Approval of Minutes: - The minutes from 9/22/98 were unanimously approved with corrections from members on a motion by C.A. Mason seconded by L. Andrews. Consistency Referrals: • Proposed Reconfiguration Perimeter and Maintenance Dredging Larchmont Yacht Club Requested by:NYS Department of State,Division of Coastal Resources - P. Milliot stated that Larchmont Yacht Club has proposed a reconfiguration perimeter and maintenance dredging project where approximately 9,800 cubic yards of material is proposed for removal and relocation to either western Long Island Sound or Central Long Island Sound disposal sites. - The Commission asked Mr. Milliot to define reconfiguration perimeter. - Mr. Milliot stated that a reconfiguration perimeter is an envelope in which a docking assembly is permitted to move within as long as it does not move outside of the perimeter, the square footage of the dock is not increased, the number of permitted boats accessing the dock is not increased and the nature of the docking assembly is not changed. - The Commission asked what are the proposed changes to the reconfiguration perimeter. - Mr. Milliot stated that currently there is no reconfiguration perimeter. It is merely being attached to the Larchmont Yacht Club dredging application as an enhancement to existing structures and use of said structures. No changes to existing docking facilities are being proposed. - The Commission asked what would happen if the substrate test results were found to be contaminated. - P. Milliot stated that the project probably wouldn't take place. - The Commission asked how far out the proposed dredging would take place. • - Mr. Milliot stated that dredging will take place approximately up to 800 feet from the floats. - A discussion ensued and the Commission agreed that the proposed reconfiguration perimeter and maintenance dredging project at Larchmont Yacht Club will neither advance nor hinder the policies set forth in the Local Waterfront Revitalization Plan (the LWRP) and accordingly is neither consistent nor inconsistent therewith. A letter will be sent to the referring agency stating such. A copy of this letter will be sent to Mr. Daniel Natchez. CZ_1098M.WPD CZMC- 10/27/98 Pg.2 THIRD REVIEW (first review at 8/25 meeting and second review at the 9/22 meeting) Freshwater Wetlands and Water Courses Permit-New Single Family Residence 28 Bonnie Way, Block 104 Lot 52.1 Requested by:Town of Mamaroneck Planning Board - C. Knopp stated that the engineer for the proposed project was unable to attend the meeting however he prepared a letter confirming the accuracy of the previous perk test results. Mr. Knopp submitted this letter for the record. - Mr. Knopp stated that he has submitted revised plans which indicate wetland boundaries and proposed wetlands plantings for the site. The plantings include chokeberry, mountain laurel and meadowsweet. He continued by stating that five (5) of the existing thirteen (13) trees on the site are proposed for removal. Mr. Knopp stated that a wetland evaluation report is being prepared for the site by the wetland specialist, however it is not yet available. This report will be submitted to the Town upon completion. - The Commission inquired where, on the site, the perk tests were conducted. - C. Knopp stated that the perk tests were conducted in the area of the proposed drainage structures (infiltrating units). Mr. Knopp added that the proposed drainage structures are fifteen (15) inches tall and they will be buried with six (6) inches of gravel underneath and twelve (12) inches of gravel on top. The entire system (the structure and gravel)will be buried beneath twelve (12) inches of soil. Knopp also stated that the perk tests were conducted deeper than the actual depth of the proposed infiltrating system. - A discussion ensued and the Commission agreed that the proposed single family residence at 28 Bonnie Way will neither advance nor hinder the policies set forth in the Local Waterfront Revitalization Plan (the LWRP) and accordingly is neither consistent nor inconsistent therewith. The Commission would, however, like to recommend that a permanent buffer of native vegetation be left undisturbed adjacent to the stream. A letter will be sent to the referring agency stating such. A copy of this letter will be sent to Christopher Knopp. Freshwater Wetlands and Watercourses Permit-New Single Family Residence 19 Fenbrook Drive, Block 309 Lot 9 Requested by: Town of Mamaroneck Director of Building - G. Volpe stated that the property owners are proposing to construct a single family residence on a currently undeveloped lot. Mr. Volpe stated that the rear of the property becomes extremely wet and water occasionally pools during heavy storm events. There is a stream that flows across the rear of the property approximately eighty (80) feet from the proposed residence. Volpe stated that silt fencing will be installed during construction around all areas of construction. CZ_1098M.WPD CZMC- 10/27/98 Pg.3 - The Commission asked how far the proposed house is from the "wet area" indicated on the site plan. - Mr. Volpe stated that the proposed house is twenty (20) feet from the "wet area" indicated on the site plan. - The Commission asked G. Volpe if the "wet area" on the site plans represents a wetland that has been delineated by a wetland specialist and if not, does he have plans of delineating the wetland(s) on the property. - A discussion ensued and Mr. Volpe stated that a wetlands delineation has not been performed on the property. - The Commission asked G. Volpe where the proposed house is to be situated on the lot. - Mr. Volpe stated that the house will be approximately fifty (50) feet from the road, twenty (20) feet on the left side and thirty (30) feet on the right side. Volpe also stated that drywell/infiltration structures are proposed for the left side of the house with an overflow that releases towards the wetland area. - The Commission asked Mr. Volpe if he had considered