was sent to Thomas Hart in the Division of Coastal Resources and Waterfront Revitalization of the Department of State. Correspondences Outgoing: a. John Zappala - Thank you letter for speaking to CZMC on January 24, 1989. b. Steven Resler - Thank you letter for assistance with Bay Constable Program. c. Wallace Irwin, President, Friends of the Reservoir - Mr. Irwin sent minutes to the CZMC Chairman, which alerted her to the potential project of the Westchester Joint Water Works. The Water Works is on Village of Larchmont property, but lies in the Town of Mamaroneck, and is listed as a Critical Environmental Area. Any actions therein would most likely be a Type I Action and should be referred to the CZMC. d. Miriam Curnin, Mayor, Village of Larchmont - Facts of Life, March edition, on implementation grant for recommendations of Premium Feasibility Study. e. Miriam Curnin, Mayor, Village of Larchmont - Information she requested on © absorbant booms for Premium River. Emergency Environmental Services will provide their services to the Village for under $2,000. f. Village of Larchmont Budgeting - Mrs. Wittner, as chairman, may have to appear before the Village Board in regard to CZMC's budget. g. Geoffrey Young - Regarding his fowarding to the Attorney for the Premiun Point Holding Company, the grant application for implementing the Premium Study before it was approved by the Town Council. She also sent documents related to conservation easements. h. An information sheet about the Premium has been updated and is now called "All about the Premium River/Pine Brook Wetlands Complex". Incoming: a. Sheldrake Watershed Study - Steven Tomecek has been retained to coordinate and implement this study. b. Tree Damage Violation - Mr. Schoenberger informed Trustee Lewy who in turn informed Fred Kellogg, the Village Engineer, of the damage to a willow designated for protection during construction of 10 Old Colony Drive. Mr. Kellogg issued a notice to Mr. Longhitano stating that a certificate of occupancy would be witheld until restitution was made. It was noted that the letter lacked any information on the penalty for the violation. Mrs. Lewy said she would look into it. Ms. Ng was asked to investigate whether the Town's Tree Preservation Law allowed for the witholding of a certificate of occupancy as well. c. Litter & Dog Waste - Wallace Irwin sent the Chairman a letter requesting that this problem be addressed. The Chairman requested Mr. Leone to Q follow up on the issue and to try to recommend a plan of action, including banning of plastic bags and styrofoam as previously suggested by Mr. McMichael. -3- CZMC Minutes - 2/28/89 /(tA Master Plan Update, Generic Environmental Impact Statement - The Chairman announced that the public hearing was scheduled for March 8 and that the deadline for written comments was March 28. Every CZMC member wanted a copy to review. Trustee Lewy announced that on March 13 the Village Board will be receiving the Environmental Assessment Form and addendums in regard to their portion of the plan. A special meeting to discuss CZMC's comments to the generic EIS was tentatively set for March 21. Members should call in before then with comments to see if the meeting will be necessary. New Business Coastal Erosion Hazard Areas Legislation - The Chairman wrote the Larchmont Village Mayor and the Town Supervisor asking what they would like the CZMC to do in regard to this legislation. A model local law has been drafted by the Department of Environmental Conservation (DEC) . Mrs. Wittner said that the CZMC would like the Village to adopt an equivalent local law. As for the Town, which has very little coastal area, it was felt that the Town attorney may be able to include the issue in one of its existing laws. County Designation of Critical Environmental Areas (CEA) - Mrs. Wittner reported that Westchester County was currently identifying areas for inclusion in a County CEA list. She thought that the CZMC should support the designation of the entire Long Island Sound area as a CEA and to see if more protection could be given to the intermunicipal Sheldrake River, Larchmont Reservoir, and Premium Complex. CZMC agreed. Mrs. Wittner will also be in touch with Commissioner John Heller of the City of New Rochelle regarding their possible designation of the Premium Complex as a CEA. Improve Control of Litter, Policy 39A - see under "Correspondences". Larchmont Yacht Club Application - The Chairman asked if anyone was planning to attend the Larchmont Zoning Board meeting which had scheduled a public hearing on the aforementioned. Mrs. Fredston said that she was planning to attend, but would be representing herself. Mrs. Wittner noted that the action was in the flood zone and therefore needed to be referred to CZMC. Dr. Mason said that he would attend on behalf of the CZMC. Coastal Policy Committee of SoundWatch - Mrs. Wittner will attend the meeting on March 8, and will alternate future meetings with Mr. McMichael LWRP Copies - Mrs. Tolley expressed the need for publishing additional copies of the LWRP and suggested contracting for same, since it would be hard to make so many copies on the office photocopying machines. She suggested the need for at least 25 copies. She thought that a copy should go to the libraries for display. Subcommittee/Liaison Status Reports Annual Report - Mrs. Johnson and Mrs. Tolley had comments. Mrs. Wittner will make the necessary changes and have Carol Hayes complete the publication. -4- CZMC Minutes - 2/28/89 Larchmont Waterfront Zoning - Mr. Schoenberger explained that there is a problem with creating a Waterfront Recreation Area Zone because the clubs and Manor Park are private. The proposed zoning restricts the use of the property. He reported that James Staudt, the Village attorney, thinks a planning study would be needed. However, Daniel Shuster, a consultant, feels the LWRP is sufficient. Mrs. Johnson mentioned the concept of putting Manor Park on the National Historic District list. It was said that it would cost $30,000 to pursue such a designation. The Commission decided to submit to the Village the zoning amendment proposal as is, with acknowledgement of the attorney's advice that a professional study be done to justify these amendments, and that CZMC recommends that the Village Board authorize such a study. The Village Board will meet on April 3. Trustee Lewy was asked to place this on the agenda. Mr. Schoenberger, Larry Lowy, and/or Mrs. Fredston will attend. Mr. Schoenberger outlined some of the changes in housing development potential as a result of the zoning changes. Erosion and Sediment Control Legislation - Ms. Ng reported that Richard Young will contact Mrs. Wittner to discuss this before the next meeting. Meeting adjourned. C C -5-
