September 23, 1997
A regular meeting of the Costal Zone Management Commission (CZMC) was held on September 23,
1997 in Conference Room A, 740 W. Boston Post Road, Mamaroneck, New York. The meeting was
called to order at 8:07 p.m.

1. Approval of Minutes:
-The minutes from 6/24/97 and 7/29/97 were approved with corrections from members on a
motion by M. Berg, seconded by M. Godick. The minutes from 8/26/97 were approved with
corrections on a motion by A. Mason, seconded by M. Berg.

2. Consistency Referrals:
-N. Seligson, CZMC Co-Chair, noted that in response to the increasing number of signage
referrals received by the CZMC, Judith Gallent, the Town attorney, has drafted a letter for
Supervisor Elaine Price, Mayor Cheryl Lewy and the Chairs of the TOM and VOL Zoning Boards
stating that until further notice, the CZMC waives Local Consistency Law review of
applications for area variances for signs located on existing structures in the Town of
Mamaroneck and the Village of Larchmont. The letter was approved with corrections by members
of the Commission.

1435 Boston Post Road-Application for a Variance to Enlarge Sign -Ray Catena/Lexus

-It was agreed upon by the Commission that the granting of a variance to enlarge the Ray
Catena/Lexus sign will neither advance nor hinder the policies set forth in the Local
Waterfront Revitalization Plan (the LWRP) and accordingly is neither consistent nor
inconsistent therewith.
2434 Boston Post Road-Maintenance of Awning Sign -High Tech Car Wash

-It was agreed upon by the Commission that the maintenance of the existing awning sign at High
Tech Car Wash will neither advance nor hinder the policies set forth in the Local Waterfront
Revitalization Plan (the LWRP) and accordingly is neither consistent nor inconsistent
therewith.
17 and 19 Shadow Lane - Two Proposed Single Family Dwellings

-K. Brenner stated that this property had come before the Commission a few months earlier
when it was subdivided by Donald Meeker. He continued by stating that he and D. Kriss
purchased the two new lots from D. Meeker with the intention of constructing one single
family dwelling on each lot. Mr. Brenner stated that there is an existing driveway on the
property that will be removed before construction, therefore the net increase of impervious
surface, upon completion of the project, will only be 600 square feet for the two lots
combined. Mr. Brenner then said that after a discussion with Joe Morgan, the Village of
Larchmont Engineer, it was decided that the roof leaders should drain to existing storm
drains on Shadow Lane.

-The Commission expressed concern about the runoff from the uphill adjacent lot. It was
stated that the existing lots have a considerable amount of herbaceous and tree cover, and
once these lots are cleared and developed the recharge capacity will be greatly reduced.
-K. Brenner stated that the new retaining wall, at the base of the hill, will use perforated
PVC piping and be backfilled with gravel to allow for the retaining and slow discharge of the
runoff.
-The Commission commented that as a result of the land contours indicated on the site plans,
it appears that the runoff will collect and flood into the house on the left (facing the lots
from Shadow Lane).
- K. Brenner replied by stating that the surrounding area is relatively flat and will be
covered with grass, which will allow the water to percolate. He also commented that footing
drains will be installed around the foundation; these drains will flow into the storm sewer.
-The Commission asked if erosion control measures are proposed during construction.
-K. Brenner stated that there is an existing stone wall on the Shadow Lane side of the
property which will act as a barrier for sediment running off during a storm event. Mr.
Brenner added that there is also tree protection proposed to avoid damaging the existing
trees and root systems.
-The Commission stated that drywells or some type of stormwater retention device may be
necessary to minimize the burden on the municipal storm drainage system.
-K. Brenner stated that he did not know the depth to bedrock anywhere on the site and before
drywells could be proposed, that would have to be looked into.
-In the opinion of the CZMC, compliance with the following recommendations would assure
consistency with the policies set forth in the Local Waterfront Revitalization Program
(LWRP):
(1) existing site plans be revised by a licensed engineer and modified in order
achieve a "no net increase in runoff' (as per Policy 14 in the LWRP) and
resubmitted to the CZMC at least one week prior to the October 20th
Larchmont Planning Commissions meeting. The revised site plans should
propose an alternative to draining the site into the municipal storm drains;
(2) Best Management Practices be adopted during construction (as per Policy 33
of the LWRP) to minimize erosion and siltation;
(3) impervious surfaces, such as driveways, be minimized; and
(4) to the extent feasible, existing trees on the site be preserved and native
plantings be used in landscaping to minimize the need for fertilizers and
pesticides.