moving the house closer to the road. - Mr. Volpe stated that it may be possible to move the house twenty (20) or so feet closer towards the road. The Commission asked G. Volpe if the proposed house has a basement and if so, what is the proposed depth below existing grade. - Mr. Volpe stated that the house will have a basement and it will be approximately eight (8) feet below grade. - The Commission asked Mr. Volpe if sump pumps are proposed for the house. If the basement is dug eight (8) feet below existing grade, the contour lines given on the site plans indicate that the basement depth will be below the elevation of the streambed. - Mr. Volpe stated that sump pumps have not yet been considered. Volpe continued by stating that he would speak to the property owners of the adjoining properties to find out if they have had any problems with water entering their basement. - The Commission commented on the large amount of proposed parking and driving area on the property. - J. Athey stated that he would check on the parking and driving area limits for the next meeting. CZ 1098 M.WPD CZMC- 10/27/98 Pg.4 - A discussion ensued and the Commission agreed that this matter should be subject for review at the next meeting of the CZMC. The CZMC requests the following additional information be obtained: 1) a delineation of all wetlands on the property by a certified wetlands specialist 2) find out if any of the neighboring properties have sump pumps or any water related problems; the infiltration system may have to be altered to accommodate water from sump pumps 3) look into the possibility of moving the house closer to the road Freshwater Wetlands and Watercourses Permit-Extension of an Approved Deck 7 Winged Foot Drive, Block 209 Lot 227 Requested by:Town of Mamaroneck Planning Board - B. Maller stated that the approved addition onto the rear of his home (subject for review at the July, 1998 CZMC meeting) has been completed however work has not yet begun on the approved deck. Maller continued by stating that he would like to reconfigure and extend the approved deck to enhance its use. - A discussion ensued and the Commission agreed that the proposed deck extension at 7 Winged Foot Drive will neither advance nor hinder the policies set forth in the Local Waterfront Revitalization Plan (the LWRP) and accordingly is neither consistent nor inconsistent therewith. A letter will be sent to the referring agency stating such. A copy of this letter will be sent to Brant Maller. Freshwater Wetlands and Water Courses Permit- One Story Bedroom/Bath Addition 91 Rockland Avenue, Block 210 Lot 588 Requested by: Town of Mamaroneck Director of Building - B. Nalven stated that they are proposing to construct a one story bedroom and bath addition onto the left side of their house. The addition will be placed on pilings over an existing driveway and terrace and will therefore not increase impervious surface on the property. - A discussion ensued and the Commission agreed that the proposed addition at 91 Rockland Avenue will neither advance nor hinder the policies set forth in the Local Waterfront Revitalization Plan (the LWRP) and accordingly is neither consistent nor inconsistent therewith. A letter will be sent to the referring agency stating such. A copy of this letter will be sent to Beverly Nalven. 3. Discussion of Mamaroneck Harbor Dredging Project: - N. Seligson stated that the CZMC has been asked to provide a letter of support for the Mamaroneck Harbor dredging project. She continued by stating the she feels that the CZMC should support the dredging project because it is consistent with several policies in the LWRP, especially those referring to public access and water dependent uses. More specifically, the following: CZ_1098M.WPD CZMC- 10/27/98 Pg.5 POLICY 2 Facilitate the siting of water dependent uses and facilities on or adjacent to coastal waters. POLICY 19 Protect,maintain,and increase the level and types of access to public water-related recreation resources and facilities so that these resources and facilities may be fully utilized by the public in accordance with reasonably anticipated public recreation needs and protection of historic and natural resources. In providing such access,priority shall be given to public beaches,boating facilities,fishing areas and water front parks. POLICY 20 Access to the publicly-owned foreshore and to lands immediately adjacent to the foreshore or the water's edge that are publicly owned shall be provided,and it should be provided in a manner compatible with adjoining uses. Such lands shall be retained in public ownership. PO1,ICY 34 Dredging and dredge spoil disposal in coastal waters will be undertaken in a manner that meets existing state and federal dredging permit requirements,and protects significant fish and wildlife habitats,scenic resources,natural protective features,important agricultural lands,and wetlands. - N. Seligson continued by stating that several national environmental organizations are using this project to try and stop dumping in Long Island Sound (the dredge spoils). - A discussion ensued and the Commission agreed that a letter should be sent to the Army Corp of Engineers (ACOE) stating that the CZMC supports the proposed dredging project based on consistency with the above listed policies of the LWRP. 4. Discussion of Mamaroneck-Larchmont Coastal Assessment Form (CAF) - Due to a lack of time, discussion of the Mamaroneck-Larchmont CAF will be postponed. The Commission will discuss this matter at its November 24th meeting. 5. Chairpersons' Reports: - N. Seligson stated that the Town has received a public notice from the ACOE stating that the NYS Department of Transportation is proposing to discharge fill materials into wetlands, install streambank protection and replace culverts in conjunction with improvements to I287 around the Blind Brook and its unnamed tributaries. She stated that she would look into the matter and report on it at the next meeting.
