MINUTES
A regular meeting of the Coastal Zone Management Commission (CZMC) was held
on Tuesday, April 26, 1988, in Conference Room A of the Town Center,
740 West Boston Post Road, Mamaroneck, New York. The meeting commenced at
8:15 P.M.

7 Bonnie Briar Lane - Freshwater Wetlands & Water Course Application
Mr. & Mrs. Swan of 7 Bonnie Briar Lane requested approval to replace an
existing deck with a new slightly larger one. William Atwell representing
Camarella Contracting explained the proposed plans for the deck and mentioned
it was made of wood and would be raised on pilings. Because the property is
adjacemt to the West Branch of the Sheldrake River it was sent to the CZMC
for review and recommendations. Claudia Ng investigated the site and only
found an erosion problem at the top of the bank. The Commission's findings
were that it would be consistent with the Local Waterfront Revitalization
Program(LWRP) and provided that hay bales be used during construction and
ground plantings put in near the riverbank to prevent erosion. It was also
agreed that 6 inches of gravel be used under the deck for improved water
retention.
Hory Chevrolet - Special Permit Application
Thomas Keane, attorney for Mr. Hory described a proposal that would enable
the car dealer to sell and display new boats at the dealership located on the

corner of the Boston Post Road and and Weaver Street. Mr. Keane explained
all the boats would be brand new, ranging in size from 16 to 25 feet. He said
• the boats would be displayed on the property fronting the Boston Post Road
and would vary in number but on the average number displayed would be 12.
• Alan Mason expressed concern about oil or gas leaks and the possibility
that these drippings would get into the storm drains. Ms. Ng
• pointed out that the Hory dealership is located in the flood zone and that it
drains into East Creek. Dr. Mason also stated he visited the sight and noted
• there was no preparation made for oil traps and without them he would be
disinclined to approve the proposal. Mr. Hory said that the new boats being
• displayed would not contain oil or gas and that any servicing would be done
inside the garage which has an oil trapping system.

During the discussion it was revealed that the dealership planned to
install an 8 foot barbed wire fence to protect against pilferage and
vandalism. Robert Schoenberger warned that scenic quality is a particuliar
concern and Elaine Price informed the committee that the Boston Post Road has
been identified in the Master Plan for aesthetic rejuvenation and the need to
• improve the scenic quality. Dr. Mason requested specific information on the
proposed fence and also the kind of lighting that would be installed.
• Mr. Schoenberger summarized the project and said that the CZMC will be
advising the Zoning Board of Appeals that it is very concerned about adequate
• drainage treatment, fencing, lighting and the scenic quality of the proposed
project. Dr. Mason will draft the letter for Mr. Schoenberger's review.
209 Houuuocks Road - Building Application
• An application for a new pool and terrace addition was made by Gene Pressman
of 209 Honmiocks Road. Ms. Ng informed the CZMC that this application is in
• the flood zone and fronts onto Larchmont Harbor.
Jeff Hutchinson, architect showed his plans and explained the design of
• the terrace and pool. He also informed the Commission that he has a letter
from the NYS DEC that states the sea wall acts as a boundary and does not

require a DEC Tidal Wetlands permit. Dr. Mason said that storm water
retention is irrevelant in this case because the water runs directly into the
•
Sound. Mr. Hutchinson explained that the water system will be entirely closed
--that is the pool water will be filtered and recycled and when there is a

need to empty the pool it would be pumped into a truck and not into the
Sound.
Mr. Schoenberger suggested shrubbery be planted to soften the look of the
new wall that will surround the pool and terrace and Mary Anne Johnson said
the plantings should be suitable for salt air. Overall, the Commission found
the application consistent with the LWRP and requested Ms. Ng to draft the
reply.
Beach Road - Subdivision request by Mr. Kluge
William Maker Jr, attorney for John Kluge explained the proposal to subdivide
Mr. Kluge's property on Beach Road in Premium Point. Mr. Kluge bought the
property on October 15, 1985 as two lots. The lots were merged in June of
1986 in order to provide for an addition which would extend towards the
second lot. On July 16, 1986 the R-50 zoning went into effect. Now,
however, Mr. Kluge has decided against doing the proposed addition and wishes
• to sell back the second lot. He is, therefore, requesting that. the property
be restored to its original status, but this now requires a variance because
• the second lot is only 33,000 square feet.