2100 Boston Post Road-Proposed 2nd Story Addition to an Existing One Story Building

-M. Tsocanos explained that they were proposing to add a second story onto an existing one
story structure. He stated the there would be no increase in impervious surface and the roof
drainage system would remain virtually unaltered.
-The Commission inquired whether or not additional parking is proposed.
-Mr. Tsocanos replied that the only changes to the current parking situation would involve
the addition of stripes and wheel stops.
-It was agreed upon by the Commission that the proposed 2nd story addition at 2100 Boston
Post Road will neither advance nor hinder the policies set forth in the Local Waterfront
Revitalization Plan (the LWRP) and accordingly is neither consistent nor inconsistent
therewith.

4. Discussion of Proposed Amendment to Consistency Law:
-The commission agreed that the Amendment to the Consistency Law should be reviewed by Judith
Gallent, town attorney, before submitting it to the Town or Village Boards.
5. Chairpersons' Reports:
-N. Seligson announced that there have been nitrogen reduction hearings held regarding the
Phase III proposals for the Long Island Sound Study. She stated that Westchester County (WC)
disagrees with the Department of Environmental Conservation's (DEC) proposal to reduce the
nitrogen input to Long Island Sound by 58.5%. She continued by saying that WC feels that the
cost estimates proposed by the DEC will cost a great deal more than stated in the proposal.
6. Members' Reports:
-H. McMichael announced that Mamaroneck Harbor will soon be a No Discharge Zone.
-Phyllis Wittner announced that there is an all day workshop on wetlands and water quality on
October 16th.
7. Environmental Coordinator's Report:
-J. Athey announced that the class from the University of New Haven performing wetlands
mapping for the Town/Village had their first field trip to Mamaroneck on Sunday, September
21st. This first trip was merely to introduce the students to the Town/Village and identify a
few wetland areas of particular interest. The actual field work and wetland identifications
will begin on their next visit (to be announced).
The meeting was adjourned at 10:10 p.m.
The next scheduled CZMC meeting will be held on October 28, 1997.

RE: Referrals of Area Variances for Signs in the Town of Mamaroneck
Recently, the Coastal Zone Management Commission (CZMC) has been receiving an increasing
number of referrals from the Town of Mamaroneck Zoning Board of Appeals (ZBA), pursuant to
the Local Consistency Law (§ 234-1 through § 234-5), of area variance applications for signs that
do not comply with the Town of Mamaroneck sign ordinance. The Local Consistency Law requires
these referrals because these applications are unlisted actions under SEQRA.
The CZMC has consistently found that these applications do not implicate the policies of the
Local Waterfront Revitalization Program (LWRP) and, therefore, a consistency determination is
neither possible or appropriate. The referral to the CZMC needlessly delays the ZBA's processing
of these applications an additional month, without providing the ZBA any meaningful information.
We note that all such applications are referred to the Town's Board of Architectural Review (BAR),
which is charged, among other things, with preserving and promoting the character and appearance of
the Town. To the extent that these values are implicated by the LWRP, the BAR has the statutory
authority necessary to protect them.
Accordingly, until further notice, the CZMC waives Local Consistency Law review of applications
for area variances for signs located on existing structures in the Town of Mamaroneck.

We bring this matter to your attention because the Coastal Zone Management Commission (CZMC)
has been receiving an increasing number of referrals from the Town of Mamaroneck Zoning Board of
Appeals (ZBA), pursuant to the Local Consistency Law (§ 234-1 through § 234-5), of area variance
