CZMC MINUTES
November 22 , 1994
A regular meeting of the Coastal Zone Management Commission
(CZMC) was held on November 22 , 1994 , at the Town Center, 740
West Boston Post Road, Mamaroneck, New York. The meeting was
called to order at 8 : 04 p.m .

I. REFERRAL - Town of Mamaroneck Building Department
A. 209 Hommocks Road - Advisory opinion-stone wall
replacement to mean high water.
Dave Larson, Architect and Elaine Fronhoffer appeared on behalf
of the applicant .
This application was referred to CZMC by the Town of Mamaroneck
Building Department under the Town' s CZM law.
Elaine Fronhoffer explained that the applicant wished to rebuild
a wall on the perimeter of their property. The wall extends into
the water and has deteriorated.

Dave Larson explained that the wall acts as a 3 foot retaining
wall along Hommocks Road. Along the reserve strip (Association
Access to water) , the wall currently is approximately 2-3 feet of

stone under a 4 foot chain linked fence . The proposed wall is a
7-8 foot high stone wall along the reserve strip.
Elaine Fronhoffer stated that she has informally contacted the
neighbors regarding the proposed construction but that their has
been no formal notification from the Town as of yet .
Dave Larson explained that the Zoning Board will hear the
variance issue on the height of the wall . CZMC is concerned with
the restoration from the seawall to mean high water.
Dave Larson stated that mean high water is approximately 20 '
beyond the seawall if it is scaled from survey. From tax
• assessors map, the wall historically is shown to extend even
further out from the seawall . But members thought from pictures
shown at high tide , that mean high water extends very close to
the existing seawall .
Mr. Larson explained that they have approached both Army Corps of
Engineers and New York State Department of Environmental
Conservation (NYS DEC) . The Army Corps (ACOE ) has referred it to
their Nationwide permit program and the NYS DEC will require a
DEC Tidal Wetland Permit . It is not in a Coastal Erosion Hazard
Area. E . Nudelman suggested that the applicant also contact N.,r
Department of State for their Coastal Consistency Review.
Regarding the wall extension beyond the seawall , Commission
members thought that the reason why the wall fell in the first
place is the heavy seas in this area and that the wall will come
down again in the future . The seas come in and hit the wall
jutting out into the water .
Members objected to the rebuilding of the wall beyond the seawall
because it will cause erosion and undermining of the seawall .
The policies ( 44 and 44A) refer to the restoration of tidal
wetlands and members felt that removing the wall (beyond the
seawall ) will do that . Members also suggested removing the
existing deteriorated wall , as well . Also, the Commission
recommended planting appropriate tidal wetlands plants .
The applicant stated that they will be using Westchester County
Best Management Practices to control erosion on-site . There is
an erosion control plan for the site .

II . ADMINISTRATIVE MATTERS
A. Approval of Minutes - The minutes of 9/27/94 , as
amended, were approved on a motion from Alan Mason, seconded by
Frank McGahan .
The minutes of 10/25/94 to be corrected, as specified by members
for approval at next meeting.
III . CHAIRMAN' S REPORT
A. Announcements -
1 . The Town and Village ( separately) will submit NYS DEC
Nonpoint Source Implementation Grants . The Town is looking
for a sewer line jet cleaner, to work in conjunction with
catch basin vacuum to clean out storm drain lines .
2 . The Watershed Advisory Committee meeting will be December
19 , 1994 , 4 : 00 p.m. .
3 . Emerson Point Estates application is returning to the New
Rochelle Planning Board on November 29 , 1994 . Joan Hanson,
Malcolm Pirnie ' s wetland delineation specialist/botanist
came to Premium Marsh to see various properties with
wetlands on them and to see if the Emerson property has
wetlands on it . She will attend New Rochelle Planning Board
meeting with Gary Trachtman as the Town' s representatives .
4 . The annual report will be presented to the Village of
Larchmont on January 23 , 1995 . The Commission will present
to the Town at a similar time .
5 . Army Corps of Engineers Notice - Instead of having a
separate review by ACOE and NYS DEC, for projects that must
be permitted by both agencies , DEC will now handle the
entire application . P . Wittner wondered how Consistency
will fit into this because , when a federal agency reviews an
application, it has to go to the Department of State for
Consistency Review and they refer it to the local CZMC. P .
Wittner spoke with Steve Resler at Department of State and
he said D . O. S . appeared before Army Corps to state their
opinion that Consistency Review be left with Department of
State .

IV. MEMBERS REPORTS
Mamaroneck Harbor Commission - H. McMichael reported that there
has been a flyover of the Harbor. Pump-out facility directions
for use needed corrections . Harbor Masters boat and some docks
are in federal channel and Harbor Commission believes they should
be moved out of it .
Village of Larchmont Planning Board - R. Metzner reported on this • '
months agenda. Three actions were County Critical Environmental
Areas , one , a proposed 3 lot subdivision at Boston Post Road and
Manor Place, unlisted action and 2 ) a proposed site plan to
convert an empty lot into a parking lot adjacent to 2345 Boston •
Post Road, Larchmont. P . Wittner thinks it may be already done .
It has been clear cut already. N. Sterbenz said that they were
talking about replanting.
R. Metzner asked for a list of Type I and Type II Actions . Those
that are not Type I or II are Unlisted Actions-. The Village of
Larchmont uses State Environmental Quality Review and the Town
has their own MEQR, Mamaroneck Environmental Quality Review Law.

V. LWRP UPDATE
P . Wittner brought Commission members up-to-date on
status of LWRP . Village had many changes and P .
Wittner complemented the Village Board and K. Bialo for
thoroughly reviewing the document .
The meeting was adjourned at 9 : 57 p .m. .