This property lies in the Premium Critical Environmental Area (CEA) and
flood zone. Ms. Ng, Mrs. Tolley and Mr. Schoenberger inspected the property
and found that flood walls surround the entire property. Mrs. Fredston
pointed out that the CZMC was the Commission that promoted R-50 zoning and
for that reason feels the Commission should stand behind it. Mrs. Wittner
noted that the proposal would be inconsistent with the concept of recent
State designation of the Premium Complex as a Significant Coastal Fish and
Wildlife Habitat and inconsistent with LWRP policies 7, 7A, 11, 14, 25, and
44.
Mr. Maker expressed his opinion that this would not set a precedent and
asked the Commission to table this matter until the next meeting so that he
could respond to the arguments being presented. The move to table this
matter was motioned and affirmed based on Mr. Maker's agreement to wave time
constraints. Mr. Schoenberger will convey the status of this application to
Joel Negrin, chairman of the Town Zoning Board of Appeals the referring
agency.
CAC vs CZMC
Robert Schoenberger informed the Commission that a joint meeting of the CAC
and the CZMC would be held on Thursday, April 28, 1988. The purpose of the
meeting was to coordinate mutual concerns and responsibilities and discuss
ways in which the commissions can help each other. Robert Schoenberger asked
each member be prepared to contribute some ideas and observations in order
for the meeting to be constructive. The topics to be discussed will include:
(1) duties charged to each commission, (2) areas of overlap, (3) management
of the CEAs and (4) professionalism improvement.
Winston/Criffen Avenue Property
The discussion revealed that the DEC had designated this area as Wetlands,
but the Village of Scarsdale was contesting this designation and intends to
sell the area to developers. The discussion centered on what position the
CZMC should take regarding this property. A letter drafted by Mrs. Tolley
concerning this issue had been sent to each member for review. The consensus
was that the Town Council should approve CZMC's letter before it is sent
out. Mr. Schoenberger said he would send a cover letter to Supervisor
Battalia along with a copy of the draft CZMC letter to see if the Town would
prefer sending such a letter since it is an intermunicipal affair.
Alan Mason informed the Committee that Dolores Battalia made her position
clear in Scarsdale.
Premium Feasibility Study
The findings and recommendation of the Premium Feasibility Study were
reported. It was suggested that the findings including the problems,
alternatives and costs be presented to the public at a public meeting. The
invitees should include the Town and Village Boards,
the New Rochelle Planning Dept. , members of the neighborhood association, and
elected representatives Joseph Di Givardi, Diane Keane, Ron Tocci and Suzi
Oppenheimer. Elaine Price said the Town could accomodate the meeting but
suggested the date should be no later than mid-June or be postponed until
mid-September. Ms. Ng will arrange a date with Elaine Price and Cheryl Lewy
for the public presentation.

Mr. Schoenberger suggested holding a special private meeting, either on
May 12 or 16, with Jack Taylor of Malcolm Pirnie, Inc. , to review findings
and proposals, and clarify all information. He also said he would also like
to investigate the possibility of Malcolm Pirnie finding a less expensive
alternative to the alternatives already provided.
The cost of the dredging projects and the alternatives were reviewed and
Robert Schoenberger inquired how much of the cost would be absorbed by the
state. Elaine Price estimated that only 10% of the costs would be covered.
Mrs. Wittner will ask Jack Taylor to provide some funding sources in his
report.
David's Island •
Robert Schoenberger informed the Committee that the Supplemental DEIS were
available. He asked for volunteers to assist him in reviewing the four
volumes. He will speak on behalf of the CZMC at the May 10 hearing.
Elinor Fredston said she planned to make comments at the upcoming
hearings and suggested that we engage the services of an expert to assist
with technical concerns, such as sewerage treatment and water quality.
Ms. Ng said that there was money in the budget to hire a consultant.
It was noted that the Town and Village Boards will also be taking a stand
against the proposed Davids Island Project. Mr. Schoenberger suggested we
try to engage the help of the Long Island towns such as Great Neck, Sea Cliff
and Oyster Bay and send them information to make sure they are aware of the
proposed project.
Cambridge Court Subdivision
The CZMC was informed that 6 large trees were taken down by mistake on that
property. Ms. Lewy informed that the owner was very sorry and furious to
find out about it and advised that the Board of Archtectural Review bears
responsibility for monitoring the situation . Mary Anne Johnson said
provisions should be made to counterbalance and keep control over occurences
like this.
Hart Island
The letter concerning the proposed Hart Island Development was discussed and
the letter was approved by the board without any changes.
Minutes for February 23, 1988
The minutes were approved pending the correction of a misquote on page 3.
New Business
Robert Schoenberger introduced and welcomed Cheryl Lewy the new Village of
Larchmont liaison to the Commission.
Robert Schoenberger read a letter of resignation as liaison from Geoffrey
Young in which he expressed his sincere gratitude to CZMC and advised the
Commission that he would still be available to them.
